E. 19 (Environmental Protection Act) for approval of: establishment of stormwater management Works related to the construction of SWM Facility # 3702 (Site 317), located on the north side of Matheson Boulevard West, between McLaughlin Road and Hurontario Street, within the Credit River watershed, in the City of Mississauga serving a drainage area of 605 hectares, to provide flood protection to the Cooksville Creek subwatershed, for the treatment and disposal of stormwater run-off, providing Enhanced Level water quality control and erosion protection and attenuating post-development peak flows to the targeted peak flows of 11 cms established in the Cooksville Creek Flood Evaluation Master Plan EA, dated July, 2012, prepared by Aquafor Beech Ltd for all storm events up to and including the 100-year storm event, consisting of the following: oil and grit separator (catchment area 393 hectares): - one (1) oil and grit separator (StormceptorMAX Model MAXX-3000-27 or Equivalent), located on the south-west side of the site, west of Avebury Road, receiving first flush inflows from a 3600 mm by 2400 mm box culvert storm sewer on Falbourne Street and a 2700 mm diameter storm sewer on Matheson Boulevard West, having a sediment storage capacity of approximately 85.6 m 3 , an oil storage capacity of approximately 3,600 L, a total storage volume of approximately 125 m 3 , and a maximum treatment flow rate of approximately 515 L/s, discharging via a 1500 mm diameter outflow pipe to the stormwater management facility (317 SWM Facility), identified bellow; oil and grit separator (catchment area 212 hectares): - one (1) oil and grit separator (StormceptorMAX Model MAXX-3000-27 or Equivalent), located on the north side of the site, north-east of Falbourne Street, receiving first flush inflows from a 2550 mm diameter storm sewers on Avebury Road, having a sediment storage capacity of approximately 140 m 3 , an oil storage capacity of approximately 5,911 L, a total storage volume of approximately 231 m 3 , and a maximum treatment flow rate of approximately 627 L/s, discharging via a 1500 mm diameter outflow pipe to the stormwater management facility (317 SWM Facility), identified bellow; stormwater management facility (317 SWM Facility - catchment area 605 hectares): - one (1) hybrid wet pond/wetland facility with two (2) sediment forebays, located on the north side of Matheson Boulevard West, between McLaughlin Road and Hurontario Street, having a permanent pool volume of 79,217 m 3 , an extended detention volume of 25,463 m 3 , and a total storage volume of approximately 236,862 m 3 , including the permanent pool volume, at a total depth of approximately 6 m, receiving inflows from the two (2) oil and grit separators, identified above, and the remaining flows from the 2550 mm diameter storm sewer and the 4575 mm by 3050 mm box culvert storm sewer, discharging through 475 mm reverse slope pipe and four (4) concrete headwall outlets connected to a centralized chamber, and then to an existing 4575 mm by 3050 mm box culvert on Matheson Boulevard West, and ultimately to Cooksville Creek; including erosion/sedimentation control measures during construction and all other controls and appurtenances essential for the proper operation of the aforementioned Works; all in accordance with the submitted supporting documents listed in Schedule "A" forming part of this Approval. For the purpose of this environmental compliance approval, the following definitions apply: "Approval" means this entire document including the application and any supporting documents listed in any schedules in this Approval; "Director" means a person appointed by the Minister pursuant to section 5 of the Environmental Protection Act for the purposes of Part II.1 of the Environmental Protection Act; “Equivalent” means a substituted product that meets the required quality and performance standards of a named product; "Ministry" means the ministry of the government of Ontario responsible for the Environmental Protection Act and the Ontario Water Resources Act and includes all officials, employees or other persons acting on its behalf; "Owner" means The Corporation of the City of Mississauga and includes their successors and assignees; "Works" means the sewage works described in the Owner's application(s) and this Approval. You are hereby notified that this environmental compliance approval is issued to you subject to the terms and conditions outlined below: TERMS AND CONDITIONS 1. GENERAL PROVISIONS (1) The Owner shall ensure that any person authorized to carry out work on or operate any aspect of the Works is notified of this Approval and