Members from all Parties thanked the deputation and commended them on their comprehensive presentation. Members then raised the following issues:

- Welcomed NIE’s apparent preparation for winter and commended those staff who worked in all weather conditions to repair damage caused by extreme inclement weather. - Enquired if the £500M referred to in the presentation had been set aside for additional works to be carried out? - With regard to renewable energy concern that many who had installed turbines and other types of generators were unable to access the grid. If this service was to be contracted out how effective might it become? - Commended the apparent dedication of NIE staff. - Reference to complaints received from businesses in Spencer Road regarding the continuous blackouts being experienced in the area resulting in the cancellation of a number of private functions and a considerable loss of revenue at this seasonal period. Could assurances be given that this problem would be addressed? - With regard to NIE’s 6 Year Plan would it be possible to sustain the current 1,200 employees or was it anticipated that this number would expand? - Concern at the exorbitant connection fee (in excess of £100,000) in respect of anaerobic digesters for customers in rural areas who had already experienced serious delays in having this service provided. - Concern that electricity charges in Northern Ireland were much more expensive that the rest of the UK and enquired if these would be reduced by the installation of the North/South inter-connector.

Mr Feeney and Mr Byrne responded as follows:

4 Page 26 - It was anticipated that the £500M referred to would be invested in the network in the following five year period. NIE had a current asset value of £5 billion. - In relation to renewables and problems being experienced in terms of connecting to the grid there were congestion issues and the cost to the consumer for renewable generators to address this was massive. In terms of target setting there was sufficient connections to achieve the targeted 40%. Per connected customer in a UK context, there had been more connectable energy sources in NI than in any other area. However acknowledged that some problems were being experienced in relation to small scale distributors and the returns were not worthwhile for those connected to a small scale generator. NIE were not in a position to address this problem. - Apologised for continuous problems being experienced in Spencer Road and committed to investigate the specifics in relation thereto. - NIE had submitted its proposed investment for the coming 6 year period which would be subject to a regulatory process and the Regulators would ultimately decide on investment levels. It was not anticipated that there would be any significant change in employee numbers and that these would remain around 1200 unless decided by Regulators. NIE tended to have more core employees and less contractor compared to other businesses across UK. - Advised that the North/South Inter-connector was linked to capacity and growth in the 2020 timeframe. The purpose of the Interconnector was to reduce energy costs with potential customer savings of £120M being achieved. Both SONI and the Regulators were committed to the building of the North/South Inter-Connector and a strong business case had been prepared. The Inter- Connector was currently in the planning process and it was anticipated that Planning permission would be granted in respect of this structure. - Explained that there were a number of costs which contributed to the electricity bill. Having recently benchmarked their network costs in a UK perspective, NIE costings marked well. - Advised that NIE were not responsible for the policy in relation to connection fees for anaerobic digesters. This was the responsibility of the Utility Regulator. The policy was specified that the connecting Party was responsible for voltage costs and payment was in accordance with the level of voltage used. NIE’s connection costs were compared and it was anticipated would be open to market competition in the future. Advised that there had been an

5 Page 27 unprecedented level of connection to the grid in the past number of years.

The Chairperson then thanked the deputation for their presentation and they withdrew from the Meeting.

Chairperson’s Business

ER259/16 Transport NI Gritting Policy

The Chairperson raised the issue of gritting footpaths in key urban areas during icy conditions and asked that Officers urgently consider options to enable these areas to be gritted.

With the permission of the Chairperson, the Director of Environment and Regeneration referred to confusion regarding who was responsible for gritting of roadways/pavements.

The Director of Environment and Regeneration explained that Transport NI had powers to grit roadways/pavements and stated that there was currently a memorandum of understanding between Council and Transport NI whereby they would call on Council for assistance during periods of prolonged and severe weather. She continued that to date Transport NI had not requested such assistance from Council this winter. She advised that Officers had met with Transport NI during the recent cold spell to discuss this issue and were currently satisfied with the existing arrangements. She pointed out that Council could consider arrangements over and above the memorandum of understanding however there were no budgetary provision or current arrangements in place to do so.

The Director of Environment advised that Officers were considering a number of options for consideration by Members however, these might have significant budgetary implications. She advised that these could be considered through the rates estimates process.

In response to concerns expressed by a Member of the DUP grouping regarding the dangerous condition of the Peace Bridge, the Director of Environment and Regeneration explained that the Peace Bridge had been adopted and was the responsibility of Transport NI and was therefore regarded the same as other footways throughout the City centre.

6 Page 28 A Member of the UUP grouping referred to the need to be mindful of other areas throughout the Council district. He enquired as to the potential benefits of identifying all areas of concern which should be treated. He commended the excellent work being carried out by community groups and stated that gritting services had to be made available to all.

A Member of the SDLP grouping referred to the number of accidents which had occurred during the recent cold spell. He stated that it was important that any formal arrangements were activated as soon as possible and referred to the importance of such arrangements being implemented early in the day.

An Independent Member of Council who was a non-Member of Committee, in referring to the number of historically dangerous areas which existed which prevented people coming into the City centre welcomed any process which would address this issue. He expressed concern that during the recent cold spell the fountains in Guildhall Square had been not been turned off until 8 pm in the evening which resulted in extremely dangerous conditions for those entering the Guildhall Square and Waterloo Place. The gritter was in operation at 9 pm which seemed somewhat illogical.

The Director of Environment and Regeneration explained that this year the fountains had been turned off on the first day of the recent cold period. However, it had taken time for the drainage to be complete. She referred to the option of having the fountains turned off when cold weather was anticipated. She recommended that from 2017 the fountains should be turned off at Halloween and reactivated in spring.

A Member of the SDLP grouping referred to the need for an interim plan to be put in place.

An Independent Member of Council who was a non-Member of Committee acknowledged that it was impossible for gritting to be made available in all areas. He requested that Officers investigate complaints received from a number of rural dwellers that salt piles had not been made available in their area as in previous years.

The Director of Environment and Regeneration advised that this was a function of Transport NI and therefore did not envisage that Council Officers would assume responsibility for this task. However she undertook to raise the matter with Transport NI.

7 Page 29 An Independent Member of Council who was a non-Member of Committee expressed concern that the customary 16 weekly inspection of roadways to identify necessary maintenance/repair works had now been extended to 24 weeks. Following these inspections works were graded and if considered to be minor a considerable period of time could elapse until the works were carried out. He stated that this process was totally unacceptable.

The said Member expressed concern that there was only one Gully Cleaner in this area. He pointed out that following the amalgamation of the two Councils there had been a decrease in the number of staff in this Section from 29 to 19 rendering it under-staffed, under-funded and under-resourced to perform their duties. He stated gullies along minor roads were not being cleaned.

The Director of Environment and Regeneration undertook to advise Transport NI accordingly and suggested that the matter be raised at the Special Committee Meeting to receive Transport scheduled for 14 December 2016.

Subsequently the Committee

Recommended that in the future Council Officers, in consultation with Transport NI carry out necessary gritting works at the onset of periods of cold weather to ensure the safety of the general public.

ER260/16 Consultation – Translink

The Director of Environment and Regeneration referred to correspondence received from Translink advising of a consultation which they were carrying out regarding the North West Multi-Modal Transport in respect of which responses were to be received by 20 January 2017. This information was received too late for inclusion on the agenda for the Meeting. She understood this correspondence had also been forwarded to Members.

A Member of the SDLP grouping referred to the importance of responses being submitted to the consultation process given the significance of this issue and encouraged involvement from all sectors. However, he referred to a previous consultation process the outcome

8 Page 30 of which displayed overwhelming support for the reopening of the original Waterside Train Station which had huge potential.

A Member of the DUP grouping that this correspondence be placed on social media to encourage public support.

ER261/16 Confirmation of the Open Minutes of the Environment and Regeneration Committee held on 9 November 2016

Minutes of the Environment and Regeneration Committee held on 9 November 2016 (ER233/16-ER246/16) were confirmed and signed by the Chairperson as correct.

Matters Arising From Minutes

ER262/16 Recycling Facility at Pennyburn (ER239/16)

A Member of the SDLP grouping sought an update in respect of a report requested at the June Meeting of the Committee on options available for collecting information on the amount of waste being disposed of in this Council area by cars with Donegal registrations.

