It’s been $7.25 since July 24, 2009. That’s 11 years without an increase – the longest period in history without a raise. Some people say we can’t raise the mini- mum wage now because times are hard. Well, if we hadn’t raised the minimum wage in hard times, we wouldn’t have a minimum wage to be- gin with. Trolleys, or, if you must, trolley cars, were an exposition of sensory happenings. For a young boy, they were an explosion that rocked his recep- tors. Yes, “Clang, clang, clang, went the trolley.” You could hear that distinctive sound from blocks away. It was best to heed the warning it called to you. “Watch Out! I’m Comin’.” Trolleys were no- torious for not stopping very quickly. But it was that bell. Piercing. Nothing sounded like it then, now, or ever. The seats, smooth as ice from years of people sliding in and out of them, from one side to the next, were as comfortable as a block of cement. “Hold on,” mom would say and rightly so. Not exactly poetry in motion, they were always in motion. They bumped, swayed, and lurched. At a jury trial on the issue of liability, Guo testified that she was the front seat passenger in a vehicle operated by her husband, Zhong Xing Zhong. Guo and Zhong both testified at the trial that Zhong stopped his vehicle at a stop sign, moved his vehicle further up and stopped again. According to Guo and Zhong, they did not see any cars approaching and Zhong proceeded into the intersection. At the time of the accident, Elle Efkarpidis was driving a vehicle owned by her mother, Evie Efkarpidis. Ellie’s friend was seated in the passenger seat of the vehicle and there were no traffic control devices that controlled Ellie’s direction of travel at the intersection. While in the intersection, the front of Efkarpidis’ vehicle struck the middle of Zhong’s vehicle on the driver’s side. Eagle file photo by Andy Katz At the close of evidence on the issue of liability, Evie and Ellie Efkarpidis moved for judgment as a matter of law dismissing the complaint. Hon. Leslie Purificacion denied that motion. The jury returned a verdict in favor of Guo and against the Efkarpidis defendants on the issue of liability. The jury found that the defendants were negligent and that their negligence was a substantial factor in causing the accident. In addition, the jury found Zhong was negligent but that his negligence was not a substantial factor in the causing of the accident. In response, the defendants moved to set aside the jury verdict on the issue of liability and for judgment as a matter of law. Justice Purificacion denied the motion. Following a trial on the issue of damages, the defendants moved to set aside the jury verdict on the issue of damages with respect to the award for future pain and suffering as contrary to the weight of the evidence and for a new trial. The Supreme Court denied that motion. A judgment was entered in favor of Guo and against Efkarpidis awarding damages. Upon an appeal by the defendants, the justices of the Appellate Division, Second Department affirmed the judgment. The justices explained that there was a rational process by which the jury could find that the defendants were negligent. The justices determined that there was evidence introduced at the trial from which the jury could conclude that, although Ellie had the right­of­way, she failed to exercise reasonable care to avoid the collision and failed to drive at a speed that was reasonable and prudent under the conditions. Additionally, they found that evidence was admitted that demonstrated the nature and the extent of the damage to Zhong’s vehicle, including photographs of Zhong’s vehicle that were taken following the collision. The justice noted that although Ellie and the passenger in her vehicle testified that Efkarpidis’ vehicle was traveling at a speed of approximately 20­25 miles per hour at the time of the accident, the jury was permitted to reject their testimony, particularly in considering the evidence that the force from the collision “propelled” Zhong’s vehicle into a tree and rendered the vehicle a total loss. Furthermore, the justices determined that although Ellie and the passenger in her vehicle testified that Zhong’s vehicle had not yet reached the middle of the intersection at the time of the collision, Zhong and Guo testified that the defendants’ vehicle struck Zhong’s vehicle after Zhong’s vehicle had already reached the middle of the intersection. They noted that Guo and Zhong’s testimony was supported by the photographs in evidence, which showed heavy damage to the middle and back portion of Zhong’s vehicle. The justices also indicated that Ellie testified that she did not see Zhong’s vehicle until it was “right in front” of her. Therefore, the justices agreed with the Supreme Court’s determination denying the defendants’ motion for judgment as a matter of law dismissing the complaint and denying that branch of the defendants’ separate motion which was to set aside the jury verdict on the issue of liability and for judgment as a matter of law. —Guo v. The events specifically target Queens’ “hard- to-count” communities — particularly immigrant neighborhoods and communities of color where the census completion rate has lagged behind the city average. In parts of Richmond Hill, the re- sponse rate is less than 40 percent, according to CUNY’s Hard to Count Mapping project, which plots response rates for every census tract in the United States. Queens’ overall response rate was 53.8 per- cent as of July 23, compared to 60 percent in 2010. The New York state response rate is 57.9 percent and the nationwide rate is 62.3 percent. The census is conducted every 10 years and counts every person living in the United States and five U.S. territories.
