Minutes of Meeting of the Environment and Regeneration Committee held in the Guildhall, Derry on Wednesday 5 December 2018 at 4.00 pm

Present: - Councillor Reilly (Chair); Aldermen Bresland, Ramsey and Warke; Councillors Campbell, Duddy, Duffy, Dobbins, D Kelly, Jackson, Hastings, R McHugh and Tierney.

The Director of Environment and Regeneration read the Notice and Summons for the Meeting.

ER283/18 Apologies

The Director of Environment and Regeneration completed the roll call. Apologies were received from Alderman Hussey.

ER284/18 Declarations of Members' Interests

Councillor Hastings declared an interest in item 7 – Lease/Procurement of Waste Transfer Station.

ER285/18 Welcome to the new Deputy Chair

The Chair congratulated Councillor Jackson on his new role as Deputy Chair of the Committee and wished him success in fulfilling the role.

ER286/18 Merry Christmas

As this was the last Meeting of the Committee before Christmas. The Chair extended festive greetings to the Members of the Committee, the staff of the Environment and Regeneration Directorate and the Members of the press in attendance.

ER287/18 Christmas Lights in Strabane

After being invited to address the Committee by the Chair, Councillor R McHugh reminded Members that enthusiasts in Strabane had raised money and purchased Christmas lights for the Strabane area last year. He informed Members that these persons now wished to donate these lights to Council, under the condition that they be used in the Strabane area. He proposed that Council accept this donation as this would pose minimal cost to Council considering the brackets for the installation of the lights were already in situ.

The Director of Environment and Regeneration sought clarity from the Member in terms of a proposal advising that this be included in the minutes to be ratified at Full Council.

The Committee

Recommended that Council accept the donation of Christmas lights from Irish Language enthusiasts under the condition that they be used within the Strabane area.

ER288/18 Christmas Lighting in Rural Areas

After being invited to address the Committee by the Chair, Alderman Devenney congratulated Council on the Spectacular Christmas light displays in the more rural areas within Council, particularly the Faughan and areas. He queried if lighting for the Bready, Ballymagorry and Park areas could be considered for next year.

Alderman Bresland concurred with these comments.

In response the Head of Environment and Regeneration clarified that Christmas lighting was subject to funding but that this could be considered as part of the Rates Estimates process for next year.

ER289/18 Bio- Digester Concerns

Alderman Devenney raised concerns surrounding the environmental impact of bio-digesters and allegations of flaws in planning processes and enforcement for bio-digesters. He suggested that a meeting be arranged to discuss the matter with the Council’s Planners, the Enforcement Section and the Environment Agency on this issue.

The Director of Environment and Regeneration advised that an update on this could be presented to the Planning Committee for Members to consider further action on the matter. In response to Alderman Devenney’s concerns on the time scale of this, the Director of Environment and Regeneration advised that there were difficulties in organising and deciding who should attend such a meeting. She added that whilst this was not the business of Environment and Regeneration she would seek direction from Members as to what action to take.

In response to Alderman Bresland echoing his suggestion of round table talks as he had received complaints of this nature from constituents in the Bready area, Alderman Devenney added that this issue was not specific to one area.

Councillor Tierney proposed that a report be presented to the Planning Committee surrounding this issues and actions decided at that stage.

Councillor D Kelly clarified that this issue had arisen from the legacy Department of Environment Planning department and did not put Council’s planning processes under question. He concurred with the Director of Environment and Regeneration regarding the difficulty of organising discussions and suggested that presenting a paper to the Planning Committee would be appropriate.

Councillor Hastings highlighted the need for enforcement action to deal with this issue within the Council area and suggested that it would be appropriate for a report on the issue to be presented to the Planning Committee.

In response to a query from Councillor Tierney, the Director of Environment and Regeneration clarified that while not all Members could vote at the Planning Committee, all Members can attend and speak on a non-planning decision matter if they so wished.

Recommended that a paper to update Members on the issue of Bio-digesters be presented to the Planning Committee.

