REPORT

SITE AND PROPOSAL Woodlands Farm is sited off Knaresborough Road between Kirk Deighton and North Deighton the prior notification concerns an agricultural building to be used for B1,B2 and B8 Business Use, this prior notification concerns the use of the building only.

The application is made under the Town and Country Planning (General Permitted Development) Order 2015, Class R, Part 3 of Schedule 2. Class R covers the permitted development of agricultural buildings to 'flexible commercial use', including Class B8 (storage or distribution).

Where the total floor space is no more than 500 sqm the applicant is required to contact the Local Planning Authority to seek whether prior approval is required to the noise, transport and highway impacts of the development, contamination risks on the site and flooding risks.

The Local Planning Authority has a period of 56 days to notify the applicant the outcome which are either; - Prior approval is not required - Prior approval is given - Prior approval is refused in which case there is a right of appeal to the Planning Inspectorate.

The application is only before committee due to the applicant being a Council Member.

ASSESSMENT OF MAIN ISSUES 1.NOISE - Woodlands Farm is outside of the village of Kirk Deighton with the nearest dwellings on School House Terrace approximately 262m away and Woodlands, the detached dwelling on Knaresborough Road, 296m. There are no other noise sensitive premises in the immediate locality.

2.TRANSPORT AND HIGHWAY IMPACTS - Woodlands Farm is accessed via a drive off Knaresborough Road, the site is a working farm and has planning permission for some of the former buildings to be used for Class B1, B2 and B8 storage and distribution.

North Yorkshire County Council Highway Authority have not been consulted, previous comments have all resulted in no objections apart from the 2011 application which conditoned that the access be upgraded which has been undertaken. With these type of notifications it is left to the officers discretion as to the need to consult so given that there are no changes to the access and it is only one additional unit it was not considered necessary in this instance.

3.LAND CONTAMINATION RISKS - The building is currently used for agricultural purposes, the Council's Environmental Protection Team have been consulted and commented the proposed use is not introducing a new sensitive user to the building; as such no mitigation measures are required. As a result of the proposed change of use the site would not be considered to be contaminated land.

4.FLOODING RISKS- The site is not within a Flood Zone.

CONCLUSION It is considered on the basis of the information submitted and consultation responses received, that Prior Approval is not required for the proposed change of use.

RECOMMENDATION

That the application be Prior approval not required

1 The unit shall only operate between the hours of 07:30 and 18:00 hours Monday to Friday and 07:30 and 13:00 hours on Saturdays with no working on Sundays or Bank Holidays.

Reasons for Conditions:- 1 In the interests of privacy and residential amenity.
