At the end of the trial I will give you more detailed [written] instructions that will control your deliberations. When you deliberate, it will be your duty to weigh and to evaluate all the evidence received in the case and, in that process, to decide the facts. To the facts as you find them, you will apply the law as I give it to you, whether you agree with the law or not. You must decide the case solely on the evidence and the law before you. Perform these duties fairly and impartially. Do not allow personal likes or dislikes, sympathy, prejudice, fear, or public opinion to influence you. You should not be influenced by any person’s race, color, religion, national ancestry, or gender, sexual orientation, profession, occupation, celebrity, economic circumstances, or position in life or in the community. Finally, you should make an effort to be aware of your unconscious biases and what effect those may have on your decision-making. You may recall during jury selection, [the attorneys/I] asked the panel if any of you had ever heard the term “unconscious bias.” That term is one used by social scientists to describe the reality that everyone[, including me,]1 has feelings, assumptions, perceptions, fears, and stereotypes, that is, “unconscious biases,” that we may not be aware of. These hidden thoughts can affect what we see and hear, how we remember what we see and hear, how we interact with others, and how we make important decisions. 1 The court can omit reference to “including me.” Page 3 of 169 3.1 DUTIES OF JURY TO FIND FACTS AND FOLLOW LAW Members of the jury, now that you have heard all the evidence, it is my duty to instruct you on the law that applies to this case. A copy of these instructions will be available in the jury room for you to consult. It is your duty to weigh and to evaluate all the evidence received in the case and, in that process, to decide the facts. It is also your duty to apply the law as I give it to you to the facts as you find them, whether you agree with the law or not. You must decide the case solely on the evidence and the law. Do not allow personal likes or dislikes, sympathy, prejudice, fear, or public opinion to influence you. You should not be influenced by any person’s race, color, religion, national ancestry, or gender, sexual orientation, profession, occupation, celebrity, economic circumstances, or position in life or in the community. You will recall that you took an oath promising to do so at the beginning of the case. Finally, you should make an effort to be aware of your unconscious biases and what effect those may have on your decision-making. You may recall at the beginning of this trial during jury selection, [the attorneys/I] asked the panel if any of you had ever heard the term “unconscious bias.” That term is one used by social scientists to describe the reality that everyone[, including me,]2 has feelings, assumptions, perceptions, fears, and stereotypes, that is, “unconscious biases,” that we may not be aware of. These hidden thoughts can affect what we see and hear, how we remember what we see and hear, how we interact with others, and how we make important decisions. Because you are making very important decisions in this case, you should evaluate the evidence carefully and resist jumping to conclusions based on personal likes or dislikes, generalizations, gut feelings, prejudices, sympathies, stereotypes, or biases. The law demands that you return a just verdict, based solely on the evidence, your individual evaluations of that evidence, your reason and common sense, and these instructions. Our system of justice is counting on you to render a fair decision based on the evidence, not on biases. You must follow all these instructions and not single out some and ignore others; they are all important. Please do not read into these instructions or into anything I may have said or done any suggestion as to what verdict you should return—that is a matter entirely up to you. 2 The court can omit reference to “including me.” Page 4 of 169 NINTH CIRCUIT MODEL INSTRUCTIONS Perform these duties fairly and impartially. You should not be influenced by any person’s race, color, religious beliefs, national ancestry, sexual orientation, gender identity, gender, or economic circumstances. Also, do not allow yourself to be influenced by personal likes or dislikes, sympathy, prejudice, fear, public opinion, or biases, including unconscious biases. Unconscious biases are stereotypes, attitudes, or preferences that people may consciously reject but may be expressed without conscious awareness, control, or intention. Like conscious bias, unconscious bias can affect how we evaluate information and make decisions. Ninth Circuit Model Criminal Jury Instructions 1.1 – Duty of Jury You must avoid bias, conscious or unconscious, based on a witness’s race, color, religious beliefs, national ancestry, sexual orientation, gender identity, gender, or economic circumstances in your determination of credibility. Ninth Circuit Model Criminal Jury Instructions 1.7 – Credibility of a Witness It is your duty to weigh and to evaluate all the evidence received in the case and, in that process, to decide the facts. Since then, we have seen the COVID-19 pandemic and the resurgence of the #BlackLivesMatter movement following the police killings of George Floyd, Breonna Taylor, and all too many others. Given these critical events, we as researchers and as members of a research organization paused to reflect on how our work speaks to the urgent injustices laid bare today. These events have dramatically foregrounded existing calls for jus- tice at the intersections of technology, unjust social and political structures, digital privacy, surveillance, and the values and purpose of technology corporations. Many of the defining events that have shaped ethics in the tech sector in recent years—including tech worker organization, walkouts and resignations over military con- tracts, continued contestations over racial and sexual harassment inside of tech companies, legislation and regulations, and critical audits—have been and continue to be the contentious background to the research conducted for this report. Our research takes place amidst, but is not primarily about, these tectonic changes that have repeatedly reframed the broader tech ethics conversation. It is in- stead about the ways those inside of tech companies have begun reshaping corporate practices against this background—how they understand the problems their industry faces, the means at their disposal to address these problems, and the lines of thought that shape those understandings.

