1.0 INTRODUCTION

1.1 BACKGROUND TO THE DEVOLUTION PROCESS IN THE MINISTRY

The Ministry of Fisheries and Livestock (MFL), together with fourteen other Government Ministries and Institutions, is required to devolve some of its functions to the Councils in line with the National Decentralization Policy (NDP) approved by Cabinet in 2002, officially launched by the President in 2004, revised and approved in 2013. The devolving Ministries and Institutions are required to produce Devolution Action Plans (DAPs). This document is, therefore, a fulfillment of that requirement and the culmination of a series of processes that have their genesis in the third Component of the Public Service Reform Programme (PSRP), namely, Decentralization and Strengthening of Local Government.

1.1.1 The Public Service Reform Programme

The PSRP, whose main aim was to improve the quality, delivery, efficiency and cost-effectiveness of the public services to the people of Zambia was officially launched in November, 1993. The programme comprised three main components, namely;

(a) Restructuring of the Public Service,

(b) Management and Human Resources Improvement (MHRI) and

(c) Decentralization and Strengthening of Local Government.

The Restructuring of the Public Service aimed at streamlining the functions, structures, establishments and operations of Government Ministries/Institutions in order to create a lean, less costly, but well a motivated civil service.

The MHRI component was aimed at introducing organizational, management and accountability systems into Government operations to improve efficiency and effectiveness in the performance of functions and delivery of services.

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______The Decentralization and Strengthening of Local Government component was aimed at decentralizing authority and control of resource allocation and utilization from Central Government to Districts and Local Authorities or Councils.

The above components have since been implemented, with some activities still going on in the Decentralization and Strengthening of Local Government.

1.1.2 National Agriculture and Livestock Policy and Restructuring

Following the PSRP of 1997, the Annual Performance Appraisal System (APAS) was introduced in 2002 as part of the MHRI component, together with an in- house policy of Decentralization. The establishment of Provincial Agriculture Coordinating Office (PACO) and District Agriculture Coordinating Office (DACO) at Provincial and district levels respectively enabled the decentralization of resources and coordination of agricultural activities to districts.

1.1.3 Vision of the MFL A nation that is self-sufficient and net exporter of fisheries and livestock products by 2030

1.1.4 Mission Statement of the Ministry The Mission Statement of MFL is to “facilitate and support the development of sustainable, diversified and competitive livestock, fisheries and aquaculture sector that assures food and nutrition security and contributes to job creation.”

1.1.5 Objectives of the Ministry This Mission Statement provides the basis for the following seven (7) operational performance-oriented objectives for which the MFL is answerable: - i. Determine, analyze and review MFL policies within the framework of national development policies; ii. Plan, provide and co-ordinate the delivery of MFL services at all levels; iii. Mobilize, develop and manage financial, human and material resources through appropriate institutions in a decentralized system;

Control the quality of MFL services at all levels of delivery; vi. Facilitate the building, maintenance and rehabilitation of infrastructure; vii. Promote and strengthen communication between the Ministry and the community.

1.1.6 The National Decentralization Policy

The National Decentralization Policy (NDP) seeks to strengthen Local Government in order to facilitate more effective citizen participation in governance and accountable delivery of public services. The vision of Government is “a decentralized system of governance within a unitary state in Zambia”.

Decentralization stems from the need for the citizens to exercise control over local affairs and foster meaningful development. Therefore, the Policy emphasizes that some degree of authority be devolved from the centre to provinces, districts, and sub-district levels.

Government has identified Devolution as the mode of Decentralization to be implemented.

1.1.7 The Decentralization Implementation Plan

The Decentralization Implementation Plan (DIP) was first formulated in 2004, two years after the approval of the National Decentralization Policy (NDP). However, it was not until December 2009 that the DIP was finally approved by Cabinet for full implementation. Thereafter, Government proceeded with the implementation of scheduled activities under the various components of the plan. During this period, substantial progress was recorded under different components including Sensitization, Legal Reforms, Human and Institutional Capacity Development as well as Sector Devolution. Due to various reasons, progress on most of these

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______components was slower than scheduled. The DIP was subjected to a review in 2012 following the review of the National Decentralization Policy.

1.2 THE MINISTRY OF FISHERIES AND LIVESTOCK - DAP

1.2.1 Development of the Plan The process of preparing the Sector Devolution Action Plan in MACO began with a Sector Devolution Sensitization Workshop that was organized and conducted by the Decentralization Secretariat (DC) in 2006. The second workshop was organized in 2007 by the Ministry’s Sector Devolution Task Force (MACO- SDTF), at which the first MACO-SDAP was prepared. Since then, the MACO- SDAP has been reviewed on a number of occasions.

