GAMA aliuliza:- Kwa kuwa kwa muda mrefu Serikali ya Jamhuri ya Muungano wa Tanzania imekuwa ikizungumzia utaratibu wa uwekezaji hususan katika sekta ya miundombinu kwa utaratibu wa Build, Operate and Transfer ili kurahisisha maendeleo. Je, Serikali inaweza kuwavutia wawekezaji wowote chini ya utaratibu huo? WAZIRI WA NCHI, OFISI YA RAIS, MIPANGO NA UBINAFSISHAJI alijibu:- Mheshimiwa Spika, napenda kujibu swali la Mheshimiwa Dr. Lawrence Gama, Mbunge wa Songea Mjini, kama ifuatavyo:- Mheshimiwa Spika, katika kikao cha Mkutano wa Kumi na Tano wa Bunge la Jamhuri ya Muungano wa Tanzania, kilichomaliza shughuli zake tarehe 23 Aprili, 2004, nilimjibu Mheshimiwa Philip Magani, Mbunge wa Ruangwa, ambaye alipenda kufahamu jinsi ya kuwavutia wawekezaji kwa njia ya Build, Operate and Transfer (BOT). Mheshimiwa Spika, katika kurejea jibu langu la msingi ni kuwa, utaratibu wa Build, Operate and Tranfer ni mbinu ambayo Serikali imeamua kuitumia kwa kutoa vivutio maalum ili kuwavutia wawekezaji wa ndani na nje, kuwekeza katika miundombinu ili kuipa Serikali unafuu katika gharama za uwekezaji. Chini ya utaratibu huu wawekezaji binafsi huruhusiwa kujenga, kuendesha na hatimaye kukabidhi kwa 1 Serikali, miundombinu waliyojenga baada ya muda wa makubaliano kumalizika kwa kuingia mikataba na Serikali. Mheshimiwa Spika, mkataba wa namna hii humruhusu mwekezaji binafsi kutoza ushuru kwa watumiaji wote wa miundombinu aliyojenga kwa kuzingatia makubaliano ambayo yako kwenye mkataba na Serikali. Ni kwa njia ya kutoza ushuru ambapo inatarajiwa kwamba, mwekezaji ataweza kurejesha gharama na pia kutengeneza faida katika muda wa mkataba. Ujenzi wa barabara na madaraja ni baadhi tu ya miradi inayoweza kufanywa chini ya utaratibu huu. Mheshimiwa Spika, chini ya utaratibu huu, Serikali imeshaanza majadiliano ya awali ya mwekezaji aliyejitokeza ikiwa ni Mfuko wa Taifa wa Hifadhi ya Jamii (NSSF), juu ya ujenzi wa Mradi wa Daraja la Kigamboni katika eneo lililoko mwisho wa mkondo wa bahari ili kuunganisha Dar es Salaam Kaskazini na Kusini. Mheshimiwa Spika, miaka ya karibuni imejitokeza Kampuni ya wageni na wazawa ya PRODECO, ambayo imefanya mazungumzo ya awali na Wizara ya Ujenzi, kwa lengo la kujenga barabara kuunganisha Mji wa Dodoma na Nzega kupitia Tabora ya km. 487 na matarajio ya kuunganisha Tabora na Kigoma km. 690. Pia barabara nyingine iliyopendekezwa kujengwa kwa utaratibu huu ni ile inayounganisha Mji wa Bagamoyo na eneo la utalii la Sadani km. 40 na uwezekano wa kuendelezwa hadi Tanga Mjini kupitia Pangani. Miradi mingine inayofikiriwa ni pamoja na ule wa Mtwara Development Corridor. Mheshimiwa Spika, ni dhahiri kuwa utaratibu huu wa uwekezaji katika miundombinu kwa njia ya Build, Operate and Transfer, utaweza kuwavutia wawekezaji wengi ili kuboresha sekta ya usafiri nchini. MHE. GAMA: Mheshimiwa Spika, nakushukuru sana kwa kunipa nafasi ya kuuliza swali moja kama ifuatavyo: Kwa kuwa huu utaratibu ni mzuri sana na unaweza kuleta manufaa makubwa sana kwa maendeleo ya Taifa letu. Je, Serikali inaweza ikaongeza juhudi kidogo katika kuwashawishi hawa wawekezaji ili wawe wengi zaidi kuliko ilivyokuwa sasa? (Makofi) WAZIRI WA NCHI, OFISI YA RAIS, MIPANGO NA UBINAFSISHAJI: Mheshimiwa Spika, ninakubaliana na Mheshimiwa Lawrence Gama kwamba, utaratibu huu ni mzuri sana hasa katika kuboresha miundombinu yetu na ndiyo maana hata katika hotuba yetu ya bajeti ya mwaka huu, tumeweka msisitizo wa kutumia utaratibu huu katika kujenga baadhi ya miradi yetu nchini. Lakini vile vile kwa sababu utaratibu huu ni mpya na bado hatujaanza kuutumia hapa Tanzania, ni kweli kabisa Serikali sasa inabidi iweke nguvu zaidi katika kuwavutia wawekezaji kwa mpango wa Build, Operate and Transfer. MHE. IRENEUS N. NGWATURA: Mheshimiwa Spika, nakushukuru sana kwa kunipa nafasi ili niulize swali moja kama ifuatavyo: Ni dhahiri kabisa Serikali ina 2 mpango wa kubinafsisha miundombinu yake na mashirika yake. Je, Mheshimiwa Waziri, haoni kwamba mpango huu unajipinga wenyewe? (Makofi) WAZIRI WA NCHI, OFISI YA RAIS, MIPANGO NA UBINAFSISHAJI: Mheshimiwa Spika, Serikali