Приведены основные теории, раскрывающие суть государства как «юридического феномена», описывается объективная потребность в непосредственном управлении экономикой в период экономического кризиса. Описывается необходимость обеспечения сбалансированности федерального бюджета как направления обеспечения экономической безопасности государства. Предложен новый подход к формированию доходов федерального бюджета Российской Федерации. Abstract: The article reveals the concept of ensuring economic security of society and individual through state participation in the economy. The basic theories revealing the essence of the state as a “legal phenomenon” are given, the objective need for direct economic management during the economic crisis is described. The necessity of ensuring the balance of the federal budget as the direction of ensuring the state economic security is described. A new approach to formation of the federal budget revenues of the Russian Federation is proposed. В процессе становления и развития рыночной экономики в Российской Федерации возникает объективная необходимость в создании новых орга- низационных форм ведения хозяйственной деятельности. В силу активного встраивания России в мировые экономические про- цессы в конце ХХ — начале XXI века имеет место трансформация граждан- ского законодательства, характеризующаяся появлением новых форм ор- ганизаций, имеющих целью получение прибыли от своей деятельности. При этом, в силу значительного государственного участия в российской экономике создаваемые организационно-правовые формы юридических лиц в Российской Федерации имеют особенности как на этапе правовой регламентации, так и в процессе хозяйственной деятельности. В настоящее время в силу цикличности мировой рыночной эконо- мики, длительного экономического спада в 2008–2009 гг. и 2014–2019 гг. становятся особенно актуальными вопросы обеспечения безопасности жизненно важных экономических интересов Российской Федерации. В сложившихся условиях предпринимаются особые усилия по обес- печению экономической безопасности, в том числе на законодательном уровне, путем прямого участия государства в экономической жизни об- щества, изыскания новых источников финансирования социальных обя- зательств, разработки новых форм и методов инвестирования временно свободных денежных средств. На уровне «государство» решаются задачи по защите жизненно важных интересов, таких как обеспечение роста эко- номики, повышение устойчивости России к внешним и внутренним эко- номическим угрозам, укрепление экономического суверенитета страны. Процесс становления любого государства происходит одновремен- но с развитием общества. В настоящее время в юридической литературе существует большое количество теорий и подходов к образованию и по- строению государства. Исходя из определения, описанного в Большом юридическом словаре, под государством понимается: «способ организа- ции общества, основной элемент политической системы, организация 8 na-journal.ru Экономика и менеджмент публичной политической власти, распространяющаяся на все общество, выступающая его официальным представителем и опирающаяся на сред- ства и меры принуждения» [1]. Русский юрист Б. Н. Чичерин писал «о древнем государстве» и подчи- ненном положении личности в нем на примере античного мира. Одновре- менно, им был сделан вывод «о новом государстве», относящемся к эпохе нового времени, когда личность начинает предъявлять свои права в обще- ственной жизни, и таким образом государство представляет собой идею «высшего единства общества» Австрийский юрист Г. Кельзен, основатель теории правового норма- тивизма, использовал понятие «государство» для обозначения «общества как такового или же какой-либо особой формы общества» (в широком смысле), либо «какого-либо особого органа или органов общества» (в уз- ком смысле), и считал, что государство должно рассматриваться в качестве юридической, социологической категорий; живого (естественного) орга- низма; нормативного порядка. В качестве «правового феномена» государство представляет собой корпо- рацию, от которой отличается наличием объединения всего общества в це- лом («масштабом нации») и наличием правового порядка. Одновременно, модель отношений между государством и правом в понимании Г. Кельзена представляла собой аналогичную форму взаимодействия личности и права. При социологическом подходе государство представляет собой некую социальную общность с распределением власти по различным органам, существующую независимо от права. В соответствии с идеей «естественного организма» государство рассма- тривалось как естественно-существующий институт, предназначенный для обеспечения благополучия всех членов общества. Согласно идее государства, как «системы норм, нормативного поряд- ка», феномен «государства» имеет политический характер, как следствие, оно создает определенную организацию общества с определенными пра- вилами поведения. Именно государство обладает монополией на насилие, поэтому им определяется порядок применения силы. На разных этапах исторического развития существовали различные подходы к феномену «государства». Kazakhstan's diplomacy has deep historical roots. “Steppe diplomacy dressed in tails” – this phrase emphasizes both the old and the young nature of the Kazakh diplomacy [1, p.27].     SELECTED WORKS OF CHOKAN VALIKHANOV CHOKAN OF WORKS SELECTED SELECTED WORKS OF CHOKAN VALIKHANOV Pioneering Ethnographer and Historian of the Great Steppe When Chokan Valikhanov died of tuberculosis in 1865, aged only 29, the Russian academician Nikolai Veselovsky described his short life as ‘a meteor flashing across the field of oriental studies’. Set against his remarkable output of official reports, articles and research into the history, culture and ethnology of Central Asia, and more important, his Kazakh people, it remains an entirely appropriate accolade. Born in 1835 into a wealthy and powerful Kazakh clan, he was one of the first ‘people of the steppe’ to receive a Russian education and military training. Soon after graduating from Siberian Cadet Corps at Omsk, he was taking part in reconnaissance missions deep into regions of Central Asia that had seldom been visited by outsiders. His famous mission to Kashgar in Chinese Turkestan, which began in June 1858 and lasted for more than a year, saw him in disguise as a Tashkent mer- chant, risking his life to gather vital information not just on current events, but also on the ethnic make-up, geography, flora and fauna of this unknown region. Journeys to Kuldzha, to Issyk-Kol and to other remote and unmapped places quickly established his reputation, even though he al- ways remained inorodets – an outsider to the Russian establishment. Nonetheless, he was elected to membership of the Imperial Russian Geographical Society and spent time in St Petersburg, where he was given a private audience by the Tsar. Wherever he went he made his mark, striking up strong and lasting friendships with the likes of the great Russian explorer and geographer Pyotr Petrovich Semyonov-Tian-Shansky and the writer Fyodor Dostoyevsky.