1.2.2 Objectives of the Plan

The objectives of the Plan are to –

(a) define the functions to be devolved from the Ministry to the Councils;

(b) identify and list the policies, legislation, administrative circulars and regulatory framework that could hinder sector devolution and should be reformed;

(c) in consultation with the Management Development Division (MDD) of Cabinet Office, work out an appropriate organizational structure that is part of the Council’s management framework, with the appropriate staffing positions and clear division of roles and responsibilities and reporting relationships, for the effective delivery of the functions to be devolved;

(d) develop an implementation plan that demonstrates how the Ministry is going to devolve the functions to the districts;

(e) identify staff to be transferred and those to remain the staff of the Ministry to perform the functions that will remain the responsibility of the Ministry;

(f) ensure improved funding to Councils, channeled to core programmes and activities to support the implementation of the transferred functions in line with the NDP; and

These objectives have been arrived at after an analysis of the implications of devolution on the Ministry and Councils in the areas of Policy and legal frameworks, financing and assets arrangements, human resource management and development, and organizational structures.

1.2.3 Plan Action Areas In the light of the above objectives, there are four priority action areas in this Plan. These are;

i. Policy and legal frameworks, ii. Human resource management and development arrangements, iii. Financial and assets arrangements, and iv. Organizational structures.

Each priority action area is further split up into four aspects, namely;

Devolution measures, Key activities under each devolution measure, estimated cost, implementation time frame and, responsible implementing organs/agencies.

An Implementation or Work Plan indicating the above aspects is provided as a matrix in Annex I.

1.2.4 Outline of the MFL - SDAP

This MFL-SDAP is organized into seven Chapters, including this Introductory Chapter. Chapter 2 deals with the definition of functions to be devolved and those which will remain a ministerial responsibility and, except for the last Chapter, the rest deal with the assessment of implications of the devolution process. More specifically, the second Chapter defines the functions to be devolved and those which shall remain as ministerial responsibility after devolution. Chapters 3 to 6 deal with the assessment of implications of devolution on the Ministry and Councils in the areas of organizational structure and personnel, financial and assets arrangements, and policy and legal frameworks. Chapter 7 presents general recommendations.

2.0 DEFINITION OF FUNCTIONS TO BE DEVOLVED AND THOSE TO REMAIN WITH THE MINISTRY

The main focus of this Chapter is to outline the mandate of the Ministry, and give the working definitions of some of the terms connected with the functions to be devolved and those to remain with the Ministry.

2.1 WORKING DEFINITIONS

In this Chapter, unless the context otherwise requires, the following are some working definitions –

(a) Livestock Extension Services means the provision of appropriate technical and advisory services to farmers and other stakeholders in order to enhance livestock production and productivity. (b) Fisheries and Aquaculture Extension Services means the provision of appropriate technical and advisory services to fishers/fish farmers and other stakeholders in order to enhance sustainable fisheries production and productivity. (c) Veterinary Extension Services means provision of technical and advisory services to farmers and the community at large in order to protect and improve human and animal health. (d) Co-management of Fisheries Resources means a participatory management strategy where government shares roles with the community in managing the fishery resource. (e) Management of Pounds means efficient and effective operations of a place or enclosure for lost, stray and unlicensed animals.

2.2.1 General Mandate MFL is one of the key and large economic sector Ministry required to contribute to the socio-economic prosperity and development through the formulation of relevant policies and mobilization of public and private investment.

2.2.2 Specific Mandate

As outlined in the Gazette Notice No. 183 of 2012 published in Gazette No. 6061 of 23rd March, 2012 the Ministry of Fisheries and Livestock is responsible for the following portfolio subjects (broad functions), statutory bodies/institutions and statutory functions (pieces of legislation): (a) Subjects or broad functions (i) Veterinary and Fisheries Training (ii) Animal Health (iii) Animal Identification (iv) Dairy Industry Development (v) Fisheries Management and Development (vi) Food Security (vii) Livestock Development (viii) Veterinary and Tsetse Control Services

2.3 DEFINITION OF FUNCTIONS TO BE DEVOLVED TO THE COUNCILS

The functions may be defined both as broad categories and specific functional activities as follows –

2.3.1 Broad Categories Functions

As listed in the NDP, the MFL has categories of functions which have been devolved from the mandate of the Ministry to the Councils.

2.3.2 Specific Functional Activities

The following functions which were being performed by the Provincial and District Coordinating Offices (PCO/DCO) have been devolved to the Councils - (a) Implementation of fisheries and livestock programmes; (b) planning and budgeting; (c) rehabilitation of infrastructure and facilities; (d) mobilization and facilitation of communities in participation in the development and delivery of MFL services in the district; (e) supervision, monitoring and evaluation of field activities and programmes in the districts; (f) Provision of livestock, fisheries and aquaculture extension services; (g) Provision of animal and veterinary public health services and; (h) Collection and dissemination of fisheries and livestock information.

2.4 FUNCTIONS TO REMAIN AS MINISTERIAL RESPONSIBILITY AFTER DEVOLUTION

Certain functions will remain as Ministerial responsibility at National Headquarters, Provincial and District Levels.