inabinafsisha mashirika yaliyokuwa yakimilikiwa na Shirika la Umma kwa maana ya ubinafsishaji, unafanyika kwa yale mashirika yaliyokuwa yakimilikiwa na Serikali. Mpango wa Build, Operate and Transfer, kama tutakavyouona ni mpango ambao unavutia wawekezaji binafsi baada ya kufanya mchanganuo na kuona watapata faida gani ndipo wanapoingia katika mradi huo. Kutokana na hilo utaratibu wa ubinafsishaji na BOT haupingani. (Makofi) SPIKA: Waheshimiwa Wabunge, kabla hatujaendelea ningependa kuwaarifu Watanzania wanaofuatilia mambo yanayotokea ndani ya Bunge kwamba, kuanzia leo wale wanaopata matangazo ya television ya Star TV wanaweza kutuona tukifanya kazi hapa Bungeni moja kwa moja kutoka kwenye Ukumbi huu. Mitambo imeshakamilika, wenye television hizo wanaweza kuzifungua sasa na watatuona tunafanya kazi kwa niaba yao. Tunaendelea na maswali kwa Wizara ya Ardhi na Maendeleo ya Makazi. (Makofi) Na. 41 Upatikanaji wa Hati ya Nyumba na Ardhi Asili MHE. MEJA JESSE J. MAKUNDI aliuliza:- Kwa kuwa kabla ya Sheria ya Ardhi ya mwaka 1974 inayohusu mtu kuwa na Hati ya Shamba na Nyumba, barabara zinazounganisha Vijiji, Wilaya, Mikoa hadi nchi jirani zilikuwa njia za miguu na hatimaye barabara ndogo za kupitisha magari madogo na sasa zimejengwa kwa kiwango cha Kimataifa na nyumba za wanavijiji zilizoko kwenye mashamba asili (vihamba) kuwekwa alama ya "X" kuashiria kuvunjwa:- (a) Je, Serikali itawalipa kabla fidia/stahili wanavijiji na nyumba/vihamba vilivyomalizwa kwa ajili ya upanuzi wa barabara hizo ambazo ni muhimu sana kwa uchumi wa Taifa letu? (b) Je, Serikali haioni kuwa ni muhimu na ni busara kutoa semina/mihadhara na vipeperushi vya kuelimisha wanavijiji juu ya upatikanaji wa hati ya nyumba na mashamba ili iwe rahisi kwa fidia endapo hapo baadaye italazimika kupitisha barabara kwenye nyumba au shamba (vihamba) vya wanavijiji? NAIBU WAZIRI WA ARDHI NA MAENDELEO YA MAKAZI alijibu:- Mheshimiwa Spika, kwa niaba ya Waziri wa Ardhi na Maendeleo ya Makazi, kabla ya kujibu swali la Mheshimiwa Meja Jesse Makundi, Mbunge wa Vunjo, napenda kutoa maelezo ya utangulizi kama ifuatavyo:- 3 Tanzania haijawahi kuwa na Sheria ya Ardhi ya mwaka 1974. Sheria za Ardhi zinazotumika sasa ni Sheria ya Ardhi Na. 4 na Sheria ya Ardhi ya Vijiji Na. 5, ambazo zilitungwa na Bunge lako Tukufu mwaka 1999. Kabla ya kutungwa kwa sheria hizo kulikuwa na Sheria ya Ardhi (Land Ordinance), Sura Na. 113 ya mwaka 1923. Mheshimiwa Spika, baada ya maelezo hayo ya utangulizi, sasa napenda kujibu swali la Mheshimiwa Meja Jesse Makundi, Mbunge wa Vunjo, lenye sehemu (a) na (b) kama ifuatavyo:- (a) Mheshimiwa Spika, suala la ulipaji wa fidia kwa wananchi walioathirika kutokana na upanuzi wa barabara nchini, linategemea maelezo yanayowasilishwa Wizarani kwangu na mamlaka husika kuhusu upana stahili wa barabara inayohusika. Baada ya kupata maelezo hayo, ndipo wathamini wanaweza kufanya kazi ya kuthamini ardhi na mali zingine zilizoko na kuandaa taarifa inayoonyesha wananchi wanaostahili kulipwa au kutolipwa fidia. Hivyo, kinachowezesha ardhi ya wanavijiji, nyumba zao na mali zingine kulipwa fidia ni sharti ijulikane mipaka ya eneo la upimaji wa barabara na kama ilivyojibiwa na Serikali kwenye swali Na. 13 la Mheshimiwa Mheshimiwa Wilfred Lwakatare, tarehe 9 Juni, 2004. (b) Mheshimiwa Spika, ninakubaliana na Mheshimiwa Mbunge kuwa, Wizara yangu inawajibika kutoa elimu kwa umma kuhusu Sera ya Taifa ya Ardhi na Sheria mpya za ardhi juu ya matakwa yake ikiwa ni pamoja na upatikanaji wa hati za kumiliki ardhi kimila au kisheria. Katika kutekeleza jukumu hilo, Wizara yangu imekuwa ikitoa elimu kwa njia mbalimbali ikiwa ni pamoja na kupitia vyombo vya habari kama redio, televisheni, kuandika makala kwenye magazeti, kusambaza vipeperushi, semina na kushiriki kwenye maonyesho ya sabasaba, mwaka 2003 tulishiriki. Aidha, Wizara yangu kwa kushirikiana na Ofisi ya Rais, Tawala za Mikoa na Serikali za Mitaa, imekwishatoa elimu kwa umma kuhusu Sheria hizo kwa Maafisa Watendaji wa Kata wasiopungua 2,408 na Viongozi 72,000 kutoka Kamati mbalimbali za vijiji katika mikoa yote 21 