It is hereby the policy of Grand County that elected and appointed representatives, staff and members of Grand County Council may participate in meetings through electronic means. Any form of telecommunication may be used, as long as it allows for real time interaction in the way of discussions, questions and answers, and voting.

At the Grand County Council meetings/hearings any citizen, property owner, or public official may be heard on any agenda subject. The number of persons heard and the time allowed for each individual may be limited at the sole discretion of the Chair. On matters set for public hearings there is a three-minute time limit per person to allow maximum public participation. Upon being recognized by the Chair, please advance to the microphone, state your full name and address, whom you represent, and the subject matter. No person shall interrupt legislative proceedings.

Requests for inclusion on an agenda and supporting documentation must be received by 5:00 PM on the Wednesday prior to a regular Council Meeting and forty-eight (48) hours prior to any Special Council Meeting. Information relative to these meetings/hearings may be obtained at the Grand County Council’s Office, 125 East Center Street, Moab, Utah; (435) 259-1346.

A Council agenda packet is available at the local Library, 257 East Center St., Moab, Utah, (435) 259-1111 at least 24 hours in advance of the meeting.

MEETING DATE: May 19, 2015 TO: Grand County Council FROM: Planning Staff SUBJECT: Public Hearing - Land Use Code Amendment for Apiculture Protection PLANNING COMMISSION RECOMMENDATION The Grand County Planning Commission forwarded a favorable recommendation to the County Council for the Land Use Code Amendment Section 3.2.5 for Apiculture Protection.

BACKGROUND Currently the Land Use Code allows any scale or type of beekeeping operation, including migratory commercial bees. Migratory commercial bees threaten the County’s bee populations because they increase the possibility of foul brood hives, bee mite migration, and other pesticide concerns. In order to protect the County bees, a regulation in the LUC would prevent migratory commercial bee keepers from bringing their hives into the County for over wintering or pollination services. Local vegetation cannot support large commercial colonies. Jerry Shue presented rationale for a Land Use Code amendment for the protection of local bee populations. The Planning Commission directed staff to draft an amendment for that protection.

DRAFT LANGUAGE

Section 3.2.5 Other Use Standards A. Animal Raising The keeping of domestic, agricultural animals and livestock shall be considered a permitted use, provided that no more than 4 animal units (as defined in Article 10) per acre shall be allowed on parcels with more than one-half acre and less than 5 acres. These standards shall not be applicable to parcels larger than 5 acres.

B. Apiculture 1. The keeping of honey bees shall be considered a permitted use in accordance with Sections 3.2.5(B)(2) and 3.2.5(B)(3). 2. Migratory beekeeping operations of any size, south of Interstate-70, either permanent or temporary, will be prohibited. 3. No parcel of land, South of Interstate-70, shall have in excess of 25 established bee colonies at any given time.

B. C. Barn, Stable, Coop, Animal Shed Barns, stable, coops, animal sheds or similar structures shall comply with the following standards: 1. A setback shall be maintained of at least 100 feet from existing dwellings, 20 feet from any open waterway; and … 2. Surface drainage from such structures shall not be permitted to drain into a natural stream or into a drainage way that drains into a natural stream.

Additionally, amendment to the Land Use Code Sec. 10.2, definitions for clarity, are as follows:

Sec. 10.2 Definitions Colony - An aggregate of worker bees, drones, and a queen living together in a hive or in some other dwelling (usually a cavity) as one social unit.

Migratory Beekeeping - The moving of bee colonies from one locality to another during a single season to pollinate different crops or to take advantage of more than one honey flow.

