During the COVID-19 Epidemic Rates of Domestic Violence are surg¡ng globally, nationally and are feared to be on the rise locally! "Those of us is the elder justice community know that social isolation is one of the greatest risk factors for elder abuse. We cannot let one catastrophe breed another. Staying connected, phoning older adults, checking on an older neighbor, writing a card or letter, can all be positive steps to ensure public safety and social justice," National Center on Elder Abuse. Help put the ELDER JUSTICE PROJECT into contact with those in need.

We can help those in later life, individuals 50 and older, who are suffering from abuse, physical or psychological, or from neglect, and/or financial exploitation living in our Windham County communities. We can also help provide emergent rescue shelter and have funds for transportation.

Brief Description of the Vermont Elder Justice Proiect:

ln 2017, the Southeastern Council on Aging, Senior Solutions, was awarded a Department of Justice grant to coordinate a Multi-Agency response to abuse in later life. The target audience was individuals 50 and older who were suffering from abuse, neglect, or financial exploitation perpetrated by someone in an ongoing relationship (e.9., spouse, family member or caregiver). This grant's objectives to address abuse, neglect, and financial exploitation are incorporated into the Vermont State Plan on Aging as a pilot for initiatives in Elder Justice throughout the state.

Dear Members of the Nonruich Select Board

I am writing to you about a recent incident that I'm certain you are aware of concerning an individual who was behaving in an "erratic" manner on Turnpike Rd.

What I am relating is all second hand from the list serve and some second hand conversations. Apparently the Norwich Police was contacted, but related that there was nothing they could do unless the individual was trespassing or engag¡ng in some criminal behavior. What concerned me was that if the individual had suffered a cardiac arrest or a broken leg, he would have undergo an evaluation, but because this individual may have been undergoing a psychiatric / behavioral crisis no health evaluat¡on was offered or carried out.

I would like to summarize my communications with Roger Arnold. As you know, there is a currently a national debate as to what the role of policing is in our soc¡ety. I want to be transparent in that I am neither supportive of defunding police departments nor am encouraging the trend to militarize the police. What appears to be contributing to the mishandling of mental health issues and escalating conflicts, by police officers is that they are ill prepared or overwhelmed by the demands placed upon them. I don't know what Non¡¡ich requires as a minimum level of education for one to apply for a position to our police department, but would like to know?

I think that a consensus is being reached by both police reform activists and police officers, in that they are in agreement that law enforcement is asked to handle too many of society's problems. I don't believe that an expectation that all police officers become mental health care workers or experts in conflict resolution is realistic.

I would first like to suggest that the Select Board / town administration consider a review the 911 calls that are received and the number responses that require police make a mental health evaluation or help resolve a conflict. I also realize that probably other

1 surrounding towns are experiencing the similar emergency calls. W¡th that data, perhaps the communities could imbed a shared individual with a Masters in Social Work with a focus in mental health and conflict resolution. Sharing such a resource would not be a huge financial investment, and would relieve our police officers of a potential stressful encounter which could result in a bad outcome.

Dear Selectboard,

I am concerned about how long the re-use zone at the dump as been closed. As far as I understand it has been closed due to the covid 19 pandemic. However, I do not understand this logic. Science tells us that the virus spreads mostly through the air. lf people aren't exchanging things in the open air at the dump then they must go to indoor shops and interact with people to get things, putting them at a greater rísk than leaving something in an open-air area and having someone pick it up there later. The risk of fomites is low and people experience that same risk shopping somewhere such as Listen anyway.

Please, can we re-open the reuse zone? Everyone relies on this crucial service of the town. lt especially serves low- income residents and lowers our environmental impact.

This meeting was conducted via teleconference using ZOOM, in order to maintain appropriate physical distance under COVID-19 precautions. Members present: Claudette Brochu, Chair; Roger Arnold, Vice Chair; John Langhus; Mary Layton; Herb Durfee, Town Manager; Miranda Bergmeier, Assistant to the Town Manager.

