Minutes of Public Hearings of the Council of the District of Sicamous held at the Seniors Activity Centre, June 26th, 2006

Call to Order: Mayor March called the Public Hearing to order at 6:30 p.m. and explained the Public Hearing was convened pursuant to Section 922 of the Local Government Act and outlined the rules and procedures for the Public Hearing pursuant to District policy. Mayor March asked the Administrator to provide an overview of the application.

Business Arising:

OFFICIAL The Administrator reported the subject property is located on the eastern COMMUNITY PLAN shore of Mara Lake and fronts on Mara Lake Lane adjacent to Gillis AMENDMENT – 326 Creek, and three residences to the north and a three to four-storey MARA LAKE LANE condominium building under construction to the south. There is a current proposal for a four to six storey condominium south of the adjacent building under construction. To the east beyond Mara lake Lane is Highway 97A and beyond that the land rises considerably to acreage with a single-family dwelling and a recently approved subdivision. She outlined the detail of the proposal.

The Administrator reported that pursuant to the provisions of the Local Government Act and the Community Charter, the proposal has been advertised in two consecutive issues of a local newspaper. She said two verbal comments opposing the proposed development were received at the District office. The Administrator reported that two written comments were received from the Eagle Valley Resource Centre and Mr. and Mrs. Harren, both of whom opposed the development proposal. She read the letters in their entirety. The Administrator reported receiving a petition signed by 156 persons opposing the development. She said the Community Development Technician is present to answer any technical questions.

Mayor March invited the developer to provide an overview of the development proposal.

Mr. Sam Boguslavsky, representing Sable Resorts, reported they wish to redevelop the subject property with a mixture of 1, 2 and 3 bedroom condominiums in a variety of single land two level apartment, apartment lofts and townhouse within two (2) concrete structures of two (2) levels of covered parking with a total density of one-hundred and sixty-two (162) residential units and a health club and large amenity areas including two outdoor pools, spa and other open space amenities. The proposed buildings will be in the form of one (1) seven (7) storey concrete tower and one (1) nine (9) storey concrete tower, both of the buildings will step down in height toward the Mara Lake. Two elevators will serve each building. He said they propose a 6.0 metre wide access along the southern property boundary for access to the lake. Mr. Boguslavsky said they will construct the development in two (2) Phases with Phase 1 including the propose seven (7) storey building, the parking structure and amenities and Phase 2 being the second nine (9) storey building. He said the on-site covered parking for three hundred (300) vehicles plus ten (10) surface visitor parking stalls for a total of three hundred and ten (310) vehicles on-site will be provided. He said they have secured an additional seventy-eight (78) vehicle spaces to meet the parking requirements of the District at an off-site location. He provided further information regarding the development proposal.

Mr. Boguslavsky referenced the District’s trademark, “Houseboat Capital of Canada” and commented regarding the lifestyle of the community. He said the project will offer labour opportunities for the community. Mr. Boguslavsky referenced Gillis Creek and commented on the proposal to return the creek to its natural state and the process involving the Department of Fisheries and Oceans and the Ministry of Environment. Mr. Boguslavsky referenced the increased growth throughout the Okanagan Valley and noted that Sable Resorts will present a marketing program locally to make units available to local residents.

7:00 p.m. Mayor March recessed the Public Hearing in order to convene the Regular Council Meeting.

7:05 p.m. Mayor March reconvened the Public Hearing.

TONY PARROTTINO, Mr. Parrottino said he opposes the development based on the height of #9, 221 TEMPLE the two residential structures being seven and nine storeys high. He referenced the petition and said if more time was allotted, additional signatures could be acquired.

ALF BRYAN, Mr. Bryan said he lives on Holly Avenue and will look directly across the 302 HOLLY highway to the proposed nine storey structure. He said the structure will block the evening sun. Mr. Bryan said he opposes the seven and nine storey structure and suggested a four storey structure would be more appropriate.

GARY WORCESTER, Mr. Worcester asked questions relative to the number of fire hydrants, 94 MONTCALM location of hydrants, size of watermain, sprinkler system inside the CRESCENT buildings and number of fire fighters in the community.

The Community Development Technician responded to Mr. Worcester’s questions and provided further detail, noting the District’s engineer is working on the design of the water system to ensure fire flows are met. He reported the property owner’s architect has contacted the District to acquire information relative to the District’s Fire Department. The Community Development Technician reported the structure will be fully sprinklered and noted the developer will be upgrading the water system and sewer infrastructure in the area.

7:15 p.m. Mayor March recessed the Public Hearing to reconvene the Regular Council Meeting.

7:25 p.m. Mayor March reconvened the Public Hearing.

TONY PARROTTINO, Mr. Parrottino referenced the Public Information Meeting held on June #9, 221 TEMPLE 21st and suggested there was insufficient time between that meeting and the formal Public Hearing for residents to acquire further information.

CLARENCE MARTIN Mr. Martin said funds should be allocated towards extending the sewer collection system and expressed concern relative to the impact to the environment with this development. Mr. Martin said the subject property is a swamp.

The Community Development Technician provided an explanation of Council’s policy to extend the sewer collection system.

JOHN HEAVENER, Mr. Heavener requested clarification pertaining to Council’s policy to 722 KAPPEL extend the sewer collection system.

The Community Development Technician provided a detailed explanation.

PAM BEECH, Mrs. Beech requested Council’s consideration to slow down 610 PINE development proposals within the community. She queried how the community gains control and deal with other issues associated with development such as affordable housing. She asked if there were impact studies regarding the increased useage of Mara Lake.

