Photo competition rules & regulations

ARTICLE 1 – ORGANISER Brussels Airlines SA having its corporate headquarters at avenue des Saisons 100-102, boîte 30, 1050 Brussels, registered in the register of legal persons in Brussels under the following number: 0400853488, organises this competition without any obligation of purchase for the participants.

Brussels Airlines is designated hereafter by the words “the organiser” or “Brussels Airlines”.

The competition starts on 01/10/2010 and ends on 30/11/2010 at midnight.

The following conditions describe the organisation of the competition and stipulate the rules and regulations of participation.

ARTICLE 2 – PARTICIPATION IN THE COMPETITION The competition is open to any person, with the exclusion of employees and administrators of the organiser or any other person implicated in the organisation of this competition, as well as any family members of the aforementioned.

Participation in this competition is strictly by email to [email protected].

A minor can take part in the competition only if he/she has obtained prior authorisation from his/her parents (or legal guardian). The fact that a minor participates in the competition signifies that he/she has already obtained this authorisation. The organiser has the right to demand a written proof of this authorisation at any moment, and also has the right to disqualify any minor who is not able to provide this proof immediately or within a reasonable deadline stipulated by the organiser.

ARTICLE 3 – COMPETITION MECHANISM To participate validly, the participant has to send an email to [email protected] containing the following: 1) a photo attachment of himself/herself holding a copy of b.there! magazine. Photos have to be at least 300dpi at 6 x 4 inches; 2) a sentence in English, French or Dutch describing why he/she is passionate about Brussels Airlines; 3) personal details including first name, last name, date of birth, phone number and email address.

Photos sent without a visible copy of b.there!, without the requested accompanying sentence, or with missing personal details will not be taken into account.

Any unlawful, harmful, threatening, endangering, illegitimate, vulgar, obscene, privacy- infringing, hateful, racist, xenophobe or otherwise reprehensible photo shall be immediately disqualified.

Photos received will be uploaded on the organiser’s social media sites.

Only one entry per name and email address is permitted.

Photos and personal information have to be received by the organiser at the latest by midnight 30/11/2010. All disputes related to the time of email delivery will be resolved based on the time of delivery inscribed on the organiser’s server.

ARTICLE 4 – THE WINNER 1 winner will be chosen at the closing of the competition. The winner will be the person whose photo and description is the most creative and original.

The winner will be picked by a panel of judges from Brussels Airlines and INK.

The winner will be informed personally, on 15/12/2010, by e-mail at the address used for the competition.

The organiser reserves the right to hand out the prize to the winner and to use his/her name as well as any pictures taken during the prize-giving ceremony for promotional purposes. The participation in this competition automatically implies that the winner agrees to the organiser using the winner’s name and taking pictures of him/her, without having to ask prior permission from the winner or offer the winner any compensation whatsoever.

The organiser also reserves the right to print the winning picture in future issues of b.there! as well as on the organiser’s social media sites without having to ask prior permission from the winner or offer the winner any compensation whatsoever.

ARTICLE 5 – PRIZE The winner of this photo competition will receive 2 Brussels Airlines b.flex economy+ return tickets all taxes included, to/from Brussels (no connections permitted).

The prize (the entirety of the prize or one of its components) cannot be exchanged for cash or any other prize in nature. The prize (the entirety of the prize or one of its components) cannot be given to someone else.

The winner will receive, by e-mail, information related to the reservation of the flight tickets.

The winner can choose the travel dates. However, the flights must be completed by latest midnight 14/12/2011, and flights are subject to availability in N class.

The winner is also free to choose the person that will accompany him/her on the same flight.

The tickets are only valid on flights operated by Brussels Airlines (ie all flights that have a flight number starting with a code SN2... or SN3...).

The General Conditions of Transport applicable to Brussels Airlines flight tickets will also apply for these tickets. The General Conditions of Transport are published on the website www.brusselsairlines.com. If the winner does not book his/her trip on a flight as per the aforementioned conditions, the unused tickets will be refused.

These flight tickets do not give the right to any miles on Miles & More.

ARTICLE 6 – REGULATIONS AND ACCEPTANCE By participating, a participant is held to have fully and unconditionally accepted the current competition rules and regulations. The results and any decision taken by the panel of judges, or the tickets cannot be challenged for any reason whatsoever. No correspondence shall be entered into regarding the result of the contest.

ARTICLE 7 INTERPRETATION AND MAILING Any dispute concerning the interpretation of the present competition rules and regulations, as well as any unforeseen situation caused by these rules and regulations will be decided by an internal jury established by the organiser, and no appeal shall be possible against the decision of this jury.

The judges’ decision is final, and the organiser will not reply to any written, telephone or verbal questions concerning the interpretation or the application of the present competition rules and regulations, the judgement on creativity and originality, or the list of participants and final winner.

ARTICLE 8 – VERIFICATION OF COMPLIANCE WITH THE COMPETITION RULES The winner and the participants agree that the organiser will be able to verify their identity or their place of residence as communicated to the organiser. Any false, incomplete or incorrect information linked to the identity or the address (e-mail or postal) will result in the elimination of the participant.

ARTICLE 9 – RESPONSIBILITY The organiser reserves the right to postpone, modify or cancel the competition in case of force majeure or for any other reason beyond the control of the organiser (for example a technical incident linked to a computer system failure, fraudulent access to the computer system, system bugs, interruptions or delays of telecommunication networks, but not only limited to that). In a similar way, the organiser cannot be held responsible for problems that are inherent to the transmission of electronic data transmission which would prevent (valid) participation.

Moreover, the organiser declines all responsibility for any damage of any kind that could arise after the prize has been handed out. Among other possibilities, the organiser declines all responsibility for errors linked to faulty prizes.

ARTICLE 10 – PROTECTION OF PRIVATE LIFE The organiser acts in accordance with Belgian legislation on the private life protection (law of 8/12/1922). Participants’ personal data gathered during the competition will be dealt with responsibly by the organiser. By taking part in the competition, the participant authorises the recording of his/her personal data, obtained via the competition, into the organiser’s folders. This data will serve for the management of the competition and for the identification of the winner.

In accordance with the law, the participant possesses the right to control, modify, or cancel his/her data. The participant who requests the cancellation of his/her data during the competition period accepts the automatic suspension of his/her participation knowing that without such data, it is not possible to appear in the list of participants.

ARTICLE 11 – VALIDITY If, for any reason, an article of the present rules and regulations proves to be illegal, invalid or inapplicable for any reason whatsoever, this article will be considered separately and will not influence the validity of the other conditions.

The conditions ruled out will have to be interpreted and/or replaced by valid conditions whose aim and effects are similar or else equivalent or closest to the conditions aimed for by the original provision.

ARTICLE 12 – LAWS APPLICABLE AND LEGAL JURISDICTION The present rules and regulations of the competition are governed by Belgian law, without giving effect to any principles of conflicts of law. The participant accepts that all court actions resulting from his/her participation in the competition, or concerning these competition rules and regulations will be of the exclusive competence of the Brussels Trial (), and he/she accepts to refer to the jurisdiction of this court of law for the purpose of such actions.
