EARLY, Deputy Section Registrar, Having deliberated in private on 8 April 2003 and 1 June 2004, Delivers the following judgment, which was adopted on the last- mentioned date: PROCEDURE 1. The case originated in an application (no. 69949/01) against the Republic of Cyprus lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by a Cypriot national, Mr Ibrahim Aziz (“the applicant”), on 25 May 2001. 2. The applicant was represented by Drakos S. & Associates, lawyers practising in Nicosia. The Cypriot Government (“the Government”) were represented by their Agent, Mr S. Nikitas, Attorney-General of the Republic of Cyprus. 3. The applicant complained under Article 3 of Protocol No. 1, taken alone or in conjunction with Article 14 of the Convention, that he was prevented from exercising his voting rights on the grounds of national origin and/or association with a national minority. 4. The application was allocated to the Third Section of the Court (Rule 52 § 1 of the Rules of Court). Within that Section, the Chamber that would consider the case (Article 27 § 1 of the Convention) was constituted as provided in Rule 26 § 1. 5. On 1 November 2001 the Court changed the composition of its Sections (Rule 25 § 1). This case was assigned to the newly composed Second Section (Rule 52 § 1). 6. On 23 April 2002 the Court decided to adjourn the examination of the applicant's complaints and declare part of the application inadmissible. 7. By a decision of 8 April 2003, the Court declared the remainder of the application admissible regarding the complaints mentioned above (see paragraph 3). 2 AZİZ v. CYPRUS JUDGMENT 8. The applicant and the Government each filed observations on the merits (Rule 59 § 1). THE FACTS I. THE CIRCUMSTANCES OF THE CASE 9. The applicant was born in 1938 and lives in Nicosia. 10. On 30 January 2001 the applicant applied to the Ministry of the Interior, requesting to be registered on the electoral roll in order to exercise his voting rights in the parliamentary election of 27 May 2001. 11. On 8 February 2001 the Ministry of the Interior refused to enrol the applicant. The Ministry specified that, by virtue of Article 63 of the Constitution, members of the Turkish-Cypriot community could not be registered on the Greek-Cypriot electoral roll. Furthermore, the Ministry informed the applicant that the matter was under consideration by the Attorney-General of the Republic and that he would be informed of any developments. 12. On 27 April 2001 the applicant lodged an application with the Supreme Court against the decision of the Ministry of the Interior. He relied on Article 3 of Protocol No. 1 and submitted that, following the dissolution of the Communal Chambers, the Cypriot government had failed to set up two electoral lists in order to protect the electoral rights of members of both communities. 13. On 23 May 2001 the Supreme Court dismissed the application on the following grounds: “... The right to vote is directly linked to the communal checks and balances which provide for the compilation of separate electoral lists and for separate elections of the representatives of each community. The ideal of democracy – one person, one vote in the person's place of residence – does not provide any grounds for the Court to assume the power to reform the Constitution. Such competence is not vested in us, nor can the judicial authorities claim such power. This would be against the principle of the separation of powers on which the Constitution is based ... Article 63 is contained in Part IV of the Constitution, which governs the matters pertaining to the House of Representatives and provides for the compilation of separate electoral lists in which the members of each community are included. The applicant belongs to the Turkish community and is one of the small number of Turkish Cypriots residing in the part of the territory of Cyprus under the control of the Republic of Cyprus. The denunciation by the applicant of the Turkish invasion and his loyalty to the law do not alter what the Constitution provides with respect to the election of the members of the legislative body. AZİZ v. CYPRUS JUDGMENT 3 Article 5 of the [Election of Members of the House of Representatives] Law makes the right to vote conditional on the provisions of Article 63 of the Constitution. The applicant admits, as it transpires from his counsel's address, that the proviso to which the right to vote is subject under Article 5, if construed literally, excludes the inclusion in the electoral list of any person other than members of the Greek community in Cyprus. Nevertheless, he suggested that this reservation must be interpreted in the light of the current situation in Cyprus, which renders the compilation of an electoral list of the members of the Turkish community impossible. Given this fact, it had to be surmised that when the House of Representatives enacted Article 5 of the Law it had this situation in mind and the impossibility of compiling an electoral list of the members of the Turkish community. Hence, this justified the interpretation of the reservation contained in Article 5 as referring only to those provisions of Article 63 of the Constitution which were rendered inactive. Adopting the interpretation of Article 5 proposed by the