The Head of Environment confirmed that data had been collected however, difficulties were being experienced in determining between users who were resident in the Republic of Ireland and those whose vehicles had a Republic of Ireland registration. He stated that endeavouring to identify and breakdown this information was proving a considerable task however, it was nearing completion. It was anticipated that a report thereon would be presented to the January, or at the latest February Meeting of the Committee.

The said Member referred to the importance of acquiring this information as quickly and accurately as possible.

In response to a query from a Member of the Sinn Fein grouping regarding figures he had requested relating to Play Parks, the Director of Environment and Regeneration undertook to seek additional information in this regard and report thereon in due course.

ER263/16 Bishop Street Car Park – Environmental Improvement Works

The Regeneration Manager presented the above report a copy of which had previously been circulated to Members. He advised that the

9 Page 31 purpose of the report was to update Members on proposals to develop an environmental improvement scheme for the Bishop Street car park and to seek Members’ approval for Officers to progress with preparing an external funding application for this project.

A Member of the SDLP grouping, as a regular user of the car park in question, welcomed these works. He expressed concern however that the lighting at the top end of the car park was continuously broken and was proving a danger and requested that this be addressed.

The said Member requested that a system be installed at Spencer Road car park advising of space availability similar to those facilities in operation at other car parks throughout the City.

The Committee

Recommended that authority be granted to scope out a proposed regeneration scheme for Bishop Street car park and to submit an application to the DFC for external funding support.

ER264/16 Historic Environment Fund – District Council Maintenance Week Catalyst

The Regeneration Manager presented the above report a copy of which had previously been circulated. He advised that the purpose of the report was to update Members on the DFC Historic Environment Division – Historic Environment Fund-Revival Stream Grant and to seek Members’ authority for Officers to accept grant in the sum of £20,000.

In response to a query from a Member of the UUP grouping, the Regeneration Manager explained that there were five conservation areas within the district. He stated that there was limited funding available and it was felt that in terms of requirements and the greater impact Newtownstewart would be the preferred area. He pointed out however that this funding would be available in the future and application would be made in respect of other areas within the City and District.

A Member of the SDLP grouping welcomed this funding.

10 Page 32 A Member of the Sinn Fein grouping enquired if any discussion had taken place with NIEA who had recognised the shortcomings in particular to Newtownstewart. He enquired if there was any scope to augment works being carried out in terms of conservation areas.

The Regeneration Manager explained that this was a discreet issue and there were other proposals coming forward in respect of shop fronts. He referred to the need for a more focused discussion to take place with NIEA which he undertook to discuss directly with the said Member. He stated that work was currently taking place with the Historic Environment Division in terms of a joint resource and the appointment of a Heritage Officer for the City and District.

Subsequently the Committee

Recommended that authority be granted to accept grant from the Historic Environment Division in the sum of £20,000 and for Officers to proceed with the delivery of the project.

ER265/16 Adoption of Fleet Safety Policy

The Head of Environment presented the above report a copy of which had previously been circulated. He advised that he purpose of the report was to seek Members approval with regard to a revised Fleet Safety Policy dated 2016 to replace the previous version dated 2006.

In response to concerns expressed by a Member of the Sinn Fein grouping, the Head of Environment explained that the term ‘Grey Fleet’ referred to employees who use their private vehicle whilst on Council business and claimed mileage and included Councillors. He said unfortunately as the vehicles did not belong to Council the policy could not be applied to individual users. He stated that Council could advise staff and monitor the situation but did not have powers beyond this to enforce the policy on users. He continued that work with Trade Unions was ongoing to determine how additional controls could be introduced.

In response to a query from a Member of the Sinn Fein grouping seeking clarification on this issue, the Director of Environment and Regeneration pointed out that there were general health and safety regulations regarding vehicle use and that discussion would take place

11 Page 33 with Health and Safety Officers and she ensured that Members were provided with clarity regarding this issue.

The Committee

Recommended that Members approve the attached document as the ‘Fleet Safety Policy’ for Derry City and Strabane District Council.

ER266/16 Food and Green Waste Collections

The Head of Environment presented the above report a copy of which had previously been circulated. He advised that the purpose of the report was to provide3 Members with an update on the progress on food and green waste collections within the district.

A Member of the Sinn Fein grouping enquired if there had been any improvement in usage of the food waste collection service and if not how could Council encourage greater public participation.

The Head of Environment advised that unfortunately participation had not increased and stated that it was intended to provide a further targetted Education Awareness Campaign to advise of the benefits of using this facility. He stated that Council would endeavour to achieve 100 per cent participation in the scheme and in attempting to achieve this it may be necessary to consider banning food waste in black bins. However such a situation would not be imminent and would only arise following the conclusion of the Education Awareness Campaign. He stated that this was a serious issue facing all Councils. He continued that in terms of targets being met it was vital that householders maximised recycling initiatives which would also result in financial benefits to Council.

A Member of the UUP grouping suggested that steps be taken to reduce the amount of food waste. He stated that there was a responsibility on supermarkets not to encourage shoppers to overspend and referred to the need for more emphasis to be placed on ‘reducing’.

In response to a query from the said Member, the Head of Environment explained that whilst there was no statutory date for the completion of the roll out of a green waste collection service to households within the Council area, it was anticipated that this would continue to be rolled

12 Page 34 out to all relevant properties. He stated that with maximising participation in the food and green waste collection schemes would reduce the need for black bin collections.

A Member of the Ulster Unionist grouping referred to the importance of all households within the Council area receiving food waste collection.

The Head of Environment referred to information recently produced which stated that the only way that Council would meet its target would be providing weekly food waste collections. He stated that Derry City and Strabane District Council had an advantage over other Councils which would enable it to maximise efficiency within the existing service.

A Member of the SDLP grouping expressed concern that approximately only fifty percent of those households who had received a brown bin participated in the scheme. He expressed concern regarding a number of issues regarding the Food Waste Collection Scheme such as replacing the container bags and a number of instances in the Ballyarnett area when brown bins had not been collected. He said if Council hoped to encourage the public to participate in this scheme it was important to ensure that these issues were addressed. He also referred to the need to address how the scheme would be rolled out throughout the district given the apparent difficulties being experienced with the existing scheme. The Member referred to the need for a large-scale publicity campaign in respect of the scheme.

Another Member of the SDLP grouping praised this initiative. He referred to a possible reduction in the number of black bin collections which could potentially free-up vehicles for use in other areas.

An Independent Member of Council who was a non-Member of the Committee stated that any initiative which produced savings for ratepayers was to be welcomed. He referred to Council’s bulky waste collection service and expressed concern that there was up to two week waiting period to avail of this service which might ultimately encourage illegal dumping. He inquired if this period could be reduced. He referred to the fact that many householders were engaging private businesses to dispose of these objects but were not assured that the items were being disposed in approved sites.

13 Page 35 The Head of Environment explained that there was normally a seven day waiting period in respect of this service which Council provided free of charge to the public. However this did increase at different periods throughout the year. He pointed out that large electrical items such as cookers were generally taken to a scrap yard. Whilst Council was aware of private collections it was not aware of where these item were disposed. He continued that Council had identified rubbish which had been dumped illegally and urged caution to any householder tempted to engage in such activity. He also suggested that householders who had enlisted a private business to dispose of waste should enquire as to where this was being disposed. He stated that fines in respect of waste dumped illegally which had been identified would be the responsibility of the householder concerned.

The Head of Environment stated that ultimately all bulky metal items collected were recycled through a legitimate source. However, he did urge caution in relation to the private dumping of items which were of little or no value.

In response to a query from a Member of the SDLP grouping the Head of Environment confirmed that a bin was used for the green waste collection and was carried out on a fortnightly basis. However, the number of employees involved in the delivery of this service was reduced during the winter period which provided necessary holiday cover therefore providing a more efficient service. He stated that it was hoped to maximise the crew to provide necessary cover and ultimately a more efficient service.

Subsequently the Committee

Recommended that Members endorse the approach as detailed in the report with regard to this matter.