2.4.1 At Ministry Headquarters

The Ministry Headquarters will retain both general and specific responsibilities as follows:

General Responsibility In general, the Ministry Headquarters will retain the overall responsibility for - (a) National Policy formulation and review; (b) Formulation and review of legislation; (c) strategic development of MFL services at national level; (d) resource mobilization and allocation; (e) quality assurance and setting of national performance standards;; (f) system monitoring and evaluation of MFL outcomes; (g) development and review of curriculum framework, core syllabi and training programmes; (h) Running of Training Institutes and Institutions; (i) provision of effective mechanism for accountability at different levels of the MFL management system; (j) research, development and dissemination; (k) Enforcement of standards and regulation.

Specific Responsibility The Ministry Headquarters will retain the following specific functions - (a) Determination of National MFL policy and legislation for –

(c) Administration of the following pieces of legislation - (i) Animal Identification Act No.27 of 2010 (ii) Animal Health Act No.28 of 2010 (iii) Dairy Industry Development Act No.22 of 2010 (iv) Export of Pigs Cap 246 (v) Fencing Cap 190 (vi) Fisheries Act No.22 of 2011 (vii) Pig Industry Cap 251 (viii) Prevention of Cruelty to Animals Cap 245 (ix) Veterinary and veterinary Para - Professionals Act No.45 of 2010

2.4.2 At Provincial Office Level

The Provincial Coordinating Office (PCO), shall be responsible for the administration of the Regional Office. This includes: implementation; the monitoring and supervision of MFL standards, functions, and programmes as well as the maintenance of an efficient data base system for the smooth operation of the province.

District Veterinary, fisheries and the livestock production officers will be retained to carry out the regulatory functions.

3.0 ASSESSMENT OF ORGANIZATIONAL STRUCTURE IMPLICATIONS OF DEVOLUTION ON THE MINISTRY AND COUNCILS AND RECOMMENDATIONS

The devolution of functions from the MFL to the Councils will have different organizational structure implications on both institutions. This Chapter assesses the implications and makes recommendations for developing appropriate organizational structures to be established at the different tiers of Council level to effectively deliver the devolved functions.

3.1 ASSESSMENT OF ORGANIZATIONAL STRUCTURE IMPLICATIONS OF DEVOLUTION ON THE MINISTRY

3.1.1 Current Organizational Structure of the Ministry

The current functions of the Ministry listed under Chapter 2, together with the organizational structures were the result of the restructuring of the Ministry in line with the provisions of Component 1 of the PSRP already mentioned above.

Ministry Headquarters The Ministry Headquarters is organized into five (5) Directorates and three (03) Support Units, all of which are directly answerable to the Permanent Secretary (PS) who is the controlling officer. The Directorates are: Human Resource and Administration, Livestock, Veterinary Services, Fisheries and Policy and Planning. The Support Units are the Financial Management Unit (FMU), the Purchasing and Supplies Unit (PSU) and the Internal Audit Unit (IAU). The Directorates are organized into sections, units and sub-units, each with its staffing levels and functions.

District Office Level Currently, the Department of Policy and Planning, Internal Audit and Procurement and Supplies Units do not exist at district level.

In addition to the functions already spelt out above, the DCO is responsible for the following specific activities:-

(i) Enforcement of regulations; (ii) Coordinating extension services in areas of fisheries and livestock; (iii) Managing the utilization of human, financial and material resources; (iv) Facilitating timely monitoring and evaluation of programmes and activities; (v) Ensuring timely preparation and submission of Ministry’s annual work plan and budgets;

In the light of the foregoing, devolution will have the following organizational structure implications on the Ministry;–

At Ministry Headquarters There will be few or no structural implications for the Ministry Headquarters when devolution fully implemented because the Ministry’s current structure is already decentralised.

At Provincial Office Level The structure at the province shall remain the same while the functions will need to be re-aligned.

This will result in reduced budgetary allocations. The Veterinary Department and research facilities based within the district, together with the support staff will remain under the Ministry.

3.2 ASSESSMENT OF ORGANIZATIONAL STRUCTURE IMPLICATIONS OF DEVOLUTION ON THE COUNCILS

3.2.1 Current Organizational Structure of Councils

Currently, there are one hundred and three (103) councils, comprising four (04) City Councils, fifteen (15) Municipal Councils and eighty-four (84) District (rural) Councils.

Operationally, a council consists of two structures: a political structure and an administrative or management structure, irrespective of whether it is a City, Municipal or a District council.

The Political Structure

The political structure is the policy making arm of the council. It consists of councilors and a mayor if the council is a City or Municipal Council or of councilors and a chairperson if the council is a District Council. In either case, the councilors include members elected from the wards of the council, Members of Parliament in the district and two chiefs’ representatives elected by the chiefs in the district. The mayor or chairperson is elected by the members from among themselves. He or she is the political head of the Council and, when present, presides over full council meetings.

In this structure, a council operates through a committee system, with the full council as the supreme authority. The chairpersons of the committees are elected by the councilors at the first meeting of the council and thereafter annually. Each councilor must be a member of at least one committee. 14

The Administrative Structure The Management Team is the administrative arm of the council, responsible for the implementation of the council policies and decisions.

This administrative structure is headed by the Town Clerk for City and Municipal Councils and the Council Secretary (CT) for District Councils. The Town Clerk or Councils Secretary is the Chief Executive Officer of a City/Municipal Council and District Council respectively.