WHEREAS, the Grand County Council (County Council) adopted the Grand County General Plan Update (General Plan Update) on February 7, 2012 with Resolution No. 2976; WHEREAS, the County Council adopted the Grand County Land Use Code (LUC) on January 4, 1999 with Ordinance No. 299 and amended February 19, 2008 with Ordinance No. 468 for the purpose of regulating land use, subdivision, and development in Grand County in accordance with the General Plan; WHEREAS, the purpose of the Amendment is to provide protection of the local bee populations by preventing migratory commercial bee keepers from bringing their hives into the County, south of Interstate-70, for overwintering or pollination services; WHEREAS, the Planning Commission reviewed the Amendment in a public hearing April 22, 2015 and forwarded a favorable recommendation; WHEREAS, on May 19, 2015 the Council held a duly noticed public hearing for purposes of obtaining and considering public input regarding the Amendment; WHEREAS, the Council heard and considered all evidence and testimony presented with respect to the Amendment and has determined, subsequent to said public hearing that the adoption of this Amendment is in the best interests of the citizens of Grand County, Utah.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY COUNCIL OF GRAND COUNTY, UTAH that the Grand County Land Use Code is hereby amended by repealing and re-enacting Section 3.2.5., to read as follows:

Section 3.2.5 Other Use Standards A. Animal Raising The keeping of domestic, agricultural animals and livestock shall be considered a permitted use, provided that no more than 4 animal units (as defined in Article 10) per acre shall be allowed on parcels with more than one-half acre and less than 5 acres. These standards shall not be applicable to parcels larger than 5 acres.

B. Apiculture 1. The keeping of honey bees shall be considered a permitted use in accordance with Sections 3.2.5(B)(2) and 3.2.5(B)(3). 2. Migratory beekeeping operations of any size, south of Interstate-70, either permanent or temporary, will be prohibited. 3. No parcel of land, South of Interstate-70, shall have in excess of 25 established bee colonies at any given time.

C. Barn, Stable, Coop, Animal Shed Barns, stable, coops, animal sheds or similar structures shall comply with the following standards: 1. A setback shall be maintained of at least 100 feet from existing dwellings, 20 feet from any open waterway; and 2. Surface drainage from such structures shall not be permitted to drain into a natural stream or into a drainage way that drains into a natural stream.

Reading about the study and unique situation with Moab honey bees, I felt inclined to tell you about an order of bees my dad got from Africa. He had a colony of them about a mile up the Colorado River in 1962. He was badly stung and nearly died from it. Dr. Mayberry saved his life.

Those bees are no doubt, part of the 'unique' honeybee population of Moab.

Dad was Bob Stocks. The honeybees provided excellent honey, but they were mean.

Grand County Council Members:

Please consider passing the ordinance to prohibit commercial and migratory beekeeping within Grand County south of Interstate 70. This last year I have had two hives on my property. One hive, collected from a "wild" swarm in Monticello, did extremely well, producing numerous, healthy offspring and much honey. The second, tested by Jerry Shue, collapsed with no apparent cause. We still have a lot to learn about bees and beekeeping.

Protecting our bee population by continuing to isolate them is an opportunity to strengthen hives, reduce potential pathogens, and eliminate one variable (such as disease brought by introduced bees) so that we can better understand what makes healthy hives. Jerry Shue has extraordinary knowledge and energy to devote to beekeeping in Grand County. We are lucky to have him here. The idea of keeping our bees isolated makes sense.

PLANNING COMMISSION RECOMMENDATION The Grand County Planning Commission reviewed the referenced application in a public hearing on April 22, 2015 and forwarded a favorable recommendation to Council.

BACKGROUND Introduction This application is submitted by the property owner, Richard and Jerry Walton (Applicants), seeking a rezone from Multi-family Residential (MFR) to General Business (GB). The area proposed for rezone consists of 2.46 acres of vacant land located at Resource Boulevard. Property to the north is zoned GB and developed with a light manufacturing business. Lots to the east and south are undeveloped and zoned MFR. The Federal Office Building is on the lot to the west and is zoned GB.

History The McKnight Properties Industrial Subdivision was approved in 1980 a fifteen (15) lot subdivision in the General Business (GB) zone district. The lots are approximately 2.5 acres or larger. In 2005 the property owner, Skip Nightingale, requested a rezone of nine (9) of the east side lots to Multi-family Residential (MFR) in anticipation of a housing development. The rezone proposal included the 2.45 acre parcel being purchased by the Walton’s. The proposed rezoning was occurring during the time of the purchase and was inadvertently left on the rezone application.

