1 The Framework Contract & Interpretation

The Contracting Authority has procured a framework of 4 economic operators to design and/or construct and/or remove the civil engineering and substructure works for a number of venues and other facilities and sites, and to carry out other works, as more particularly described in the Framework Information.

In this Part 4 of the ITQ, the terms “Framework Contract” and “Framework Information” shall

1. have the meanings given to them in the Framework Contract for the TVF Civil Engineering Framework Agreement between the Contracting Authority and the Tenderer dated 17 July 2009; or

For the purposes of this Part 4 of the ITQ, “Contract” shall have the meaning given to that term in paragraph 4.6.

2 The Project – in brief

During the Olympic Games, 1.1m spectators are expected to watch events at ExCeL. During the Paralympics, 400,000 spectators are expected. In public transport terms, ExCeL is served virtually exclusively by the branch of the (DLR). The Woolwich Arsenal branch of the DLR runs parallel to ExCeL, several hundred metres to the south, on the opposite side of the . If the Woolwich Arsenal branch were to be used by ExCeL spectators, it is proposed that spectators would arrive via West (for ExCeL West) and depart via Pontoon Dock (from ExCeL East). This ExCel Southern Access Project is to build a walking route between the ExCel centre and Pontoon Dock DLR station, which will involve putting in place a temporary bridge over the Victoria Dock.

3 The Works Package – in brief

The Contracting Authority is seeking to procure the design and construction works required for the ExCel Southern Access Project works (‘the Works’) to between the ExCel centre (‘the Venue’) and Pontoon Dock DLR station as more particularly described in Appendix D (Project Information) to this ITQ (‘the Project’) and illustrated in Fig 1.1.

4 Key Requirements

4.1 To acquire the additional network resilience on the Woolwich/Arsenal DLR line through the use of Pontoon Dock Station the following will be delivered which includes: 4.1.1 The delivery of an outline design and infrastructure specification for all temporary infrastructure.

4.1.2 The delivery detailed design, supply, installation, maintenance and decommissioning of all temporary infrastructure including (see adjacent site plan):

1. Temporary pedestrian bridge crossing the Royal Victoria Dock from the Eastern End of the Excel Centre to the 2. Graded walkway from Silvertown Quays up to the temporary road bridge 3. Temporary road bridge from the Silvertown Quays to the mezzanine level of Pontoon Dock DLR Station Optional Works 1. Temporary footpath from the south side of the Royal Victoria Dock across the Silvertown Quays to the foot of the graded walkway 2. Provide lighting to the new temporary bridge, across Royal Victoria Dock 3. Provide lighting across the Road bridge 4. Provide lighting to the walkway across the Silvertown Quays 5. Removal of the existing DLR balustrade in readiness to receive the temporary bridge. Reinstate to existing standards upon decommissioning of the bridge.

4.1.3 The delivery of all planning related tasks including the planning application, associated licence agreements and road closures for the proposed temporary infrastructure.

4.2 The Contracting Authority intends to award the Contract in July 2011 with access to the Site to be provided in July 2011.

4.3 The Contracting Authority intends that the Contract will comprise the following phases:

4.3.1 Mobilisation and design;

4.3.2 Deliver, supply and erect;

4.3.3 Commission and test;

4.3.4 Undertake planned maintenance; and

4.3.5 Removal and reuse.

4.4 The Contracting Authority requires that completion of the Works shall take place by 28 th September 2011 (for the test event elements) and November 2012 for contract completion (including post Games legacy work elements).

4.5 The Contract shall be awarded in accordance with the provisions of the Framework Contract, the PCR, EU Directives and the ODA’s Procurement Policy and Procurement Code.

4.6 The Contract will be the NEC 3 ECC Option A attached to Schedule 2 of the Framework Contract as amended in accordance with the Schedule of Works Package Contract Detail applicable to the ITQ (see Appendix C of this ITQ) and Contract Data Parts 1 and 2.

4.7 Payment under the Contract will be by way of payment against a fixed lump sum, all as set out in the Contract.

4.8 The Tenderer is to complete and return the Pricing Document (the ‘Commercial Questionnaire’) and Contract Data Part 2 (Appendix C of this ITQ) as a part of his Commercial Submission. The Tenderer is also required to provide an activity schedule, in accordance with the requirements of the Contract that aligns with the amounts included in its Pricing Document submission.

5 Summary of Procurement Timetable

5.1 The proposed timetable for this procurement process is set out below. This timetable is for guidance only and the Contracting Authority reserves the right to alter the timetable at any time.

6 Tenderer Briefings

6.1 The Contracting Authority held a briefing for all tenderers on 4 April 2011.

7 Clarifications

7.1 If Tenderers have any questions or request a clarification concerning any aspect of this ITQ, they are permitted to send questions and/or requests for clarification to the Contracting Authority through the 2012 eTendering Service as described in detail in Part 2 of this ITQ (Instructions for Responding), until the Clarifications Deadline which is 11 May 2011 has passed.

8 Deadline for Submission of Quotation

8.1 Quotes must be submitted no later than 12h00 BST on 23 May 2011 via the London 2012 eTendering Service. Any submissions received after this deadline will not be considered by the Contracting Authority.

8.2 In addition to the provision of the Technical Submission and the Commercial Submission, the following additional submissions are to be submitted:

8.2.1 Completed Approval In Principle document as set out in technical question H05 and attached in Appendix D;

8.2.2 Activity Schedule using same level of detail as the tendered programme;

8.2.3 Completed Contract Data Part 2.

9 Variant Quotes

9.1 The Contracting Authority will not consider a Variant Tender or Tenders in relation to this Opportunity.

10 Tender Clarification Meetings

10.1 The Contracting Authority may hold a series of clarification meetings with all Tenderers after submission of the Quotes. These clarification meetings are expected to be held on w/c 30 May 2011. Further details will be made available prior to this date and details of the questions the Contracting Authority will require the Tenderers to address will be issued to individual Tenderers two days prior to the Interview.

12 Award of Contract

12.1 The Contracting Authority intends to award the Contract in July 2011.

13 Period of Validity

13.1 Quotes must remain open for acceptance by the Contracting Authority for a minimum period of 120 Working Days commencing from the Deadline for Submission of Quote.

14 Contract

14.1 Tenderers should note that mark up of or amendment to the Contract is not permitted. The Contract to be applied for these works will be as the NEC 3 ECC Option A Contract attached to Schedule 2 of the Framework Contract and as amended in accordance with the Schedule of Works Package Contract Detail applicable to the ITQ (see Appendix C of this ITQ) and Contract Data Parts 1 and 2.

14.2 Tenderers must ensure that any rates, fees or percentages contained in the Contract Data Part 2 of the Tenderer’s commercial submission do not exceed those rates, fees or percentages contained in Section 8 of the Framework Information or Schedule 4 of the Framework Contract or stated within the Commercial Questionnaire of its tender submission for the Framework Contract (the ‘Framework Rates’). Any Quote which contains rates, fees or percentages in excess of the Framework Rates may result in a Quote being non-compliant.

15 Stakeholders

15.1 The Stakeholders for the Contract shall be the following:

16 Supporting Documentation
