Report by Luis Yáñez-Barnuevo García, Chair of the DMER, on the visit by a Working Group to () and () from 29 April to 3 May 2013

I. INTRODUCTION

A Working Group (WG) from the Delegation for relations with the Mercosur countries (DMER) visited Montevideo (Uruguay) and Buenos Aires (Argentina) from 29 April to 3 May 2013.

The WG included the Chair of the DMER, Luis Yáñez-Barnuevo García (S&D, Spain), and the Members Jean-Pierre Audy (PPE, France), Mario Pirillo (S&D, Portugal), Ana Miranda (Verts/ALE, Spain) and Josefa Andrés Barea (S&D, Spain), rapporteur of the Committee on International Trade, to monitor trade negotiations on the EU-Mercosur Association Agreement (AA).

II. MONTEVIDEO (29-30 April 2013)

1. Interparliamentary meetings

1.1. Meting with the President of the and Vice-President of Uruguay, Danilo Astori

The WG met with the and Vice-President of Uruguay, Danilo Astori, at 4 pm on Monday 29 April in the Legislative Palace.

In his opening address, Mr Yáñez-Barnuevo noted that smaller countries such as Uruguay can have a major role to play in developing regional integration processes, as was the case of the Benelux countries in relation to the EU, and stressed the importance of association agreements boosting economy and employment, particularly in times of crisis such as that currently affecting Europe. He said that the path to Europe’s economic recovery was through increased

The EU- Mercosur Association Agreement therefore needed to be completed as soon as possible, before any signature of the EU-US Agreement, which would have an impact on future EU agreements, and also before the end of the 7th of the EP, the members of which were largely in favour of the Association Agreement.

After expressing his support for the conclusion of a comprehensive and balanced AA, Senator Astori and noted that there were, unfortunately, two lines of thought, with the large countries, Brazil and Argentina, taking a more protectionist approach and the small countries, Uruguay and Paraguay, favouring free trade.

In closing, Senator Astori emphasised the importance of parliamentary diplomacy and, in particular, the role played by the EuroLat Assembly. He highlighted the need todevelop scientific and cultural cooperation between Mercosur and the EU.

1.2. Meeting with the President of the Chamber of Representatives, Germán Cardoso

The meeting of the WG members with the President of the Chamber of Representatives, Germán Cardoso, was held at 11.30 on Tuesday 30 April in the Legislative Palace. The topics discussed were parlaiemntary diplomacy and the internal organisation of the EP, Parlasyur and the Uruguayan Parliament.

Mr Yáñez Barnuevo explained the competences of the DMER, emphasised the extent to which a legislative power was able to influence the external relations of a country or regional integration group and drew attention to the fact that the EP’s Members were grouped by ideological affinity rather than along national lines.

In response, Mr Cardoso described the organisation of Parlasur, whose members, unlike those of the EP, were not directly elected. The only exception was Paraguay, which already directly elected its 18 representatives in Parlasur. He also referred to the situation of these parliamentarians, who had been suspended following the ousting of President Lugo and was glad to note that things had improved following the recent elections in Paraguay.

1.3. Meeting with the Chair of the Committee for International Affairs, José Carlos Mahía

The WG met with José Carlos Mahía, the Chair of the Committee for International Affairs, at 14.30 on Monday 29 April in the Legislative Palace.

Mr Yáñez Barnuevo introduced the members of the WG and welcomed the recent progress in the EU-Mercosur negotiations with a view to signing the future Association Agreement. Reference was then made to the exchange of offers which was due to take place during the last quarter of 2013, Paraguay’s reintegration into Mercosur and Venezuela’s accession.

PE474.369v01-00 2/16 CR\1001420EN.doc EN Mr Mahía felt that after the last few months of crisis, Mercosur was now at a more positive stage, with the return of Paraguay and the accession of Venezuela, within a context of increased integration and a more open form of regionalism. He saw this as being the moment to push ahead with the negotiations so that the Agreement could at last be signed.

1.4. Meeting with the Chair of the National Defence Committee, Tabaré Viera

The members of the WG met with Senator Tabaré Viera, Chair of the Senate’s National Defence Committee at 15.15 on Monday 29 April in the Legislative Palace.

Mr Viera outlined the recent . After being ruled by a military dictatorship from 1973 to 1985, the country made a peaceful return to democracy. In order to leave the past behind, the Ley de Caducidad (Expiration Law) was passed, putting an end to the investigation of human rights abuses and granting a de facto amnesty to those responsible. This law, which still divided Uruguayan society, had been upheld in a 1989 referendum and a 2009 plebiscite. However, in October 2011 the Congress passed another law which declared crimes committed under the military regime to be crimes against humanity and therefore not subject to statutory limitations. This new law left the 1986 law without effect, although it had not yet been formally abolished.