The administrative structure of the council operates through Departments, each of which is headed by a Director or Manager as a technical or professional officer. These departments are further divided into sections and units. The number of departments depends on the type council.

In this regard, a typical City Council has eight to nine Departments which include Human Resource and Administration, Engineering Services, Housing and Social Services, Legal Services, Finance, Valuation and Real Estates, City Planning and Public Health Services.

A typical municipal council may have the same type and number of departments as a city council. However, a typical district council has only four departments which include the departments of: Planning, Works, Administration and Finance.

In each case, the department head reports to the Chief Executive Officer and a relevant committee of council.

3.2.2 Organizational Structure Implications of Devolution on the Councils Devolution of fisheries and livestock extension services from MFL to Councils will result in organisational structure changes in councils. The councils will be required to develop appropriate organisational structures in order to effectively implement and deliver the devolved extension services.

3.3 RECOMMENDATIONS

In view of the above organizational structure implications of devolution on the Ministry and Councils, the following recommendations are made:– (i) The Agricultural Sector is composed of specialized disciplines in the areas such as Crops, Livestock, Veterinary Services, Aquaculture and Capture Fisheries Management, Nutrition, Farm Power, Land Husbandry, Agribusiness and Marketing and Irrigation and therefore, should remain as a separate Department so as to effectively facilitate provision of agricultural extension services; (Figure 1); (ii) The four Units under the Department should be headed by Deputy Directors who will be supported by officers at Chief level or its equivalent; and (iii) There will be need for Councils to employ their own Vets since the current Vets under the Ministry are to be retained to carry out the regulatory and enforcement functions.

4.0 ASSESSMENT OF HUMAN RESOURCE IMPLICATIONS OF DEVOLUTION ON THE MINISTRY AND COUNCILS AND RECOMMENDATIONS

This Chapter assesses the personnel or human resource implications of devolution on the Ministry and Councils and makes recommendations on the staff that will be transferred to Councils and those that will remain a ministerial responsibility in order to ensure a smooth, equitable, competent and quality public service delivery.

4.1 ASSESSMENT OF PERSONNEL IMPLICATIONS OF DEVOLUTION ON THE MINISTRY

4.1.1 Staff Members Currently Performing the Functions to Be Devolved

Total Number of Staff Members Currently Performing the Functions to be Devolved

Analysis of the current organizational structure and staff establishment of the Ministry shows that, because of the manner in which the Ministry is structured, almost every person in almost every directorate, section or unit is performing some aspect of the functions to be devolved, namely, livestock and fisheries Extension services. However, the major structures responsible for performing the bulk of the activities of the functions to be devolved are the structures at the district level.

In this regard, staff-wise, there are about 1,020 staff to be transferred to Councils, serving on various salary scales, broken down by location as indicated in Table 1 (a) and Table 1 (b) below.

4.1.2 Movement of Staff to Councils

The personnel will be transferred from the Ministry to the Councils, facilitated by the Public Service Commission (PSC) to be employees in the Local Government Service (LGS), managed and supervised by the Local Government Service Commission (LGSC).

Although the staff will be moved to the councils, national programs will take precedence over council programs. This entails that the devolved staff will be called upon whenever programmes of national economic importance that cut across Councils are to be implemented. Such programmes may include control of diseases. The funds for such programmes shall be mobilized by Central Government. However, Councils will be expected to provide human and material resources.

4.1.3 Personnel Implications of Devolution on the Ministry

Based on the foregoing, the devolution of the functions with accompanying resources will have the following implications for human resources on the Ministry:

(a) The Ministry will remain with fewer staff to perform functions that will be retained by the Central Government. (b) Some staff may consent to the transfer and others may not. (c) Some staff may not fit into the Council structure and this may cause anxiety (d) The morale and motivation of staff will be adversely affected because of the uncertainty of their future and legitimate concern about the impact of devolution on the quality of services. (e) The loss of morale and motivation may also cause some of the staff to seek employment in the private sector or outside the country. (f) Staff will have to be identified and transferred from the Ministry to the Councils. Some staff may consent to the transfer and others may not. 20

4.2 ASSESSMENT OF PERSONNEL IMPLICATIONS OF DEVOLUTION ON COUNCILS

Currently, there are no staff under the Council undertaking extension services in livestock, veterinary and fisheries, therefore the devolved functions will be undertaken by the staff that will be transferred to the Council and those to be recruited.

Personnel Implications of Devolution on Councils

From the foregoing analysis of the staffing situation of Councils, the following general and specific personnel implications of devolution are evident:

General Implications The Devolution will have far reaching human resource implications on the Councils. The devolving functions have no structures at the council level at the moment. The creation of new positions in Councils will entail increased number in the staffing levels. Current council Staff may be apprehensive about devolution as they may uphold the view that devolution may be a threat to their positions.

Specific implications More specifically, the devolution of the functions of Extension services will lead to the following human resource implications;- (a) Councils will have to take on board all field extension staff currently performing the functions to be devolved; (b) Councils will have to prepare for the receipt of staff transferred from the Ministry; (c) The workload of the LGSC will increase with the increase in personnel for the Councils;

(e) The staff establishment of councils will expand leading to an increase in expenditure on personal emoluments and capacity building activities.

