ii Executive Summary

1. The Government of Cambodia is in receipt of an ADB Loan # 2376 CAM (SF) and Grant # 0092 CAM (SF) to fund the Tonle Sap Lowlands Rural Development Project executed by the Ministry of Water Resources and Meteorology (MOWRAM) and is implemented in the three Provinces of , (KCHN) and Kampong Thom (KTH). The Project aims to improve rural infrastructure and support agricultural development with major sub-projects and also includes a component of block grants to selected Commune Councils for their implementation of small scale infrastructure sub- projects that assist in the livelihoods enhancement of beneficiaries.

2. The 2nd semester monitoring report is covered from 1 st May to 31st October 2012. During the period, EMO has focused their activities in the three provinces, namely PST, KCHN and KTH by participating in public meeting, direct observation on DMS, contract making, conduct SES in KTH (Batch: 1, 2, 3 &4) and follow up on grievance process. In addition, EMO also follow up and fine out other outstanding issues.

3. Up to 31st October 2012, IRC WG has completed DMS in total= 1,331 AHs, comprising 418 AHs from Pursat, 506 AHs from Kampong Chhnang and 407 AHs from .

4. Until now, there are 1,053 AHs signed their contracts, comprising 418 AHs in Pursat, 506 AHs in KCHN province and 129 AHs in KTH province. Compensation payment has been done only for AHs in batch 1 and 2 of the three provinces. All 651 AHs in the three provinces, who signed their contracts, have received their compensation payments for their loss assets.

5. The same as previous semester, up to now, the total amount for cash compensation is USD 115,288.27 , comprising USD 78,511.26 for land compensation, USD 115.00 for structures compensation, USD 3,572.01 for tree compensation and USD 33,090.00 for other allowances.

6. In order to development of baseline survey (SES/KARE), a structured sub-sample of approximately 20% of AHs and as well as at least of 25% of severely affected households. Up to now we have interviewed in total 82 households which drawn from 235 AHs of DMS list (Batch: 1, 2, 3, & 4). For PST and KCHN the survey will be conducted in next semester.

7. On the other hand, EMO also followed up and found some outstanding issues during the monitoring period. Please read in section V for more detailed information.

iii I. Project Background

8. The Government of Cambodia is in receipt of an ADB Loan # 2376 CAM (SF) and Grant # 0092 CAM (SF) to fund the Tonle Sap Lowlands Rural Development Project executed by the Ministry of Water Resources and Meteorology (MOWRAM) and be Implemented in the three Provinces of Pursat, Kampong Chhnang and Kampong Thom by the Provincial Departments of the Ministry of Interior, Ministry of Rural Development and Ministry of Agriculture, Forestry and Fisheries. The Project aims to improve rural infrastructure and support agricultural development with major sub-projects and also includes a component of block grants to selected Commune Councils for their implementation of small scale infrastructure sub-projects that assist in the livelihoods enhancement of beneficiaries.

9. Pursat (PST) SRP of Batch 1 & 2 in August 2011 and Batch 3, 4 & 5 in October 2012: The Batch I involves the expansion of Natural Pond which will provide irrigation to 20 ha agricultural land in the surrounding irrigation command area. Civil work under the subprojects and related civil works will expand the capacity of the pond and create a water gate. Batch II of the Pursat irrigation programme is for increased capacity in the Otatong irrigation system, involving 6 Secondary Canal subprojects and seven tertiary canal sub-projects. Batch III consists of 2 subprojects; namely i) Kampang Village Dyke Rehabilitation and ii) Preah Chambork Canal System Rehabilitation. Batch IV consists of 2 subprojects; namely i) Koh Svay Canal System Rehabilitation Part A and ii) Koh Svay Canal System Rehabilitation Part B. Batch V consists of 2 subprojects; i) namely Siya Secondary Canal Rehabilitation Part A and ii) namely Siya Secondary Canal Rehabilitation Part B.

10. Kampong Chhnang (KCHN) SRP of Batch 1 &2 in September 2011 and Batch 3 & 4 in October 2012: The subprojects which are the subject for Resettlement involve, in Batch I, two subprojects for the rehabilitation and heightening of the dike enclosing the Kanleang Bei reservoir, and will increase the command area of the irrigation system by hectares. Batch II subprojects consist of the expansion of three Reservoirs, Chumnyke Mon, Beung Kul and Beung Lang. Batch III consists of 4 subprojects; namely i) Banteay Thlok main canal rehabilitation Part A, ii) Banteay Thlok main canal rehabilitation Part B, iii) Banteay Thlok main canal rehabilitation Part C, and iv) Banteay Thlok main canal rehabilitation Part D. Batch IV consists of 2 subprojects; namely i) O Kan Yous main canal rehabilitation 1 and ii) O Kan Yous main canal rehabilitation 2.