the Conditions herein and shall take all reasonable measures to ensure any such person complies with the same. (2) The designation of the Corporation of the City of Mississauga as the operating authority of the site on the application for approval of the Works dose not relieve the owner from the responsibility of complying with any and all of the this Approval. (3) Except as otherwise provided by these Conditions, the Owner shall design, build, install, operate and maintain the Works in accordance with the description given in this Approval, and the application for Approval of the Works. (4) Where there is a conflict between a provision of any submitted document referred to in this Approval and the Conditions of this Approval, the Conditions in this Approval shall take precedence, and where there is a conflict between the listed submitted documents, the document bearing the most recent date shall prevail. (5) Where there is a conflict between the listed submitted documents, and the application, the application shall take precedence unless it is clear that the purpose of the document was to amend the application. (6) The Conditions of this Approval are severable. If any Condition of this Approval, or the application of any requirement of this Approval to any circumstance, is held invalid or unenforceable, the application of such Condition to other circumstances and the remainder of this Approval shall not be affected thereby. (7) The issuance of, and compliance with the Conditions of this Approval does not: (a) relieve any person of any obligation to comply with any provision of any applicable statute, regulation or other legal requirement, including, but not limited to, the obligation to obtain approval from the local conservation authority necessary to construct or operate the sewage Works; or (b) limit in any way the authority of the Ministry to require certain steps be taken to require the Owner to furnish any further information related to compliance with this Approval. (8) This Approval includes the treatment and disposal of stormwater run-off from 605 hectares of the Cooksville Creek subwatershed draining to the stormwater management facility located on the north side of Matheson Boulevard West, between McLaughlino Road and Hurontario Street on Blocks 4 and 5 (Part of Blocks 3 and 12) and Blocks 4 and 6 (Part of Blocks 5 and 7, parts 1 to 29 but excluding Parts 21-24), assuming an average imperviousness of approximately 70%. Any changes within the drainage areas that might increase the required storage volumes or increase the flows to or from the stormwater management facility or any structural/physical changes to the stormwater management facility including the inlets and outlets will require an amendment to this Approval. 2. EXPIRY OF APPROVAL This Approval will cease to apply to those parts of the proposed Works which have not been constructed within five (5) years of the date of this Approval. 3. CHANGE OF OWNER (1) The Owner shall notify the Director, in writing, of any of the following changes within thirty (30) days of the change occurring: (a) change of Owner; (b) change of address of the Owner; (c) change of partners where the Owner is or at any time becomes a partnership, and a copy of the most recent declaration filed under the Business Names Act , R.S.O. 1990, c. B17 shall be included in the notification to the Director; (d) change of name of the corporation where the Owner is or at any time becomes a corporation, and a copy of the most current information filed under the Corporations Information Act , R.S.O. 1990, c. C39 shall be included in the notification to the Director. 4. OPERATION AND MAINTENANCE (1) The Owner shall inspect the Works at least once a year and, if necessary, clean and maintain the Works to prevent excessive build-up of sediments and/or vegetation. (2) The Owner shall maintain a record the results of these inspections and shall identify any cleaning and maintenance operations undertaken. The record shall include the following: (a) the name of the Works; and (b) the date and results of each inspection, maintenance and cleaning, including an estimate of the quantity of any materials removed. 5. MONITORING AND REPORTING (1) The Owner shall carry out a monitoring program for the inspection and maintenance of the Works as outlined in the section on Operation and Maintenance on page 25 of the Cooksville Stormwater Management Pond Retrofit (Suite 317) - Facility #3702 for the 317 SWM Facility, dated December 1, 2015, prepared by Aquafor Beech Ltd, forming part of this Approval, and shall make the information available to the Ministry, upon request.