4.3 RECOMMENDATIONS

In light of the above implications of devolution for human resources Management and development in the Ministry and Councils, the following general and specific recommendations are made:–

General Recommendations

It is recommended that: (a) The budget for Councils in general, and the personal emoluments and capacity building recurrent expenditure budget, in particular, should be increased considerably to meet the expansion of the staff establishment of Councils; (b) All senior management positions should be advertised and filled up through interviews; (c) A sensitization Programme should be designed and implemented for the institutions and staff to be devolved and those remaining in the ministry; (d) A capacity building and human resource development programme should be designed and implemented for the Ministry/Councils and individual members of staff to strengthen their skills and provide them with resources to enable them perform new roles and responsibilities competently, efficiently and effectively; (e) A workable separation package or strategy should be put in place in line with the Employment Act so as to compensate the staff who may opt to stop working; (f) Staff performance audit should be carried out before transfer of staff to the Councils; (g) All vacant positions should be filled in Councils to ensure effective service delivery;

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______(h) When transferring staff to Councils, there should be total adherence to employment and labour laws relating to pension contributions and benefits. (i) Staff movement from the Ministry to Councils should be through transfer from the Public Service Commission to the Local Government Service Commission.

(j) There is need to revise and harmonize the various pension laws in order to effectively handle transfers and separation cases;

(k) Working environment at district councils should be improved

Specific Recommendations District Level a) The Veterinary and Livestock Development Section should include fisheries Unit; b) The Section should be divided into three Units, namely; Fisheries, Livestock Development and Veterinary Services; c) The Units should be headed by Chiefs while the Section is headed by Assistant Director.

Field Level

Veterinary and Livestock Development All veterinary and Livestock Assistants should be under their respective Chiefs who will be reporting to the Assistant Director.

The establishment of a veterinary or Livestock camp shall be guided by the: i. The veterinary and livestock extension staff (Veterinary and Livestock Assistant) to livestock unit ratio of 1 to 1,500; the veterinary and livestock assistants shall conduct farmer follow-ups of not less than 2 times a month.

ii. For every dip tank there shall be a dip tank capitao

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______iii. Infrastructure such as Dip tanks, crush pens, livestock service centres and marketing facilities will be under Councils.

iv. The Animal Disease Task Force shall be a sub-committee of the Camp Livestock Committee which will be reporting to the appropriate sub-committee of the Council.

Fisheries Extension Services All field extension staff in a district should be under the Chief Capture Fisheries and Aquaculture Officer.

The establishment of Fisheries posts and Camps shall be guided by: (i) the existence of fisheries stratum based on vastness of the fishery area and population of fishers; (ii) The extension staff to fish farmer ratio of 1 to 200 farmer households; the extension staff shall conduct farmer follow-ups of not less than 2 times a month. (ii) The Village / Zonal fishing management committee shall continue to work hand in hand with the fisheries assistant who is an Ex-officio. This Committee which will be reporting to the appropriate sub-committee of the Council.

4.4 FUNCTIONS OF THE SERVICE COMMISSIONS (PUBLIC SERVICE COMMISSION AND LOCAL GOVERNMENT SERVICE COMMISSION)

The functions of recruitment, promotions, discipline and transfers of officers should be devolved to the Local Government Service Commission (LGSC) from Public Service Commission (PSC);

Transfer of Staff, Salaries and Salary Structures All professional and technical staff in the current establishment should be moved to Councils where possible. Only those who will not be able to fit into the Council structures and those expected to carry out functions of Central Government are to remain.

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______In carrying out these staff transfers, the following measures should be taken into account: - (a) The Employment Contract for all the officers to under the Council should be with the LGSC, and Government should decide how handle the terminal benefits of those who may opt to leave; (b) The wage bill for the devolved functions should be the responsibility of Central Government; (c) There should be no break in the membership and contributions of workers to their pension schemes as provided for by the National Pensions Act; (e) The employees should not lose their leave days when transferred to the Councils. Similarly, the benefits so far accrued by these employees should be carried over under the new arrangement; (f) Union membership for workers that will move to the Councils should be managed in line with provisions of the Labour and Industrial Relations Act, Cap 269 of the laws of Zambia; (g) The personnel files should be transferred to Councils; (h) Government must offer an alternative to workers who may not fit in the council structure; (i) Transfers of field staff within the district shall be done by the Councils while Local Government Service Commission will handle inter-district transfers

4.5 STATUTORY DISTRICT VETERINARY OFFICE

A separate organizational structure shall remain in each district to enforce the Animal Health Act, Animal Identification and Traceability Act and other related regulations. Other functions that have not been devolved to the councils such as certification, sanitary issues and control of diseases of national economic importance will be carried out by this office.

A separate organizational structure shall remain in each district to conduct fisheries research and regulate the operations of collaborative fisheries management structures as contained in the Fisheries Act No. 22 of 2011.

