The following Environmental ssessment Report is one of several that was prepared in support of the Urban Infrastruclure Project for Ukraine which was under preparation in 2005-2006. This is a category project for rehabilitation of various utilities, including water supply, waste water treat nent, and solid waste. The EAs cover investments under Component B for Rehabilitatioi Investments under the project. Any technical variations in the final plans for these sites will be addressed in the review of the EMPs scheduled to take place in conjunction with he launch workshop. All subsequently identified works under Component B. must cor ply with the preparation of similar EAs in accordance with the Environmental Framework Policy dated November, 2005, before the disbursement of any funds for the specific site. U ban Infrastructure Project (Ul Project) and Nistru River/Black Sea Protection P oject (NR/BSP Project) (GEF si b-project) have been merged into a single Urban In rastructure Project (GEF sub-projicts are treated under the Ul Project) as their broad er vironmental goals include imprq 'ement of hygiene and health of the population, pr vision of low-cost and sustainablL water supply and sanitation delivery services, and irnprovement of environmental con tions in Ukraine, with a special focus on the Nistru Ri er and Black Sea basin as aprior tregion.

T le existing methodological frame orks for environmental assessment, developed in U craine and adopted by the Wor j Bank, have been reviewed. as part of the EFP p eparation. This review reveals a v ry close similarity of these frameworks, with only few minor inconsistencies, which haw not been encountered in the preparation of ei vironmental assessments for sele ted investment projects.

T ie Environmental Assessment d cuments, presented in this submission, have been p epared according to the World B nk environmental policies (OP4.01) and procedures, w hich are compatible with the Law of Ukraine "On Environmental Review" and the EIA- r lated State Construction Stand rd DBN A.2.2-1-2003 "The Environmental Impact A ,sessment Content and Compositi n for Construction Projects" (Kyiv, 2004).

T *ere have been numerous chang s in the list of proposed projects, which should be S bject to environmental assessme t. The most recent list of projects, provided to the EA C onsultant and dated 12 October! 2005, appears to be different from the initial list, ircluded in the Terms of Reference.

A the same time, the Environmental Assessment studies were carried out for a number of o her projects/locations, included in the expert's findings/e-mails dated 13 May, 11 June, 1 August and 26 August, 2005 (Iva o-Frankivsk, and towns in Kharkiv : Kupyansk, I ium, Chuguev).

A cording to above mentioned, the Fresent report consists of two volumes: * Volume 1 - preliminary su :-projects identified for inclusion under Ul project (according to the list dated 12 lctober, 2005). * Volume 2 - addition sub-proje ts reviewed according to expert's findings.

2 .1 INTRODUCTION

T e objective of the Environmental Assessment (EA) report is to identify and assess the f ture environmental impacts assoc ated with the proposed Urban Infrastructure Project in a manner that meets the requirl ments of the World Bank. The proposed Urban Ir frastructure Project is anticipatec to provide funds for financing the costs of priority irvestments, designed to address tl e most urgent issues faced by key municipal service s ctors, including water supply, sew rage, and solid waste management.

T he need for the Urban Infrastruq ure Project in Kharkiv is substantial and has many d mensions, key of them being tt e promotion of socio-economic development in an e vironmentally sustainable manne

This report presents the results of pi liminary environmental assessment of each project in Kharkiv, proposed for the World Eank funding, with particular focus on the potentially s gnificant impacts of these projects nd options for mitigating them.

According to the Terms of Referen e, and in order to ensure compliance with World Bank environmental policies (OP/BP/GP 4.01), the Environmental Assessment should be carried o ut in compliance with the EA requil ments for Category A projects.

The existing situation in Kharkiv with respect to drinking water supply, wastewater c Dllection and treatment, and solid N/aste management is first described before the need f r proposed developments is cc nsidered. The development proposals and existing environmental features are describbd to allow the assessment of environmental impacts and identification of mitigation optio s.