applicant would amount to it being reworded. The fact that the legislator was apprised of all the facts relating to the situation in Cyprus and chose to place the right safeguarded by Article 5 under the reservation of Article 63, supports the opposite of what the applicant is suggesting; it indicates an intention by the legislature to subject the compilation of the electoral list to the statutory provisions of Article 63. From the wording of Article 5 we conclude that the legislature's intention was to place the right to vote under the reservation of all provisions of Article 63. This conclusion refutes the allegation of the illegality of the administrative decision under appeal. The second ground on which the applicant's appeal is based is the law of necessity. The necessity of his inclusion in the electoral list ... is derived from the impossibility of compiling an electoral list of the members of the Turkish community. Given this state of affairs, Mr Drakos submitted that the inclusion of the applicant in the electoral list of electors of the Greek community was justified and gave him the right to participate as an elector in the forthcoming parliamentary election. This was justified by the fact that the applicant resided in the areas controlled by the Republic of Cyprus where he operates, having the same rights and obligations as every other citizen. ... Assessment of the necessity relied on by the applicant and the establishment of measures to deal with it ... is a duty that falls upon the legislature. The competence of the judiciary is limited, provided the matter is submitted to it or arises in a case brought before it, to determining the constitutionality of the law ... It is not for the judiciary to assess the need to fill in gaps in the function of the constitutional statutes nor to establish measures to tackle them, which is basically what the applicant pursues with his application.” II. RELEVANT DOMESTIC LAW AND PRACTICE 14. Articles 31, 62 and 63 of the Cypriot Constitution provide as follows: Article 31 “Every citizen has, subject to the provisions of this Constitution and any electoral law of the Republic or of the relevant Communal Chamber made thereunder, the right to vote in any election held under this Constitution or any such law.” 4 AZİZ v. CYPRUS JUDGMENT Article 62 “1. The number of representatives shall be fifty: Provided that such number may be altered by a resolution of the House of Representatives carried by a majority comprising two-thirds of the Representatives elected by the Greek community and two-thirds of the representatives elected by the Turkish community. 2. Out of the number of representatives provided in paragraph 1 of this Article, seventy per cent shall be elected by the Greek community and thirty per cent by the Turkish community separately from amongst their members respectively, and in the case of a contested election, by universal suffrage and by direct and secret ballot held on the same day. ...” Article 63 “1. Subject to paragraph 2 of this Article every citizen of the Republic who has attained the age of twenty-one years, and has such residential qualifications as may be prescribed by the Electoral Law, shall have the right to be registered as an elector in either the Greek or the Turkish electoral list: Provided that the members of the Greek community shall only be registered in the Greek electoral list and the members of the Turkish community shall only be registered in the Turkish electoral list. 2. No person shall be qualified to be registered as an elector who is disqualified for such registration by virtue of the Electoral Law.” Article 5 of the 1979 Election of Members of the House of

OVERVIEW OF THE CONSTITUTION The Republic of Cyprus was born in the early hours of 16 August 1960. On that date the Republic´s constitution was signed by the lst Governor of the Colony of Cyprus, Sir Hugh Foot, the Consul-General of Greece, George Christopoulos, his Turkish counterpart, Turel, and Archbishop Makarios and Dr. Fazil Kutchuk on behalf of the Greek Cypriot and Turkish Cypriot communities. The range of signatories reflected the fact that the constitution of Cyprus did not emanate from the free will of its people, who were not consulted either directly or through their ad hoc elected representatives, but from the Zurich Agreement between Greece and Turkey. The terms of that agreement, outlined in the last chapter, were included in the constitution as fundamental Articles, which could not be revised or amended. The constitution was drafted by the Joint Constitutional Commission created under Part VIII of the London Agreement of 19 February 1959. It comprised representatives of Greece, Turkey, the Greek Cypriot community and the Turkish Cypriot community. But the structure of the constitution again reflected the Zurich Agreement, with various provisions from the 1950 Greek constitution also incorporated along with the provisions of the European Convention of Human Rights in respect of fundamental rights and liberties. Two main principles underpinned the constitutional structure agreed at Zurich. The first recognised the existence of two communities on the island - the Greek and the Turkish - who, despite their numerical disparity, were given equal treatment.