1. Approval of Agenda. Selectboard (SB) members agreed to defer agenda item#14 (NEMRC Bulk Time Agreement) until a future meeting.

2. Public Comment. Linda Cook said the Blood Hill residents may be putting together a petition. Gered Dunne said he is concerned about speeding on Union Village Road. He thinks it may be safer to have the blinking speed sign moved farther up the hill. Also, Dunne said that maybe speed bumps and another speed limit sign heading up the hill. Dunn also suggested speed cameras for additional enforcement.

3. Consent Agenda. Layton moved (2nd Langhus) to approve the consent agenda, with the exception of the Blood Hill Road letter. Motion passed unanimously. Layton expressed support for not paving Blood Hill Road and said she'd like to know more about plans to pave the road, if any. Brochu said it won't automatically be paved; that possibility was raised in the capital budgeting plan originally under the former DPW director. Layton moved (2no Langhus) to accept as correspondence the letter regarding Blood Hill Road. Motion passed unanimously.

4. Presentation by Norwich Youth Advisory Council. Tracey Hayes spoke about the Youth Advisory Council (YAC) and shared a presentation developed by the YAC. The YAC is a youth-led group focused on building stronger connections between Nonuich youth and their community. Hayes spoke about the activated that have been conducted and planned by the YAC. Brie Swenson said that this is an amazing group of kids who are following through with their planning and doing the work Nina Sablan, a high school student and member of YAC, spoke to say that Tunes on the Trail was a very successful event. Sablan said she has learned about what it takes to plan events and it has been great to connect with Norwich as a community. SB members thanked Sablan for her work and participation.

5. W Elder Project Outreach. Arthur Smith, the Grant Coordinator for the W Elder Project spoke to the SB. Smith talked about the grant as it relates to Windsor County. Under the grant, they are focusing on elders who have experienced abuse, fínancial exploitation, etc. The project looks at identified needs for the target population - elders. Among other activities, the project has provided training to area providers and first responders regarding elder issues. ln particular, they are training those personnel to spot signs and issues around possible abuse. The project is doing outreach in cooperation with area agencies and providers. Smith said the Elder Project is asking the town to help publicize the project's services and other resources. The project works with the local council on again, Senior Solutions. 6. Appointments to Open Positions. There were no applications received for open positions, so the SB did not take up this item.

7 . Lister Request re: Errors and Omissions, 2020 Grand List. Cheryl Lindberq said that the request is to remedy an error related to current use allocation. Layton moved (2no Langhus) to approve the correction to the 2020 Grand List proposed by the Board of Listers relating to property at T42Vermont Route 132, as described in the October 22,2020 memo from the Board of Listers to the Selectboard, which memo is included in the Selectboard meeting packet. Motion approved unanimously. g. Town Plan lmplementation Plan. SB members discussed the reformatted implementation plan as drafted by Brochu. Rod Francis said that the Affordable Housing Subcommittee has been working on the issue of possible land suitable to affordable housing. g. Village Center Designation Request. Rod Francis introduced Richard Amore of the Vermont Department of Housing & Community Development, who reviewed the presentation included in the SB meeting packet, which explained the process and benefits of a Village Center designation. Francis reviewed the proposed boundaries of the village center. Langhus asked if the school is part of the village center, would they qualify for possible grants to address the septic system. Francis and Amore said yes, that is a possibility. Layton said she likes the additions to the village center boundaries. Jaci Allen said Dan and Whits is already interested in some of the benefits of the program. Layton moved (2nd Langhus) to approve the Resolution Authorizing the Application for Villãge Center Designation for the Town of Norwich, as contained in the Selectboard meeting packet. Motion approved unanimouslY.