ER267/16 Cleaning of Mews Lanes Within the Council District

The Head of Environment presented the above report a copy of which had previously been circulated. He pointed out that the purpose of the report was to advise Members of Council’s current position with regard to the cleaning of mews lanes.

A lengthy discussion ensued following which Members raised the following issues:

14 Page 36 - Commended the Head of Environment for the comprehensive report. - Welcomed the work carried out by community organisations throughout the City involved in the maintenance and general upkeep of mews lanes. - Suggested that in going forward Officers consider options open to Council regarding the upkeep/maintenance of mews lanes. - Further to Council’s position regarding the maintenance/uptake of mews lanes concern was expressed that whilst not in its ownership Council had carried out maintenance works to the Diamond War Memorial at a cost of £250,000. - Need for Council to consider all requests for assistance. - Commend Council staff on the efficient manner in which they have carried out maintenance/repair works. - Congratulate those community groups who had undertaken these necessary works but acknowledged that in some instances this was not possible due to a lack of resources. - Referred to the need to pursue those individuals responsible for fly tipping and illegal dumping. - Made specific reference to works carried out by community groups to mews lanes in the Ballyarnett where residents had been unable to leave their bins for collection. - Referred to the fact that there was a responsibility on all to ensure that laneways were maintained and the need to have the problem resolved without delay. - Expressed concern at competition between community groups and concern that the issue was being used for political point scoring. - Concern expressed that those living in the areas concern were causing the problem. - Referred to the need for Council to promote a zero tolerance approach in regards to this issue and publish figures in respect of the number of fines issued to perpetrators in respect of such offences. - The need for residents to be vigilant in terms of illegal dumping in laneways. - Expressed concern at suggestions that Council was abdicating its responsibility in relation to the maintenance/upkeep of mews lanes which was an utter fabrication. - Commend those employees concerned on their response and the excellent work carried out in relation to the maintenance/upkeep of mews lanes.

15 Page 37 - Whilst referring to the responsibility on neighbourhoods in terms of the upkeep/maintenance of mews lanes/laneways acknowledged difficulties because of the transient nature of residents which had to be addressed. - Referred to the need for Council to be more creative in terms of dealing with those responsible for illegal dumping. - The need to make residents aware of their responsibility to maintain alleyways/laneways outside their properties. - Referred to the responsibility on other Agencies in relation to enforcement and targeting offenders. - Enquired as to the number of prosecutions in this regard which might provide some reflection on how successful Council was in addressing this problem. - Referred to the need for an audit of the sites concerned. - Referred to the need to establish responsibility for the carrying out of maintenance/upkeep works to laneways/alleyways. - Referred to the need to establish costings involved in the carrying out of these works. - Whilst not suggesting that Council was abdicating its responsibility in this regard but expressed concern that when contacted by members of the public to have cleaning works carried out members of the public had been advised that this was not the responsibility of Council. Subsequent concerns that ratepayers money had been used for maintenance works to the Diamond War Memorial. - Commended Council staff on their efficiency in dealing with the 300 bags of refuse collected from laneways during the previous week. But expressed concern that regardless of these works having been carried out the problem continued.

The Head of Environment advised that to date since April 2016 147 incidents of fly tipping had been reported and investigated. 48 penalty notices were issued.

The Head of Environment advised that in 2015 315 incidents had been reported and investigated. 374 fixed penalty notices were issued. He advised that all incidents reported to Council were investigated.

A Member of the SDLP grouping sought clarity in regards to the figures. He said he did not feel they reflected the severity of the problem. He said evidence would suggest that the problem was much greater and Council was experiencing difficulties in terms of

16 Page 38 successfully prosecuting offenders. However he urged that this work continue.

In response to a suggestion from a Member of the DUP grouping, a Member of the SDLP grouping suggested that to fine the owners of contaminated bins would surely increase the incidence of fly tipping.

Subsequently the Committee

Recommended (a) that Members endorse the approach being taken by Council to deal with this issue; and

(b) that Council Officers (i) prepare a report outlining options available to Council for consideration which would facilitate the development of a strategy of working together to ensure the upkeep/maintenance of the area and also (ii) provide information on the number of mews lanes/alleyways throughout the City and district and the financial implications of the maintenance thereof to Council; and (iii) identify which statutory organisations/agencies had responsibility for mews lanes/alleyways and include them in this process.

ER268/16 Newtownstewart – Shopfront Enhancement Scheme

The Regeneration Manager presented the above report a copy of which had previously been circulated. He advised that the purpose of the report was to update Members on proposals to develop a shopfront enhancement scheme in Newtownstewart and to seek Members approval for Officers to progress with preparing an external funding application for this project, including the appointment of an architect to develop proposals to planning stage.

A Member of the UU grouping welcomed this scheme and anticipated that this would be a pilot for other rural communities. He state that in the past such schemes were in respect of urban areas and previously there had also been cross-border schemes.

17 Page 39 In response to a query from the said Member, the Regeneration Manager confirmed that he £15,0000 commitment from Council was in respect of administrative costs.

The said Member anticipated that this was the beginning of a process.

A Member of the Sinn Fein grouping welcomed Council’s pro-active approach in this regard. He assumed the project was solely in respect of conservation zones.

Subsequently the Committee

Recommended (a) that authority be granted to scope out a proposed shopfront enhancement scheme for selected buildings within Newtownstewart and to submit an application for external funding support through the Rural Development Programme 2014-2020; and

(b) apart from Officer time and input, the only direct financial implications envisaged to Council will be the commitment of £15,000 to support the development of the project.

In response to a request from a Member of the Sinn Fein grouping the Committee agreed that item 28 be discussed in Open Business.

ER269/16 Christmas Lights Budget

The Head of Environment presented the above report a copy of which had previously been circulated. He advised that the purpose of this report was to update Members with regard to the overall budget for Christmas lights and the purchase of additional lighting schemes.

A lengthy discussion ensued during which the following issues were raised:

- Concerns expressed regarding an issue which had arisen in terms of Christmas lighting in Sion Mills. - Outlined the disappointment expressed by the residents of Sion Mills regarding the Christmas lighting display.

18 Page 40 - Acknowledged work carried out by Council throughout the City and district to accommodate communities in terms of the Christmas lights installation. - Whilst the owners of the Christmas lighting supply in Castlederg had donated their stock to Council, in Sion Mills they had refused to do so. - Council Officers had to operate within the limited resources available. - Referred to £5000 which had been made available to community associations in previous years in respect of the installation of the Christmas lights display and if these monies were still available could they be incorporated into the budget of the Department responsible for the installation of Christmas lighting. This could be used to improve the standard of the display in Sion Mills. - Concern that Councillors were being blamed by the local community for the quality of the Christmas lighting display in Sion Mills. - Referred to the tremendous Christmas lighting display in Sion Mills in previous years carried out by the local community. - Concern expressed at the decision of the Sion Mills community not to donate their Christmas lighting display to Council and referred to possible health and safety issues which may have arisen concerning the stock. - Referred to the need for appropriate action to be taken to allay the feeling of community resentment. - Referred to the possibility of this issue being addressed through the community planning process. - Referred to a lack of knowledge among elected representatives regarding the background of this situation. - Referred to the need to reduce hostility among the Sion Mills community in relation to this issue.

The Director of Environment and Regeneration stated that as Members would be aware directly following the amalgamation of the two Councils arrangements had been put in place in respect of the different areas. She stated that in terms of the installation of Christmas lighting, it had been agreed initially that as per previous legacy Strabane District Council arrangements, in the first year, Council had installed the lighting display within the Strabane area and the local communities installed lighting within the areas of Castlederg, Newtownstewart and Sion Mills and received a grant of £5,000 from the community services budget in respect thereof. However, a review of the situation had been carried out when a number of health and safety issues had arisen. She

19 Page 41 advised that Council had initially installed additional infrastructure to enable the installation of the Christmas lighting display more securely and had subsequently met with community groups to discuss the option that Council install the lighting in Castlederg, Newtownstewart and Sion Mills. She stated that agreement was reached in with the community groups in Castlederg and Newtownstewart that Council carry out this task and donated their existing supplies to Council. However, in Sion Mills this was not the case. She stated that discussions had taken place in relation to the nature of health and safety requirements in order to facilitate the safe and secure installation of the Christmas lighting. The community group advised however that they were not able to comply with these requirements. Council Officers subsequently offered to install the lighting display available and carry out testing in terms of safety requirements. However this was also declined. She advised that Council therefore had to consider options in terms of installing a different scheme for the current year which differed visibly from previous years Christmas lighting displays.