5.0 ASSESSMENT OF FINANCIAL AND ASSETS IMPLICATIONS OF DEVOLUTION ON THE MINISTRY AND COUNCILS AND RECOMMENDATIONS

The devolution of the functions of fisheries, veterinary and livestock extension services, co-management of fisheries resources and management of pounds from the Ministry of Fisheries and Livestock to the Councils will have several implications on both institutions. This Chapter assesses the financial and assets implications and makes recommendations on the appropriate financing and asset arrangements to be put in place in order for the devolution process to succeed as envisaged in the NDP.

5.1 ASSESSMENT OF FINANCIAL AND ASSETS IMPLICATIONS OF DEVOLUTION ON THE MINISTRY

5.1.1 Current Financing Arrangements for Functions to be Devolved to Councils 15 15 Ministerial Share of the National Budget Funding Levels, Sources and Modalities According to the 2016 National Budget, which is the main source of financing for the sector in general and the functions to be devolved in particular, the Ministry had been allocated a total sum of K 708,533,323 which is 1.3 percent of the total National Budget of K 53,136,825,364.

The Zambian Government raises revenue from mainly two sources, namely, local revenues and foreign financing. The local revenues include both direct and indirect taxes and non-tax revenue such as levies and fees. Foreign financing is channeled towards direct budget support and project financing which comes straight to the Ministry.

The Ministerial share of the 2016 National Budget is summarized in Table 2 below -

Capital (Development) Funding

Funding for capital projects is done by the national headquarters in line with the approved budget.

Funding Formula/Channels of Disbursement

Funds to Districts as spending units are made according to budgetary allocation. The process is as follows - (i) Funding from Central Government is disbursed through MoF to the MFL Headquarters; (ii) Authority is obtained from the controlling officer to disburse the funds to districts; (iii) Once the authority is granted, disbursements are made to the districts based on the according to the approved budget. Once the districts have received the funds in their respective Bank accounts, the respective departments are able to utilize the funds to implement the activities in line with the approved budget.

5.1.2 Financial Management and Accounting Systems Currently all accounting functions are carried out by the Financial Management Unit at district level.

(a) Systems at the District Level The management of accounts at the district level includes the keeping of the following books of accounts and documentation: (i) Financial Regulations (ii) Cash Books (iii) Receipt Books (iv) Financial Registers (v) General Expenditure Ledger (vi) Payment Vouchers (vii) Bank Reconciliation (viii) Local Purchase Order (ix) Expenditure Returns and Reports (x) Imprests - Accountable Imprest; Special Imprest; Standing Imprest (xi) Cheque Distribution Register

(b) Procedures for payments Payment procedures are done in accordance with: (b) Public Finance Act, 2004 (ii) The Zambia Public Procurement Authority Act, 2008 (i) Terms and Conditions of Service for the Public Service workers (iv) Approved annual work plans and budget and; (v) Cabinet Circulars (c) Governance Issues (Accountability and Transparency) (i) Financial Committees Coordinates the execution of funds according to approved work plans and budgets. (ii) Internal Control The District Coordinating Office authorizes payments as sub-warrant holder. Cheque signing arrangements act as part of control systems.

5.1.3 Financial Implications of Devolution on the Ministry

The devolution of the extension service functions to Councils will have the following financial implications on the Ministry: –

(a) Resource requirements in the Ministry will decrease as a result of the transfer of some of responsibilities and roles to Councils; (b) In the long run, the Wage Bill for the Ministry will decrease due to reduced workforce; (c) Demand for infrastructure development will decrease as there will be reduced volume of work resulting from reduced workforce,

5.1.4 Current Inventory of Assets of the Ministry

Non-Movable Assets According to records held by the Ministry, the following inventory of non-movable assets will be surrendered to Councils: (i) Camp houses (ii) Dip Tanks (iii) Livestock Service Centres (Levels 1+ and 2)

Movable Assets

This will include the following:- (i) Motor cycles, (ii) Veterinary and Livestock kits

The assets will be transferred to the Councils through a legal instrument or in accordance with provisions of any Zambian written law pertaining to transfer of government owned property as soon as possible. 31

5.1.5 Assets Implications of Devolution on the Ministry

The Devolution of Ministry Functions will have the following implications on assets:- (a) Government owned assets being utilized under the devolved functions will be transferred to the Councils; (b) The asset inventory of the Ministry will reduce while that of the Councils will increase; (c) Any locally generated funds through the utilization of the assets of the Ministry to be transferred to councils on devolution will reduce.

5.2 ASSESSMENT OF FINANCIAL AND ASSETS IMPLICATIONS OF DEVOLUTION ON COUNCILS

5.2.1 Current Financing Arrangements of Councils

Funding levels, sources and modalities

Currently councils receive funds from Central Government through block grants amounting to well over 60% of the total budget depending on the type and size of council. This is in addition to their locally sourced revenue from rates, levies and fees charged within the area of their jurisdiction.