11. Kampong Thom (KTH) SRP of Batch 1 &2 in August 2011 and Batch 3 & 4 in September 2012: The Batch I is a secondary canal subproject. The subprojects in Batch II involve the reconstruction and improvement of the existing reservoir at Kampreal Village, Pralay Commune, , by the heightening of a total of 936m length of the dam, and replacement of three head works structures. The two subprojects aim to improve the irrigation of 286 ha of agricultural land in the surrounding irrigation command area. Batch III consists of 2 subprojects; namely i) Boeung Tbong Secondary Canal Rehabilitation Part A and ii) Boeung Tbong Secondary Canal Rehabilitation Part B. Batch IV consists of 4 subprojects; namely i) Nong San Secondary Canal Rehabilitation Part A, ii) Nong San Secondary Canal Rehabilitation Part

1 B, iii) Dambok Youn Main Canal Rehabilitation Part A, and iv) Dambok Youn Main Canal Rehabilitation Part B.

12. The land acquisition and resettlement impacts of all subprojects in the three provinces are considered not significant. Therefore, the subprojects are classified as Category B and a short resettlement plan is required.

II. Scope of resettlement impacts and Budget

2.1 Scope of Land Acquisition and Resettlement

13. Pursat-SRP of Batch 1, 2, 3, 4 and 5: The detailed measurement surveys were conducted among the above sub-projects to collect data on the number of affected people (APs) and the types and amounts of land, structures and other assets that will be affected by the land acquisition. DMS assessment in the subprojects identified i) for Batch 1 and 2, there are three households will suffer land loss of a total of 2 hectares in the expansion of the Natural Pond. The impact is primarily on 12.05 ha of rice land and 0.25 ha of residential land. No structures are affected; ii) for Batch 3, 4 and 5, there are A total of 153 trees and fruit trees are lost 168 households (700 persons) to be lost small amount of land, structures and/or crops and trees, 8 households to be lost 10% or more of productive land. In total for Batch 3, 4 and 5 of the 6 subprojects will acquire 50,301.42m2 of rice field and 3,383.5m2 of residential land.

14. Kampong Chhnang-SRP of Batch 1, 2, 3 and 4: The resettlement impact of Batch 1, there is only impact is on rice paddy adjoining the dike with the total land loss of 1.7 ha and 98AHs. For Batch 2, the impact is mainly agricultural land for rice production is affected and no structures are affected by the subprojects. Based on the DMS, the Chumnyke Mon Reservoir will need to acquire 8,177.34m2 of rice land and 445.65m2 of residential land belonging to 46 households. Of the 46AHs, one household is severely affected. The Boeung Kul Reservoir has small areas of affected residential land of 525.10m 2 (without structure) and 7,974.38m2 of rice land, which are owned by 42 households. There were also no trees and structures were affected by the Boeung Lang Reservoir. The reservoir needs to acquire only rice land of 20,810.56m2 currently owned by 86households. Although, the affected rice land is larger than the other two reservoirs, the affected area of each household is less than 5% of their productive land (82% of 86AHs), and less than 2% of their productive land (18% of the 68 AHs). No AH loses more than 5% of productive land. Of the 86 AHs, there is one small shop will be affected by the Chumnyke Mon reservoir and it is required to be shifted back.

15. For Batch 3 and 4, the detailed measurement surveys (DMS) were conducted among the sub-projects to collect data assets that will be affected by the land acquisition. DMS assessment in the 6 subprojects identified i) 235 households to be lost small amount of land, structures and/or crops and trees, ii) 5 households to be lost 10% or more of productive land, and iii) no single household to be relocated or rebuilt house and/or shop on new place. The land acquisition and resettlement impacts of the subprojects are considered not significant.

