In it we sec pictures that represent what historical painting of the twentieth century, filled with signs of terror and destruction, has to offer. Pictures Ernst produced shortly after Hitler's seizure of power, reminiscent of Goya's Capriehos and Desastres de /a guerra, are clear references to that event. But mixed in with them again and again we find more harmonious, lighter works in which melancholy and horror give way to an almost cosmic serenity. The two moods are intimately related in this pictorial world, so inti- mately in fact that at any moment night can turn to day, paralysis to exhilaration: Ernst gives us both nightmare and deliverance. Encountering Max Ernst's work, we soon realize that it is impossible to catego- rize his extremely diverse oeuvre in terms of style. Yet we find in everything he did a single overriding artistic concept: that of the collage. Ernst took inspiration from the bewildering glut of available images in reproduction. Illustrations of objects and processes that he discovered in publications from the late nineteenth and early twentieth centuries provided material he could recycle in the form of collages.

Discouraging Collusion in the Secondary Art Market Nicole Dornbusch Horowitz In the 1920s and 1930s, major oil companies took advantage of market conditions to raise gasoline prices. They sold a limited amount of gasoline on smaller submarkets and the remainder of their gasoline by other methods. Despite the fact that the submarkets only represented a small portion of the overall gasoline market, pricing in the greater market was based on them. Thus, through collusive agreements, major oil companies were able to raise prices in the overall market by inflating prices in the smaller markets. In United States v. Socony-Vacuum Oil Co., the U.S. Supreme Court held that these agreements constituted price-fixing and violated the Sherman Act. Today, conditions in the art market create opportunities and incentives for coordinated price manipulation similar to those present in Socony-Vacuum. Art sold at auction represents a small portion of the art market, but prices paid for art at auction are used to determine prices in the larger market. Further, the art market’s opacity and the fact that small, tight-knit groups buy and sell high-end artworks provide even greater opportunities for collusion than those present in Socony-Vacuum. This Note examines these comparable opportunities and incentives through a study of activity in the market for artworks by Andy Warhol. J.D. By CAROL VOGEL Published: September 15, 2008 LONDON — Against a backdrop of reeling financial markets and nervous investors, Sotheby’s and the British artist Damien Hirst forged ahead with “Beautiful Inside My Head Forever,” a highly publicized auction of 223 works, all by Mr. Hirst and all made within the last two years. In a gamble that could have ramifications for other artists, Mr. Hirst was bypassing his dealers — the Gagosian Gallery, based in the United States, and White Cube, based in London — and taking his work straight to auction with a sale that began here on Monday night and concludes on Tuesday afternoon.
