Harvard Journal of Law & Technology Volume 17, Number 2 Spring 2004 Commercialization of Space Commercial Space Launch Amendments Act of 2004 On March 4, 2004, the Commercial Space Launch Amendments Act of 20041 (“CSLAA”) was passed by the House of Representatives by a vote of 402 to one.2 The bill is “designed to promote the devel- opment of the emerging commercial human space flight industry,” and is sponsored by Space and Aeronautics Subcommittee Chairman Representative Dana Rohrabacher (R-CA).3 If enacted, the CSLAA will establish a regulatory regime tailored to the needs and dangers of the commercial space launch business, thereby freeing the industry from the tangle of ill-suited regulations with which it has been forced to contend, and consequently allowing the private sector to challenge the hegemony of the National Aeronautics and Space Administration (“NASA”) in space.4 This Note will begin by briefly discussing the potential for valuable commercial development in space. Next, it will explore the key reasons why NASA has failed to tap this potential and why existing regulatory frameworks have prevented private enterprise from doing so. It will then describe how the CSLAA would advance the emerging suborbital human space flight industry by explicitly de- fining the industry to be regulated, by vesting control in a single regu- lator, and by limiting the regulatory obstacles standing in the way of commercial development. Finally, the Note will frame the CSLAA as one piece of a potentially much broader trend in the promotion of pri- vate space entrepreneurship by gover nment. Though its future prospects are far from certain,5 commercial human space flight is one of a number of industries whose activities in space could create substantial value on Earth.6 Proposed business 1. -

The vehicle system is divided into design features. Every design feature can have alternative characteristics. All combinations of design features and characteristics are compared pairwise with each other with respect to relative importance for a feasible vehicle concept as seen from technical, economic, and political aspects. This valuation process leads to a ranked list of design features for suborbital and orbital applications. The result is a theoretical optimized suborbital and orbital vehicle each. The method of pairwise comparison allows to determine not only ranking but also assessing the relative weight of each feature compared to others. Keywords: Pairwise Comparison, Reusable Launch Vehicle, Space Tourism Introduction The potential for an introduction of reusable launch vehicles is derived from an expected increasing demand for transportation of passengers in the decades to come. The assumed future satellite market does not justify to operate reusable launch vehicles only for satellites due to a low launch rate. Finding feasible vehicle concepts, which satisfy operator’s, passenger’s, and public’s needs, will be a challenging task. Since it is not possible to satisfy all space tourism markets by one vehicle, different vehicles that are capable to serve one particular segment (suborbital or orbital) are needed. -

Allen serves as the Program Executive for Crew Health Christine Anderson is the Executive Director of the New Mexico and Safety at NASA Headquarters, Washington DC, where he Spaceport Authority. Anderson was the founding Director of the Space from Baylor College of Medicine (1996). Upon completion of Vehicles Directorate at the Air Force Research Laboratory, Kirtland his Master’s degree, he worked for the Easter Seals Treatment Air Force Base, New Mexico. She also served as the Director Center in Rockville, Maryland as an audiologist and speech- of the Space Technology Directorate at the Air Force Phillips language pathologist and received certification in both areas. AIAA SPACE 2007 Conference & Exposition AIAA 2007-6076 18 - 20 September 2007, Long Beach, California The Globalization of Space – The Astrosociological Approach Marilyn Dudley-Flores* and Thomas Gangale† OPS-Alaska, 2262 Magnolia Avenue, Petaluma, California 94952 USA [Abstract] The primary author coined the phrase “globalization of space” in the 1990s in lectures and presentations, thus the term was conceived in the sociological record. And, though texts and journal articles on sociology are full of studies of the phenomenon of globalization, sociologists are not serious about the study of those aerospatial events that made possible the extent of modern globalization. And, although it is in their purview, they do not keep track of advancements in the aerospace industry that can provide clues to where globalization is taking human societies. On the other hand, the “globalization of space” is referenced by a host of organizations connected to the aerospace community (i.e., NASA, the Air Force Academy, et al.). However, to the reverse of the sociological community, aerospace organizations have little concept of social factors at varying levels of analysis that can provide clues to where human societies are heading in space – a destination that will impact aerospace industries. The authors advocate for taking the astrosociological approach, a merging of social science and aerospace perspectives in order to examine the coming benefits and challenges to the globalization of space.