The property owners are requesting to rezone the property back to the General Business district. They purchased the property in 2005 for the potential use as a warehouse. The Walton’s were not aware of the rezone that was transpiring as they purchased the land, the land was purchased in August of 2005 and the rezone was approved November of 2005.

LAND USE CODE Rezoning is a discretionary, legislative decision, meaning the County may reasonably decide the request either way. In addition to the policies outlined in the General Plan and Future Land Use Plan, the Land Use Code offers further guidance in Sec 9.2.7, Issues for Consideration. Staff comments are provided below. A positive finding with respect to each issue is not required. Sec. 9.2.7 Issues for Consideration

1. Was the existing zone for the property adopted in error? Staff believes the property was rezoned in error. Staff researched the time of purchase and the recording of the rezone and found the recorded rezone of the property was by Ordinance 416, November 1, 2005. The owner/applicant recorded the purchase in August 2005, the Walton’s were not a signature of record on the application for rezoning of the property. WALTON REZONE APPLICATION (CC) MAY 19, 2015

2. Has there been a change of character in the area (e.g. installation of public facilities, other zone changes, new growth trends, deterioration, development transitions, etc.)? The property is located in the McKnight Industrial Subdivision. Existing warehouses, offices, and manufacturing are adjacent to the property.

3. Is there a need for the proposed use(s) within the area or community?

4. Will there be benefits derived by the community or area by granting the proposed rezoning? The rezone was processed without the acknowledgment of the land owner; the County would be correcting the error.

5. Is the proposal in conformance with the policies, intents and requirements of Grand County General Plan, specifically the Plan’s zoning map amendment guidelines? The proposed rezone is supported by the Future Land Use Plan or the vision, goals, and strategies identified in the General Plan.

6. Should the development be annexed to a City? No, the City does not provide any services.

7. Is the proposed density and intensity of use permitted in the proposed zoning district? The current uses in the McKnight Industrial Subdivision include light manufacturing, warehouses, and Government Office building.

8. Is the site suitable for rezoning based on a consideration of environmental and scenic quality impacts? No significant impacts are anticipated.

9. Are the proposed uses compatible with the surrounding area or uses; will there be adverse impacts; and/or can any adverse impacts be adequately mitigated? Commercial manufacturing uses are intended use for the area, site plan standards in the Land Use Code for construction will mitigate impacts on the undeveloped MFR property to the east. The lot size will limit the size of commercial use on the property.

10. Are adequate public facilities and services available to serve development for the type and scope suggested by the proposed zone? If utilities are not available, could they be reasonably extended? Is the applicant willing to pay for the extension of public facilities and services necessary to serve the proposed development? Public facilities are available; individual service lines are all that is necessary to serve the lot.

11. Does the proposed change constitute spot zoning? No, within the McKnight Industrial Subdivision there are currently five (5) acres of Highway Commercial zoning and seven (7) acres of General Business. The MFR zoned lots to the east are vacant.

ZONING STANDARDS Traffic Highway 191 is the primary access through Spanish Valley, a major north-south UDOT Highway. Resource Boulevard has access from Highway 191 and will provide the entrance to the subject property.

Annexation The City does not have plans to annex the parcel at this time. Public services are provided by Grand Water and Sewer Service Agency (GWSSA), Rocky Mountain Power, and Questar gas and fronts on a County road, there are no services provided by the City.

Public Notices The public notice was posted in the a newspaper of general circulation U.C.A. 17-27a-205 and Land Use Code Sec. 9.1.8 B.2. Posted on the County website – http://grandcountyutah.net , the Utah Public Meeting Notice Website at http://pmn.utah.gov/, and posted on site.

There were no citizen comments at the Planning Commission.

GENERAL PLAN The FLUP calls for Highway Mixed Use as the pattern along US 191 South of Moab comprised of businesses that depend on highways for customers as well as mixed use businesses that may depend on highway traffic for customers. Limitations on uses in this designation direct sales tax generating activities into Moab. Standards for screening, landscaping, earth tone colors, and non-reflective materials should be applied to new development and major additions/redevelopment.