Financial Management and Accounting Systems in Councils For accounting and control purposes, the councils use their own system of financial management in accordance with the provisions of the Local Government Act, 1991. Among others, the following instruments are used by Councils: ii) Financial Regulations of 1969;

iii) Public Finance Act, No. 12 of 2004;

iv) Local Authorities (Financial) Regulations 1994;

v) Constituency Development Fund guidelines of October 2003 (Revised);

vi) Internal audit function is independent of Office of the Auditor General (Finance Act, No. 12 of 2004);

vii) Auditing manuals; 32

5.2.2 Financial Implications of Devolution on Councils

Devolution of the identified functions to councils will result in the following financial implications:- (a) An increase in resource requirements in councils because of increased overheads and responsibilities/roles. (b) There will be an increase in the wage bill for councils arising from an expanded workforce. The MoF should accommodate the resultant financing gap; (c) The need to attract and retain qualified and experienced personnel in councils will mean improving salaries and conditions of services. In addition, successful devolution entails harmonization of the salary structures and conditions of service obtaining in Central Government and Councils; (d) A conflict is likely between the Central Government and Council financial management and accounting systems due to two different systems used; (e) There may be financial and accounting management challenges with respect to transparency and accountability; (f) Demand for infrastructure development in councils will increase because of the need to develop operating infrastructure and auxiliary facility and plant. (g) Councils should be empowered by law to strengthen their capacities to collect revenues (h) Demand for infrastructure development in councils will increase because of the need to develop operating infrastructure and auxiliary facilities, plant and equipment;

Currently, councils have a lot of assets, both movable and non-movable, whose managements is governed by the provisions of the Local Government Act No. 22 of 1991.

5.2.4 Assets Implications of Devolution on the Councils

Devolution will have the following implications on council assets: (a) Council assets will increase and with the increase of assets there will be need to improve the management and utilization of the assets; (b) Assets to be transferred from the devolved functions will have to be properly accounted for and this means that there will be need to establish means of receiving and accounting for such assets; (c) Councils will be able to generate income through the efficient utilization of the assets accrued;

5.3 RECOMMENDATIONS

Based on the foregoing implications of devolution on the Ministry and Councils, the following recommendations are made: –

a) Funding to Council should be increased by Ministry of Finance to finance to the Decentralization process and the operations of the Council; b) The Ministry of Fisheries and Livestock should continue to receive budgetary support and, additionally, Councils will be encouraged to engage in revenue generation for purposes of funding the extension services; c) The financial regulations for Central Government Ministries should be harmonized with those for Councils; d) The basis for resource allocation should be according to the number of camps and farmers, terrain and vastness of districts; e) The Medium Term Expenditure Framework and Activity Based Budgeting should be adopted by Councils.

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______f) The Government should retain responsibility for mobilizing resources for the provision of devolved functions g) Independent Bank accounts should be opened at each district council for the purpose of running extension services; h) The different accounting systems used by Central Government and Councils should be harmonized; i) Councils should not enter into any financial negotiations/agreements/obligations with any foreign/external financiers. This responsibility should remain the preserve of MoF; j) Financial/procurement and existing policies and regulations should be adhered to in the decentralized systems;

k) External auditing for Councils should be provided by the Auditor General and audit committees should be established in Councils, in accordance with the Public Finance Act of 2004;

l) The Councils should adopt the procurement guidelines being used by Central Government Ministries; m) An audit of debts should be undertaken to facilitate management of possible debt carryovers by either the transferring or receiving institutions; n) There should be an increased political will in Central Government to empower Councils to raise revenue

Salaries and Conditions of Service

(a) Salaries should be paid to the staff using the existing DDACC system;

(b) Salaries and conditions of service should be improved to attract and retain qualified and experienced staff in Councils and salary structures and conditions of service obtaining in Councils and Central Government should be harmonized

6.0 ASSESSMENT OF POLICY AND LEGAL IMPLICATIONS OF DEVOLUTION ON THE MINISTRY AND COUNCILS AND RECOMMENDATIONS

The Ministry of Fisheries and Livestock has its own Policies and administrative circulars as well as pieces of legislation that govern the performance of the Ministry. The proposed functions to be devolved to the Council are Fisheries, Veterinary, Livestock Extension services, Regulation of Fencing and Fences and the management of Pounds. Others are Co- management of Fisheries Resource. The Policies and pieces of legislation were formulated or enacted before the introduction of the NDP and could hinder the implementation of the NDP. This Chapter assesses the implications of devolution on both institutions in relation to their policies and enabling legislation and makes recommendations to ensure that such instruments facilitate the process of devolution.

6.1 ASSESSMENT OF POLICY AND ADMINISTRATIVE CIRCULARS IMPLICATIONS OF DEVOLUTION ON THE MINISTRY

6.1.1 Current Internal and External Policies and Administrative Circulars Used by the Ministry to Guide the Provision of the Functions to be Devolved

Existing Policies within and outside the Ministry Guiding the Provision of the Functions to be Devolved

Currently, there exists only one main policy document called “National Agricultural Policy”. This policy document contains all the policies on various aspects of agriculture – i.e. crops, livestock and fisheries. In addition to the National agricultural policy, the Ministry is in facilitating the process of formulating the Fisheries and Livestock Policy.