ER290/18 Confirmation of the Open Minutes of the Environment and Regeneration Committee held on Wednesday 14 November 2018

The Open Minutes of the Environment and Regeneration Committee held on 14 November 2018 (ER248/18-ER272/18) were confirmed and signed by the Chair.

Matters Arising

ER291/18 ER255/18- Burnt Out and Abandoned Vehicles

In response to a request from Councillor Tierney, the Head of Environment and Regeneration clarified that an update report on the performance of the removal company which held the contract with Council would be presented to the Committee within a 3 – 6 month period.

ER292/18 ER257/18- Fly - Tipping at Mews Lanes

In response to a query from Councillor D Kelly, the Head of Environment confirmed that a report concerning the above matter would be brought to the January Meeting of the Committee.

ER293/18 ER264/18 Memorandum of Understanding- Winder Gritting

In reply to a query from Councillor Dobbins, the Head of Environment said he had been assured by Transport Northern Ireland that all 400 grit boxes would be replaced. He advised Members to liaise with himself for queries surrounding specific boxes.

ER294/18 ER253/18 Royal Mail Postbox on Chapel Road

The Regeneration Manager clarified that Royal Mail had removed the post box in Chapel Road for Health and Safety reasons and that it had been replaced. He added that communication was taking place with Royal Mail and an update of any other situation where historic post boxes may need to be removed would be presented to the next Meeting of Committee.

In response to a query from Councillor Kelly, the Regeneration Manager was unable to clarify if this post box had been a listed feature of the Church curtilage, but would check this out and update within the context of an update report to a future Environment and Regeneration Committee. The Regeneration advised members that if they had any specific/similar issues relating to historic post boxes, that he would welcome any information which could be incorporated within Council’s follow up communication to Royal Mail.

In reply to questioning from Councillor Reilly, the Regeneration Manager advised that the process of getting such features listed status would be a matter for DFC Historic Environment Division (HED) and that Officers would make enquiries with HED in this regard.

ER295/18 Lease/Procurement of Waste Transfer Station

The Head of Environment presented the above report, a copy of which had previously been circulated. He explained that the purpose of the report was to advise Members on the outcome of a recent exercise seeking Expressions of Interest with regard to the lease/procurement of a Waste transfer Station.

The Committee Recommended that Council approve engagement with RiverRidge in terms of the Lease/procurement of the Waste Transfer Station with a further report to be presented to Members in due course.

ER296/18 Applications Processed under Building Regulations (NI)

The Head of Capital Development and Building Control presented the above report, a copy of which had previously been circulated. He explained that the purpose of the report was to advise Members of applications processed under Building Regulations (NI) between 1 October and 31 October 2018.

ER297/18 Proposed Disabled Parking Bay

The Head of Environment presented the above report, a copy of which had previously been circulated. He explained that the purpose of the report was to advise Members of correspondence received in November 2018 from Transport Ni, network Development Section, regarding proposed disabled persons’ parking bay at Mountjoy Street, Derry.

Members noted the content of the report.

ER298/18 Six Monthly Progress Report - Environment and Regeneration Directorate

The Director of Environment and Regeneration presented the above report, a copy of which had previously been circulated. She advised that the purpose of the report was to present Members with a six monthly update in relation to progress against the Environment and Regeneration Annual Service Plan for 2018/19.

The Chair welcomed the report, thanked Officers for all the beneficial work which had been completed and praised the partnership between Council and Central Government.

In response to a request from Councillor D Kelly, surrounding work completed in Beechmount, Strabane the Director of Environment and Regeneration advised that a report there on would be presented to the next Committee.

Members welcomed the report and commended Officers on their achievements.

ER299/18 Heritage Angel Awards 2018

The Regeneration Manager presented the above report, a copy of which had previously been circulated. He advised that the purpose of the report was to inform Members of the Heritage Angel Awards NI Ceremony which took place in the Guildhall on 6 November 2018 and provide update on the outcome of the awards and in particular the DCSDC shortlisted projects.