When the Waltons bought this propelty in early 2005. They were told that it was zoned General business. They were to build the warehouse that is currently built at 2281 Resource Blvd. The developer with the county changed the zoning on them without their knowledge to MFR on November 2, 2005. They had to buy another lot to build their warehouse. Resource boulevard has a lot of office buildings and warehouses in that area. It is a mix of GB and MFR zoning. The subdivision is called the McKnight Propelties Industrial Subdivision. The General Business zone fits the area. There is a need for areas in Moab for people to build business related buildings especially in a Industrial Sub-division. The surrounding property owner all have offices and warehouses built on the lots in that area. We are petitioning to change the zoning back to GB.

RESOLUTION OF THE GRAND COUNTY COUNCIL APPROVING A CONDITIONAL USE PERMIT FOR SAND AND GRAVEL EXTRACATION AND A TEMPORARY ASPHALT PLANT

WHEREAS, Nielson Construction has leased land for sand and gravel extraction and a temporary asphalt plant located in Section 2 T21S R16E SLB&M, parcel 04-016-0086 and parcel 04-016-0045 in Grand County, Utah;

WHEREAS, Nielson Construction is the property owner representative on behalf of property owner William Hatfield;

WHEREAS, the applicant is requesting a five-year limited duration Conditional Use permit in order to bid for upcoming projects including, but not limited to, Utah Department of Transportation;

WHEREAS, the Grand County Planning Commission reviewed the subject application in a public hearing on May 13, 2015 and forwarded a favorable recommendation subject to conditions;

WHEREAS, due notice was given that the County Council would meet to hear and consider this application in a public hearing on June 2, 2015;

WHEREAS, the County Council has considered all evidence and testimony presented with respect to the subject application.

NOW, THEREFORE, BE IT RESOLVED that the Grand County Council does hereby approve a Conditional Use Permit for sand and gravel extraction and a temporary asphalt plant for parcels 04-016-0045 and 04- 016-0086 in Grand County, Utah, subject to the following conditions:

PLANNING COMMISSION RECOMMENDATION The Grand County Planning Commission reviewed the referenced application in a public hearing on May 13, 2015 and forwarded a favorable recommendation to Council based on the following findings: 1. INTRODUCTION This application is submitted by Nielson Construction on behalf of the property owners William Hatfield (Applicants). The applicant proposes the extraction of sand and gravel from a section of land, located approximately 1.25 miles north of the interstate on Hastings Road (Parcels 04-0016-0086 and 04- 0016-0045). The land is currently developed with as non-irrigated farm land; the land also has gravel mineral mining operation. The site is zoned RG, Range and Grazing, and Mining on Private Land is allowable by Conditional Use Permit in the RG district. The proposed operation is summarized as follows: . Areas north and south of the operation have been used for gravel extraction in the past and some are currently ongoing. . Excavation of sand and gravel from the earth then it will be fed into a crusher where it will be crushed and separated in to different sized product of rock and sand. Stockpiled for further use by the Hot Mix Asphalt plant. . An area of approximately 16 acres will provide the needed material for the project. Other areas of the land will be used for the asphalt plant and stockpile/crusher areas. . Reclamation of the mined area will be reclaimed as directed by the land owner in the agreement signed by both parties. . The Extraction plan shows the extraction area, the crusher site and the stockpile site. COUNTY COUNCIL/ NIELSON CONSTRUCTION CUP - PH JUNE 2, 2015

. A temporary use permit will be processed at the same time for the asphalt site (hot mix asphalt plant) . The current contours and will not change, the County Engineer has approved the plans. . Grand County Road Department Supervisor has signed an agreement with the applicants for use of the County roads; including encroachment permits. (attached)