6 C,onsultation has taken place with ,arious stakeholders, and feedback is summarized in ection IV of this report.

General Information on the City d Kharkiv

Kharkiv is a major industrial, cientific and cultural centre in Ukraine, and the Edministrative centre of Kharkiv 0 last. Economically, it is associated with the Donetsk- l nipro Economic Region. Kharkiv has a cross-border location with respect to two . eographic zones (Forest-Steppe a nd Steppe), both classified as arid. Kharkiv has three r vers (, Kharkiv, and ), v ith their confluence located within the city boundaries. v 1he Udy River is the tributary of the Siversky River. 1 he climate in the area is typically oontinental, with long but relatively mild winter, and hot summer. Mean annual temperature is at 6.9 °C. The coldest months are January (-7.1 0C) end February (-6.7 °C), and the wirmest months are June (19.5 °C), July (20.5 0C) and / ugust (19.4 °C). Mean annual pr cipitation is about 522 mm, with its major proportion ( 352 mm) falling during the warm sqason, from April through October. Local wind pattern can be characte zed as follows: . Eastern and south-eastern wind are predominant in winter; . Western and north-western win are predominant in summer; Idean annual wind velocity is 4.33 n/s, with the 20-year maximum probable wind velocity teing at 22 m/s. The wind velocity P ad is about 30 kg-s/m2 Slow cover sefttles in early Decemb r and melts in late March, with mean thickness being at 20 cm, and normalized snow cver mass ranging between 95 to 100 kg/i 2. frost pe netration depths are at 1.0 m on tte average, and 1.1 m at the maximum.

Kl arkiv occupies the area of approx mately 305 ki 2, lying on the slightly undulating plain, di sected by river valleys and gorge . Surface elevations in relation to the sea level range be tween 90 to 192 m.

Kl arkiv has a population of about .5 million. It has been, and still is, one of the most important regions in Ukraine for in strial development, particularly for machine-building in ustry. Kharkiv's economic activi es include power engineering, tractor construction, machine-building, aircraft constru ion, chemistry, metal fabrication, forestry, wood p ocessing, tannery, food processin, construction industry.

B ing a major conurbation and entre of industrial activity, Kharkiv needs serious iniprovements in its municipal infra ructure, including water supply, wastewater collection and treatment, and solid waste management, in order to ensure its sustainable de velopment and maintain a althy environment. The achievement of these iniprovements requires large-scale pital investments and, given the scope of investment re quirement, loans provided by the international financial institutions are seen as a very in portant mechanism, particularly uring the transitional period, in which the municipal s ctor moves towards commercial i ependence.

3.1. Existing Situation

T e need for developing an effe ive and sustainable MSW management system in K arkiv, which has a 1'.5 million population, is substantial and demonstrated by the g nerally poor state of every aspec of current waste management system. The Kharkiv C ty and Oblast Administrations h ve consolidated their efforts in order facilitate the p ogress towards a more sustainab e waste management arrangement. The Kharkiv City Waste Management Strategy and Iction Plan have been approved by the City Council. T ese documents identify and prior ise actions that need to be taken in order to improve tt e existing waste management sy tem through a combination of technical, institutional a d organizational measures. Key p oposed improvements are listed below: a Purchase of 60 waste collection ehicles; . Purchase of 7,000 waste collecti n containers.

Pi rchase of 60 waste collection veh ls: It is proposed to purchase and o erate a new collection vehicle fleet, consisting of d mestically manufactured vehicles This option is considered to be most affordable and e onomical due to a relatively lovO price range of Ukrainian waste collection vehicles (4 ,000 to 72,000 USD). Taking in account the significant size of purchase order, and tir ne required for tendering and elivery, the estimated timeframe for this project c imponent is about 80 weeks. P eliminary technical characteristics of locally manufactured collection vehicles, using the MAZ-533702 chassis, are provided t elow: . High compaction ratio (up to 1:6) achieved due to the use of pushing plate; . High-quality hydraulic load-handl ng system; . Provision for automatic, sem automatic and manual operation of compaction mechanism; * Provision for automatic and man al operation of loading system; . Adjustable container lifting mec anism, which can be used with local and imported collection containers, ranging in X apacities between 0.12 m3 to 1.1 m3.

\Naste collection vehicles are int nded for outdoor operation under the moderately c ntinental climate conditions (temp rature range between -30° to +40°C). The designed o erational life is at least 10 ye rs at annual mileage of at least 60,000 km. The m anufacturer's warranty term is 36 time since the commissioning date. Some additional c aracteristics of proposed collectio vehicle type are provided in Table 3.2.

Ir accordance with the World Bank 's Operational Policy on Environmental Assessment, th e proposed infiltration intake proje t is rated as an environmental category B in terms of it.,; environmental impacts and their significance.