Luis Yáñez, Jean-Pierre Audy, Mario Pirillo and Ana Miranda spoke, after which Mr Viera went on to talk about Uruguay’s participation in United Nations peacekeeping missions, which was agreed on unanimously.

1.5. Meeting with Members of Uruguay’s delegation to the Mercosur Parliament

The members of the WG held a meeting with eight of the 18 members of the Uruguayan delegation to Parlasur at 12.30 on Tuesday 30 April 2013 in the Legislative Palace. The following members attended from the Uruguayan side: Tabaré Viera, Alberto Couriel, Constanza Moreira, José Bayardi, Gustavo Borsari, Doreen Ibarra, Daniela Payssé and María Elena Laurnaga. Topics discussed were regional integration (Mercosur), EU-Mercosur relations and Mercosur- relations.

In relation to the first topic, participants spoke about the future readmission to Mercosur of Paraguay, in light of the recent elections there, and about the outlook for direct elections to Parlasur. Within the context of EU-Mercosur relations, the parliamentarians insisted on the need to move ahead with negotiations leading to the Association Agreement and were informed that the city of Buenos Aires was willing to host the future Euro-Latin American Observatory on Migration. Lastly, there was discussion of the complex nature of relations with China, owing to the total absence of labour and trade union rights for workers.

2. Meetings with the Uruguayan executive

The members of the WG met with the President of Uruguay, José Mujica, at 17.15 on Monday 29 April at the presidential offices (Executive Tower).

The President focused on the following points in his address to the MEPs:

- Europe is no longer the centre of the world, nor does it have statesmen able to match those who founded what is now the EU. Nevertheless, a united Europe is still a force to contend with in today’s ever more globalized, interconnected and multipolar world. Europe has the intelligence and the technological capacity needed to successfully tackle the current crisis. Crises cause undesirable effects such as the rise of nationalism. Europe should continue diversifying its contacts to the greatest extent possible, establishing relationships of equality with its partners. These relationships should provide mutual benefits, as the key to their continued existence.

- The negotiations on the EU-Mercosur Association Agreement are dragging on endlessly. It would be helpful if progress could be made in these negotiations, particularly as the economies of both blocs are complementary to each other. French farmers have nothing to fear from their Uruguayan counterparts.

- Democracy is strong in Latin America. Nevertheless, Latin America is still the continent with the greatest economic and social inequalities. Brazil could play a more significant role in the continent, taking advantage of its more flexible trade relationships.

- The US is determined to pursue multiple trade negotiations, with the EU, the Pacific Alliance and the East Asian countries. China is playing an increasingly important role on the world stage. International policy will become increasingly sominated by the largest countries and by regional groups. The international political stage will remain extremely complex over the next 20 years.

2.2. Meeting with the Minister for Foreign Affairs, Ambassador Luis Leonardo Almagro Lemes

The WG met with Mr Almagro at 10.00 on Tuesday 30 April at the Foreign Ministry.

Mr Yáñez Barnuevo spoke about the outlook for progress in the negotiations towards the signature of the EU-Mercosur Association Agreement. He considered the current context to be favourable, given the solution of the Paraguayan crisis, the exchange of offers between the EU and Mercosur scheduled to take place in the last quarter of 2013 and the fact that a majority of MEPs in Parliament’s 7th legislature supported the project. Ms Andrés Barea asked about the possible repercussions of an EU-US Agreement.

Mr Almagro said he favoured a flexible Agreement which took into account the asymmetries between the two blocs, but that unfortunately some countries, such as Argentina and Venezuela, were unenthusiastic about the Agreement. The exchange of offers scheduled for the last quarter of 2013 would coincide with Argentina’s mid-term elections in October 2013. The exchange

PE474.369v01-00 4/16 CR\1001420EN.doc EN would make it possible to assess the prospects for signature of the EU-Mercosur Association Agreement.

3. Meeting with the Mercosur High Representative, Ivan Ramalho

The meeting with the Mercosur High Representative, Ivan Ramalho, was held at 15.30 on Tuesday 30 April at the Mercosur building.

Discussion focused on the outlook for the EU-Mercosur Association Agreement and on the internal organisation of Mercosur. Regarding the first topic, the High Representative summarised the development of the EU-Mercosur negotiations and the way in which they worked. Mr Ramalho also felt that, despite some difficulties, Mercosur was still attractive: Bolivia’s application to join was making good progress and there was already talk of applications by Surinam, Guyana and Ecuador.

4. Meeting with representatives of the Eurocámaras

During this meeting the members of the WG were able to discuss the prospects for the Association Agreement, the importance of interparliamentary dialogue, the repercussions of a possible EU-US agreement, the growing importance of China on the world stage and the Pacific Alliance. The President of the Eurocámara, Manuel Ascer (who also chairs the Uruguayan- Italian Chamber of Commerce), and the presidents of six bi-national Chambers (German, British, Czech, Greek, Polish and Portuguese) took part in the meeting.