2 16. Kampong Thom-SRP of Batch 1, 2, 3 and 4: The Batch I secondary canal subproject will have the impact 31,131.85 m2 agricultural land and 592 m2 residential land. It will also cause the loss of 1 dug well and 1 toilet. The loss of trees is 1 mango, 56 palm, 8 cashew, 2 Krasaing, 3 bamboo clumps, 2 coconuts and 241 cassias. There are 115 households were affected by this Batch I secondary canal. The subprojects of Batch 2 will acquire approximately 0.57 ha agricultural land. According to the DMS, there are 14 households were affected by the subprojects in Batch II, and there are a total of 129 AHs affected by the Subprojects in Batch I and II, in which 34 AHs are vulnerable households with 40 factors of vulnerabilities.

17. The detailed measurement surveys (DMS) were conducted among the sub- projects of Batch 3 and 4 to collect data assets that will be affected by the land acquisition. DMS assessment in the 6 subprojects identified i) 106 households (501 persons) to be lost small amount of land, structures and/or crops and trees, ii) 1 households to be lost 10% or more of productive land, and iii) no single household to be relocated or rebuilt house and/or shop on new place.

2.2 Implementing Agency

18. The DMS was conducted by IRC WG jointly with Pursat, Kampong Chhnang and Kampong Thom Provincial Working Group and local authorities (thereafter called Team). The team was organized in each province and was divided into 2 sub-groups, in each sub-group there are 4 or 5 members. IRC WG includes 2 staffs from MEF, 1 staff from MOWRAM, 1 staff from MLMUPC, 1 staff from MAFF and 4 staffs from PRSC. The DMS result is demonstrated as below:

4 2.3 Budget (USD currency)

19. All costs for subproject resettlement programs (Batch 1, 2, 3, 4 and 5/PST) under TSLSP including compensation and allowances, operation and administration costs, surveys, with exception of monitoring and reporting that is financed from grant funds from ADB. The Ministry of Economy and Finance (MEF) will provide the above budget directly to the IRC and the IRC will disburse the fund to PDEF for payments of land acquisition, compensation and allowances to AHs.

5 III. Schedule

20. IRC and MOWRAM will ensure that contractor will not be issued notice to commence for any part of a section of a road to begin construction work unless it has (a) satisfactorily completed in accordance with the approved RR, compensation payment; (b) ensured that income restoration program is in place under component 2 of the project; and (c) area required for civil works is free of all encumbrances.

21. The table below contains an implementation schedule of the Approved RP 2011 and 2012 in PST, KCHN and KTH province. The implementation schedule is for subprojects of batch 1, 2, 3,4 and 5/PST with resettlement impacts only.

IV. Status of Accomplishment during the Monitoring Period

4.1 EMO’s Activities

22. In the second semester (from 1 st May to 31st October 2012), EMO carried out their activities in Pursat, Kampong Chhnang (KCHN) and Kampong Thum (KTH) province as following: - Direct observation on DMS process in KTH province; - Participation in Public Meeting in Pursat and KCHN province; - Direct observation on Contract Making process in Pursat and KCHN province; - Conduct SES in Kampong Thum province for batch 1,2,3 and 4; - Follow up on Grievance process in KCHN province; and - Follow up and fine out the outstanding issues.

4.1.1 Direct observation on DMS process in Kampong Thum province

23. On 10th July 2012, at Bakong Pagoda, Bakong village, Tbaeng commune, , Kampong Thum province, there was a public meeting before DMS process which conducted by IRC WG jointly with Provincial Resettlement Sub- Committee Working Group and local authorities (thereafter called Team). The meeting was headed by Mr. Nil Ratanak, deputy team leader of IRC WG/MEF. There are 78 participants participated in the meeting, comprising 23 AHs from Tbaeng Kha village, 44 AHs from Bakong village, 2 AHs from Ta Ream village and 9 persons from IRC WG, LA and EMO. The three villages are located in Tbaeng commune, Kampong Svay district. During the meeting the AHs (by 6 secondary canals, Batch 5) were informed about the project background information, benefit and impact of the project, compensation entitlement, allowance and assistance (for relocated and vulnerable people), and grievance procedure. The dissemination was also notified to AHs about the COI. They also confirmed that the project cost is a loan from ADB, but the resettlement cost is the responsibility of the Cambodia Government. During the DMS process, the AHs were requested to bring their family book, ID card, land title...etc.