3.3.1. Physical Impact

T le potential physical impacts to th environment are likely to be associated with waste- re lated traffic. However, the propos d waste collection vehicle and container type appears tc be adequate in terms of ensuring that potential environmental impacts of their operation a e kept at an acceptable level, whi ch does not affect the ecological equilibrium and the sl ate of environment.

V/ater Resources: Vater-related mitigation measures ei ainly involve the provision for adequate maintenance a id cleaning of container sites and imely collection of waste in order to avoid the overflow o containers.

L nd Resources: Similarly, the provision for adequatc paving, maintenance and timely cleaning of container si tes is designed to minimize the im act on soil. Where necessary, restoration programme will be developed and implemented ollowing the organization of container sites.

3 3.2. Social Impact

T he proposed project is expected to produce visible improvements in the quality and o -ganization of MSW collection se vice. New container capacity will enable the gradual e (tension of existing separate wast ! collection initiatives in different areas of Kharkiv, and p oposed collection vehicle capa( ity will enable the increased frequency of waste c Ilections and avoid the overflo of waste in containers. No human resettlement re quirement is involved in the projecl. 3 4. Review of Alternative Optio s

By increasing the collection vehicle and container capacity, the progress will be made in implementing the City' Waste Man gement Strategy, especially in terms of achieving an improved level of waste collection s rvice and minimizing the adverse impact.of waste on th e environment.

3 5. Environmental ManagemenL Plan

3 5.1. Brief Description of Key En ironmental Issues

T e potential environmental impactp are likely to be associated with the operation of waste c llection vehicles and containers p rchased as part of the proposed project. Noise and di st are likely to be generated by co lection vehicles. In the event of disruption in collection se rvice, container site may becore a nuisance, being overflowed with waste. Where c ntainer lids are kept open, waste Oan easily mix with rainwater, accelerating the leachate g neration.

T e City regulation requires the cc struction provision of a special paved site for each waste container, in order to provide better containment for containerised waste.

3.5.2. Mitigation and Monitoring Ti e detailed mitigation and monito ing programme will be developed at a later stage of p oject implementation, though in general terms, the most effective form of mitigation a ainst adverse impacts, associate with the provision of waste collection service, is to e isure a high level of service management, especially with regard to collection fr quencies, container/vehicle fleet r aintenance, container site cleaning and maintenance.

T ie regulatory compliance effort of 8n implementing organization should be supported and a sisted by relevant regulatory autt orities. The Environmental Management Plan will be ir iplemented by the Borrower in or er to ensure compliance with existing environmental ar d sanitary regulations in the pr cess of implementing the proposed water supply, w stewater collection and solid wa te management improvements in Kharkiv. Relevant e ecutive authorities will be respon ible for overall control and supervision of construction ar d operation of all proposed fa Ilities. The day-to-day supervision of environmental p rformance will be part of the desig i/construction supervision process.

T ere is no plan for the involvement f non-governmental organizations in the independent monitoring of the project.

5. PUBLIC CONSULTATION

In accordance with the World Bar k requirement, the public consultation process was o0ganized as part of the environm Erntal assessment, in order to discuss the proposed ur ban infrastructure development pr jects with various stakeholder groups in Kharkiv. This p iblic consultation involved two stag is.

T he Need for Public Consultation

A-cording to the requirements of th World Bank and Ukrainian legislation, it is necessary tc consult project-affected groups a d local nongovernmental organizations (NGOs) about t e project's environmental aspects and to take their views into account when performing Environmental Assessment (EA) of investment project on municipal infrastructure. Thus, g neration of positive attitude on cli stages of projects is the necessary requirement for t e project performance.

C rganisation of Public Consultati ns

According to Terms of References, the Consultant (IWMC) has organized the public cl nsultation process in the following way:

1 Two public consultations for eac project location were carried out: . The first public consultatio - the purpose of this consultation was to present the planned project, review the A outline and schedule, Terms of Reference, and to solicit from affected groups a local NGOs any environmental issues they consider to be a priority and they wish see addressed in the EA report. * The second public consult tion - the purpose of this consultation was to present the results of EA work, discuis positive and negative impacts of planned project, to review the draft EA docume to insure that the issues identified in the first public consultation have been prop ly addressed and resolved to the satisfaction of locally affected groups and NGOs.

