Tidey Permanent panel members iii PREFACE rhis is the fortieth volume of issuances (1 - 387) of the Nuclear Regulatory Commission and its Atomic Safety and Licensing Boards, Administrative Law Judges, and Office Directors. It covers the period from July 1, 1994 - Decem• ber 31, 1994. Atomic Safety and Licensing Boards are authorized by Section 191 of the Atomic Energy Act of 1954. These Boards, comprised of three members conduct adjudicatory hearings on applications to construct and operate nuclear power plants and related facilities and issue initial decisions which, subject to internal review and appellate procedures, become the final Commission action with respect to those applications. Boards are drawn from the Atomic Safety and Licensing Board Panel, comprised of lawyers, nuclear physicists and engineers, environmen• talists, chemists, and economists. The Atomic Energy Commission first established Licensing Boards in 1962 and the Panel in 1967. Beginning in 1969, the Atomic Energy Commission authorized Atomic Safety and Licensing Appeal Boards to exercise the authority and perform the review 'unctions which would otherwise have been exercised and performed by the Commission in facility licensing proceedings. In 1972, that Commission created an Appeal Panel, from which are drawn the Appeal Boards assigned to each licensing proceeding. The functions performed by both Appeal Boards and Licensing Boards vere transferred to the Nuclear Regulatory Commission by the Energy Reorganization Act of 1974. Appeal Boards represent the final level in the idministrative adjudicatory process to which parties may appeal. Parties, however, ire permitted to seek discretionary Commission review of certain board rulings. Fhe Commission also may decide to review, on its own motion, various decisions >r actions of Appeal Boards. On June 29,1990, however, the Commission voted to abolish the Atomic Safety ind Licensing Appeal Panel, and the Panel ceased to exist as of June 30,1991. In he future, the Commission itself will review Licensing Board and other idjudicatory decisions, as a matter of discretion. See 56 Fed. Reg. 29 & 403 (1991). The Commission also has Administrative Law Judges appointed pursuant to the \dministrative Procedure Act, who preside over proceedings as directed by the Commission. The hardbound edition of the Nuclear Regulatory Commission Issuances is a inal compilation of the monthly issuances. It includes all of the legal precedents or the agency within a six-month period. Any opinions, decisions, denials, nemoranda and orders of the Commission inadvertently omitted from the monthly loftbounds and any corrections submitted by the NRC legal staff to the printed ioftbound issuances are contained in the hardbound edition. Cross references in he text and indexes are to the NRCI page numbers which are the same as the page lumbers in this publication.
