Notice to Purchasers

Foreword – Kivells are delighted to have been instructed to conduct this important dispersal on behalf of the Stanbury family. A very warm welcome awaits you at the Milky Way Adventure Park with a special entry of lots that includes something for everyone.

The vintage farming collection includes a wonderful display of Tractors & Machinery from ‘Yesteryear’ and will be available for viewing on the morning of the sale. Also included is the very special ‘Pidler Collection’ of equipment, tools and goods which portray Devon farming life from years gone by.

Sale Venue – The sale will be conducted in the on-site Theatre. There will be stewards available to show you the sale lots prior to the auction itself. You can register to bid on the day at our office which will be situated at the entrance to the Theatre area.

The auctioneer will sell from the Rostrum and buyers will be seated in front of him and will see a slide show of each lot as they are sold.

Directions – From Wadebridge/Camelford/Bude follow the A361 (Atlantic Highway) North towards Bideford. Through Kilkhampton and past the Clovelly turn off. Stay on the main road for another 2 miles and the Milky Way is on your right. From M5/Barnstaple follow the A361 towards Bude/Camelford passing Bideford over the bridge. Follow on through Bucks Cross, 1 ½ miles and the Milky Way is on the left.

Parking – Please enter the Milky Way site and follow the ‘to the sale’ signs where our staff will assist you. Please be aware that the Milky Way Adventure Park will be open to the public on this day.

Viewing - From 8am on morning of sale

Registration and Conditions of Sale - In order to bid all Buyers are required to register before the auction, at the Pay Office. All Buyers unknown to the Auctioneers will be asked for two forms of identification. Acceptable identification include Driving Licence/Passport together with a Business Card/Utility Bills/Proof of Address/Business Letter Heading. The Auctioneers reserve the right to request a deposit ahead of any purchase or during sale proceedings. It is strongly recommended that Bidders and Buyers visit Kivells.com and read Kivells Standard Terms and Conditions of Sale ahead of the sale. You will be signing to the effect that you have read, agree with and will abide by those Conditions and these Notice to Purchasers.

Payment - All Lots must be paid for on the day of the Sale by the Buyer prior to any removal or consolidation unless alternative arrangements have been agreed with the Auctioneers. Payment will only be accepted from the successful purchaser or their duly appointed agent. Any payment is to be by a means approved by the Auctioneers and include the Buyers Commission and VAT. Our terms are strictly cash, Bank Transfer, Debit Card, NO Credit Cards accepted. Our Bank Account details are: Sort Code 56-00-49 Account Number 32376359

Payment in Cash - In order to comply with money laundering regulations we will not accept Cash payments above the maximum permitted at the time of sale. The maximum varies according to exchange rates and currently it is circa £9,000. Buyers are advised to check with the Auctioneers ahead of the sale.

Commission/Buyers Premium - All Lots will be subject to a Buyers Commission / Premium whether sold by auction, by private treaty or tender. VAT at the standard rate will be charged on all commissions. Buyers shall pay Commission to the Auctioneers at the following rates:- • 10% on any single lot up to and including £2000 • 5% on any single lot over £2000

Value Added Tax - Please be aware some lots will be subject to VAT and therefore VAT will be charged in accordance to the current rate and added to all accounts and is applicable to the Commission/Buyers Premium.

Bidding for You - The Auctioneers will bid on your behalf if written instructions are received on the form supplied, adequate time is available to enter such bids and you have previously inspected the lot. Descriptions of Lots - Buyers should satisfy themselves prior to making bids as to the condition of any Lot and should rely on their own judgement as to whether the Lot accords with its description. All Lots are sold with all faults and imperfections and errors of description.

Risk - All lots remain at the risk of the Buyer from the fall of the hammer and it is strongly advised that the Buyer effects insurance immediately.

Removal of Lots - Lots can only be removed once payment has been made. All lots need to be cleared from the saleground by 5:00 PM SALE DAY unless alternative arrangements have been agreed with the Auctioneers. No removal of lots will be permitted until after the conclusion of the selling unless agreed by the Auctioneers. There will be one way in and one way out, only people with their invoices will be able to remove their goods.

Health & Safety - The Auctioneers and their clients accept no liability for any damage or injury to persons or plant. Any person entering the Saleground does so at their own risk and must comply with the requirements of all health and safety notices. All persons entering the Saleground are hereby given notice that there are significant risks due to the type and display of lots. Caution should be exercised and children must be fully supervised at all times. The Auctioneers reserve the right to refuse admission to any person or vehicle into the Saleground without giving reason. No vehicle will be allowed in the Saleground during the sale without the express permission of the Auctioneers. Permission from the Auctioneers is required ahead of starting powered equipment or machinery. Any incidents or accidents on the Saleground should be reported to the Pay Office immediately.

Refreshments and Facilities – The on-site restaurant will be available for customers throughout the day selling hot/cold food and drinks.

LOT 173 Fordson Standard N Type, Road Model. Here we have a water wash air filter tractor registration number ETT 852 reg 31st December 1937 with original logbook. This tractor was supplied from the factory with pneumatic tyres all round, the rear firestone wheels house rare extra hand operated road brakes. It has wide wings, fibre PTO belt pulley, swinging drawbar, engine mounted large toolbox and original type carburettor. Turns over freely.
