Smithson INTRODUCTION On the 29th of April 1997, the majority of the world’s nations joined to activate an arms control and nonproliferation accord that will gradually compel the elimination of one of the most abhorred classes of weapons of all times. Previously, the international community had fallen short of the mark in efforts to try to abolish poison gas, despite the opprobrium following its widespread use in World War I.1 The new Chemical Weapons Convention (CWC) extends the no use-prohibitions of the 1925 Geneva Protocol2 to outlaw the development, acquisition, production, transfer, and stockpiling of chemical weapons as well. The CWC requires the destruction of chemical weapons production facilities and arsenals over a ten-year period, and countries will witness the shrinking numbers of poison gas factories and munitions. A less tangible function of the CWC, but one that may turn out to be equally valued over the long term is that the CWC will help redefine how states assure their national security. The CWC requires nations to declare activities that were previously considered state secrets and private business information. The treaty authorizes routine and challenge inspections to monitor compliance with its prohibitions. Instead of building large caches of arms, the CWC’s verification processes give governments reason to be confident that managed transparency—a limited waiver of state sovereignty—can enhance national and international security. -

The FBI has not produced concrete evidence on key questions: • Where and how were the anthrax spores in the attack letters prepared? There is no material evidence of where the attack anthrax was made, and no direct evidence that any specific individual made the anthrax, or mailed it. On the basis of a number` of assumptions, the FBI has not scrutinized the most likely laboratories. • How and why did the spore powders acquire the high levels of silicon and tin found in them? The FBI has repeatedly insisted that the powders in the letters contained no additives, but they also claim that they have not been able to reproduce the high silicon content in the powders, and there has been little public mention of the extraordinary presence of tin. -

GRAHAMSTOWN Jan 5 Sapa THREE OF DE KOCK'S CO-ACCUSED TO CHALLENGE TRC DECISION Three former security branch policemen plan to challenge the Truth and Reconciliation Commission's decision to refuse them and seven of their former colleagues, including Eugene de Kock, amnesty for the 1989 murder of four policemen. De Kock, Daniel Snyman, Nicholaas Janse Van Rensburg, Gerhardus Lotz, Jacobus Kok, Wybrand Du Toit, Nicolaas Vermeulen, Marthinus Ras and Gideon Nieuwoudt admitted responsibility for the massive car bomb which claimed the lives of Warrant Officer Mbalala Mgoduka, Sergeant Amos Faku, Sergeant Desmond Mpipa and an Askari named Xolile Shepherd Sekati. The four men died when a bomb hidden in the police car they were travelling in was detonated in a deserted area in Motherwell, Port Elizabeth, late at night in December 1989. Lawyer for Nieuwoudt, Lotz and Van Rensburg, Francois van der Merwe said he would shortly give notice to the TRC of their intention to take on review the decision to refuse the nine men amnesty. He said the judgment would be taken on review in its entirety, and if it was overturned by the court, the TRC would once again have to apply its mind to the matter in respect of all nine applicants. The applicants had been "unfairly treated", he said and the judges had failed to properly apply their mind to the matter. The amnesty decision was split, with Acting Judge Denzil Potgieter and Judge Bernard Ngoepe finding in the majority decision that the nine men did not qualify for amnesty as the act was not associated with a political objective and was not directed against members of the ANC or other liberation movements. -

5. The Question of Offensive/Defensive Distinctions in Biological Weapons Related Research, and the Potential Stimulus to BW Proliferation by Expanded Research Programs The word "research," or any specific reference to "offensive" or "defensive" in a research context, does not appear in Article I of the Biological Weapons Convention. That reads as follows: "Each State Party to the Convention undertakes never in any circumstances to develop, produce, stockpile or otherwise acquire or retain: (1) Microbial or other biological agents, or toxins whatever their origin or method of production, of types and in quantities that have no justification for prophylactic, protective or other peaceful purposes; (2) Weapons, equipment or means of delivery designed to use such agents or toxins for hostile purposes or in armed conflict.,,1 However, the word research did appear in the provisional treaty draft that had been drawn up by the U.K. and that had been presented to the negotiating states on July 10, 1969. That draft required states signing or ratifying the treaty "not to conduct, assist or permit research aimed at production ... " of the agents or weapons forbidden by Article I (1) and (2) above. 2 Even earlier in a working paper on microbiological warfare that the U.K. submitted to the states negotiating in Geneva, the U.K. stated: The Convention would also need to deal with research work. It should impose a ban on research work aimed at production of the kind prohibited above, as regards both microbiological agents and ancillary equipment. It should also provide for the appropriate civil medical or health authorities to have access to all research work which might give rise to allegations that the obligations imposed by the Convention were not being fulfilled. -

Shea Analyst in Science and Technology Policy Resources, Science, and Industry Division Congressional Research Service ˜ The Library of Congress High-Threat Chemical Agents: Characteristics, Effects, and Policy Implications Summary Terrorist use of chemical agents has been a noted concern, highlighted after the Tokyo Sarin gas attacks of 1995. The events of September 11, 2001, increased Congressional attention towards reducing the vulnerability of the United States to such attacks. High-threat chemical agents, which include chemical weapons and some toxic industrial chemicals, are normally organized by military planners into four groups: nerve agents, blister agents, choking agents, and blood agents. While the relative military threat posed by the various chemical types has varied over time, use of these chemicals against civilian targets is viewed as a low probability, high consequence event. High-threat chemical agents, depending on the type of agent used, cause a variety of symptoms in their victims. Some cause death by interfering with the nervous system. Some inhibit breathing and lead to asphyxiation. Others have caustic effects on contact. As a result, chemical attack treatment may be complicated by the need to identify at least the type of chemical used. Differences in treatment protocols for the various high-threat agents may also strain the resources of the public health system, especially in the case of mass casualties. Additionally, chemical agents trapped on the body or clothes of victims may place first responders and medical professionals at risk. -
