NASA Plan for Commercial LEO Development to Achieve a Robust Low-Earth Orbit Economy from Which NASA Can Purchase Services As One of Many Customers NASA Plan for Commercial LEO Development to achieve a robust low-Earth orbit economy from which NASA can purchase services as one of many customers Summary and Near-Term Implementation Plans June 7, 2019 NASA Plan for Commercial LEO Development Executive Summary NASA is opening the International Space Station for commercial business, unleashing U.S. industry on the path to a commercial economy in low-Earth orbit. NASA will partner with industry to achieve this commercial economy as the agency moves full speed ahead toward its goal of landing the first woman and next man on the Moon by 2024. Commercial companies will play an essential role in establishing a sustainable presence in low-Earth orbit as well as on and around the Moon, working with NASA to test technologies, train astronauts and strengthen the burgeoning space economy. A robust and competitive low-Earth orbit (LEO) economy is vital to continued progress in space. The United States is committed to encouraging and facilitating the growth of the U.S. commercial space sector that supports U.S. needs, is globally competitive, and advances U.S. leadership in the next generation of new markets and innovation-driven entrepreneurship. NASA has developed a long-term vision to achieve this goal where, one day, NASA will become one of many customers in LEO. This plan builds on, uses the capabilities of, and applies the lessons learned from over a decade of work and experience with commercial companies. This plan, entitled NASA's Plan for Commercial LEO Development, addresses supply, demand, and lays out steps to date that have been taken. It also includes detailed steps that will be taken in the near-term, mid-term, and long-term (see graphic below). NASA utilized the recommendations provided by 12 companies from recent market studies while developing this plan. The companies assessed the potential growth of a LEO economy and how to best stimulate private demand for commercial human spaceflight and other commercial and marketing activities in LEO. NASA developed a five part plan of near-term actions that will build on the work of the last two decades. These plans have all developed opportunities, policies and information that can be found on this website. First, NASA established a commercial use and pricing policy for the International Space Station (ISS) that will enable companies to purchase ISS resources for commercial activities, thereby reducing uncertainty and allowing them to build business plans; Second, NASA has announced the intent to allow companies to fly private astronauts to the ISS with the first mission as early as 2020; Third, NASA has initiated a process for developing commercial LEO destinations, including the overall strategy, timeline, and a synopsis for the solicitation of the ISS's Node 2 Forward Port to be followed by a solicitation for a free flying platform before the end of 2019; Fourth, NASA has laid out a plan to pursue opportunities to stimulate demand, including two ISS Utilization NRAs with calls for demand stimulation ideas as well as a call in the NextSTEP2 BAA Appendix J; And Fifth, NASA has updated a white paper providing quantification of the agency's long term needs in LEO. NASA by its very nature is an exploration agency. We like to challenge the status quo and discover new things. We like to solve impossible problems and do amazing things. NASA also realizes that we need help and do not know everything. We can only accomplish amazing things by team work. NASA is reaching out to the US private sector to see if they can push the economic frontier into space. To evaluate this plan and identify opportunities for improvement, NASA is seeking feedback from industry and others through a Request for Information (RFI) on this plan and the five steps that have been outlined above by July 3, 2019. Background A robust and competitive commercial space sector is vital to continued progress in space. The United States is committed to encouraging and facilitating the growth of the U.S. commercial space sector that supports U.S. needs, is globally competitive, and advances U.S. leadership in the generation of new markets and innovation-driven entrepreneurship. NASA recognizes that to financially sustain a commercial platform in low-Earth orbit (LEO), developing new markets beyond the traditional research and technology development market will be required. While NASA will always have a requirement to train crews, perform fundamental and applied research, and develop technology in LEO, if NASA is to achieve its goal of becoming one of many customers of a platform after ISS end of life, a targeted strategy for enabling the development of a robust, sustainable commercially-driven economy in LEO is required. More than 50 companies already are conducting commercial research and development on the space station via the International Space Station U.S. National Laboratory, and their results are yielding great promise. In addition, NASA has worked with 11 different companies to install 14 commercial facilities on the station supporting research and development projects for NASA and the ISS National Lab. Opportunity exists to move projects beyond research and development into manufacturing and production. A new NASA directive enables commercial manufacturing and production, allows both NASA and private astronauts to conduct new commercial activities aboard the orbiting laboratory, and sets commercial prices for use of U.S. government resources