24. From 11th to 28 th July 2012, IRC WG and Local Authorities have done DMS registration in 6 secondary canals of Bakong (3), Tbaeng Kha (2) and Ta Ream (1) sub-

7 project area, in Tbaeng commune, Kampong Svay district, KTH province. The sub- project is affected on 172 AHs (205 plots) who are living in Tbaeng commune. The DMS process was conducted smoothly and in transparency manner with EMO observation.

4.1.2 Participated in Public Meeting

25. The public meeting has been organized at village or commune level in advance 2 or 3 days before DMS conducting. LA has played the key role in dissemination of the meeting schedule to AHs in their village. In the meeting, IRC WG has informed participants on project schedule, COI, compensation entitlement, and grievance procedure.

Pursat province:

26. On 10th July 2012 at 2:30 PM, IRC WG jointly with PRSC of , 10 members, has organized a public meeting with the affected households (by Siya secondary canal, Batch5) at Kandeang commune center, Kandeang district, Pursat province. The meeting was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF. During the meeting IRC WG also inform about the contract making schedule, allowance and assistance (for relocated and vulnerable people), and grievance procedure. There are 21 participants in the meeting, comprising 7 AHs from Kampong Krasaing village, 5 AHs from Prey Kdei village, and 9 persons from IRC WG and LA. The two villages are located in Kandeang commune, Kandeang district. All participants are happy and commitment to joint with the project.

27. At 2.00 p.m. on 12 th July 2012 at Poraingsey pagoda, in Nikom Leu village, Svay Daunkaev commune, , Pursat province, there was a public meeting to inform affected households by Kapang dam (Batch3) sub-project area about contract making process. There are 8 committee members, coming from IRC, Sub-IRC committee members and LA, and 69 villagers in Nikom Leu, comprising 37 males and 32 females. The meeting was headed by Mr. Khen Sovatha Ra, deputy team leader of IRC WG/MEF with the purposes are to i) inform about contract making schedule of the project, ii) spread out the RCS rates and compensation process, iii) compensation entitlement and iv) Grievance procedure. The RCS rates are Res. land: 1.50$/m 2, Agric. land: 0.30$/m 2,

8 Mango 28$/tree, Coconut 27$/tree, Sugar palm 25$/tree...concrete well 221$/set... vulnerable group, SAH and poor household assistant 240$/AH.

28. On 17 th July 2012 at 2:30 PM, IRC WG jointly with PRSC of Pursat province, 10 members, has organized a public meeting with the affected households (by Koh Svay canal, Batch 4) at Koh Savy primary school, in Koh Savy village, Khna Totoeung commune, Bakan district, Pursat province. The meeting was headed by Mr. Chheang Chhor Line, team leader of IRC WG/MEF. During the meeting IRC WG also inform about the contract making schedule, allowance and assistance (for relocated and vulnerable people), and grievance procedure. There are 30 participants in the meeting, came from Koh Svay village. The RCS rates are Res. land: 0.63$/m 2, Agric. land: 0.39$/m 2, Mango 28$/tree, Coconut 27$/tree, Sugar palm 25$/tree...concrete well 221$/set... vulnerable group, SAH and poor household assistant 240$/AH.

29. On 19th July 2012 at 2:00 PM, IRC WG jointly with PRSC of Pursat province, 8 members, has organized a public meeting with the affected households (by Preah Chambak canal, Batch 3) at Preah Chambak village center, Trapaing Chorng commune, Bakan district, Pursat province. The meeting was headed by Mr. Khen Sovatha Ra, deputy team leader of IRC WG/MEF with the purposes are to inform about the contract making schedule, allowance and assistance (for relocated and vulnerable people), and grievance procedure. There are 26 participants in the meeting, came from Preah Cham Bak village. There are 15 committee members, coming from IRC, Sub-IRC committee members and LA, and 87 AHs coming from Serey village, comprising 51 males and 36 females. The meeting was headed by Mr. Khen Sovatha Ra, deputy team leader of IRC WG/MEF. The main purposes of the meeting are to i) inform on contract making schedule, ii) Compensation rates, iii) Other allowances and iv) Grievance procedure. Public meeting on contract making process at Anchanh Roung commune center

4.1.3 Direct observation on contract making process

Pursat province:

32. On 11 th July 2012 at Kandeang commune center, Kandeang district, Pursat province, there was a contract making process for 12 AHs (by Siya secondary canal, Batch5) , comprising 7 AHs from Kampong Krasaing village, 5 AHs from Prey Kdei village, in Kandeang commune, Kandeang district. The committee is consisted 8 members, coming from IRC, PRSC and LA. The contract making process was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF, joined by LA and External monitors. The processes were smoothly and transparently. All AHs agreed to sign their contracts.

