D’AVRAY Fellow of the British Academy Abstract: Papal law is known from the late 4th century (Siricius). There was demand for decretals and they were collected in private collections from the 5th century on. Charlemagne’s Admonitio generalis made papal legislation even better known and the Pseudo-Isidorian collections brought genuine decretals also to the wide audience that these partly forged collections reached. The papal reforms from the 11th century on gave rise to a new burst of papal decretals, and collections of them, culminating in the Liber Extra of 1234. The Council of Trent opened a new phase. The ‘Congregation of the Council’, set up to apply Trent’s non-dogmatic decrees, became a new source of papal law. Finally, in 1917, nearly a millennium and a half of papal law was codified by Cardinal Gasparri within two covers. Papal law was to a great extent ‘demand- driven’, which requires explanation. The theory proposed here is that Catholic Christianity was composed of a multitude of subsystems, not planned centrally and each with an evolving life of its own. Subsystems frequently interfered with the life of other subsystems, creating new entanglements. This constantly renewed complexity had the function (though not the purpose) of creating and recreating demand for papal law to sort out the entanglements between subsystems. For various reasons other religious systems have not generated the same demand: because the state plays a ‘papal’ role, or because the units are small, discrete and simple, or thanks to a clear simple blueprint, or because of conservatism combined with a tolerance of some inconsistency. -

Part 1 – Church Becomes Powerful Institution Evidence of Rome’s power grab • In 2nd century we see bishops over regions; people looked to them for guidance. • Around 195AD there was dispute over which day to celebrate Passover (14th Nissan vs. Sunday) • Polycarp said 14th Nissan, but now Victor (Bishop of Rome) liked Sunday. • A council was convened to decide, and they decided on Sunday. • But bishops of Asia continued the Passover on 14th Nissan. • Eusebius wrote what happened next: “Thereupon Victor, who presided over the church at Rome, immediately attempted to cut off from the common unity the parishes of all Asia, with the churches that agreed with them, as heterodox [heretics]; and he wrote letters and declared all the brethren there wholly excommunicate.” (Eus., Hist. eccl. 5.24.9) Everyone started looking to Rome to settle disputes • Rome was always ending up on the winning side in their handling of controversial topics. 1 • So through a combination of the fact that Rome was the most important city in the ancient world and its bishop was always right doctrinally then everyone started looking to Rome. • So Rome took that power and developed it into the Roman Catholic Church by the 600s. Church granted power to rule • Constantine gave the pope power to rule over Italy, Jerusalem, Constantinople and Alexandria. -

After four years of pontificate, this is the assessment that has been made by the cardinals who brought Jorge Mario Bergoglio to election as pope. The operation that produced the Francis phenomenon arises from a long time ago, as far back as 2002, when for the first time "L'Espresso" discovered and wrote that the then little-known archbishop of Buenos Aires had leapt to the top of the candidates for the papacy, the real ones, not the figureheads. It laid the groundwork at the conclave of 2005, when it was to none other than Bergoglio that all the votes were funneled from those who did not want Joseph Ratzinger as pope. And it came into port at the conclave of 2013, to a large extent because many of his electors still knew very little about that Argentine cardinal, and certainly not that he would deal the Church that “punch in the stomach” spoken of a few days ago by his rival defeated in the Sistine Chapel, Milan archbishop Angelo Scola. Between Bergoglio and his great electors there was not and is not full agreement. He is the pope of proclamations more than of realizations, of allusions more than of definitions. There is however one key factor that meets the expectations of a historic turning point of the Church capable of making up for its emblematic lag of “two hundred years” with respect to the modern world that was denounced by Carlo Maria Martini, the cardinal who loved to call himself the “ante-pope,” meaning the anticipator of the one who was to come. -

When Cardinal Carlo Maria Martini passed away in 2012, a storm of (mostly Italian) newspaper articles appeared in honor of the archbishop, who had been both a scholar and a socially-conscious man of God. In him, it seemed that the Ambrosian tradition had found a great exponent, in the tradition of Carlo Borromeo in the sixteenth century. Unfortunately, the discussion in the media focused on only two aspects of Martini’s wide interests: namely, the dialogue between faith and atheism, and his societal involvement. Above all, this was due to his prolific journalistic activity, as a columnist for a national newspaper in Italy. With few exceptions, Martini’s portrait, as rendered by these journalists, hardly resembled a Jesuit. Furthermore, the political categories so often used to describe his position with the college of cardinals impeded a nuanced understanding of his spiritual path. Enrico Impalà’s Il Bosco e il Mendicante [The Woods and the Beggar] aims to fill this gap. Among the many biographies that appeared after the cardinal’s death, this well-written, anecdotal account deserves special attention, because its author was one of Martini’s colleagues during his tenure in Milan. The book’s curious title echoes a Hindu proverb that Martini was fond of quoting during his last years of pastoral work in Milan, to the effect that life has four stages: the first, when one learns from others; the second, when one teaches others; the third, when the time comes to enter the woods and meditate; and the last, when one becomes a beggar, since one requires help from everyone, for everything. -