10. Sept. Revenue/Expense Report. Arnold asked whether it will be a problem that the town won't be getting some of its projected revenue, such as for Tracy Hall rental. Durfee said that most of the revenue is property taxes, which remain steady. Also we are limiting expenditures where possible, so the decreased revenue should not be a significant problem. Arnold said he is interested in hearing about details such as Durfee's reporting about a recent grant to offset Rec Dept. losses due to COVID-19. Durfee talked about financial report; Durfee said he is paying smaller outside agency allocation at one payment; Durfee is working on how to handle the Cemetery Commission's finances going fonruard to streamline the process. Durfee said he will get the budget to SB members at their Ñovémber 11 meeting. Durfee said that a cash receipts report was included in the packet, which should answer Brochu's questions about collected taxes.

11. Solaflect Contract. Durfee introduced the topic of Solaflect net metering agreement. He suggested that the budget process will be a good time to discuss credits. Durfee recommends that the iown's legal counsel should review the proposed net metering agreement revisions. Layton said she has many questions about how to evaluate the proposed agreement. Linda Gray said that Solaflect was selected in 2013 based on a competitive bidding process. Gray said that Solaflect has done a very good job in making sure the town gets all possible solar credits. Bill Bender, of Solaflect, talked about the details of the net metering agreement. Langhus said he agrees that he is not the right person to review the contract because of his relationship with Solaflect personnel. Langhus said he will comment generally on this type of contracUagreement, Langhus gave an explanation of the "exclusivity" clause of the agreement. SB members discussed whether they want to have town counsel review the proposeã contract changes. Layton moved (2nd Arnold) to ask the Town Manager to consult legal counsel on the proposed amendments to the Net Metering Agreement offered by Bill Norwich Selectboard DRAFT Minutes - 1012812020 Mtg Page2 of 4 Bender of Solaflect, inclusive of comments offered by the Energy Committee via Erich Rentz, and then to report back to the Selectboard at its November 11,2020 meeting. Motion approved (3 yes, 0 no, Langhus abstained).

12. Winter Salt Bid. Durfee said that the DPW Director recommends the SB choose Cargill as a salt provider because it is a higher quality product. Layton moved (2nd Langhus) to approve the purchase of winter salt from Cargill at a cost of 69.21 per ton, per the winter salt bid tabulation results contained in the Selectboard's meeting packet. Motion approved unanimously. 13. a. Policy Updates - lncident Reporting, Medical Treatment, and Investigation Policy. Layton asked if this draft policy represents a change from the one previously submitted to the SB. Durfee said no, it is just re-introduced after discussion with the union in recently concluded negotiations. Layton moved (2nd Langhus) to approve as a first reading the draft lncident Reporting, Medical Treatment and Accident lnvestigation Policy, as presented in the Selectboard packet. Motion approved unanimously. 13. b. Transitional Return to Work Policy. Layton moved (2nd Langhus) to approve as a first reading the draft Transitional Return to Work Program Policy, as presented in the Selectboard packet Motion approved unanimously.

14. NEMRC Bulk Time Agreement. SB members previously agreed to defer this item

15. Town Manager Updates. Durfee had previously provided written updates. SB members briefly discussed the goals and process for the upcoming OML training.

16. Climate Change Designated Fund. Brochu requests 2 SB volunteers to draft a fund policy. Langhus volunteered to lead this effort and Brochu volunteers to assist.

17. Executive Session - Union Contract. Layton moved (2nd Arnold) to find that premature general public knowledge about a pending labor relations agreement would clearly place the Selectboard at a substantial disadvantage. Motion approved unanimously. Layton moved (2nd Gere) to enter executive session under VSA S313(aX1)(B) "labor relations agreements with employees" to discuss the union contract with the New England Police Benevolent Association and to include Herb Durfee in the executive session. Motion approved unanimously.

The SB moved into executive session at 9:41 pm.

Layton moved (2nd Langhus) to enter into public session. Motion approved unanimously. The SB entered public session at 9:57 pm.

Layton moved (2nd Langhus) to ratify the proposed Agreement Between Town of Nonruich and New England Police Benevolent Association, dated July 1 ,2018, provided the union drops its two outstanding grievances, as agreed by the union in an emailfrom Sean McArdle to Susan Gilfillan, dated October 28,2020. Motion approved unanimously.

