A Communist Newspaper for Hungarian-Americans: The Strange World of the Uj Elore Thomas L. Sakmyster On November 6, 1921 the first issue of a newspaper called the Uj Elore (New Forward) appeared in New York City.1 This paper, which was published by the Hungarian Language Federation of the American Communist Party (then known as the Workers Party), was to appear daily until its demise in 1937. With a circulation ranging between 6,000 and 10,000, the Uj Elore was the third largest newspaper serving the Hungarian-American community.2 Furthermore, the Uj Elore was, as its editors often boasted, the only daily Hungarian Communist newspaper in the world. Copies of the paper were regularly sent to Hungarian subscri- bers in Paris, Berlin, Vienna, Moscow, Buenos Aires, and, on occasion, even smuggled into Budapest. The editors and journalists who produced the Uj Elore were a band of fervent ideologues who presented and inter- preted news in a highly partisan and utterly dogmatic manner. Indeed, this publication was quite unlike most American newspapers of the time, which, though often oriented toward a particular ideology or political party, by and large attempted to maintain some level of objectivity. The main purpose of Uj Elore, as later recalled by one of its editors, was "not the dissemination of news but agitation and propaganda."3 The world as depicted by writers for the Uj Elore was a strange and distorted one, filled with often unintended ironies and paradoxes. Readers of the newspaper were provided, in issue after issue, with sensational and repetitive stories about the horrors of capitalism and fascism (especially in Hungary and the United States), the constant threat of political terror and oppression in all countries of the world except the Soviet Union, and the misery and suffering of Hungarian-American workers. -

Judging Cruelty
Judging Cruelty Meghan J. Ryan* The wisdom of the death penalty has recently come under attack in a number of states. This raises the question of whether states’ retreat from the death penalty, or other punishments, will pressure other states — either politically or constitutionally — to similarly abandon the punishment. Politically, states may succumb to the trend of discontinuing a punishment. Constitutionally, states may be forced to surrender the punishment if it is considered cruel, and, as a result of a large number of states renouncing it, the punishment also becomes unusual. If a punishment is thus found to be both cruel and unusual, it will be proscribed under the Eighth Amendment Punishments Clause of the U.S. Constitution. Considering the disappearance of some punishments and the emergence of new ones, whether a punishment is cruel under the Punishments Clause is an important question. Curiously, there has been very little discussion of what constitutes a cruel punishment, as distinguished from whether a punishment is also unusual. This Article examines the concept of cruelty as enshrined in the Eighth Amendment Punishments Clause and suggests that the Supreme Court focus on this elusive concept through its independent judgment analysis. The Article emphasizes that such an independent judgment focus on cruelty should be constrained by specific, identified factors and that these factors should go beyond examining the penological purposes of punishment. The Article asserts that motive and the nature and quality of a punishment are central to the concept of cruelty and suggests that a more nuanced understanding of punishment rationales, supplemented by factors focused on elements such as the bloody * Assistant Professor of Law, Southern Methodist University, Dedman School of Law. -

Eldredge, Ph.D. Date approved: April 11, 2011 ii Abstract During the 1930s and 1940s, as the United States weathered the Great Depression, World War II, and dramatic social changes, heroes were sought out and created as part of an ever-changing national culture. American artists responded to the widespread desire for heroic imagery by creating icons of leadership and fortitude. Heroes took the form of political leaders, unionized workers, farmers, folk icons, historical characters, mothers, and women workers. The ideas they manifest are as varied as the styles and motivations of the artists who developed them. This dissertation contextualizes works by such artists as Florine Stettheimer, Philip Evergood, John Steuart Curry, Palmer Hayden, Dorothea Lange, Norman Rockwell, and Aaron Douglas, delving into the realms of politics, labor, gender, and race. The images considered fulfilled national (and often personal) needs for pride, confidence, and hope during these tumultuous decades, and this project is the first to consider the hero in American art as a sustained modernist visual trope.