The main objectives of public co ultations were as follows: * To make the EA project tra sparent and open for the public; * To discuss various issues n d concerns with project-affected groups, to familiarize pubic with potential neg tive impacts and problems during realization of investment projects; * To have feedback from cor petent bodies and local project-affected groups during the EA process on potentia positive and negative impacts.

Conclusions

A set of very important and interest ng issues/comments/opinions were identified/received a s a feed-back from interested anc project-affected groups, in particular, potential Grant Recipients, NGOs and general put lic. All comments have been taken into account and p roperly addressed during the prept ration of EA reports.

The feedback received from the p| lic consultations has proved invaluable in assessing tl e following aspects of the propose projects:

* Compliance of planned inS stment projects with the Ukrainian environmental legislation and regulations; * Completeness of available inf rmation on the current environmental situation; * Current environmental permi ng status of each proposed project; U * Completeness of available nformation on the potential environmental impacts associated with the proposed nvestment project implementation; * Adequacy of proposed mitiga tion measures in terms of ensuring the environmental safety and sustainability; * Acceptability of potential envit nmental impacts and environmental feasibility of each * proposed project;

;f., * Need for additional envir nmental information or clarification of available environmental data.

1'he feedback received from variouX stakeholder groups was one of a strong support to the p roposed projects in Kharkiv and . Their implementation is expected to Mrovide much needed improvement in water supply, waste water collection/treatment and . olid waste management sectors. hese improvements would facilitate the provision of c ood quality services to populatio and compliance with the national and international tandards. The proposed projects would provide social benefits to the populations of Kharkiv, Chuguev, Izium and Kup ansk by improving the quality and reliability of vital services.

Dyachenko V.Y., Head of K yansk Vodokanal Utility - made a short report about the activity of the Utility. he Utility provides water supply and wastewater collection/treatment services. e underlined the necessity to perform rehabilitation of pipelines (length of water upply pipelines - 38 km, length of sewer pipelines - 78 km, about 60 % of pipes ae in bad condition). He explained the aim and specific sub-projects, in particular sub rojects on replacement of new equipment.

7. Shevchenko L.F., Director o Izium Vodokanal Utility - gave information about the Strategic Action Plan for Izium Vodokanal. Key problems relate to the modemization of water supp y and sewer pipeworks (including reconstruction of water abstraction facility, networks, pumping equipment, rehabilitation of wastewater system) was dev loped in the framework of preparation of the above mentioned Action Plan. Ke information and data for formulation of proposed investment projects were tak from the Action Plan.

8. Shtondenko V.E., Director o Chuguev Vodokanal Utility - underlined that the main problem for the Utility was quipment of sewage pumping stations. Most part of equipment was put into oper tion in 1970-s. He made a brief report on developed "Programme on rehabilitationt A list of priority measures was developed during the preparation of the programm

9. Alyabiev S.G., Director of unicipal Waste Management Facility, Chuguev - explained the situation with vaste management in Chuguev. The Programme on L rationale waste management as developed with IWMC support in order to improve waste management. It incl des up-to-date approaches to solution of waste management problems. Ad itional funding is necessary for fulfillment of the Programme, that is why WB i vestment projects are very topical.

10. Babenko V.V., Deputy Direct r of Kharkiv Municipal Waste Management Company - described the urgency Ind need for waste management improvements in Kharkiv, with special focus o the fact that existing landfill site has reached the end of its life. The Utility plans to urchase waste collection vehicles (20 t capacity) and containers (1100 I) in the fra ework of proposed project.

11. Abramov l.B., Deputy Direc pr of Ukrainian Environmental Engineering Research and Design Institute, IWMC xpert -explained the WB and Ukrainian requirements for EA process. He provid 3d brief review of Ukrainian legislation for waste management, in particular, c ncerning the development of new regulation (to come into effect from 1 January 20 6). The systemic approach and engineering surveying are necessary for practical int oduction of this document. Discussion: 12. Tsiguleva O., NGO MAMA-8 - said that MAMA-86 was responsible for the social assessment for the propose projects. The most interesting point for population is the impact of proposed projez s on service tariffs.