Dear members of the Norwich Select Board,

We are a group of Norwich families whose children part¡c¡pate in Ford Sayre ski programs. As you know, Ford Sayre has been an UpperValley institution since the 1930s and has served thousands of localchildren, instilling in them a love of skiing in all its forms and giving them an opportun¡ty to stay active and healthy during our long winters. The pandemic and, specifically, Vermont's limitations on interstate travel for non-scholastic sports, has thrown the season into doubt for our families. We request your assistance in obtaining an exemption for our children to join their SAU70 classmates and neighbors to participate on this beloved, outdoor, socially distanced team this winter.

Unlike most ski programs in Vermont and New Hampshire that cater to second homeowners from Boston or Connecticut, Ford Sayre is a local program that serves kids from Norwich, Lyme and Hanover. These are the same kids who are already in schooltogether during the day as part of the bi-state Dresden School district, SAU70. Ford Sayre's trails and jumps are in the border towns of Hanover, Lyme, Lebanon and Enfield, NH. We view Norwich-based Ford Sayre skiers' use of these nearby, small, community-based skivenues as safer than alternatives like Killington, Okemo and other central Vermont destination resorts where our children would be in contact with families from outside our own community and beyond our state borders.

We are confident that ski¡ng outdoors - whether Nordic, Alpine or jumping - is an activity that will not jeopardize our primary priorities of keeping our communities safe and our kids in school, To that end, we propose that Ford Sayre athletes and coaches who live in Norwich be allowed to use New Hampshire venues that are proximate to the Vermont border without having to quarantine upon returning home to Vermont.

The New England Municipal Resource Center (NEMRC) and the Town of Norwich VT agree to the following:

l) Starting September 15 2020 NEMRC agrees to offer services to the Town of Norwich at a reduced hourly rate of $l10.00. This is a reduction from our culrent nonnal hourly rate of $145.00 plus travel expenses, Billing will take place weekly and will be billed based upon all hours expended by NEMRC personnel on Town of Norwich projects (travel time will be billed at%this hourly rate).

2) This will include any and all direct work by any NEMRC employee either on-site or off'site pertaining to the Town of Norwich. This agreement does not cover the annual support fee, disaster recovery agreement, maintenance agreements, off-site seminars or any supplies that the Town of Norwich may purchase from NEMRC.

3) The Town of Norwich agrees to purchase a minimum of 96 hours within the year starting September l5th 2020 and ending September l4th202t. There is no maximum on the number of hours that can be purchased at this reduced rate during this time period.

4) The Town of Norwich will be billed on September 15th 2021 (ata rate of $l10.00/trour) for any unused hours that did not meet the minimum of 96 hours as agreed above.

This policy establishes procedures for the report¡ng of all work-related incidents when an injury occurs that is treated via first aid or actual medical treatment in the form of a vis¡t to a medical provider. lncidents with no medical treatment or first aid do not fall under this policy.

This policy also establishes a designated medical provider for all Workers' Compensation injuries, in compliance with Rule L2 of the Vermont Workers' Compensation Rules.

Lastly, the policy outlines specific procedures to be used in recording and following-up on work- related injuries. The Norwich, VT Emplovee lncidentlniurv Review Report form must be used to document information regarding employee injuries for filing Workers' Compensation claims and to identify loss prevention opportunities. lt is incorporated into this policy by reference.