    Harvard Journal of Law & Technology Volume 17, Number 2 Spring 2004 Commercialization of Space Commercial Space Launch Amendments Act of 2004 On March 4, 2004, the Commercial Space Launch Amendments Act of 20041 (“CSLAA”) was passed by the House of Representatives by a vote of 402 to one.2 The bill is “designed to promote the devel- opment of the emerging commercial human space flight industry,” and is sponsored by Space and Aeronautics Subcommittee Chairman Representative Dana Rohrabacher (R-CA).3 If enacted, the CSLAA will establish a regulatory regime tailored to the needs and dangers of the commercial space launch business, thereby freeing the industry from the tangle of ill-suited regulations with which it has been forced to contend, and consequently allowing the private sector to challenge the hegemony of the National Aeronautics and Space Administration (“NASA”) in space.4 This Note will begin by briefly discussing the potential for valuable commercial development in space. Next, it will explore the key reasons why NASA has failed to tap this potential and why existing regulatory frameworks have prevented private enterprise from doing so. It will then describe how the CSLAA would advance the emerging suborbital human space flight industry by explicitly de- fining the industry to be regulated, by vesting control in a single regu- lator, and by limiting the regulatory obstacles standing in the way of commercial development. The use of space as a platform for increasing the benefits of our technological evolution continues to increase in a way that profoundly affects us all. Whether we use these resources to synchronize communications networks, to improve agriculture through precision farming assisted by imagery and positioning data from satellites, or to receive entertainment from direct-to-home satellite transmissions, commercial space is an increasingly large and important part of our economy and our information infrastructure. Once dominated by government investment, commercial interests play an increasing role in the space industry. As the voice of industry within the U.S. Government, the Department of Commerce plays a critical role in commercial space. Through the National Oceanic and Atmospheric Administration, the Department of Commerce licenses the operation of commercial remote sensing satellites. Through the International Trade Administration, the Department of Commerce seeks to improve U.S. industrial exports in the global space market. Through the National Telecommunications and Information Administration, the Department of Commerce assists in the coordination of the radio spectrum used by satellites. And, through the Technology Administration's Office of Space Commercialization, the Department of Commerce plays a central role in the management of the Global Positioning System and advocates the views of industry within U.S. Government policy making processes.     Research Paper The Future of Space Commercialization Joshua Hampson Security Studies Fellow The Niskanen Center January 25, 2017 Executive Summary This paper argues for the importance of commercial uses of outer space to the economy and national security of the United States. It lays out a short history of developments in commercial outer space, enumerates the challenges facing this emerging market, and offers suggestions for policies to address these challenges. It’s not possible to provide comprehensive answers to all of the problems the United States may encounter in outer space, but the suggestions provided offer a starting point for creating a healthy, safe, and robust commercial space environment. Commercial outer space can promote economic growth, innovation, and stronger national security. However, achieving these goals will require several changes in space policy: ● The Office of Commercial Space Transportation (FAA AST) should be elevated to a separate bureau under the Department of Transportation; ● Responsibility for situational awareness of non-national-security-related space assets should be placed in a non-profit, non-governmental, multi-stakeholder organization; ● When the government requires space capabilities, it should buy privately-provided services and encourage competition in launch and non-launch markets; and ● Government agencies with regulatory or oversight authority over the commercial space industry should default to approval for new missions. Agency procedures for overruling default approval should be transparent and should include a process of appeal. The United States is on the cusp of having an independent commercial space market. With a few smart decisions and a policy of regulatory restraint, the government can simultaneously promote innovation, growth, and national security, while proving that enterprise in space does not require the backing of a large nation state.

Throughout NASA's history, human space flight has been overseen by NASA. In CCP, regulatory oversight for public safety will be done by the Federal Aviation Administration's Office of Commercial Space Transportation after NASA certification. The FAA currently licenses the launch and reentry of U.S. commercial providers under the CRS program and has licensed over 300 commercial launches since 1989. The transition from a historically government-run activity to a government-commercial partnership has generated several safety challenges. NASA's focus is on crew safety and mission success for NASA missions while FAA's focus is on ensuring public safety on licensed launches or reentries. A Memorandum of Understanding (MOU) between NASA and FAA was signed in 2012 to avoid conflicting requirements and multiple sets of standards.