The Director of Environment and Regeneration explained that in moving forward Council was anticipating engaging with the local community in Sion Mills and take on board the views expressed by them. In terms of budget allocation for the installation of Christmas lighting displays, this had come from the community services budget made available within the transfer Council and remained within the Health and Communities budget with the intention that it would be used within the area of community services in respect of local community planning issues. She continued that in terms of the provision of Christmas lighting Council had incurred the cost of the installation of displays which would have been met by the original grant. She confirmed that Officers would be willing to meet with the local community in terms of moving forward.

In response to a query from a Member of the Sinn Fein grouping the Director of Environment and Regeneration confirmed that Officers could explore the possibility of future funding in respect of the provision of this service being made available from the community services budget and the matter be subsequently progressed through the Department responsible.

A Member of the UU grouping welcomed the potential within the coming days for an enhancement of the present scheme in Sion Mills. He expressed concern that the local community did not donate their lighting display to Council staff for installation.

20 Page 42 The Director of Environment and Regeneration reiterated that this option had been offered to the Sion Mills community group.

A Member of the UUP grouping welcomed the assistance from Council Officers in this regard.

In response to concerns expressed by a Member of the Sinn Fein grouping regarding the transfer budget, the Director of Environment and Regeneration said she understood the under the former Strabane District Council monies from the community services grant had been allocated in respect of the Christmas lighting installation. She continued that following the amalgamation of the two Councils the cost of lighting installation within Castylederg, Newtownstewart and Sion Mills had been met from within the Environment and Regeneration budget. She advised that further discussion would take place however in this regard.

Subsequently the Committee

Recommended (a) that Members approve the purchase of additional Council lights in the sum of £75,000 funded from savings and efficiencies within the Environment Directorate budget; and

(b) that those monies contained in the transfer budget be allocated to enhance the Christmas lighting displays in Sion Mills, Castlederg and Newtownstewart.

ER274/16 Litter Picking and Grass Cutting Along Rural Roads, Dual Carriageway and Trunk Roads Within District

The Head of Environment presented the above report a copy of which had previously been circulated. He pointed out that the purpose of the report was to advise Members of the Health and Safety issues relating to the provision of street cleansing and grounds maintenance services on dual carriageways, rural and trunk roads in the Derry City and Strabane District Council area.

The Head of Environment said it was anticipated that the cleansing/maintenance works would be carried out as soon as possible and when the necessary procedures were in place.

22 Page 44 In response to a query from a member of the DUP grouping Council’s Streetscape Manager explained that all relevant staff had been trained to T1 and T2 – the minimum required. All relevant safety managers required appropriate training up to T6 and T7 (supervisory standard and this training had now been completed. He stated that it was proposed that in all instances to develop and implement an Action Plan to address specific health and safety concerns on an individual road basis.

A Member of the Sinn Fein grouping queried if works had begun given that the health and safety issues had now been addressed.

The Head of Environment pointed out that the process had begun and risk assessments in respect of each of the roads would be carried out on an individual basis. On roads where speed was not an issue works would be carried out more rapidly than on roads where speed did present an issue where the issue of public safety must be guaranteed.

A Member of the Sinn Fein grouping asked if rural roads, which carried a 60mph speed limit would be assessed on the same basis as perhaps the A5.

The Streetscape Manager explained that where the speed limit on rural roads was 60 mph and not considered high risk it would not be necessary to carry out a risk assessment. This would not be to the same on higher risk category roads. He continued however, that there were some rural roads which were considered high risk and this would be addressed. He advised that it could take considerable time to for the completion of the cleansing/maintenance works to all of the roads concerned

A Member of the Sinn Fein grouping advised that in accordance with Party policy Sinn Fein would be recommending the adoption of 4.4 of the report - 1- In-House Crew.

The Head of Environment advised that Council adopted a pragmatic approach and in accordance therewith the works would be carried out as soon as was reasonably possible in terms of adhering to health and safety requirements.

ER276/16 Sion Mills Heritage Led Masterplan

The Regeneration Manager presented the above report a copy of which had previously been circulated. He advised that the purpose of the report was to update Members in relation to the progress of the heritage-led regeneration masterplan for Sion Mills and next steps.

A Member of the Sinn Fein grouping referred to the need to ensure that the proposed consultation is thoroughly inclusive. He referred to concerns within the local community that where projects which were heritage-led tended to be heritage dominated to the exclusion of other concerns. He referred to the need for all relevant groups to have an opportunity to contribute to the Masterplan.

The Regeneration Manager explained that this was not a conservation scheme and would consider the village in its entirety and all requirements would be addressed.

A Member of the UUP grouping welcomed that the consultation process would be inclusive of the entire community.

SER16/16 Deputation – To receive representatives from Transport NI to present their Works Programme Autumn Report

The Network Development Manager (NDM) presented the Transport NI Western Division Works Programme Update report (Autumn 2016), details of which had been previously circulated to Members. He provided a brief update on the following strategic road improvement schemes as outlined in detail within the report:

A5 (Western Transport Corridor)

A Northern Ireland Executive led scheme which aims to provide 55miles of dual carriageway from south of Londonderry at New Buildings to the border at Aughnacloy. Subject to the successful completion of all the statutory procedures as outlined it is hoped that construction would commence in late 2017 (between New Buildings and north of Strabane).

A6 Randalstown to

The Regional Strategic Transport Network Transport Plan (RSTN TP) 2015 had endorsed the provision of a continuous dual carriageway from the western end of the M22 at Randalstown to the Castledawson Roundabout and the design development work was ongoing.

A6 Londonderry to

The (RSTN TP) had endorsed the provision of a 30 Kilometre dual carriageway from Londonderry to Dungiven including a dual carriageway bypass of Dungiven and subject to making the statutory orders, approval of the final business case and procurement it was possible that the first phase of the Derry to Dungiven scheme could commence in the latter part of 2018/19.

A2 Buncrana Road

The RSTN TP had endorsed improvement of the route A2 Buncrana Road, Londonderry from Pennyburn Roundabout to the border with the Republic of Ireland and it was anticipated that the statutory process could be concluded in early 2019 however delivery of the scheme would depend on the level of funding available.

The Network Maintenance Section Engineer (NMSE) provided an update on the structural maintenance planned works 2016-2017 outlined in detail within the report which included resurfacing works, surface dressing, drainage improvement to various locations throughout the DCSDC area.

Members noted that in the 2016-2017 financial year £190k had been allocated for Local Transport and Safety Measures within the DCSDC area and the location of the traffic management schemes were outlined within the report. It was also proposed to take forward an improvement scheme at Ballyarnett Roundabout for which a developer contribution had been secured.

Members also noted progress update on planned works 2016/2017 in the following areas:

 Structures – Planned works  Bridge Management  Vehicle Restraint Systems  Street Lighting

Members noted receipt of the Request/Enquiry pro-forma circulated at the meeting to be completed if necessary and returned to the Transport NI Officials to be actioned accordingly. They also made reference to the following:

- The need to prioritise progression of the A5 and A6 road schemes - The A2 Buncrana Road scheme to be progressed sooner and for traffic safety measures to be provided. A request for information on the public enquiry of A2 scheme to be provided to Members. - The ongoing drainage problems at Road, Gransha and Temple Road. - The backlog of cleaning gullies at various locations to be given priority. - An explanation on the delay in the traffic management scheme proposed at Drumlegagh Road. - The resurfacing of road from Ferguson Crescent towards Killeter Road - Welcomed the lobbying of traffic calming schemes at Nixon’s Corner and Lone More Road and for the Department to look favourably on the requests and for all safety measure to be provided when appropriate. - The backlog of street lighting scheme to be addressed and update on funding issue to be provided.