Nothing in this policy amends or changes existing contractual rights, obligations or language. Rather, it intends to enhance Norwich's ability to prevent injuries, manage workers' compensation claims in accordance with regulatory requirements, and to obtain the best medical outcomes for employees who experience a work-related injury. l. ReportingRequirement

a. All injuries that occur as outlined above shall be reported to the shift supervisor immediately or as soon as practical (but no laterthan the end of the shift). b. These initial injury reports may be provided in writing, in person, via phone, 2-way radio or other appropriate means. c. The employee shall participate and cooperate with the department head/supervisor in the investigation of the accident (see section lll). d. ln cases where an employee voluntarily delays medical treatment or first aid for a work- related injury until some time after the injury (including those deciding to seek treatment hours or days later), that employee shall promptly notify their immediate supervisor that treatment is desired and shall obtain treatment as outlined in section ll below. e. lf the employee has been kept out of work for medical reasons due to the work-related injury, they shall report their expected absence as required by the Town's Transitional Return to Work Program Policy and provide written documentation from the treating medical provider indicating that the individual has been directed to remain out of work. ll. Care shall be taken to avoid discipline-related issues during the incident review discussion between the supervisor and the injured employee. Any warnings or other disciplinary actions shall take place separately from the incident review process. d. Both the supervisor and the injured employee shall sign the form attesting to its accuracy' e. Also, the supervisor shallcomplete the on-line VLCT First Report of lniury form with the injured employee within 72 hours upon learning of the injury. lf extenuating medical circumstances prevent the employee from participating, the supervisor shall complete the form as soon as possible, using any and all information and assistance available. f. This memo serves to inform you that the Selectboard adopted policy regarding a Designated Physician for Workers Compensation following a work related accident. Workers Compensation law, Rule 12 (copy available at the Town Offices or on-line at VT Dept of Labor) gives employers the right to refer an employee to a particular provider for his/her first medical visit after an injury. ln case of an emergency, it may not be practical to use a network provider. However, in non- emergency situations, the employer maythen request follow up treatment with a network provider. After the employee's first Designated Physician visit, he/she may:

Select their own physician if they meet the following conditions

L. The employee must notify the employer in writing setting forth the employee's reasons for dissatisfaction with the physician designated by the employer; 2. The employee's written notice must identify the physician or medical provider from whom the employee intends to seek treatment.

Please note that Rule L2 states that an employer can refuse to reimburse for medical charges, if these guidelines are not followed, as well as those listed under Rule 12, Section (b) regarding maximum allowable medical expenses.

As such, the Selectboard has selected Alíce Peck Doy Memoriol Hospítøl in Lebanon, NH as their provider. Please speak with your supervisor or the Town Manager's Office, if you have questions regarding the procedure outlined above.

Transitional Return to Work Program (TRTW) Policy

Introduction. Norwich, VT has set up a transitional return to work program (TRTW) for those employees who sustain a work-related injury. The TRTW seeks to match an injured employee's current functional limitations with temporary work assignments that are either modified in some way to match those limitations or with other task assignments that fall within established medical limitations. The contents of this program outline the philosophy and mechanics of program operation.

Policv. By means of temporary job restructuring, offering modified work schedules, and other methods, the Town seeks to enhance the recovery of injured employees by attempting to temporarily match them with duties and tasks that are within acceptable limitations or physical restrictions placed on them by the treating healthcare provider. This program does not guarantee that transitional work assignments are available in all situations. The provision of suitable work assignments is left to the disretion of the Town, depending on elements (e.g., availability of suitable tasks, payroll budgets, and other elements).

Overview. This program intends to help injured employees safely recover from a work-related injury by helping them progress from transitionalwork duties back to their normal duties whenever possible. This program does not address permanent limitations resulting from serious work-related injuries suffered by employees, nor does it an offer of an alternate job or position within the municipality. All duty re-assignments under this program are temporary in nature, subject to the needs of the Town.

Recovering from most injuries normally requires limiting physical activity in some manner. Going to work and performing duty assignments with reduced physical demands helps to maintain physical conditioning that will promote faster recovery and reduce the potential for permanent damage. lt also helps employees maintain a sense of work ethic, self-worth, and helps maintain social relationships, all of which help speed recovery.

The Town will communicate its TRTW to employees at the time of hire and periodically as necessary. The TRTW commitment statement (attachment) is incorporated into this policy by reference and will be posted in prominent areas as a reminderto employees of the program's mechanics and the Town's desire to help employees safely return to full duty after a work- related injury, when feasible.

