DRAFT

AN ORDINANCE TO AMEND THE LAND SETTLEMENT ORDINANCE, 1928

BE IT ENACTED by the for Palestine with the advice of the Advisory Council thereof:—

This Ordinance may be cited as the Land Settlement .!־ .Short title (Amendment) Ordinance, 1932, and the Land Settlement No. 9 of 1928. Ordinance, 1928 (hereinafter called the principal Ordinance), No. 18 of 1930. the Land Settlement (Amendment) Ordinance, 1930, and this Ordinance mav together be cited as the Land Settlement Ordinances, 1928-1932.

Addition to 2. The following shall be added to section 56 of the principal section 56 of Ordinance as sub-section (3) thereof: — the principal Ordinance. "(3) An appeal shall be decided in chambers unless the Court, of its own motion or on the application of any party, shall otherwise direct. At any such appeal in chambers no party shall be heard".

Validation. 3. Any judgment given or order made by a Land Court in chambers in any appeal prior to the commencement of this Ordinance shall be deemed to be and always to have been validly given or made.

Substitution of 4. Section 30 of the principal Ordinance shall be repealed new section for and the following shall be substituted therefor:— section 30 of principal Ordinance. "(1) After the investigation of such claims to rights in a block as are undisputed, the Settlement Officer shall draw . up a Schedule of Rights in such form and containing such particulars as may be prescribed by regulation under this Ordinance, and after dealing with such Schedule as hereinafter provided, shall transmit a signed copy thereof to the Registrar, together with a signed plan of the parcels comprised in the Schedule. (2) Upon the determination by the Settlement Officer of any disputed claim, after the Schedule has been sent by him to the Registrar, the Settlement Officer shall inform the Registrar of his decision in such matter, and the Registrar shall thereupon enter particulars of the right which was in dispute in accordance with such decision in the appropriate page of the new register for which provision is made by section 35 of this Ordinance".

Substitution of 5. Section 35 of the principal Ordinance shall be deleted and new section for the following shall be substituted therefor: — section 35 of principal " A new register in a form to be prescribed by regulation Ordinance. under this Ordinance shall be opened for each village 15th September, 1932 THE PALESTINE GAZETTE 795

and notwithstanding any appeal that may be pending the land shall be registered by the Registrar in such register in accordance with the Schedule of Rights and the plan transmitted as provided in sub-section (1) of section 30 of this Ordinance, and in accordance with the decisions of the Settlement Officer in the case of rights shown as disputed in the Schedule of Rights".

6. Section 49 of the principal Ordinance as enacted in Addition to s n 9 c section 13 of the Land Settlement (Amendment) Ordinance, ^^ af 1930, shall be amended by the addition thereto of the following Ordnance, proviso:—

"Provided that where the subject matter of such appeal does not affect the total number of shares in which the parcel or village musha' is owned, the Settlement Officer may effect the partition notwithstanding that a judgment in the appeal has not been given by the Land Court".

CERTIFICATE

I, LIEUTENANT-GENERAL SIR ARTHUR GRENFELL WAUCHOPE, High Commissioner for Palestine, hereby certify that the construction of a new municipal water supply in the town of Nablus is an undertaking of a public nature within the meaning of section 3 of the Expropriation of Land Ordinances, 1926-1932.

The plans indicating the land to be expropriated are deposited at the office of the Engineer in Charge, Public Works Department, Nablus.

NOTICE IS HEREBY GIVEN that Schedules of Claims to land in the villages of Abu Shusha and El Muzeiri'a in the Ramie Settlement Area have been posted in the Settlement Main Office, Jaffa, in the Camps of the Assistant Settlement Officers, in the villages of Abu Shusha and El Muzeiri'a and in the District Office of the Ramie Sub-District in Jaffa, in accordance with section 24 of the Principal Ordinance.

Persons having any interest in the lands of the said villages should examine the Schedules and should take the necessary steps to ensure that their rights including mortgages, leases for a period of more than three years, or servitudes, are examined by the Settlement Officer of the Ramie Settlement Area.

IN EXERCISE of the powers vested in him by section 3 (i) of the Urban Property Tax Ordinances, 1928-1932, the High Commissioner has declared that the Urban Property Tax Ordinances, 1928-1932, shall apply to the Urban Area of Majdal, and that in place of the house and land tax payable at the date of this Order, there shall be payable annually Irom the 1st April, 1933, by the reputed owners of house property and land within the Urban Area of Majdal a tax which shall be assessed and paid in accordance with the provisions of the said Ordinances. j

For the purpose of the Ordinances, the Urban Area of Majdal shall be the area comprised and outlined in red on the Survey Department map of Majdal and environs on the 1/625 scale.