33. During four days from 12 th to 16 th July 2012, IRC WG jointly with PRSC of Pursat province, 8 members, has made contract with the affected households by Kapang dam (Batch3) sub-project at Nikom Leu village, Svay Daun Kaev commune, Bakan district, Pursat province. The contract making process was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF. There are 82 AHs, coming from Nikom Leu village. All AHs have signed their contracts. They are happy to joint with the project. The contract making process is going smoothly with the observation from EMO.

34. From 17th to 18 th July 2012, IRC WG jointly with PRSC of Pursat province, 12 members, has made contract with the affected households (by Koh Svay canal, Batch 4) at Koh Savy primary school, in Koh Savy village, Khna Totoeung commune, Bakan district, Pursat province. The contract making process was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF. There are 48 AHs coming from Koh Svay village. All of them have signed their contracts and happy to joint with the project. The contract making process is going smoothly with the observation from EMO.

11 Kampong Chhnang province:

36. From 24 th July to 4th August 2012, IRC WG jointly with PRSC of KCHN province, 15 members, has made contract with the affected households (by Banteay Thlork main canal, Batch 3) at Khon Rang and Psar commune center, Baribour district, KCHN province. The contract making process was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF. There are 159 AHs, comprising 35 AHs from Psar commune and 124 AHs from Khon Rang commune. All of them have signed their contracts and happy to joint with the project. The contract making process is going smoothly with the observation from EMO.

37. From 6 th to 8 th August 2012, IRC WG jointly with PRSC of KCHN province, 10 members, has made contract with the affected households (by O Kan Yuos canal, Batch 4) at Anchanh Roung commune center, Baribour district, KCHN province. The contract making process was headed by Mr. Khen Sovathara, deputy team leader of IRC WG/MEF. There are 76 AHs are coming from Anchanh Roung commune. All of them have signed their contracts and happy to joint with the project. The contract making process is going smoothly with the observation from EMO.

4.1.4 Conduct SES/KARE survey in KTH province for Batch 1, 2, 3 and 4

38. In order to development of baseline survey (SES/KARE), a structured sub-sample of approximately 20% of AHs and as well as at least of 25% of severely affected households. Up to now we have interviewed in total 82 households which drawn from 235 AHs of DMS list (Batch: 1, 2, 3, & 4). For PST and KCHN the survey will be conducted in next semester. See the interviewee name’s list in annex 2.

4.1.5 Grievance process

Kampong Chhnang province:

39. After first and second consultation meeting between IRC WG and 35 AHs (11% of all AHs) who have their rice field in the reservoir, on 9 August 2012 at 2:30 pm there was another meeting to negotiate with the AHs. The meeting has finished without any solution, but the committee and AHs agreed to have another meeting in next time.

4.2 Achievable IRC’s Activities

40. Base on the schedule above of updated RP 2011 and 2012, all IRC-WG activities have been achieved. The detailed activities are described follow:

4.2.1 Public meeting

41. IRC-WG has conducted public meetings with AHs and LA in KTH before they conduct DMS, and in PST and KCHN provinces before they conduct contract signing. During the Public meetings IRC-WG has described on the project background and benefit, explained the project policy and compensation entitlement, about RCS rates to ensure that all affected properties will be compensated at market price, DMS and compensation (contract and payment) process, expected impact of the project, local

12 authority participation in Resettlement Sub-Committees, and grievance procedures such as they can lodge their complaints through LA if they have disagreed with the project. The detailed schedules are described in section 4.1.1 and 4.1.2.

4.2.2 DMS process

42. Up to 31st October 2012, IRC WG has completed DMS in total= 1,331 AHs, comprising 418 AHs from Pursat, 506 AHs from Kampong Chhnang and 407 AHs from Kampong Thom province. The result demonstrates by district as below:

4.2.3 Compensation process

43. - Contract making process: Until now, there are 1,053 AHs signed their contracts, comprising 418 AHs in Pursat, 506 AHs in KCHN province and 129 AHs in KTH province (see table 1 above for more detailed results).

44. - Payment process: The same as previous semester, up to now only 651 AHs in the three provinces have received their compensation payments for their loss assets. The total amount for cash compensation is USD 115,288.27 , comprising USD 78,511.26