Epoyan S.M., Kharkiv State Technical University of Construction and Architecture, Head of Chair, Doctor of Tec nical Sciences, Professor - proposed cooperation in implementing the rehabilit ion projects for water supply and wastewater management systems. He u derlined the need in resolving existing problems with the help of proposed project and attracting the WB investment.

14.Popova l.M., NGO Ekoinfo m - a question on separate waste collection. She proposed cooperation in the field of waste management and informed about the conference that would take lace in February 2006. The conference will be under the aegis of Kharkiv Nation Economical University, State Department of Ecology in Kharkiv Oblast, Ukraini n Scientific and Research Institute of Ecological Problems and IWMC. She i vited everybody to take part in the conference and to discuss various issues. She ave information about the World of Waste website.

15.Sherenkov l.A., Head of hair "Environmental Engineering and Life Safety", Kharkiv State Technical Uni ersity of Construction and Architecture - underlined the necessity to analyse th costs and benefits of proposed projects. He focused attention on specific issues, particular, on landfill gas collection (should be taken into account during design rks on construction of new waste site), construction of infiltration intake system, ap ication of bio-technologies.

16.Kuzin A.K., Scientific Direc or of IWMC - thanked all participants for attention, promised to address all iden ified issues in EA report. He invited the participants to cooperate on the implemer ation of proposed projects. Tl e analysis of proposed projects monstrates their significant social benefits, resulting fr m the improvements in existing w ter supply, wastewater collection/treatment and solid w ste management systems in Kha iv, Chuguev, and Izium. These projects will c ntribute to the improvement of er ironmental situation in the region, provide access to b tter quality services, and result in duced energy costs of these services.

T e proposed projects will not ca e involuntary resettlement. Their potential physical inipacts on local geology, climate, ir quality, fauna, water bodies, soil, vegetation cover, a id existing utilities/infrastructure are considered to be minor and limited to the c nstruction phase.

S nce the generation of positive p blic attitude at all stages is a key requirement for p oposed projects, the results of EA re presented to public.

He told about calculations on repayment of loans. He e phasized the benefits associated with improved water quality and achieved energy savings (pipe breaks will be reduced by 20%, 5 million UAH will be saved in transp rtation costs).

6. Shtondenko V.E., Director of Chuguev Vodokanal Utility - underlined that proposed investment project were very topical for Chuguev. He said that EA was performed on high level and here were no comments and no negative remarks to the Draft EA Report.

7. Pustovoit V.V., Deputy Mayc of Kupyansk -said that projects were very necessary for the town. Corresponding calculation on repayment of loans were made. Loan will be returned in agreed per d. Town Council fully supports the projects.

8. Shevchenko L.F., Director f Izium Vodokanal Utility -told about the developed Strategic Action Plan for zium Vodokanal. Special attention was given to .5,_ repayment period (18-19 yea s).

He u derlined the necessity and importance of proposed projects for Kharkiv. He propo ed cooperation.

* Answer: Abramov I.B., De ty Director of Ukrainian Environmental Engineering Research and Design Institut , IWMC expert - there are two options: the first option is to transport them to M efa and other towns where special plants will be constructed for waste treatm t; the second option is to the existing site, in this case it is planed to create a syst for utilization of various types of wastes. However, such issues were not covere in the framework of proposed projects.

* Kuzmenok N.V., NGO MAM -86 - noted that EA was performed on high level and it allowed to see potential 0oblems that might occur in the result of performed projects. The most interestin point for population is how the proposed project will impact on tariffs.

* Answer: Petrosov V.A., Gen ral Director of Voda Municipal Water Supply Company - performance of proposed p jects will allow to reduce energy consumption and will give other economic benefits, That is why our Utility will have possibility to repay the loan without increasing tariffs

Today the second p blic consultation on investment projects on urban infrastructure was conducted in - cnferencec hall of Voda Municipal ater Supply Company.

T he second public consultation was organized by Association Industrial Waste ! Nanagement Centre and Voda Mu6 cipal Water Supply Company.

N.Yakovleva, Director of IWMC, h s informed that EA process and preparation of EA F eports is an important part of wor on preliminary stage for investment projects. EA has s own that due to carry out of pr posed projects, quality of municipal services will be irrnproved. Projects will have great cial impact in Kharkiv City, Chuguev town, Izium town d Kupyansk town. Expected phys cal impacts are minimal.
