SUPREME COURT 3 Welcome to the Supreme Court ith jurisdiction throughout Spain, the Supreme Court is the uppermost tier Wof our judicial structure and the highest judicial body in all areas except for matters pertaining to constitutional safeguards. Without forgetting more distant historical precedents such as the Royal and Su- preme Council of Castile, established by the Catholic Monarchs, we can say with pride that our Supreme Court came to life as an aspiration of freedom and moder- nity in the Cádiz Constitution of 1812 (“There shall be a Court of Justice at the court which shall be called the Supreme Court of Justice”,Article 259). At a particularly diffi cult time for Spain, with Napoleon’s troops all over the country, the 1812 Constitution marked the reaffi rmation of national sovereignty and a renewed atmosphere of liberalism that was to spread throughout the outda- ted institutional structure of the time, with the Supreme Court playing a decisive role in its regeneration. Over the last 200 years the Supreme Court has risen up as a bastion in defence of freedom and is now the utmost guarantee for the defence of the rule of law from a jurisdictional perspective. Unlike many of the countries around us where there are ordinary and administrative jurisdictions, the Spanish Supreme Court is a single body as there is only one jurisdiction. In addition to the President and Vice-Presi- dent it is made up of the presidents of the fi ve Chambers and seventy-four judges, divided into fi ve chambers: the First, for Civil matters; the Second, for Criminal SUPREME 4 COURT matters; the Third, for Contentious Administrative matters; the Fourth, for Labour matters; and the Fifth, for Military matters.

A blatant regression, uneven and arbitrary that has been exacerbated over the last two decades throughout the world and, in the last three years, has been unleashed against Catalan and Spanish society in a very unequal ways – some suffering from it, others legitimising it. Against all odds, this comes from afar and some want it to PÀGINA 1 / 11 last. The regression is rooted in a double international and state process. Alternatively, in a single merged one, if you like, with particular Spanish speciﬁcities. The global one is the already unquestionable regression and the disturbing demolition of the so-called post-war social constitutionalism, which is already moving between world un-democratisation, global Weimar and what we call post-democratic authoritarianism. The local-particular one is what we call the 78 regime, mediated by the current democratic involution in Spain and incubated penal reform after penal reform -thirty since 1995.

RESUMEN La Constitución española de 1978 se asienta inexorablemente en el prin- cipio de separación de poderes, toda vez que no es concebible el Estado social y democrático de Derecho al margen de aquél. Pero nuestra Norma Fundamental no es muy explícita en cuanto a las relaciones entre las Cortes Generales y el Poder Judicial, salvo en tres puntos concretos: (i) la elección de los vocales del Consejo General del Poder Judicial, (ii) el carácter no vinculante para los tribunales de justicia de los dictámenes de las Comisiones de Investigación y (iii) la autorización parlamentaria necesaria para la inculpación o procesamiento de los diputados y senadores. Aparte de esto, se han abierto también nuevas vías de interrelación entre ambos poderes cuanto menos discutibles, como la comparecencia del Presidente del Consejo General del Poder Judicial, que lo es también del Tribunal Supremo, ante las Comisiones de Justicia de las Cámaras para presentar la Memoria del Consejo, de la que en algún momento se ha pretendido indebida y erróneamente derivar la posibilidad de exigir una suerte de responsabilidad política al órgano o a quienes lo componen. PRESENTATION On 20 December 2011, Mariano Rajoy was sworn in as President of the Government by the Lower House of Parliament (Congreso de Diputados) after the victory of the People's Party (Partido Popular) at the elections held a month earlier on 20 November 2011. Two years have passed since this Government and its leader took up the reins and assumed responsibility for steering the serious situation in which the country found itself, immersed in the deepest and most prolonged crisis in its recent history. Because of this, the Government was obliged, from the very start, to focus its efforts on a reform of the economic and financial structures, which had been seriously deteriorated by the crisis. This has been done through the application of a tough and profound reform programme. Domestic scene Grappling with a second wave of the pandemic, as cases hit more than 1 million Spain was one of the countries most affected during the first wave of COVID-19 (March to June) and is now being hard hit by a second wave. Cases of the virus are rising fast and the total hit more than one million, the highest number in Europe and the fifth in the world (see Figure 1) Figure 1. Unmatched fun.” Letters From the Directors Dear Delegates, Hello! My name is Morgan Birkenstock, and I will be serving as your in-room director at WMHSMUN XXXIV. I’m thrilled to be directing the Catalan side of the Catalan Secession Movement JCC and I cannot wait to get to know you all, albeit via Zoom. I am a freshman here at William & Mary, originally from Arlington, Virginia, and I’m majoring in Chemistry with a minor in Classical Studies. Though I am not currently studying it, international relations is a topic that has always intrigued me. This interest led me to Model United Nations in seventh grade, founding my school’s first MUN team with just three other people! Since then, my love for Model United Nations has only grown and I am beyond excited to serve at WMHSMUN this year. Outside of MUN, I love to read, travel, and listen to literally any and every music genre there is. Enough about myself, let’s get on to the committee! You will be serving as a member of the Generalitat de Catalunya. Our government held the National Catalan Independence Referendum on October 1st, 2017 with immense backlash from Spain’s governing bodies. Spain threatened the Catalonian people with fines for poll workers; they seized ballots and cell phones and the Guardia Civil even raided our polling stations. Their actions were criticized by the United Nations High Commissioner for Human Rights, Amnesty International, and Human Rights Watch, yet Spain still has not let up.