TEMPORARY USE OF AN ASPHALT OR CONCRETE BATCH PLANT A. Asphalt or Concrete Batch Plant Asphalt or concrete batch plants shall comply with the standards of this section. 1. Minimum Lot Area: 5 acres FINDING = the area of operation will be 35+acres; applicant will be leasing 16 acres of the parcel. 2. Minimum Setbacks (All Sides): 200 feet from any residential zoning district or lot containing a principal residential use for all activity areas, including driveways and on site roads. FINDING = Applicant provides in the narrative that the batch plant will be placed at least 600 feet from a residence and 200 feet from the property lines. 3. The above minimum setback shall be from any residential zoning district or lot containing a residential use for all activity areas, including driveways and on-site roads. 4. The County may specify the times of operation. FINDING = hours of operation will be a maximum of 13 hours a day, during day light only. Duration of the plant will be 5 years unless an extension is approved by the County. 5. All internal roads shall be maintained in a dust-free condition. The access drive from the site shall be paved with a surface of asphalt or concrete for a distance of at least 100 feet from the rights-of-way of the public road from which access is taken. Provisions shall also be made to remove dust, dirt, mud or other debris from the vehicles before they leave the site. FINDING = A State Air Quality permit has been issued. 6. Provisions shall be made for the on-site reduction and containment of dust and other particulate matter. FINDING = provided in the State Air Quality permit and approved by the County Engineer. 7. The site shall have frontage on and access to a collector or arterial street, provided the authority with jurisdiction over the subject road may approve alternative access. FINDING = the County Road Department is under contract with the applicant for use of Hastings Road. 8. All such plants shall be subject to the limitations on noise, dust, fumes, odors, etc., of 6.12, Operational Performance Standards. FINDING = The applicant has worked with surrounding property owners to make them aware of the project, mitigated fugitive dust, and will limit the hours of operation.

IV. CONDITIONAL USE REQUIRMENTS Conditional uses are regulated as follows: 9.11.1 General A conditional use is a use that may be permitted subject to conditions imposed upon the approval of the use that are designed to reasonably mitigate any adverse impacts upon

surrounding properties. Conditional use permits may be approved for the uses indicated in the use regulations of the zoning district of the property for which the conditional use permit is requested. Provided, however, that any change or expansion of a conditional use, whether pre-existing or otherwise, shall require a new conditional use permit pursuant to the terms of this section. 9.11.3 A. Submittal Requirements 1. The street address and legal description of the property affected; (submitted) 2. Title report; 3. Site plan: a. Drives, streets, and rights-of-way; (submitted) b. 9.11.6 Conditional Use Criteria Conditional Use Permits shall be approved where the County determines that there will be no significant negative impact upon residents of surrounding property or upon the public. The following criteria shall be considered in the application review:

A. Effect on Environment The location, size, design and operation characteristics of the proposed use shall not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property, nor cause substantial or permanent interference with the right to peaceful enjoyment of property. B. Compatible with Surrounding Area The proposed site plan, circulation plan and schematic architectural designs shall be complementary with the character of the surrounding area with relationship to scale, height, landscaping and screening, building coverage, and density. C. External Impacts Minimized The proposed use shall not have negative impacts on existing uses in the area and in the county through the creation of noise, glare, fumes and odors, dust, smoke, vibration, fire hazard, excessive light, or other injurious or noxious impact. The applicant shall provide adequate mitigation responses to these impacts. D. Infrastructure Impacts Minimized The proposed use shall not have negative impacts on existing uses in the area and in the county through impacts on public infrastructure such as roads, parking facilities and water and sewer systems, and on public services such as police and fire protection and solid waste collection, and the ability of existing infrastructure and services to provide services adequately. E. Consistent with LUC and General Plan The proposed use will be consistent with the purposes of this LUC, the General Plan, and any other statutes, ordinances or policies that may be applicable, and will support rather than

interfere with the uses otherwise permitted in the zone in which it is located. F. Parcel Size The proposed use may be required to have additional land area, in excess of the lot area otherwise allowed by the underlying zoning district, as necessary to ensure adequate mitigation of impacts on surrounding land uses and the zoning district.