The ethnic territory of the Kazakh people is the national borders of today’s Republic of Kazakhstan, inherited from the nomadic ancestors – the Kazakh Khanate. Uluses are a distinctive feature of the social structure of nomads, Zhuzes are one of the Kazakh nomads. In this regard, our goal is to determine their role in shaping the ethnic territory of the Kazakh people. To do this, a comparative analysis will be made according to different data and historiographic materials, in addition, the article will cover the issues of the appearance of the zhuzes system in Kazakh society and its stages. As a result of this work, the authorial offers are proposed – the hypothesis of the gradual formation of the ethnic territory and the Kazakh zhuzes system. The formation of the ethnic territory of the Kazakh people is closely connected not only with the political events of the period under review, but with ethnic processes. In the article considers with the problem of the steppe memory of a nomad within the limits of memory studies. The article deals with the problem of nomad steppe memory in the framework of memory studies.Steppe memory is presented as a system of intuitive memories from the past to the present and future. The movement of the steppe memory in time and space is investigated by means of codes. The scientific paper states, that cultural codes are carriers of the steppe memory, identity, knowledge, values and represent the internal historical, cultural reserves and heritage of the steppe civilization. The representation of steppe memory occurs through visual and cultural codes. Visual and cultural codes are the specific language for the transfer of national identifiers. The visual codes of the Kazakh nomad consist in the remodeling of the steppe memory through the art of the artists of Kazakhstan in the XXI century. The scientific paper attempts to make sense of the cultural code of the Kazakh culture through the visualization of two frequently encountered images - the image of a woman and a yurt. Comprehension of cultural codes occurs in the historical and philosophical feedback of the woman’s image in the Turkic and Kazakh culture.

Oral Tradition ABSTRACT The origin and development of statehood in the territory of Kazakhstan dates back to a long time. Alasha the Khan is certainly the nominal, generalized image of that era. Horse-breeding tribes created the very first nomadic civilization in the world which were far ahead compared to the others on labor productivity level, on benefit to the individual and as a way of improving the economy, it is as well in harmony with nature. In this environment, there was a feeling of statehood among the people and this subsequently made far and close neighbours stick together. The formation of Kazakh khanate is connected with the political disintegration of the Golden Horde at the end of the 14th and the beginning of the 15th century. The events connected with the falling of the Golden Horde and the formation of the Kazakh Khanate have found a reflection in the Kazakh historical legends and in monuments. Aiteke Bi, Almaty, Kazakhstan ABSTRACT The authors analyzed the diplomatic practice of the Kazakh Khanate and independent Kazakhstan. Based on the works Kussainova A. and Gusarova A. try to describe the main diplomatic actors – the khans, sultans, biys, diplomats and the First President of sovereign Kazakhstan NursultanNazarbayev – which in their foreign-policy activity were used such diplomatic methods as the conclusion of inter-dynasty marriages, the use of interstate and intrastate conflicts, searching and finding allies, representation of amanats in the past and establish economical and political agreements, held multi- vector policy in nowadays. KeyWords: The khans, sultans, biys, amanat, agreement. Kazakhstan's diplomacy has deep historical roots. “Steppe diplomacy dressed in tails” – this phrase emphasizes both the old and the young nature of the Kazakh diplomacy [1, p.27]. Since the second half of the XV century on the stage of history goes independent Kazakh feudal-patriarchal state. Diplomatic practice of the Kazakh Khanate not initially relied extensively on the forms and methods of the rich arsenal of predecessors – the ancient Turks and the Golden Horde [2, p.66].