    SYSTEMIC RACISM, POLICE BRUTALITY OF BLACK PEOPLE, AND THE USE OF VIOLENCE IN QUELLING PEACEFUL PROTESTS IN AMERICA WILLIAMS C. IHEME* “Our lives begin to end the day we become silent about things that matter.” —Martin Luther King Jr Abstract: The Trump Administration and its mantra to ‘Make America Great Again’ has been calibrated with racism and severe oppression against Black people in America who still bear the deep marks of slavery. After the official abolition of slavery in the second half of the nineteenth century, the initial inability of Black people to own land, coupled with the various Jim Crow laws rendered the acquired freedom nearly insignificant in the face of poverty and hopelessness. Although the age-long struggles for civil rights and equal treatments have caused the acquisition of more black-letter rights, the systemic racism that still perverts the American justice system has largely disabled these rights: the result is that Black people continue to exist at the periphery of American economy and politics. Using a functional approach and other types of approach to legal and sociological reasoning, this article examines the supportive roles of Corporate America, Mainstream Media, and White Supremacists in winnowing the systemic oppression that manifests largely through police brutality. The article argues that some of the sustainable solutions against these injustices must be tackled from the roots and not through window-dressing legislation, which often harbor the narrow interests of Corporate America. Police Arbitration Stephen Rushin* Before punishing an officer for professional misconduct, police departments often provide the officer with an opportunity to file an appeal. In many police departments, this appeals process culminates in a hearing before an arbitrator. While numerous media reports have suggested that arbitrators regularly overturn or reduce discipline, little legal research has comprehensively examined the outcomes of police disciplinary appeals across the United States. In order to better understand the use of arbitration in police disciplinary appeals and build on prior research, this Article draws on a dataset of 624 arbitration awards issued between 2006 and 2020 from a diverse range of law enforcement agencies. It finds that arbitrators on appeal reduced or overturned police officer discipline in 52% of these cases. In 46% of cases involving termination, arbitrators ordered police departments to rehire previously terminated officers. On average, arbitrators reduced the length of officer suspensions by approximately 49%. Arbitrators gave several common justifications for reductions in officer discipline.

In two studies, we explore the social psychological process of stereotype threat as it differentially affects the performance of first- and second-generation West Indian students. An initial questionnaire study of 270 West Indian students provided data on perceived favorability of African American and West Indian stereotypes, ethnic identification, and perceptions of discrimination. An experimental study of stereotype threat showed a significant interaction between generation and stereotype threat condition: first- and second- generation West Indian students performed equally in neutral conditions, but differed significantly when stereotype threat was present. While first- generation students increased their performance in the threat condition, second-generation students showed the performance decrements characteristic of African American students. Effects due to the race of the experimenter were also found, suggesting the importance of context in testing situations. Overall, the findings argue for the relevance of psychological processes in understanding broader demographic patterns of immigration and change.