5. Meeting with representatives of the Uruguayan academic sphere

The WG held a working lunch with representatives of the academic sphere: Professors Norberto Ianelli (Director of the regional office of the Ibero-American General Secretariat-SEGIB), Lincoln Bizzozero (Faculty of Social Sciences), Gerardo Caetano (Academic Director of the Centre for Regional Integration Training-CEFIR), Horacio Bafico (ORT Uruguay University) and Gustavo Michelin (ORT Uruguay University)..

The main focus of discussion was the the EU-Mercosur Association Agreement negotiations. The academics felt that the initial obstacles to the Agreement (farming issues, european subsidies, etc) had become unimportant. Nevertheless, the European crisis and the the complex economic and political situations of some Mercosur countries also hindered rapid progress in the negotiations. It was felt that ‘crisis is the worst enemy of trade agreements’. Those present also spoke about the role of Brazil, the advance of China and the meagre results of agreements so far signed between Mercosur and third countries, in fact only Israel and Palestine.

6. Meeting with ambassadors of the Member States represented in Uruguay

CR\1001420EN.doc 5/16 PE474.369v01-00 EN The WG members were able to exchange impressions with diplomats from their countries in Uruguay and with Juan Fernández Trigo, the head of the EU Delegation in Montevideo. The meeting was held from 9.30 to 10.30 on Monday 29 April 2013.

Debate centred mainly on the negotiations leading to the Association Agreement, the repercussions of the recent elections in Paraguay, the exchange of offers due to take place in the last quarter of 2013, the negotiations towards the EU-US Agreement, the new regional players (Pacific Alliance and far eastern countries) and the outlook for European elections in 2014 and entry into office of the new Commission.

III. BUENOS AIRES (2-3 May 2013)

1. Inter-parliamentary meetings

1.1. Meeting with the President of the Chamber of Deputies’ Committee on External Relations, Guillermo Carmona, enlarged to include the bureau of the Committee and with the attendance of the Vice-President of the Mercosur Committee, Julia Perie.

The MEPs met with their Argentinian counterparts at 13.00 on Thursday 2 May at the Legislative Palace. The meeting was dominated by discussion of the negotiations towards the EU-Mercosur Association Agreement. The members present were pleased with the recent general elections in Paraguay which would allow the country to be fully readmitted to Mercosur’s structure. This would also enable the Mercosur partners to jointly draft the proposal which would form the basis for the exchange of offers towards the end of 2013.

It was pointed out that the Agreement would not be limited to a trade chapter and that the political and cooperation pillars should reflect the values shared by both parties, as well as including topics which were important to bi-regional dialogue, such as the environment and migration. The impact which the Agreement could have on encouraging regional integration within the framework of Mercosur was also highlighted. Mr Carmona regretted that the Mercosur integration process continued to be a fundamentally intergovernmental process and that there was not yet a sufficiently supranational perspective.

1.2. Meeting with the Chair of the Senate Committee on External Relations, (FPV - Autonomous city of Buenos Aires), enlarged to include the Bureau of the Committee: Samuel Cabanchik (formerly of Coalición Cívica - Autonomous city of Buenos Aires) and Sonia Escudero (Alianza Justicialista - Province of Salta)

The WG met with Senator Filmus (Chair of the Senate Committee on External Relations), Sonia Escudero and Samuel Cabanchik at 15.00 on Thursday 2 May 2013 at the Legislative Palace.

Discussion centred on trade and political matters. Those present reiterated their hope that a successful Agreement would be reached. The Argentinian senators mentioned their country’s

PE474.369v01-00 6/16 CR\1001420EN.doc EN considerable trade deficit with the EU, resulting from a 23 % increase in imports, and deplored European complaints against Argentina in the ILO. They emphasised that the expropriation of YPF had been within the terms of the constitution. The senators also asked the MEPs to make efforts to assist Argentina in opening up a dialogue with the UK to address the issue of the Falkland Islands. Senator Filmus said that ‘It would be a beneficial move, furthering the consolidation of the Agreement, if the EU could undertake to help persuade the UK to engage in a bilateral negotiation process.’ The Chair of the WG, Luis Yáñez Barnuevo, replied that it was unadvisable to give the Falklands issue a European dimension and that the matter remained a bilateral Anglo-Argentinian one.

2. Meetings with the Argentinian executive

2.1. Meeting with the Minister for External Relations and Worship, Ambassador Héctor Timerman

The members of the WG met with the Foreign Minister, Héctor Timerman, at 11.15 on Thursday 2 May at the San Martin Palace.