Forsyth, Advisor This study examines the role of both the United States and Great Britain during a series of crises that plagued Cyprus from the mid 1950s until the 1974 invasion by Turkey that led to the takeover of approximately one-third of the island and its partition. Initially an ancient Greek colony, Cyprus was conquered by the Ottoman Empire in the late 16th century, which allowed the native peoples to take part in the island’s governance. But the idea of Cyprus’ reunification with the Greek mainland, known as enosis, remained a significant tenet to most Greek-Cypriots. The movement to make enosis a reality gained strength following the island’s occupation in 1878 by Great Britain. Cyprus was integrated into the British imperialist agenda until the end of the Second World War when American and Soviet hegemony supplanted European colonialism. Beginning in 1955, Cyprus became a battleground between British officials and terrorists of the pro-enosis EOKA group until 1959 when the independence of Cyprus was negotiated between Britain and the governments of Greece and Turkey. The United States remained largely absent during this period, but during the 1960s and 1970s came to play an increasingly assertive role whenever intercommunal fighting between the Greek and Turkish-Cypriot populations threatened to spill over into Greece and Turkey, and endanger the southeastern flank of NATO.

    BUJSS 9/2 (2016), 99-115 DOI: http://dx.doi.org/10.18221/bujss.33634 * ETHNIC NATIONALISM AND CONSOCIATIONAL DEMOCRACY IN CYPRUS 1 Pinar Erkem ABSTRACT The 1960 Cyprus Republic, which had a bi-communal power-sharing system, could not have lasted for long and it turned from consociational democracy to majoritarian in 1963 after ethnic conflict. Attempts to find a solution to Cyprus problem still focus on ethnic power-sharing but the conditions and bi-communal relations prior to 1960 system, which are conducive to its failure, are not adequately consumed. The paper argues that, the reasons for the prolonged conflict derive from ethnic rivalry and lack of an overarching loyalty. Modernization, kin-state relations and colonial policies are the contributing factors. This paper aims to contribute to future institutional designs for not only Cyprus but for all divided societies.     The Cyprus Question and the Role of the UN: An Overall Assessment Andreas Theophanous Odysseas Christou Since its creation the Republic of Cyprus has had a very turbulent history. From the outset the geopolitical implications of the Treaty of Establishment, the Treaty of Alliance, and the Treaty of Guarantee on the one hand and the particular characteristics of the Cold War on the other were not fully understood. Domestic tensions as well as foreign interventions led eventually to the cataclysmic events of the summer of 1974. Fifty years after the establishment of the Republic of Cyprus, this island-state faces critical problems and multidimensional challenges.1 The greatest challenge remains the reestablishment of the territorial integrity and unity of the country. Prior to the Turkish invasion of 1974, the basis of the intercommunal negotiations revolved around the establishment of a unitary state with elements of local and communal, self-administration on issues of low level politics. Since the latter part of the 1970s, the model for the solution to the Cyprus problem, according to conventional orthodoxy, has essentially been a bizonal bicommunal federation.2 Yet despite successive and repeated rounds of intercommunal negotiations under the auspices of the UN and the support of the international community there has not been an agreement.3 In fact, the problem remains unresolved while the gap between the two sides is widening. Thus, it is not surprising that to the present day the bizonal bicommunal federation does not yet have a commonly accepted precise definition. Besides it is indeed doubtful whether the implementation of such a model could lead to stability and cooperation.4 Historical Background and Context Cyprus is the third largest island in the Mediterranean, located approximately 70 km to the south of Turkey.