The Regeneration Manager advised the Committee that the Mayor had recently confirmed his intention to host a civic reception on Thursday 10 January 2018 at 7pm in the Guildhall. The Chair invited Members of the Committee to also attend this civic reception.

Members acknowledged the success of hosting the Heritage Angel Awards in the City and raising the profile of heritage. Members also recognised the success of the Walled City Partnership Townscape Heritage Initiative in winning their Heritage Angel Award.

1 Purpose of Report/Recommendations

1.1 To advise Members of applications processed under Building Regulations (NI) between 1 November and 30 November 2018.

2 Background

2.1 Applications:

During the period, 1 November and 30 November 2018, 469 applications have been received for assessment involving 469 individual addresses.

3 Key Issues

3.1 Certifications:

417 Building Notice Applications were approved 16 Notice applications were approved for the Affordable Warmth Scheme. 66 Full Plan applications were issued with Approval Certificates, covering 80 sites. 47 Regularisation applications were issued with Regularisation Certificates.

3.2 Inspections:

1000 inspections were carried out in this period including 262 commencement inspections and 320 completion inspections, of which 298 were deemed satisfactorily complete.

184 Property Certificates were received in the report period, of which 90.8% were processed within 10 working days and the overall average response rate was 10.4 working days.

3.4 Income Generated

The total income generated by the Building Control Section in the 8 months to the end of November 2018 was £634,752.17.

3.5 In the 8 months to the end of November 2018 the Building Control Section received applications with a construction value of £58,450,073.00.

Update on the preparation of an Outline Head of Environment Business Case for the Development of a Regional Crematorium Author:

1 Purpose of Report/Recommendations

1.1 To update Members on progress with the preparation on an Outline Business Case (OBC) with regard to the development of a regional crematorium.

2 Background

2.1 Members will recall previous items setting out the detail with regard to Council agreeing to progress options for the development of a regional crematorium in partnership with Fermanagh and Omagh and District Councils.

2.2 In consideration of this, Members had previously endorsed a joint procurement exercise to appoint a consultant team to prepare an Outline Business Case with regard to the project.

2.3 On conclusion of the procurement process Cogent Management Consulting LLP were appointed to undertake the preparation of the OBC on behalf of the three participating councils.

3 Key Issues

3.1 Cogent have been progressing with the drafting of the OBC as per the terms of reference and have met with the officer team on a number of occasions to discuss and agree aspects of the work.

3.2 Whilst significant progress has been made with the majority of the OBC the consultant team have highlighted issues with regard to the legislative provisions enabling District Councils to bring forward proposals with relating to the development and operation of crematoria within Northern Ireland.

Page 143 3.3 The legislative arrangements in place at present were prepared to support the development and operation of the Roselawn Crematorium by Belfast City Council. There are however different and conflicting views on how these can be applied by others – both in the public and private sectors – considering the development and operation of crematoria in other parts of Northern Ireland.

3.4 Officers have requested further legal clarification on this matter so that the consultant team can progress with the appraisal and evaluation of options as required under the OBC process.

3.5 Once received the legal advice will be forwarded to the consultant team to enable them complete and submit the OBC to all three Councils. It is anticipated therefore that the completed report will be brought back to Members for consideration in the early spring.

2.1 Members may recall previous E&R item ER267/16 setting out the background to this matter and advising on the approach that Council had adopted in terms of addressing the issues relating to the condition and dumping that occurs on laneways across the City.

2.2 In summary, the report set out issues relating to ownership and the problems that this presented in having laneways cleaned and maintained whilst also setting out the position with regard to budgets / funding.

2.3 In addition, the report highlighted the actions that Council had and continues to take with regard to the issue with Members endorsing the approach as set out in the item.

3 Key Issues

3.1 In reviewing the number of mews lanes, officers have determined that there are approximately 236 laneways across the city. The majority of waste related issues occur in a relatively small number of lanes across the City centred in Rosemount, Lower Strand, Spencer / Chapel Road and Bond Street.

3.2 The appearance and quality of the local environment is of particular importance to those living on or adjacent to these lanes.