- Clarification was sought on the design of the traffic calming at Ballynagard Road. - Clarification was sought on who was responsible for replenishment of Salt/Sand boxes. - Update on the provision of road safety measures at Coshquin School. - Update on the Street Light repair maintenance scheme. - Request to review road gritting on minor and major roads.

Representatives of Transport NI responded as follows:-

- The A5 strategic road scheme was being progressed and it was anticipated that works would begin on site in 2017 as reported. - The A6 judicial review was underway concerning the habitat assessment and it was anticipated that the outcome would become clear early 2017. - The progress of the A2 Buncrana Road scheme would have to be viewed as priority within the funding allocation and it was anticipated that the outcome of the public enquiry would determine the traffic problems to be addressed. - Gully clearance backlog was being worked through as timely as possible with limited resources available. - There was a reduction in funding of road maintenance works across all Council areas. - Network development funding was limited therefore the Drumlegagh Road scheme was not progressed as planned. - Traffic calming schemes included in 2 year programme of works. - Detail on the traffic calming measures at Ballynagard Road would be provided for information to Members. - Salt box replenishment to be reported by residents and the request will be logged and dealt with accordingly. - Ferguson Crescent resurfacing scheme to be progressed. - Coshquin Road – traffic calming scheme to be looked at and prioritised with other similar schemes. - External contractors appointed to repair street lighting was ongoing throughout the District area. - An information session was scheduled to take place at Pilots Row Community centre to give the residents of Rosville an opportunity to discuss the new parking scheme initiative.

SER17/16 Local Transport and Safety Measures, Bridges and Street Lighting Draft Programme 2016-2019

The Network Development Engineer (NDE) presented the above report a copy of which was previously circulated to Members. The purpose of the report was to provide details of proposed schemes however due to current funding levels it would not be possible to deliver all of the schemes included in the draft programme over the 2017-2019 period. The Division would continue to bid for funding and plan ahead by developing schemes in terms of design and land acquisition to ensure that the Division was well placed to utilise additional funding should it become available.

Discussion ensued after which the Committee

Recommended i) that Council notes for information the Transport NI Works Programme update reports Autumn 2016.

ii) that Council writes to the relevant Minister to express the view of Members in relation to the need for funding provision to deal with the backlog of roads maintenance schemes throughout the District.

1 Purpose of Report/Recommendations 1.1 To seek Members approval to submit an application for European funding under the Northern Periphery Programme, Atlantic Area (Trans-National) Programme Priority Axis 1.1 - Enhancing Innovation Capacity through Cooperation to Foster Competitiveness.

2 Background 2.1 The Council's Energy Manager has been approached by ERNACT to participate in a bid for European funding from the Northern Periphery Programme in collaboration with a number of regional partners as follows, Udaras na Gaeltachta and Letterkenny Institute of Technology (Ireland), Regional Government of Cantabria (Spain), Forum Oceano and Foodintech (Portugal) and CPMR and Polemer (France). This partnership provides a diverse mix of expertise, knowledge, varying maturity levels, backgrounds and innovative approaches. 2.2 The Council's Energy Manager has worked in conjunction with the Business and Culture Department in developing the bid information required by ERNACT to complete the application form.

3 Key Issues 3.1 The aim of the project is to improve the innovation performance of the seafood sector by increasing the adoption of technology and transnational cooperation as a way of giving a response to the challenges faced by the sector identified with high- potential for the smart growth of the Atlantic regions participating in the project.

3.2 The main objectives of the project are:

Create an innovation platform to sustain an effective transnational network of seafood clusters by putting in place governance, organisation, innovation, services and the tools to enable the network to sustainability drive innovation with SME's and Applied Research Centres throughout the Atlantic region.

(2). Inspire the intensity of technology adoption and collaboration within the seafood sector by using the innovation platform and develop and implement a series of Living Lab pilots to test the effectiveness of the platform.

(3). Serve as an empirical input for the Regional Innovation Smart Specialisation Strategies (RIS3) of the Atlantic regions by evaluating project results and providing recommendations for consideration by the RIS3 decision makers.

3.3 The approach will be to network cluster across regions to facilitate the transfer of innovation and stimulate the emergence of new product, services and processes through the establishment of a live smart fishing pilot area in their region. New technologies will provide opportunities to introduce new processes, improve efficiency and communication between actors in the seafood value chain, while addressing emerging consumer and societal concerns, such as food traceability and security. 3.4 This project will help council build on the success of festivals such as "flavours of the Foyle", "Clipper Kitchens", "Slow Food Festival" and the Foodie Destination award to develop the food sector with particular emphasis on the Seafood Sector at a regional level. This development will encompass a whole life approach engaging with local suppliers, SME's, food distributors, restaurants and end users through innovation and business support.

Building on the relationships with SME's, food distributors and restaurants, the delivery of additional services such as advice on energy efficiency, the introduction of alternative energy sources to reduce costs and the exploration of opportunities to collect food waste for composting or energy generation.

4 Financial and Other Implications 4.1 The Northern Periphery Programme provides 65% funding for successful applicants. 4.2 The total budget for the project is €1.9M with an overall budget for Derry City and Strabane District Council of €194,120 over the three year project.

Page 62 4.3 Derry City and Strabane District Council's annual contribution would be €22,647 (£19,109), while it will receive €42,059 (£35,489) from the NPP programme. This will enable Council to secure an additional Officer for a 3 year period in order to progress the project and identify opportunities to develop a wider regional food network. 4.4 The application process closed on 13th December 2016, and due to restricted timescales, Council Officers agreed to participate in the bid, advising that this was subject to Council approval. Successful projects will be informed in February 2017 with an anticipated start date in May 2017.

2 Background 2.1 The Council Energy Manager has been approached by a consortium led by Letterkenny Institute of Technology to participate in a bid for European funding from the Northern Periphery and Arctic Programme in collaboration with a number of regional partners as follows, Scandinavia (University of Oulun, City of Oulun, - Finland, the Faroe Islands and Iceland) and West Atlantic (Derry City and Strabane - UK). This partnership provides a unique mix of expertise, knowledge, mix of maturity levels, climatic backgrounds and innovative approaches.

3 Key Issues 3.1 The Energy Efficient Education Sector -project (E3S) will focus on energy issues in schools and kindergartens. Besides plans to decrease energy consumption by educating users of school and kindergarten buildings, it will produce various methods and tools to raise energy awareness among stakeholder groups, to make long-term influence on target groups on their values of life. It will also study the balance between good energy management and a good educational environment by studying air quality in schools. 3.2 E3S aims to increase the reliability of energy supply while reducing excess consumption. It uses two approaches: actively through monitoring and control of energy systems to reduce waste; passively through the design of new, and the modification of existing, buildings to reduce energy need - in all cases without sacrificing air quality (e.g. mold creation, increased CO2, dust particles). E3S will support increased use of renewable generation technology, such as solar, biomass and wind. E3S will also produce demonstration material on how to save energy. This material will cover people working in schools and kindergartens, and their customers (children, pupils). So the influence of the project covers children from the age of 4 years up to adulthood. Page 65 3.3 The project will use wireless sensor and monitoring technologies to study energy usage and air quality, and will integrate renewable sources into schools' energy systems. This approach recognizes that the technology is maturing but is not currently being exploited by many regions or integrated across regions. The project will raise awareness of new technology through training, demonstrations, and test beds. The inclusion of public bodies in the project partnership will influence changes in public policy on the adoption of technology in general building design (as well as school buildings) and operation to help meet NPA program objectives on climate change. 3.4 The project utilises a unique quadruple transnational partnership comprising of low carbon knowledge centres, public authorities with responsibility for schools, pupils and staff of schools (user groups), and companies in low carbon sector. 3.5 The capacity, knowledge, and expertise of the public authorities will be enhanced by the transfer of technical and policy knowledge across the NPA regions, analyses of school operation, energy consumption, school air quality, good education vs good energy environment and building demonstrator "Smart Energy Schools" as beacons to promote adoption of renewables, smart energy efficient building techniques, and energy-wise education programmes to promote behavioural change among pupils and staff. 3.6 Increased energy management awareness through education of pupils and staff, combined with the adoption of low carbon energy techniques, will deliver a better education and energy management environment in schools. 3.7 A school pilot in each region, "Smart Energy School" managed by local authorities, will be a demonstrator to promote efficient energy building techniques, the adoption of renewable energy sources, and best practice in pupil and staff energy management, and promote public building policy change. 3.8 This approach goes beyond existing practice by concentrating on educational building sector and adopting knowledge and solutions from higher maturity regions. Through the quadruple partnership knowledge centres will be built up based around the Smart Energy Schools. Sustainability will be increased through stakeholder energy behavioural change which will lead to increased societal awareness. 3.9 DC&SDC will engage with the Education Authority and local schools to deliver the project and will replicate the learning and experience gained in the project to identify and implement similar projects in council buildings. The project will also be a catalyst to build relationships with other public bodies to meet the deliverables of the Environmental Pillar (energy section) of the Community Plan.