9.11.7 Conditions of Approval The County may, in the interest of the public welfare and to assure compliance of this LUC, establish conditions of operation, location, arrangement and construction of any use for which a permit is authorized. In authorizing the location of any use listed as a conditional use permit, the County may impose such development standards and safeguards as the conditions and location indicate important to the welfare and protection of adjacent property from noise, vibration, dust, dirt, smoke, fumes, gas, odor, explosion, glare, traffic circulation or other undesirable or hazardous conditions.

Introduction Nielson Construction is requesting a conditional use permit to crush gravel and asphalt aggregate on private property near Green River Utah. We also plan to produce asphalt at the proposed location. The property is owned by William Hatfield (parcels 04-0016- 0086 & 04-0016-0045) and Nielson Construction is submitting this application on his behalf. The property is located in the southwest quarter of Section 11, Township 21 South, Range 16 East and is approximately1.25 miles north of SR-19 on Hastings Road. The products will be used for various projects in the Green River area. The operation is summarized as follows:

• Excavation of sand and gravel on approximately 16 acres • Temporary equipment (Crusher and Hot Mix Asphalt Plant) • The applicant is in the process of obtaining an encroachment permit from the Grand County Road Department to access Hastings Road from the gravel pit • A State Air Quality permit has been issued • A State of Utah Notice of Intent has been issued for the location • The resulting land will be rehabilitated for agricultural use as directed by the land owner.

A. Effect on Environment

The disturbed area is approximately 35 acres. The operation is located away from residential neighborhoods and has no immediate effect to the landowner who has granted us access to their property. The Hatfields are agreeable to all aspects of the gravel extraction operation on their property. We will operate within requirements set forth in our Utah Division of Air Quality permit There is a fugitive dust plan included in this permit. We will comply with this plan as we bring water in and provide dust control operations on the roads and the drop points of the crusher. We have also filed a notice of intent with the State of Utah. This notice of intent has requirements for storm water pollution prevention methods to be deployed on the project We will establish temporary drainage channels to allow storm water to flow around the operation during construction and will re-establish the drainage upon completion of the project

B. Compatible With Surrounding Area The areas north and south of the Hatfield pit have been used for gravel extraction in the past and some are ongoing. There is farm land and grazing land adjacent to the pit location. ">,' -:":' ,~l';:,''"' _

, ~ •...... ~, C. External Impacts Minimized The crushing and asphalt production operations are governed by air quality and the permits obtained for these operations. We will operate the crushing and asphalt production processes in adherence to these permits and will ensure not to create impacts more so than these operations will normally create.

D. Infrastructure Impacts Minimized We will work with the County Road Department on mitigation requirements as we haul material from the pit location to local projects. The pit access road ties into Hastings Road approximately 1.25 miles from SR-19 in Green River. We intend to haul gravel and asphalt material on Hastings road as we transport it to project locations. We do not intend to utilize or impact any other infrastructure as part of the operation. Once we begin producing asphalt, we plan to pave the approach out of the pit to provide a good solid tie in to Hastings Road. We will work with the Grand County road department to ensure we meet their requirements.

Asphalt Batch Plant 1. The lot area for the batch plant is approximately 7 acres 2. Minimum setbacks are 600 ft 3. The batch plant will operate for daylight hours and could possibly work at night depending on project schedules. 5. The haul roads within the pit will be kept watered to control dust. Nielson Construction will pave the approach from the pit as it ties into Hastings Road. 6. We will follow the Air Quality permit to mitigate for dust 7. The pit will access Hastings Road 8. The batch plant is brand new and meets all current operational performance standards.

MEETING DATE: June 2, 2015 TO: Grand County Council FROM: Planning Staff RE: Amendment to the Land Use Code ______PLANNING COMMISSION RECOMMENDATION The Grand County Planning Commission held a public hearing on May 13, 2015 and forwarded a favorable recommendation for approval of an amendment to permit “All other Major Utilities” to the list of uses allowed by Conditional Use permit in the Resort Special (RS) and Resort Commercial (RC) zone districts.