ya Tanzania Bara. Natoa wito kwa asasi zisizo za Kiserikali na wadau wengine, washirikiane na Wizara yangu kutoa elimu ya Sera ya Taifa ya Ardhi na Sheria za Ardhi ili kuwafikia wananchi katika vijiji vyote nchini. MAKUNDI: Mheshimiwa Spika, nakushukuru kwa kunipa nafasi ya kuuliza angalau swali moja kama ifuatavyo:- Kwa kuwa kwa mujibu wa Hansard ya tarehe 9 Juni, 2004, Mheshimiwa Naibu Waziri wa Ujenzi, wakati akijibu swali la Mheshimiwa Wilfred Lwakatare, alisema kwamba, Wabunge na Madiwani watawajibika kama Serikali itakapopata fedha itakuta wananchi hawajaondoka katika maeneo yaliyowekwa alama ya "X" na kwamba watasukumizwa pembeni mwa barabara na kwamba sijui wataliwa na simba kama ilivyokuwa operation ya Serikali ya Awamu ya Kwanza. MAKUNDI: Je, kwa tamko hili haoni kwamba amevunja Katiba ya Nchi na kwamba amewafanya Wabunge na Madiwani watakaogombea mwaka 2005 hasa wa CCM, kukosa nafasi katika sehemu zao na kuwafagilia Upinzani, wanaowatetea wanyonge ili hatimaye TLP inayoongozwa na Mheshimiwa Augustino L.

    PARLIAMENTARY OVERSIGHT OF DEFENCE AND SECURITY IN TANZANIA’S MULTIPARTY PARLIAMENT Mwesiga Baregu Introduction In 1992, the Parliament of the United Republic of Tanzania enacted the Political Parties Act, which reinstated multipartism in Tanzania’s politics. This was after nearly 30 years of constitutional single-party rule that was formally established in 1964, following a failed military coup attempt. The process of proscribing competing political parties and the muzzling of the autonomous civic organi- sations had, however, been evolving from the early days of independence under the aegis of the Tanganyika African National Union (TANU), which was bent on creating national unity to promote development. Rationalising this trend, Mwalimu Nyerere argued at the time that in order for the twin objectives of nation building and economic development to be effectively pursued and achieved “… there is as much need for unity as was required during the struggle for independence. Similarly there is no room for difference”.1 The country now has 14 registered political parties, five of which are variously represented in Parliament. During this period of single-party rule parliamentary business as a whole was dominated and manipulated by the ruling TANU party in the 1960s and its successor Chama Cha Mapinduzi (CCM) from the mid-1970s, until the advent of multipartism in 1992. This was also a time during which Julius Nyerere, the ‘Father of the Nation’, almost single handedly directed the affairs of state and party as president and chairman, respectively. It was particularly the time when the separation of powers and checks and balances between the executive, the judiciary and the legislature were quite tenuous under party supremacy, implementing a policy of ‘socialism and self-reliance’.

On the mainland multi-partyism is working well; a by-election under way in Dar es Salaam will help to indicate how the main parties stand after almost a year of this new system of government. In Zanzibar, by contrast, it is becoming increasingly difficult for TA to present an accurate and unbiased report on what is happening because of the conflicting information received. The opposition continues to refuse all cooperation with the government elected under questionable circumstances last year and the ruling party is resorting to strong arm tactics in its determination to maintain law and order. MKAPA Popular President Mkapa's dominant position was consolidated on June 20 when he was elected Chairman of his Chama Cha Mapinduzi (CCM) Party by an overwhelming 1,248 votes out of 1,259 at an emotional ceremony in Dodoma. Former President and Chairman Ali Hassan Mwinyi handed over the CCM Constitution, 1995 Election Manifesto and Chairman's gong midst deafening chants of tCCM', tCCM', tCCMf, dancing, ululation and music by the party's cultural troop 'TOTt. The new Chairman said that he would maintain earlier policies of socialism and self-reliance and would continue to fight tribalism, discrimination and religious bigotry.