4 Financial and Other Implications 4.1 The Northern Periphery and Arctic Programme provides 65% funding for successful applicants. 4.2 The total budget for the project is €1.4M with an overall budget for Derry City and Strabane District Council of €215,627 over the three year project. Page 66 4.3 Derry City and Strabane District Council's annual contribution would be €25,156 (£21,221), while it will receive €46,719 (£39,412) from the NPA programme. This will enable Council to secure an additional Officer for a 3 year period in order to progress energy efficiency projects and regional energy benchmarking. 4.4 The application process closed on 30th November 2016, and due to restricted timescales, Council Officers agreed to participate in the bid, advising that this was subject to Council approval. Successful projects will be informed in February 2017 with an anticipated start date in April 2017.

2 Background 2.1 Members will be aware that since the merger of Derry City Council and Strabane District Council, Keep Northern Ireland Beautiful (KNIB) have continued to undertake quarterly independent surveying and reporting of cleanliness levels throughout the new Council area. The process involved the surveying of 80 transects per quarter, equating to 320 transects per annum covering 8 land use types.

2.2 The results for the 2016 periods are as outlined in the following tables:

Page 69 3.1 Keep NI Beautiful Provides Derry City & Strabane District Council with a quarterly independent report of Cleanliness Levels achieved by Street Cleansing Services. Inspection of the most recent complete survey for 2016 recorded in table 2 above indicates that 88% of the surveyed transects achieved the desired cleanliness index and is therefore exceeding the target performance indicator of 85%.

Fly Posting Author: Head of Environment

1 Purpose of Report/Recommendations 1.1 To advise Members of Councils position with regards to the enforcement and removal of fly-posting within the Derry City and Strabane District Council area.

The relevant legislation in relation to Fly Posting is listed at Appendix 1.

2 Background

2.1 Member will be aware of the presence of fly-posting and advertising not only within the City and Town centers but also in villages rural approach roads across the District. The location of this form of advertisement is selected for maximum exposure in areas of either high pedestrian footfall or constant vehicular movement.

2.2 Fly-Posting is the commercially driven defacement of the public realm and local environment by the illegal display of signage that is pasted or attached to buildings, street furniture or structures such as utility service boxes. These normally advertise events locally although some of the posters relate on occasion to events outside of the District.

2.3 If allowed to remain the posters slowly deteriorate resulting in litter issues which creates a negative perception and projects an unwelcome image to residents, businesses and visitors to the area. In some circumstances the presence of illegal posters can create a perception of crime and may encourage antisocial behavior.

2.4 The generally accepted definition of fly-posting is “any printed material and associated remains of previous posters, informally or illegally fixed to any structure”. This definition excludes approved managed sites or hoardings were advertisements can be fixed legally. Also excluded from the definition are business cards, hand bills, “A” boards and moveable billboards.

Page 71 2.5 Advertisement is distinct from fly-posting in that this is defined as any words, signs, models, placards or notices including sign hoardings that convey a message. The Planning Service have powers with regard to the regulating and restricting the display of advertisements and how they are fixed and erected. This requires consent to be obtained from planning, before the erection and display of advertisements.

2.6 As stated fly-posting generally occurs in locations of either high footfall or in proximity to vehicular traffic. In the Council area this will include

 Street/road signage and bollards particularly those located at traffic lights and road junctions.  On pedestrian railing associated with footpaths and roads, on a variety of fencing and railings on the perimeter on buildings and open land.  Vacant properties.  Within car parks or other locations associated with transport movement such as bus stops, taxis ranks and the railway station.  Various surfaces in close proximity to retail shopping and entertainment centers and other licensed venues.

Examples of this are provided as Appendices 2(1) – 2(5).

2.7 in consideration of the issues associated with this practice Council have at present five main approaches to dealing effectively with the matter.

1. Reactive measures, the instant removal or obliteration of the posters to prevent those erecting them from deriving commercial publicity from the illegal activity.

2. Preventive Measures, this can include legitimate sites for legal posting, license agreements for events to ensure the removal of posters after the event. Anti- poster coatings for service utility boxes and action plans involving Council, Community Planning Partners and Business/Retail forums.

3. Enforcement Action, the issue of Fixed Penalty Notices, power to remove or obliterate placards or posters, the issue of Defacement Removal Notices and Prosecution under Planning Regulations.

4. Engagement, the use of formal and informal business and community contacts, such as the Chamber of Commerce, to discourage the use of fly-posting.

5. Monitoring and Review, established service standards deployed and reporting systems introduced to assess compliance with monitoring to evaluate the extent of the problem over time, and across the geographical area, to identify “hot spots” of illegal activity and repeat offenders.

Page 72 3 Key Issues 3.1 Members are advised that effective management of fly-posting is at best difficult and the complete eradication of this problem is almost impossible particularly in urban areas. 3.2 A review of best practise would suggest that no single measure is likely to be wholly effective, but a coordinated approach that reflects the community, location and the scale of the problem may contribute to successful outcomes. 3.3 In consideration of the above it’s considered that policy and operational strategies should include a mixture of preventative and enforcement approaches with coordinated cross-departmental working not only within Council but with other Statutory Agencies primarily Transport NI. 3.4 Anti-Fly-posting strategies must be suitably resourced, funded and coordinated in line with other City Centre, Village, Business and Community initiatives and strategies to ensure long term effectiveness. 3.5 Derry City & Strabane District Councils’ Legal Services Section now provide legal guidance to two neighbouring Councils who share boundaries with Council, Causeway Coast and Glens and Fermanagh and Omagh District Council. 3.6 This provides the opportunity to develop operational and legal approaches to the enforcement of fly-posting reflecting good practice and a common regional strategy. Similar forums have been established with Donegal Council and other Local Councils again with primary objectives of sharing information and developing officer contacts, to address issues such as fly-posting enforcement. 3.7 Important elements of this Strategic Approach are

 Employing a corporate approach within Council with collaboration between departments,  Clear understanding of roles and responsibilities,  Effective external partnership working,  Clear guidelines,  Strategies appropriate to the location and the scale of the problem

3.8 When planning and developing spaces within the Council area, thought must be given to the provision of advertisement or poster facilities thus creating legal and managed facilities. Additionally, Public and Private utility companies should be encouraged to apply suitable surface coating to their equipment cabinets so facilitating the easy removal of posters. 3.9 Operational managers must ensure that provision is made for Cleansing Response Teams to include the removal of fly-posters as part of their regular routines. This is the most commonly used method of controlling this problem as the speedy removal of posters can deter fly-posting companies as the display and exposure period can be greatly reduced in priority areas.

Page 73 3.10 Members are aware that the powers of enforcement for fly-posting have been strengthened by the introduction of the Clean Neighbourhoods and Environment Act NI 2011. Council Authorised Officers can issue fixed penalty notices (FPN’s) on those who place or erect the poster in contravention of the Planning (NI) Order 1991. Additionally Transport NI have a range of similar enforcement powers related to the Road Traffic Regulations (NI) Order 1997 and the Roads (NI) Order 1991 for the removal of posters from road and street signage. FPN’s are most effective for directly dealing with fresh newly erected posters. 3.11 Council have also enforcement powers to serve a “defacement removal Notice” (“DRN”) for posters in or on the street. This is served on the owners, occupiers, operators of “relevant surfaces” (including street furniture), statutory undertakers and educational institutes whose property is defaced with fly-posting. Operationally, Officers would first discuss relevant issues with owners to resolve fly- posting problems in an attempt to find more sustainable solutions to the issue. DRN, s would therefore be only issued as a last resort were these partnerships have not been effectively established.

