    Remarks for Vice President Joe Biden Soles Lecture, University of Delaware 9.16.2011 Dr. Harker, it is an honor to be back on the campus that played such a role in shaping my life. During my years on campus, some of the most transformative events of my generation took place. It was here that I listened to JFK warn us of an impending showdown with Russia during the Cuban Missile Crisis. One year and one month later, standing on the steps of Hullihen Hall, I learned of his death. With my friends in the lounge at Harter Hall, I remember debating the drumbeat of impending war in Vietnam. When I came back here in 1972 as a 29 year-old candidate for the US Senate – embraced by my old faculty and supported by my university, I said: “Our failure… has not been the failure of the people to meet the challenges placed before them, but rather the failure of both our great political parties to place those challenges honestly and courageously before the people.” I was unaware that my career would play out against the most extraordinary period of change in American history.     WITHDRAWING FROM CONGRESSIONAL- EXECUTIVE AGREEMENTS WITH THE ADVICE AND CONSENT OF CONGRESS Abigail L. Sia* As President Donald J. Trump withdrew the United States from one international agreement after another, many began to question whether these withdrawals required congressional approval. The answer may depend on the type of agreement. Based on history and custom, it appears that the president may unilaterally withdraw from agreements concluded pursuant to the treaty process outlined in the U.S. Constitution. However, the United States also has a long history of concluding international agreements as congressional-executive agreements, which use a different approval process that does not appear in the Constitution. But while academics have spilled ink on Article II treaties for decades, the congressional-executive agreement has received relatively little attention. It is neither clear nor well settled whether the president has the constitutional authority to withdraw unilaterally from this type of agreement. This Note proposes applying Justice Robert H. Jackson’s tripartite framework, first articulated in a concurring opinion to Youngstown Sheet & Tube Co. v. Sawyer (Steel Seizure), to determine whether or not a president may constitutionally withdraw from a congressional-executive agreement without Congress’s consent. However, in certain dire emergency situations or when Congress is physically unable to convene and vote, the president should be permitted to eschew the framework and withdraw the United States from a congressional-executive agreement without waiting for Congress’s consent—so long as the president reasonably believes that withdrawal is in the country’s best interest. To support this approach, this Note also calls for a new reporting statute, similar in structure to the War Powers Resolution, to address the significant information asymmetries between the executive and legislative branches.

    CHAIRMEN OF SENATE STANDING COMMITTEES [Table 5-3] 1789–present INTRODUCTION The following is a list of chairmen of all standing Senate committees, as well as the chairmen of select and joint committees that were precursors to Senate committees. (Other special and select committees of the twentieth century appear in Table 5-4.) Current standing committees are highlighted in yellow. The names of chairmen were taken from the Congressional Directory from 1816–1991. Four standing committees were founded before 1816. They were the Joint Committee on ENROLLED BILLS (established 1789), the joint Committee on the LIBRARY (established 1806), the Committee to AUDIT AND CONTROL THE CONTINGENT EXPENSES OF THE SENATE (established 1807), and the Committee on ENGROSSED BILLS (established 1810). The names of the chairmen of these committees for the years before 1816 were taken from the Annals of Congress. This list also enumerates the dates of establishment and termination of each committee. These dates were taken from Walter Stubbs, Congressional Committees, 1789–1982: A Checklist (Westport, CT: Greenwood Press, 1985). There were eleven committees for which the dates of existence listed in Congressional Committees, 1789–1982 did not match the dates the committees were listed in the Congressional Directory. The committees are: ENGROSSED BILLS, ENROLLED BILLS, EXAMINE THE SEVERAL BRANCHES OF THE CIVIL SERVICE, Joint Committee on the LIBRARY OF CONGRESS, LIBRARY, PENSIONS, PUBLIC BUILDINGS AND GROUNDS, RETRENCHMENT, REVOLUTIONARY CLAIMS, ROADS AND CANALS, and the Select Committee to Revise the RULES of the Senate. For these committees, the dates are listed according to Congressional Committees, 1789– 1982, with a note next to the dates detailing the discrepancy.

    Cherry Crayton North Carolina State University Typhoid Mary and Suck-Egg Mule: The Strange Relationship of Jesse Helms and the News Media In 1997 the Washington office of Jesse Helms, a five-term United States Senator from North Carolina, included several walls decorated with about fifty framed clippings of news articles and political cartoons. All the news clippings and political cartoons pertained to Helms, who retired from the United States Senate in 2002 at the age of seventy-nine. Some of the clippings, such as a news story about Helms’ 1962 adoption of a nine-year-old orphan boy with cerebral palsy, appeared flattering. Most of the clippings, such as a political cartoon depicting Helms as the “Prince of Darkness,”1 appeared less than flattering. On one wall hung nearly two dozen political cartoons drawn over a twenty-year period by the Raleigh (N.C.) News & Observer’s political cartoonist Dwane Powell.2 The political cartoons encircled a news clipping from the Dunn Daily Record, a small-town daily newspaper in North Carolina. In what appeared to be a thirty-inch bold headline for a front-page, above-the-fold story, the Dunn Daily Record screamed: “The Truth at Last!...Senator Helms Won, News Media Lost!” The date on the news clipping—November 7, 1984—came one day after Helms defeated the Democratic Governor James B. Hunt in an epic battle with 51.7 percent of the vote to earn a third-term as a Senator from a state that then historically produced more Senators in the mold of Sam Ervin, a moderate Democrat who oversaw the hearings on the Watergate investigation, than in the mold of Helms, 1 Helms was first called the “Prince of Darkness” in 1984 by Charles Manatt, the former chairman of the Democratic Naitonal Committee.