BACKGROUND Planning Staff sponsored this code amendment to address major utilities in the RS and RC zone districts previously permitted. Major utilities are not currently permitted uses in the RS and RC zone districts. As a way to rectify the situation, staff would like to allow by conditional use. By definition, a conditional use may be compatible only if certain conditions are required that reasonably mitigate or eliminate the detrimental impacts. Grand Water and Sewer serves the community south of the Colorado River Bridge. Any development north of the river bridge will require private or a major utility installation. The zone districts that are north of the Colorado River Bridge are; RG, RS, RC, and limited HC.

All minor utilities are a permitted use in all zone districts, which will include residential and commercial septic systems approved by the State Sanitarian. Currently those types of private systems exist on Highway 128 and Highway 191 North.

LAND USE CODE AMENDMENT ADDING “AUTO REPAIR GARAGE” TO THE LIST OF USES ALLOWED BY CONDITIONAL USE PERMIT IN THE GENERAL BUSINESS (GB) ZONE DISTRICT

WHEREAS, the Grand County Council (County Council) adopted the Grand County General Plan Update (General Plan Update) on February 7, 2012 with Resolution No. 2976; WHEREAS, the County Council adopted the Grand County Land Use Code (LUC) on January 4, 1999 with Ordinance No. 299 and amended February 19, 2008 with Ordinance No. 468 for the purpose of regulating land use, subdivision, and development in Grand County in accordance with the General Plan;

WHEREAS, Grand County desires to amend Section 3.1 Use Table by permitting, by conditional used, auto repair garage in General Business (GB) district in order to resolve a problem of “nonconformity” for such uses in the GB district;

WHEREAS, the Planning Commission reviewed the draft amendment in a public hearing on May 13, 2015 and forwarded a favorable recommendation;

WHEREAS, due notice was given that the County Council would meet to hear and consider this ordinance; and

WHEREAS, the County Council has heard and considered all evidence and testimony presented with respect to the amendment and has determined, subsequent to said public hearing, that the adoption of this Ordinance is in the best interests of the citizens of Grand County, Utah and consistent with the Sec. 1.5 Purposes, of the Code.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY COUNCIL OF GRAND COUNTY, UTAH, THAT the Grand County Land Use Code, Sec. 3.1 Use Table is hereby amended by the addition of “Auto Repair Garage” to the list of uses allowed by Conditional Use Permit in the GB district; PASSED, ADOPTED, AND APPROVED by the Grand County Council in open session this __ day of June, 2015, by the following vote:

MEETING DATE: June 2, 2015 TO: Grand County Council FROM: Planning Staff RE: Amendment to the Land Use Code ______PLANNING COMMISSION RECOMMENDATION The Grand County Planning Commission held a public hearing on May 13, 2015 and forwarded a favorable recommendation for approval of an amendment to permit “Auto Repair Garage”, to the list of uses allowed by Conditional Use permit in the General Business zone district.

BACKGROUND Planning Staff sponsored this code amendment realizing the practicality of auto repair in General Business (GB) district and resolving a problem of “nonconformity” for such uses in the GB district; “auto repair” by definition may be compatible only if certain conditions are required that reasonably mitigate or eliminate the detrimental impacts.

Auto sales, rental, or leasing facility is a permitted use in the GB zone district and allows for servicing of the vehicles.

Auto Repair Garage All motor vehicles on the premises must carry a current registration and/or work order with a completion date not to exceed 90 days. Motor vehicles without valid registration and/or work order shall be classified as salvage and junk, and may not be kept, stored or worked on in an auto repair shop.

Sec. 10.2 Definitions Auto Repair Garage – permitted in HC, LI, HI A building or place arranged, designed, used or intended to be used for the primary purpose of providing general repair and servicing of motor vehicles. Such repair or servicing may include reconditioning of engines, air conditioning systems and transmissions; wrecker service; collision services including body, frame or fender straightening or repair; painting, undercoating and rust-proofing; replacement or repair of brakes, shock absorbers, tires, batteries, mufflers, or upholstery; and other similar services.