4 Financial, Equality, Legal, HR, Improvement and other Implications 4.1 Employing these approaches to the issues of fly-posting would provide a more focused and concerted operational, educational and enforcement strategy for fly- posting that would directly contribute to an environmental improvement of affected areas both from an appearance prospective and the direct control of this illegal activity.

5 Recommendations 5.1 The development of a cross departmental group to establish the most effective enforcement and educational approaches to the issues of fly-posting and which would coordinate the activities of Planning Enforcement, Environmental Enforcement, Legal Services and approaches currently adopted by Transport NI. 5.2 Advisory input to the planning and development of Council spaces and public realm projects to advice on good practice that would reduce the incidents of fly-posting and introduce preventative measures that will enhance the maintenance of these areas. 5.3 More focused operational techniques and approaches to the systematic removal of fly-posting. 5.4 The development of good monitoring systems that identify the perpetrators of fly- posting which would give direction to both the enforcement and educational approaches to the issues. 5.5 Establishing forums with the business and retail sectors to formulate best practice and achieving sustainable solutions to the issues of fly-posting.

3 Key Issues 3.1 Certifications:

142 Building Notice Applications were approved. 50 Notice applications were approved for the Affordable Warmth Scheme. 31 Full Plan applications were issued with Approval Certificates, covering 33 sites. 15 Regularisation applications were issued with Regularisation Certificates.

3.2 Inspections:

588 Inspections were carried out in this period including 91 commencement inspections and 264 completion inspections, of which 192 were deemed satisfactorily complete.

3.3 Property Certs:

216 Property Certificates were received in the report period, 98.2% of which were processed within 10 working days and the overall average response rate was 12.6 working days.

1 Purpose of Report/Recommendations 1.1 To seek approval to provide financial assistance to support the hosting of the Ulster Architectural Heritage Society/Irish Georgian Society Cross-Border Summer School in 2017.

2 Background 2.1 Officers are in receipt of correspondence from the Ulster Architectural Heritage Society (UAHS) & Irish Georgian Society (IGS) in relation to a proposal to host their two-yearly cross-border summer school in Derry and Donegal in June 2017. 2.2 The UAHS and IGS are charitable architectural heritage organisations set up to conserve and promote the historic built fabric within Northern Ireland and Republic of Ireland respectively. UAHS engage in a variety of conservation/built heritage initiatives including hosting conferences, publications, undertaking a buildings at risk register as well as a range of skills and educational activities. The IGS are engaged in similar activities within the Republic of Ireland. 2.3 The UAHS have engaged with the former legacy Councils in a range of initiatives including the Stable Buildings at Sion Mills and the production of a street gazetteer publication for Derry City in 2013. The UAHS regularly maintain contact with Council officers in relation to relevant built heritage and conservation matters within the District.

In 2015 the Irish Georgian Society and the Ulster Architectural Heritage Society came together to organise a cross border Summer School in counties Armagh and Monaghan to consider issues relating to the built heritage of both counties. Key supporters of the event included Armagh City & District Council, Monaghan County Council, and The Heritage Council and proceedings were launched by Heather Humphreys TD, Minister for Arts, Heritage & the Gaeltacht. Speakers included established academics, architects and town planners, and delegates were drawn from professional firms, local authorities, interest groups and a wide range of heritage enthusiasts.

Page 151 2.4 The three-day event explored common themes in conservation policy and practice with a view to identifying the mutual benefits that could be derived from cross- border co-operation. A key theme was the critical importance of the built heritage in maintaining the distinctive qualities of the region and supporting the sustainable growth of tourism, economic development and prosperity.

3 Key Issues 3.1 Following the success of the first Summer School in 2015, it was resolved by the IGS and the UAHS to organise a similar event with the current proposal relating to staging the 2017 in the event in DCSDC and Donegal County Council areas. As before, the proposed 2017 summer school will bring together students, enthusiasts and practitioners to explore, discuss and debate issues relating to our shared Irish heritage through participation in workshops, lectures, and panel debates. 3.2 The Summer School will take place over three days, from 8th to 10th June, and will focus on the positive changes in the built environment of Donegal, Derry and Strabane areas. The programme will be structured to include lectures, break out session, and site visits to vernacular and civic buildings of architectural interest across the two counties. 3.3 The UAHS/IGS advise that the Summer School will host up to 120 participants of which 30 spaces are to be allocated for student scholarships. The UAHS/IGS state that the scholarships will be available through an open application process to third level students studying in a related discipline (architecture, art history, conservation, engineering and planning) and whose studies would be enriched by their participation in the Summer School. 3.4 According to the UAHS/HIS, the scholarships are offered to students from across the island of Ireland to ensure a good geographical spread of participants and to facilitate students from a variety of academic backgrounds. These scholarships cover all the students’ costs including accommodation, transport, printed materials and food. The Summer School will provide the other delegates with an opportunity to gain a deeper understanding of the historic built environment of Donegal and Derry City & Strabane areas. 3.5 The UAHS and IHS are currently developing a draft programme of activities and events relating to the proposed Summer School for 2017. However the details are at an early stage, until such times that there is confirmed support for the Summer School by potential sponsors.

Page 152 4.1 The UAHS/IGS have written to both DCSDC and Donegal County Council to advise on the proposal relating to the proposed 2017 Summer School and to establish the potential for financial support towards the overall hosting costs. Officers from both Councils have met with UAHS officials to establish further details relating to the Summer School in terms of overall costs, partners, proposed programme of activities and proposed outputs. 4.2 Based on 2015 figures, the UAHS advise that the total estimated costs for hosting the 2017 event amount to c.£32k. Ticket sales are estimated at £8k with a further £8k drawn from other unconfirmed sources. The shortfall amounts to £16k with UAHS/IGS requesting assistance from both DCSDC and DCC to the value of £8k each. 4.3 The proposed Summer School presents an opportunity to host a prestigious built heritage event in the DCSDC and DCC region in 2017. The event will consist of a range of expert speakers who are locally and nationally recognised in the field of conservation and built heritage. The Summer School will offer the opportunity to positively profile the NW region’s built heritage assets, learn from national best practice as well as networking opportunities. In addition, the Summer School will attract upwards of 120 people to the region for a period of 3 days which in turn will generate additional economic benefits through increased hotel bed-nights and additional spend.

4.4 There is budget provision from within the Environment & Regeneration Department 2017/18 to support the event to a maximum of £8k, based on a similar sum being committed by Donegal County Council. 4.5 Should Members be minded to approve support for this initiative, then Officers will work with the organisers to ensure that the Summer School seeks to profile DCSDC’s built heritage assets within the context of the event programme.

5 Recommendations 5.1 On the basis of the above, authority is sought to support funding for the UAHS/IGS 2017 Summer School to a maximum sum of £8k.

1 Purpose of Report/Recommendations 1.1 The purpose of this report is to update Members on the status of the Nearly Zero- Energy Sports Facilities European Projects.

2 Background 2.1 Members are reminded about Committee item, ES27/14 which approved Council's participation in the Nearly Zero-Energy Sports Facilities European project and Committee items ES185/14, ES324/14, ER86/15, ER109/15, ER89/16 and ER244/16 which provided previous updates on the progress of the project.

3 Key Issues 3.1 The Nearly Zero Sports 7th project meeting and Closing Conference was held in Florence, Italy on 23rd & 24th November 2016, which was attended by the Council's Energy Manager and the Council's Energy Co-ordinator. 3.2 The meeting was opened by Sergio Gatteschi from the Florentine Energy Agency, welcoming all participant's to Florence and gave a brief introduction to region and outlined the agenda for the two day event. 3.3 Overview of the project work plan, deadlines and responsibilities were discussed as follows:

3.3.1 Miriam Siciliano (Resolvo), Project Co-ordinator) discussed the project’s social media activity and spoke about the planned interview schedule for the partners. She continued by explaining the Guideline & Policy Recommendations document which Resolvo had produced and the proposed method of dissemination.