REGULATIONS MADE BY THE HIGH COMMISSIONER

IN EXERCISE of the powers vested in him by section 11 of the Immigration- Ordinance, 1925, the High Commissioner in Executive Council, with the sanction of the Secretary of State, has varied as follows the Regulations published in the Gazette of the 15th June, 1925, as amended by the Regulations dated; 15th September, 1932 THE PALESTINE GAZETTE 805

the 29th November, 1927. and published in the Gazette of the 1st December, 1927, and the Regulations dated the 1st April, 1930, and published in the Gazette of the 16th April, 1930.

1. Regulation 2 (2) is cancelled and the following is substituted Amendment of thereofor :— Regulation 2 (2).

(a) to remain in Palestine for a further period not exceeding nine months, and such permission may be granted by the Director, Department of Immigration, at his discretion; or

(b) to remain permanently in Palestine as an immigrant, and such permission may be granted by the Director, Department of Immigration, subject to his being satisfied that the applicant is a person who might properly be permitted to enter Palestine as an immigrant if he were not already in the country: Provided also that permission to remain permanently in Palestine as an immigrant in Category A (i) may be granted by the Director, Department of Immigration, at his discretion to any person, on payment of the prescribed fees, notwithstanding that the capital of such person is less than LP. 1000, but such discretion shall not be exercised in favour of any person who was not resident in Palestine on the 1st August, 1931, and who had not applied for such permission before the 16th December, 1931/'

2. Regulation 4 (1) is amended by the addition of the Amendment of following proviso at the end thereof: Regulation 4(1).

"Provided that Immigration Certificates shall not be required from the wives and unmarried children under the age of eighteen years, of persons who, having been born in Palestine and being Ottoman nationals, have failed to acquire Palestinian citizenship under Article 2 of the Palestine Citizenship Order- ''.Council, 1925־in

3. Regulation 4 (1) is cancelled and the following is substituted Amendmen ot therefor! Regulation 4(3).

"Categories of (3) No person shall be granted an Immigration Immigrants. Certificate or permit unless he belongs to one of the following categories :—

CATEGORY A. Persons of independent means who shall be deemed to include :

(i) Any person who is in bona fide possession, and freely disposes of a capital of not less than LP.1000; provided . that if the person is to engage in agriculture the capital may include land, implements and stock, and that regard 806 THE PALESTINE GAZETTE 15th September, 1932

may be had to the value of land, implements and stock placed at his disposal for a term of years and any advance of money made to him for a term of years by any agency recognised by the Government for assisting agricultural settlement; and if the person is to engage in industry the capital may include the site for an industrial establish• ment and machinery and regard may be had to the value of land placed at his disposul for a term of years and any advances of money made to him for a term of years by an agency recognised by the Government for assisting industrial enterprises.

(ii) Any person who, being a member of a liberal profession, freely and without restriction of time disposes of a capital of not less than LP.500; provided that the Director, , Department of Immigration, is satisfied that the need exists in Palestine for additional members of the profession in question.

(hi) Any person who, being skilled in certain trades or crafts, freely and without restriction of time disposes of a capital of not less than LP.250; provided that the econ• omic capacity of the country is such as to allow the immigrant to be absorbed in the practice of his profession, trade or craft.

(iv) Any person who has a secured income of not less than LP.4 a month, exclusive of earned income.

(v) Any person who is in bona fide possession of, and freely disposes of, a capital of not less than LP.500, if the Director, Department of Immigration, is satisfied that :—

(a) the settlement of such person in Palestine will not lead to the creation of undue competition in the pursuit which the proposed immigrant states his intention of entering; and

(b) his capital is sufficient to assure him a reasonable prospect of success in that pursuit; and

(c) he is qualified and physically fit to follow that pursuit.

CATEGORY B. Persons whose maintenance is assured, who shall be deemed to include : —

(i) any orphan of less than 16 years of age whose maintenance in or by a public institution in Palestine is assured until such time as he is able to support himself; (ii) any person of religious occupation whose maintenance is assured; (iii) any student whose admission to an educational insti• tution in Palestine and whose maintenance is assured until such time as he is able to support himself.

CATEGORY C. Persons who have a definite prospect of employment in Palestine.

CATEGORY D. Dependants of permanent residents or immigrants belonging to Categories A, B (ii) and C: 15th September, 1932 THE PALESTINE GAZETTE 807

Provided that the Director, Department of Immigration, may, at his discretion, grant an Immigration Certificate to any near relatives (not being dependants within the meaning of the Ordinance) or fiancees of permanent residents or immigrants who are respectively wholly and directly dependent upon such permanent residents or immigrants."

ANGLO-EGYPTIAN PROVISIONAL COMMERCIAL AGREEMENT

IT IS HEREBY NOTIFIED that the Anglo-Egyptian Provisional Commercial Agreement which was established in the correspondence between the Egyptian Foreign Minister and His Majesty's High Commissioner in Egypt, and which was published in the Official Gazette of the 1st December, 1930, has been extended for a further period of one year until the 16th February, 1933, by notes exchanged on the 23rd January last in terms similar to those of the notes exchanged in February, 1931.

The text of the notes exchanged in February, 1931, was published in the Official Gazette of the 1st July, 1931.