After injuries are reported, all medical documentation from the treating provider must be provided to the Town Manager. The Town Manager, or the injured worker's immediate supervisor as delegated by the Town Manager, will communicate with the injured worker regarding any transitio¡al duty ass¡gnment(s). This will be based on documents received from the treating healthcare,provider and a review of potential tasks that are available.

The Town Manager and an injured employee's immediate supervisor are responsible for facilitating return to work and coordinating specific work activities with employees. Supervisors are required to support Fair Haven's efforts in this regard and also monitor employee work activities whenever possible.

Post-lniurv. The treating healthcare provider may release the employee to return to work with certain restrictions. To qualify for consideration for transitional duty assignments, the provider must provide a report that clearly identifies the injured worker's physical limitations and defines the physical capabilities of the employee. This is used to help identify possible tasks that fall within the work restrictions. ln cases where it is not clear that identified transitional duties fall within the limitations established by the healthcare provider, the Town or their representative will communicate with the provider to ensure that potential duties are appropriate for that employee.

Offers of transitional duty assignments can be provided to the injured employee using the "TRTW Commitment Agreement" to document the proposed tasks and work conditions of the transitional duties and to outline the responsibilities of both the Town and injured worker. This written agreement can be modified from time to time to reflect changes in duty assignments and as changes occur to the employee's work restrictions. lf a TRTW Commitment Agreement is used, the injured employee and the Town Manager will serve as the signed parties to the agreement.

Per Vermont Workers' Compensation regulations, an injured employee who does not accept an offer of modified duty, may be subject to interruption or termination of indemnity benefits.

Transitional Dutv/Task Listing. The following table lists tasks and/or jobs that could be used to fulfill transitional duty requirements. This list is not comprehensive but, rather, attempts to provide a starting point for the Town when considering transitional task assignments.

Transitional Duty Commitment Agreement

1. Planning Commission held two special meetings on the alleged 0ML violations and a related claim that OML violations would invalidate the Town Plan. This matter has preoccupied the PC for most of October, Commissioners are participating in the OML training scheduled for November 17 ,2020 and are looking forward to clear direction. 2. Development Review Board Next meeting is scheduled for November 19, which likely will be devoted to training and administrative matters. 3. Planning Director: I filed an application for Village Center Designation with Vermont Department of Housing and Community Development (DHCD). The application has been accepted and will be heard by the Downtown Board Novemb er 23,2020.I continue to wok with town legal counsel in support of PC deliberations around OML issues and supporting the integrity of the 2020 town plan. I continue to support the design/permit process for the "Kid's Bridge" from Huntley Meadow to Beaver Meadow Rd. 4. Zoning Administrator: There is one active violation case, a very high zoning enquiry load and strong level of permitting activity.

Part of my responsibilities as Town Fire Chief, is to seek out grant opportunities that benefit the operation of the Norwich Fire Department (NFD). Accordingly, I applied for, and was awarded a micro-grant from the Federal Emergency Management Agency (FEMA). My goal in applying for this specific micro-grant was to secure financial help to purchase and stockpile PPE in preparation for our current COVID response capability, and for any future, unknown need for PPE that may arise.

The cost benefit of acquiring the $3000 Assistance to Firefighter Micro-Grant (AFG) is tied directly to our ability to provide for NFD FF/EMT health and safety, in support of our community mission.

This award impacts the daily operation of the NFD by providing our members a stockpile of the medical grade protective PPE necessary to carry out our mission during the COVID-l9, or any other disease outbreak. By allowing the NFD to stock the requested PPE, the $3000 AFG gives us that increased margin of safety when addressing high risk, low frequency pandemic events.

The daily benefit of efficiently and effectively protecting the lives of NFD FF/EMT first responders is directly linked to our mission fulfillment (protection of lives, property & the environment).