Miriam continued to discuss the content of the final report, what partners have to contribute and the need to complete budget documentation and monitoring reports by end of December and what communication activities are foreseen before the end of the project.

Page 155 3.3.2. Rene Schepers (City of Eindhoven), discussed the final versions of Deliverable 3.3 and 3.4 which have been completed by all partners and uploaded to Box.com.

3.3.3. Leo Strawbridge (Derry City and Strabane District Council) reviewed the last versions of the Implementation Reports submitted by each partner and highlighted outstanding issues which needed to be completed before the end of the project. Namely, final versions of the report from Cyprus Energy Agency and City of Vukovar.

3.3.4. Each partner gave a brief summary of energy efficiency projects which they planned to implement from the good practice knowledge gained during the project.

3.3.5 Miriam Siciliano (Resolvo) re-emphasised timescales and deadlines for the outstanding documents required to complete the final report.

3.4 The Florentine Energy Agency hosted a visit to San Marcellino Swimming Pool which was one of the original pilot buildings visited by the project partners during the first project meeting in Florence. Improvements to the building since the first meeting included new insulation, LED lighting, new boiler plant, high efficiency heat exchangers and filtration systems.

Adjacent to the swimming pool is a University of Florence demonstration project utilising solar energy concentrated on a single pipe to generate high temperature water or steam. The swimming pool owner has plans to pipe this heat to preheat boiler make up water. This project is still in development, with a suitable route between both locations yet to be determined.

3.5 The project closing conference was held on the second day hosted by the Municipality of Florence in one of their historic buildings and was attended by local representatives from Council, sports agencies and sports centre operators.

3.5.1 The main focus of the closing conference was to highlight the some of the energy efficiency projects installed or planned in the pilot buildings. The conference was opened by Sergio Gatteschi from the Florentine Energy Agency who welcomed everyone to the event, spoke about the objectives of the day and summarised the work the Energy Agency carried out at a regional level.

3.5.2 Andrea Vannucci, Council Member for Sport, Municipality of Florence spoke briefly about the council’s support to sporting facilities at a regional level, what their investments have achieved and how the Nearly Zero Sports project has been beneficial to local sports facilities.

Page 156 3.5.3 Two local sporting heroes, Giacomo Galanda, a Basketball player and Leonardo Binchi, a Water Polo Player, both of whom played with the Italian national team in their respective sports were introduced to the attendees. Each person gave a brief summary of their career and emphasised the benefits of investing to maintain sports facilities to a high standard to nurture talent at an early age. Without good quality sports facilities, they believed their careers would have be significantly different.

3.5.4 Sergio Gatteschi presented the nearly zero sports project followed by each partner discussing one of the energy efficiency projects either installed or planned to be installed in the next few months. Joe Hendron, Council’s Energy Co-ordinator discussed the cost analysis and benefits of installing DE-Stratification fans in large enclosed areas such as swimming pools or sports halls.

3.5.5 Miriam Siciliano (Resolvo) led a participation session with the local attendees discussing the benefits of learning from the previous speakers and indications of their plans to install energy efficiency projects.

1 Purpose of Report/Recommendations 1.1 The purpose of this report is to update Members on the status of the SECURE, Smarter Energy Communities European Projects

2 Background 2.1 Members are reminded about Committee items, ER175/15 and ER164/16 which approved Council's participation in the SECURE, Smarter Energy Communities European project and provided a previous update on the project. 2.2 The Partnership consists of ERNACT (Donegal, Ireland) as the Lead Partner, Derry City & Strabane District Council (UK), Donegal County Council (Ireland), Leitrim County Council (Ireland), Karelia University of Applied Science (Finland), ALVA Vasternorrland (Sweden), Umhvorvisstovan (Faroe Islands) and the Ecology Action Centre (Canada).

3 Key Issues 3.1 The SECURE 2nd project meeting and launch conference was held in Donegal on 8th & 9th November 2016 and was attended by the Council’s Energy Manager. 3.2 The meeting was opened by Paddy Mullen from Donegal County Council who welcomed all partners to the region, gave a brief summary of the tourist highlights in the area and explained the agenda for the two day event 3.3 The first day was dedicated to the SECURE Project with an overview of the project work plan, deadlines and partner responsibilities were discussed and agreed as follows:

3.2.1 Work Package M. Caitriona Strain (ERNACT) discussed the project goals and objectives and gave an update on the project plan highlighting what deliverables had already been achieved. She went on to discuss the Partnership Agreement, the budget, eligible expenditure and the procedure for reporting progress and some of the issues with the new eMS on-line reporting portal.

Page 159 3.2.2. Each partner gave a brief update on their respective activities in each of their regions which has been undertaken since the last meeting. DC&SDC’s activities centred around meetings with Ulster University on the feasibility of District Heating, the Community Planning thematic group meetings, regional discussions with Donegal County Council and Leitrim County Council, an industrial visit arranged through the Energy Managers Forum to a large solar farm, the development of Good practice examples and current energy efficiency projects.

3.2.3. Ianire Renobales (ERNACT) discussed the project communication activities and media channels. She discussed the continued development of a website and the shared collaboration platform. She also discussed the publication of the short partner videos produced in Finland and the second set of partner videos to be shot the next day.

3.2.4. Work Package 1 - Build Smarter Energy Communities, led by Donegal County Council & ERNACT (Ireland). Issues discussed included progress on the establishment of a "Green" Stakeholder team in each region, progress on community energy baseline survey, how to co-ordinate local energy awareness events and the development of a smarter energy communities programme.

Emma Norton (Ecology Action Centre, Canada), reviewed the content of the Community Energy Survey and the Staff Energy Survey. There was considerable discussion about the content of each survey, the terminology used in the questions, the number of questions and the distribution timeline. Each survey was revised with Emma indicating she would send a sample survey to partners in the next few weeks.

3.2.5. Work Package 2 - Develop Transnational Low Carbon Services Directory, led by Karelia (Finland). Issues discussed included the Good Practices already submitted to the WP Leader, identifying ways to share Good Practice and developing Governance and Service Delivery structures.

3.2.6. Work Package 3 - Implement Transnational Low Carbon Actions, led by ALVA (Sweden). This work package is scheduled for later in the project and the work package leader gave a brief overview highlighting the timescale and deliverables.

3.2.7. Caitriona Strain (ERNACT) summarised the agreed activities, objectives and deliverables for the next six month reporting period.

3.4 Donegal County hosted a visit to a wind turbine farm outside Letterkenny, operated by SSE Aitricity.

Page 160 3.4.1. The wind turbine farm was one of the first opened in Ireland in the early 2000’s with some of the earlier turbines now having reached their operational lifespan and are due for renovation within the next few years

3.4.2. The wind turbines varied in height of tower and electricity generation capacity with the more recent one’s installed having higher efficiencies and thus capable of producing more electrical power.

3.4.3. There was a visit inside one of the turbines to view the control systems and electrical connections to the national grid.

3.5 The next project meeting to review progress, update documentation and to continue the learning experiences with other project partners will be held in Vasternorrland, Sweden on 16th, 17th & 18th May 2017.

3.6 The official launch conference was held on the second day at Glenveagh Visitors Centre.

The event was opened by Seamus Neely, CEO of Donegal County Council and the Mayor, Terence Slowey, after which several speakers spoke to the 80 attendees on energy management, funding opportunities and the challenges of climate change.

The speakers included; Michael O’Brien and Dennis Kelly from the Northern & Western Regional Assembly who spoke about funding opportunities. Ruth Buggie from SEAI who spoke about the Sustainable Communities programme. Donal Doyle from RPS who spoke about the opportunities for energy generation from former landfill sites. Mary Daly from Letterkenny Institute of Technology who spoke about the institute’s energy efficiency programme. Emma Norton from the Ecology Action Centre gave a different perspective on Nova Scotia’s innovative approach to energy efficiency.

The keynote speech was delivered by Duncan Stewart, an Architect, Environmentalist and media personality. He spoke about the effects of climate change, sustainability and the challenges facing the world today and in the future.