    13 Points (30 November 1963) An Introduction The constitutional structure of the Republic of Cyprus which resulted from the 1960 Zurich and London Agreements suffered from fundamental defects which impeded the smooth functioning of the State. The fact that the Constitution did not emanate from the free will of the Cyprus people but was imposed upon them by virtue of the agreements was at the origin of feelings of discontent among Cypriots. Moreover many of the constitutional provisions conflicted with international law e.g. the fact that the Constitution could not be amended, rendering the Republic of Cyprus subject to the will of the guarantor powers and depriving it of the fundamental requirements of the state such as internal independence and territorial supremacy. Other provisions promoting communal segregation prevented the smooth functioning and development of the country and created permanent sources of friction between Greek and Turkish Cypriots. The ratio of participation in the public service attaining 30 per cent for the Turkish Cypriot community (which represented 18 per cent of the population) constituted one of the causes of discontent for Greek Cypriots as it offended the international accepted principle of the right of everyone of equal access to the public service of his country. The constitutional provision relating to separate majorities for the enactment of certain laws in the House of Representatives was another source of serious problems affecting the smooth functioning of the state which was left without any taxation legislation for several months. Another element that created problems was the right of final veto accorded to the President and the Vice-President of the Republic against any law or decision both in the House of Representatives and the Council of Ministers.

The population of Cyprus during British rule and at the time of its independence was composed of 82 percent of Greeks and 18 percent of Turks. The Greek community included the small Christian communities of Maronites Armenianians and Latins making up approximately 2 percent of the population who opted to belong to the Greek community under the provisions of Article 2.3.of the Constitution.

The aim of this paper is to provide for a systematic account of the different variations of the bi-communal principle enshrined in the Constitution of the Republic of Cyprus and in the Annan Plan as the most comprehensive proposal for the reunification of the island. In order to achieve its scope, the paper focuses on the provisions concerning State institutions and citizenship. It argues that in all those constitutional structures State-building is not linked with nation-building. In fact, the acceptance of bi-communalism as a fundamental principle of the united Cyprus proves that the main concern has been the accommodation of the political tensions resulting from a divided society.   • The Experience of Cyprus with Electoral Politics Did Not Begin with the Island’S Advent to Independent State­ Hood
    This brief paper is no more than a research note aiming to offer some hints on the electoral history of Cyprus and op the nature of sources of pertinent data that might be of interest to students of political change and political behaviour. Considered in a comparative framework this entirely unexplored material appears quite promising as a source for the study ofpolitical mobilization and political cleavages in the context of a changing society. In the perspective of Cypriot history, these phenomena are charac­ terized by particular complexity given the multidimensional nature of political conflict in an ethnically segmented society, highly vulnera ble to external influences because of its geographic location and histo­ rical ties. Accordingly political change as registered in electoral poli­ tics, has been the product of .conflict on four distinct but interconnect­ ed levels: intracommunal social and political conflict; intercom­ munal antagonism escalating in violent ethnic conflict; native resis­ tance to the foreign colonial regime whose establishment, however, i- naugurated the process of modernization; and finally international conflict among external powers w ith interests in the strategically sen­ sitive geopolitical space of the island. It is amidst all these interloc­ king pressures and tensions that the contest of democratic govern­ ment through electoral participation had to be fought. The systema­ tic study of the relevant evidence therefore, eould derive fruitful itisi ghts in connection with some central empirical, but also evaluative, concerns of political analysis. The aim of this paper is to provide for a systematic account of the different variations of the bi-communal principle enshrined in the Constitution of the Republic of Cyprus and in the Annan Plan as the most comprehensive proposal for the reunification of the island. In order to achieve its scope, the paper focuses on the provisions concerning State institutions and citizenship. It argues that in all those constitutional structures State-building is not linked with nation-building. In fact, the acceptance of bi-communalism as a fundamental principle of the united Cyprus proves that the main concern has been the accommodation of the political tensions resulting from a divided society.
