Lobatse Town Council STATE LAND ACT (Cap. 32:01) STATE LAND (PROCEDURE FOR ENFORCEMENT OF PAYMENT OF LEVIES AND LOANS) REGULATIONS, 1982 (S.I. 137 of 1982) (regulation 6) Notice of Defaulting Occupiers IT IS HEREBY NOTIFIED, in performance of the duty imposed by regulation 6 of the Regulations, that there is owed by and due from each of the persons named in the first column of the Schedule, being the holder of a Certificate of Rights in respect of the Plot of State Land 'tuated within the Lobatse Township the number of which is specified in the corresponding entry in the second column of the Schedule, the amount specified in the corresponding entry in the third column of the Schedule, which amount represents the amount owed by and due from him or her of the service levy imposed on him or her, as the occupier of the said Plot, by the Lobatse Town Council under section 4A of the Act, and the amount specified in the corresponding entry in the fourth column of the Schedule, which amount represents the amount owed by and due from him or her of instalments towards repayment of a Building Material Loan granted him or her, as occupier of the said Plot, by the LobatseTown Council under section 4C of the Act. 2. Selebi-Phikwe Town Council STATE LAND ACT (Cap. 32;01) STATE LAND (PROCEDURE FOR ENFORCEMENT OF PAYMENT OF LEVIES AND LOANS) REGULATIONS, 1982 (S.I. 137 of 1982) (regulation 6) Notice of Defaulting Occupiers IT IS HEREBY NOTIFIED, in performance of the duty imposed by regulation 6 of the Regulations, that there is owed by and due from each of the persons named in the first column of the Schedule, being the holder of a Certificate of Rights in respect of the Plot of State Land situated within the Selebi-Phikwe Township the number of which is specified in the corresponding entry in the second column of the Schedule, the amount specified in the corresponding entry in the third column of the Schedule, which amount represents the amount owed by and due from him or her of the service levy imposed on him or her, as the occupier of the said Plot, by the Selebi-Phikwe Town Council under section 4A of the Act, and the amount specified in the corresponding entry in the fourth column of the Schedule, which amount represents the amount owed by and due from him or her of instalments towards repayment of a Building Material Loan granted him or her, as occupier of the said Plot, by the Selebi-Phikwe Town Council under section 4C of the Act. 2. The Selebi-Phikwe Town Council is now required by regulation 7(1) of the Regulations forthwith to apply to the Magistrate’s Court at Selebi-Phikwe for an order to sell any movable property of each of the aforementioned persons in satisfaction of his or her default in payment of the service levy and Building Material Loan repayment instalments in question and of the interest accruing in respect thereof. 3. The aforementioned Court may make the aforementioned order after the expiry of the period of 14 days immediately following the day on which the Town Council's application is made to it; but the Court may decline to make such an order if, before the expiry of that 14 days’ period, payment is made into the Court of not less than 25 per cent of the amount then owed and due and of the amount of any court fees incurred up to the date of the payment by the Selebi-Phikwe Town Council and instead make an order for payment by instalments over a period of 12 months.
