NOTIFICATION OF THE MINISTRY OF DEFENSE ON PRESCRIPTION OF ARMAMENTS WHICH SHALL ACQUIRE PERMISSION UNDER THE CONTROL OF ARMAMENTS ACT B.E. 2530 ______By virtue of section 5 and section 7 of the Control of Armament Act B.E. 2530 contains certain provisions in relation to the restriction of rights and liberties of a person, in respect of which section 29 in conjunction with section 41 of the Constitution of the Kingdom of Thailand so permit by the virtue of law; the Minister of Defense upon the approval of the Council of Ministers hereby issues the Notification as follows: Clause 1. The followings shall be repealed: 1.1 Notification of the Ministry of Defense on the prescription of type of armament which shall acquire permission under the Control of Armaments Act B.E. 2530 dated the 20th of December B.E. 2541; 1.2 Notification of the Ministry of Defense on the prescription of type of armament which shall acquire permission under the Control of Armaments Act B.E. 2530 (No. 2) dated the 5th of October B.E. 2547; 1.3 Notification of the Ministry of Defense on the prescription of type of armament which shall acquire permission under the Control of Armaments Act B.E. 2530 (No. 3) dated the 28th of October B.E. 2548. Clause 2. The weapons, tools of weapons, chemical biochemical, radioactivity or nuclear or equipment which may be used during a battle or war shall be armaments as follows: 2.1 weapons, tools of weapons, rocket launcher or electromagnetic radiation and equipment which may be used in battles or war: 2.1.1 type of weapons, rocket launcher, drop and tools: 2.1.1.1 pistol; 2.1.1.2 short gun; 2.1.1.3 small gun; 2.1.1.4 machine gun; 2.1.1.5 gun with a barrel of more than 6 inches and more than one person stationed at the gun; 2.1.1.6 cannon; 2.1.1.7 gun with the bullets containing nuclear, biochemical, chemical which causes danger or poisonous; 2.1.1.8 submarine weapon; 2.1.1.9 nuclear weapon, biochemical weapon, ; 2.1.1.10 rocket launcher, missile and arms released; 2.1.1.11 explosive bomb launcher; 2.1.1.12 firework signal; 2.1.1.13 chemical launcher, military chemical subject; 2.1.1.14 smoke machine or smog; 2.1.1.15 rocket launcher, drop, including the location searching system, location specification, targeting, inspection or monitoring, searching equipment, data collection, informant and inspection, inspection machine; 2.1.1.16 anti-weapon machine under 2.1.1.1 to 2.1.1.15 2.1.1.17 components and equipment under 2.1.1.1 to 2.1.1.16 2.1.1.18 tools, equipments for manufacturing, inspecting, testing, composing, repairing under 2.1.1.1 to 2.1.1.17; In this regard, except guns which the Registrar may issue a license under the Firearms, Ammunitions, Explosive, Firework and the equivalent of Firearms Act B.E. 2490; 2.1.2 ammunitions, explosive and component and equipment: 2.1.2.1 dynamites, soil submerged, rocket propellant, missiles and arms released for both solid fuel and liquid fuel. In this regard, this includes combustible container; 2.1.2.2 ammunition; 2.1.2.3 rocket, missile and arms released; 2.1.2.4 torpedo; 2.1.2.5 explosive; 2.1.2.6 explosive underwater mine and every kind of explosive; 2.1.2.7 nuclear ammunition, biochemical and chemical; 2.1.2.8 nuclear explosive, biochemical and chemical; 2.1.2.9 rocket, missiles and arms release, nuclear fission, biochemical and chemical; 2.1.2.10 military signal firework; 2.1.2.11 smoke explosive, smoke can, and others; 2.1.2.12 slate point for firing, releasing under 2.1.2.1 to 2.1.2.11; 2.1.2.13 machines including the equipment for manufacturing, inspecting or destroying the armament under 2.1.2.1 to 2.1.2.12; In this regard, ammunitions which the registrar may issue a license under the Firearms, Ammunitions, Explosive, Firework and the equivalent of Firearms Act B.E. 2490 shall be exempted; 2.1.3 type of water, land and air vehicle used for military purposes and equipment which may be used in battles or war; 2.1.3.1 battle vehicle; 2.1.3.2 battle support vehicle including a vehicle transformed for the military purpose by changing its structure, electronic system or mechanism which shall involve the component designed particularly for the military purpose, for instance; (1) tire which is a tire designed especially for bullet proof or being able to use without air inside the tire; (2) air pressure system of inside the tire of a vehicle; (3) armour for important points of vehicle, for instance, fuel tank, or passenger room; (4) equipment or extra machine for weapon installation; This does not include civil vehicle, or truck which is designed or transformed for money or valuable transportation and armour and vehicle especially designed for commercial purpose. 2.1.3.3 warship 2.1.3.4 supporting war ship except for a ship designed especially for commercial purpose; 2.1.3.5 combat aircraft; 2.1.3.6 supporting combat aircraft including UAV (unmanned aerial vehicles), Remotely Pilot air Vehicles designed for the military purpose except for combat aircraft designed especially for commercial purpose; 2.1.3.7 component and other equipment in 2.1.3.1 to 2.1.3.6; 2.1.3.8 bullet proof vest or protective shield; 2.1.3.9 protective sheet or shield; 2.1.3.10 bayonet; 2.1.3.11 military fire; 2.1.3.12 preventative machine or wire made specifically for making the danger to prevent soldiers and military vehicle; 2.1.3.13 Camouflage in the military; 2.1.3.14 every kind of military communicative tool and electronic equipment; 2.1.3.15 ariel photography including film and printing paper; 2.1.3.16 Military surveillance equipment for the type that can see pictures in during the day and at night and military satellite except satellite registered with the United Nations for educational, research and commercial purposes; 2.1.3.17 military distance measurement; 2.1.3.18 special equipment with the necessary importance in containing or packaging for transporting the armament; 2.1.3.19 mask and chemical preventative equipment, chemical agents and biological agents which is solid, liquid, gas, smoke or aerosol under the particular specification as follows: (1) mask made with rubber or other materials resistant to chemicals, biological agents which upon composing it with the glasses on the mask and wearing it, it can protect the whole face and is able to prevent the chemical, solid, gas or air military biological agent transmitted into the skin and destroy the skin around the facial area and; (2) being a mask used with an air filter like aerosol and air filter (gas- particulate filter) with has the capability to filter chemical and military biological agent. A mask which has the above capability and characteristics may be a mask which can be brought to other places or is a mask designed to prevent poisonous gas under the specification as a bag covering head preventing poisonous gas from fire with the purpose to ear while escaping the fire and designed to use only once and can be used for 20 minutes; 2.13.20 tools, equipments and objects for measuring, inspecting, comparing the standard, analyzing , testing, composing, repairing, preventing, destroying, searching or using it to compose with other objects under 2.1.3.1 to 2.1.3.19.