The Community Development Technician reported property ownership has inherent rights and Council considers the best interests of the community. He provided further information and noted the District’s influence on Mara Lake only extends 200 metres and the Province has jurisdiction over the majority of the lake. He described the referral process and requirements under a Development Permit. The Community Development Technician reported that the District can not answer for Provincial authorities.

When queried regarding construction workers, Mr. Boguslavsky, Sable Resorts, referenced another development in and , noting in that location, his company secured a nearby hotel to provide accommodation for workers on the project. He provided further detail.

RUTH CAMERON, Mrs. Cameron asked if the development will be a time share. #25, 221 TEMPLE

Mr. Boguslavsky said the project will not be a time share, that it will be privately owned residential units.

BRIAN CUFF, Mr. Cuff reported that his property is above the proposed development 297 HOLLY and said he felt the meeting was a positive meeting. Mr. Cuff said that he agrees with every speaker including the developer. Mr. Cuff said Council has the ability to protect community interests and felt the proposed development is not in the best interest of the community. He said he likes the project but would prefer to see it in a different location. Mr. Cuff said the project will eliminate his lake view and will devalue his property.

CYRIL DAWES Mr. Dawes said there has been no consideration for the residents of the community. He said this project will require upgrading of fire department equipment which will cost the taxpayers of the community. Mr. Dawes referenced upcoming policing costs and suggested Council slow down the development in the community.

DENIS MAILLE, Mr. Maille reported his property is adjacent to the proposed development 334 MARA LAKE and that he purchased his property for lake access. He queried LANE proposals for a marina fronting the development.

The Community Development Technician reported that the marina portion of the development will be a separate application which will involve the Department of Fisheries and Oceans and the Ministry of Environment. He referenced restorative works planned for Gillis Creek and noted the District will be meeting with the three adjacent property owners to ensure their concerns are addressed.

JIM HARREN, 338 Mr. Harren asked if the Gillis Creek inlet will be closed to boat traffic. MARA LAKE LANE The Community Development Technician said that issue comes under Provincial jurisdiction.

BRIAN CUFF, Mr. Cuff said he thought the Official Community Plan was a sector plan 297 HOLLY and offered property owners security. He said he felt the Official Community Plan is being changed at the whim of developers.

The Community Development Technician reported the Official Community Plan was adopted in 1994 and is amended from time to time. He said the OCP has designated this property as multi family residential since its adoption. He said the amendment will designate the property as a Comprehensive Development Permit area to control the form and character of the development.

ALF BRYAN, Mr. Bryan suggested the proposal be constructed outside of the 302 HOLLY community.

THOMAS CHIDLOW, Mr. Chidlow asked if there is a written record of this meeting. The 710 FOREST PARK Administrator confirmed that Minutes are being taken of the Public Hearing.

FRANK MCNABB, Mr. McNabb reminded Council members that it was elected to serve the 82 MONTCALM citizens of the community. June 26th, 2006 Public Hearings Page 5

After calling three times for comments from the gallery, and receiving none, closed the Public Hearing at 8:15 p.m.

Business Arising: Mayor March called the Public Hearing to order at 8:15 p.m. and dispensed with the reading of the Opening Statement pursuant to District policy. She asked the Administrator to provide an overview of the application. The Administrator noted that the Public Hearing relative to the proposed rezoning of 326 Mara Lake Lane is the same property as the previous hearing.

REZONING The Administrator reported the subject property is located on the eastern APPLICATION – 326 shore of Mara Lake and fronts on Mara Lake Lane adjacent to Gillis MARA LAKE LANE Creek, and three residences to the north and a three to four-storey condominium building under construction to the south. There is a current proposal for a four to six storey condominium south of the adjacent building under construction. To the east beyond Mara lake Lane is Highway 97A and beyond that the land rises considerably to acreage with a single-family dwelling and a recently approved subdivision.

The Administrator reported that pursuant to the provisions of the Local Government Act and the Community Charter, the proposal has been advertised in two consecutive issues of a local newspaper. She said the correspondence received at the Public Hearing immediately preceding also pertain to this application. She said the Community Development Technician is present to answer any technical questions.

JIM HARREN, Mr. Harren asked what the density is under the proposed zoning 338 MARA LAKE category. The Community Development Technician provided a detailed LANE explanation of the proposed zoning category.

TONY PARROTTINO, Mr. Parrottino asked if the proposed zoning category controls the height 221 TEMPLE of residential structures. The Community Development Technician responded the zoning category was developed specific to this proposed development. Mr. Parrottino asked if the zoning category applies to properties on Riverside Avenue. The Community Development Technician reported that any similar proposals will require the same process to rezone the property and would involve a Public Hearing.

DAVE WILLIAMSON Mr. Williamson asked what the size of the property was and what was the proposed density.

The Community Development Technician reported the net area of the property is approximately 2.5 acres and will support a density of between 300 to 350 people. He described land dedications and improvements to the beach area.

ALF BRYAN, Mr. Bryan said the proposed development was a surprise and he was 302 HOLLY AVENUE not aware of the proposal until a week ago. He suggested the Council delay the proposal in order to acquire further community input.

FRANK MCNABB, Mr. McNabb queried if there were development proposals for the Two 72 MONTCALM Mile Subdivision area and referenced Waterway Houseboats property.

The Community Development Technician reported that no formal applications have been received at the District office.

After calling three times for comments from the gallery, and receiving none, Mayor March closed the Public Hearing at 8:30 p.m. The Administrator reminded Council and members of the gallery that Council is not permitted to receive further submissions after the close of the Public Hearing.

Adjournment: The Public Hearings of June 26th, 2006 were adjourned at 8:30 p.m.