(a) Cabinet Office Circular No. 10 of 2014 on Implementation of the Revised National Decentralization Policy (b) Cabinet Office Circular No. 9 of 2014 on Retirement of Officers on Attainment of Statutory Retirement Age; (c) Cabinet Office Circular Minute of 2015 on the Guidelines on the Implementation of Circular No. 10 of 2014.

6.1.2 Policy and Administrative Circulars Implications of Devolution on the Ministry

Policy Implications All the Policies mentioned above subjects are not in conflict with the NDP provisions. However, the Decentralization of extension services which play a dual role are in conflict to some extent – e.g. the District Veterinary and Fisheries Officers, do carry out some regulatory functions in addition to extension services and these will not be devolved but be retained by Central Government to continue carrying out their regulatory functions.

6.2 ASSESSMENT OF LEGAL IMPLICATIONS OF DEVOLUTION ON THE MINISTRY

In order to successfully implement Decentralization, some of the above stated Acts will need to be reviewed and harmonized.

6.3 ASSESSMENT OF POLICY AND LEGAL IMPLICATIONS OF DEVOLUTION ON COUNCILS.

6.3.1 Current Policies and Administrative Circulars of Councils The following are the existing policies and administrative circulars of councils guiding the performance of their functions:

Existing Policies of Councils Currently there is no general or national policy on local government to guide the operations of the local government system. However, there are some subject specific policies which are used to guide the general operations.

Existing Administrative Circulars of Councils MLGH also issues a number of Administrative Circulars to Councils guiding them on how to conduct their business as local authorities. Others Circulars include: (i) Procedure on Approval of CDF Projects; (ii) Amendment to Existing CDF Guidelines of December, 2006; and (iii) Annual Call Circular.

6.3.2 Policies and Administrative Circulars Implications of Devolution on Councils The absence of a national policy on local government is a hindrance to giving effective direction and guidance to the development of local government. However, the specific subject policies do facilitate the day to day administration of Councils.

MINISTRY OF FISHERIES AND LIVESTOCK SECTOR DEVOLUTION PLAN ______6.4 EXISTING LEGISLATION, REGULATIONS AND PROCEDURES USED IN COUNCILS TO GUIDE THE PROVISION OF LOCAL SERVICE DELIVERY

The Councils are currently guided by the following laws, among many others, regarding their establishment, constitution, functions and operation:- (a) The which gives Parliament powers to enact laws on Local Government; (b) The Local Government Act, which provides for the establishment, constitution and operation of Councils; (c) The Local Government (Amendment) Act, 2010, which provides for the establishment of the LGSC and defines its powers.

Legal Implications of Devolution on the Councils a) The Constitution of Zambia, Cap 1 of the laws of Zambia, as amended in 1996, does not sufficiently provide guidance on the subject of local government, let alone Decentralization by devolution; and b) The Local Government Act, Act No. 22 of 1991 and the Local Government (Amendment) Act, No. 6 of 2010 do not incorporate the NDP principles of devolution;

6.5 RECOMMENDATIONS

Policies

(a) The Fisheries and Livestock Policy should be finalized in order to provide guidance in the implementation of the devolved functions; (b) There is need to formulate a Local Government Policy;

Legislation a) The Public Finance Act No. 15 of 2004 should be amended to designate the Chief Executive Officer of a council as the Controlling Officer in order to facilitate the direct funding of councils by the Ministry of Finance; b) The Local Government Act, Cap 281 of the laws of Zambia should be amended to incorporate the provisions of the NDP to bring it in conformity with

7.0 GENERAL RECOMMENDATIONS

In addition to the recommendations made under specific themes of the Plan, the following general recommendations should also be considered:

a) Political leaders should support and provide leadership during the implementation of the decentralization programme; b) District Councils, with the help of Central Government and Cooperating partners, should undertake infrastructure development in form of houses and office block in order to attract and retain the qualified staff that will be recruited; c) Government should embark on an aggressive nation-wide campaign programme to prepare the staff and other stakeholders who are likely to be affected by the Decentralization programme; d) There should be a capacity building programme for Councils staff country–wide to prepare them handle the added responsibilities and tasks; e) Qualified and experienced sector ministries’ personnel in the support services units must be given priority during the recruitment into the new structures of the Councils to ensure continuity in terms of focus; f) The salary scale for Directors in the Department of Agriculture, Environment and Natural resources should be uniform in all Councils. In terms of extension services delivery, rural based Councils will be doing more work compared to those in City and Municipal Councils; g) Funding for Councils should be channeled directly to Councils from the Treasury with matching management controls, including the establishment of separate bank accounts for devolved functions, in line with the Treasury’s Financial Regulations in order to improve on efficiency and accountability; h) Existing Council debts should be liquidated by the Central Government so as to ensure that Councils effectively discharge their functions; i) A management audit of staff, accounts, plant and equipment should be conducted by affected institutions to facilitate the devolution process; j) Devolution should proceed should be implemented with caution in newly created districts where the administrative structures are not fully operational; 43