The Chair of the WG introduced the MEPs, explained the purpose of their visit and thanked the Minister for agreeing to meet them. He emphasised that both the EU and the EP placed great value on relations between regional groups and welcomed the forthcoming EU-Mercosur exchange of trade offers scheduled for the last quarter of 2013. He also noted that it was essential in a multipolar world to strengthen interregional relationships and that the common historical and cultural background of both regions and their shared values and political, economic and social interests should simplify completion of the AA.

Mr Timerman stressed that Mercosur is still a highly dynamic regional bloc which is open to the accession of other South American countries. Concerning the AA, Mr Timerman said that Mercosur would speak with one voice in the negotiations with the EU and that Argentina sought an Agreement which could benefit both sides while respecting the existing asymmetries. He added that Argentina needed to safeguard social cohesion and employment and protect its industries, which had been undermined by the deindustrialisation policies applied towards the end of the last century, and that Argenitna and its partners were working to ensure that the content of the future offer matched Mercosur’s needs.

3. Meeting with representatives of civil society

The members of the WG held a working lunch on 3 May 2013, which was attended by: Antonio Estrany, Vice-President of the Argentinian Council for International Relations (CARI), Viktor Klima, former Prime Minister of Austria and former President of Volkswagen Argentina, José Ignacio de Mendiguren, President of the Argentine Industrial Union, Felix Peña, academic specialising in regional integration, and Carlos Restaino, member of the Mercosur Economic and Social Forum. The lunch was also attended by Ambassador Alfonso Díez Torres, head of the EU Delegation in Argentina.

CR\1001420EN.doc 7/16 PE474.369v01-00 EN The following topics were discussed: progress and setbacks in South American regional integration (Mercosur and the Pacific Alliance); outlook and reality of the EU-Mercosur Association Agreement; the role of the EU and European parliamentary diplomacy in the EU- Latin America strategic partnership and Latin American regional integration; Latin American trade relations and Brazil-Argentina relations.

Mr Yáñez Barnuevo pointed out that the EP had been at the forefront of the European institutions in establishing relations with Latin America and thanked the participants for attending.

4. Meeting with ambassadors of the Member States represented in Argentina

The WG members were able to exchange impressions with diplomats from the Member States represented in Argentina and with Alfonso Díez Torres, the head of the EU Delegation in Buenos Aires. The meeting was held from 8.45 to 10.15 on Thursday 2 May, at the residence of Ambassador Díez Torres.

The main topic under discussion was the negotiations leaing to the AA (calendar and obstacles), Argentina’s current political and economic difficulties, and relations between the Mercosur partners, particularly those between Argentina and Brazil.

IV. CONCLUSIONS

It is important to note that the visit was politically well-timed, as it took place three months after the first Summit meeting of the Community of Latin American and Caribbean States (CELAC) and the EU, held in Santiago de on 26-27 January 2013. This summit encouraged the EU and Mercosur to continue with the negotiations towards the AA and supported the decision by the Europeans and Mercosur members to move ahead to the exchange of trade offers scheduled for the last quarter of 2013.

As a result, this topic headed the agenda at the cordial meetings with Uruguayan and Argentinian counterparts. It should be pointed out that the former expressed unreserved support for the AA, whereas the latter continued to insist on the need for reciprocal trade concesssions in order to reach a complete and balanced agreement.

Such an agreement would send out a clear message rejecting trade protectionism, which has been fed by the crisis, and would make a significant contribution towards the recovery of the international economy. The impact on the EU-Mercosur AA of a possible EU-US trade and investment agreement was considered, as was the role of the Pacific Alliance and China. The latter could become Mercosur’s main social and economic partner. Lastly, the European elections will take place in 2014 and there is no guarantee that the new Members of the EP will favour the AA. This makes it more than ever necessary to find the political will to achieve a rapid completion of the Agreement.

PE474.369v01-00 8/16 CR\1001420EN.doc EN Mention was made of the common historical and cultural background and shared values and principles of the two regions as being factors favouring completion of the Agreement, added to the fact that the AA is not just trade-based but has political and cooperation components. There was also discussion of parlamentary diplomacy and the need for the EP and Parlasur to provide political back-up to the AA negotiating rounds

Both parties favoured increased political and economic integration for Mercosur and South America (Unasur) Completion of the EU-Mercosur Agreement would be of benefit to both sides, reducing the impact of the crisis in Europe and opening up the economies of the Mercosur countries.

The WG thanks the embassies of Uruguay and Argentina in Brussels and the EU Delegations in Uruguay and Argentina for their excellent cooperation and availability. The members of the WG also wish to thank the Uruguayan and Argentinian authorities for their magnificent welcome, which contributed enormously to the success of the visit.
