La rivista nasce poco dopo il Conventus Internationalis Canonistorum (preparato dalla PCCIC Recognoscendo), tenutosi a Roma dal 20 al 25 maggio 1968. Il primo numero della rivista uscirà nella metà del 1969, con il chiaro compito di aiutare a conoscere come stavano procedendo i lavori per l’elaborazione del nuovo Codice. L’obiettivo che ci prefiggiamo è di offrire uno strumento che possa essere d’aiuto a coloro che, per motivi accademici, professionali o personali, sono interessati ad uno studio approfondito delle pubblicazioni sui lavori per l’elaborazione dei canoni relativi ai libri del Codex Iuris Canonicum 1983. Concentreremo l’attenzione sui libri “De Ecclesiae munere sanctificandi (titulus: de matrimonio)” e “De processibus”, con il fine di procedere ad un’unificazione che aiuti ad ordinare l’abbondantissimo materiale reperibile nei diversi numeri della rivista. Anche abbiamo pensato nella possibilità di farlo studio sul libro VI “De Sanctionibus in Ecclesia”. È stato a guidare il “Coetus” nella riforma dell’attuale Codice, Pio Cipriotti. Purtroppo si è tenuto i verbali delle sessioni che poi si sono persi, ragion per cui non ci sono sulla rivista Communicationes 3. Siamo partiti dallo studio di J. FOX e G. CORBELLINI del 1987 4, e contenuto in Communicationes nel nº 19. Si tratta di una sintesi dei lavori per l’elaborazione del Codex, tali come sono stati realizzati. Ma come gli autori affermano nei Praenotanda: 1 Sono stati studiati i nn. 1-43 (1969-2011) della rivista Communicationes (attualmente semestrale, con uscita a luglio e a dicembre). 2 Prima del Concilio Vaticano II era chiamata Pontificia Commissio Codici Iuris Canonici Recognoscendo (PCCICR), per passare ad essere chiamata Pontificia Commissio Codici Iuris Canonici Authentice Interpretando nel 1985. Dal 1989 fino al 1998 sarà chiamato PCLT Interpretandis. Nel 2000 il nome del PC rimane senza “Interpretandis”. 3 Sono stati finora pubblicati in Communicationes: i lavori preparatori del nuovo Codice (Diritto Penale), in Communicationes 2 (1970) 99-107, 194-195; Communicationes 5 (1973) 195-196; Communicationes 7 (1975) 93-97; i resoconti delle riunioni di consultori, in Communicationes 8 (1976) 166-183; Communicationes 9 (1977) 147-174, 304-322; e le osservazioni fatte dai cardinali membri della Commissione di riforma all'ultimo progetto, in Communicationes 16 (1984) 38-51 (cann. 1263- 1351). La revisione di questa parte del Codice di diritto canonico è stata una delle più rapide; dopo un questionario preliminare del giugno 1966, si susseguirono vari progetti, che, discussi dai consultori (a questa materia), divennero praticamente definitivi nel primo semestre del 1969, ad eccezione di alcuni punti dubbi che furono risolti negli anni successivi. Tutto ciò, insieme con le riforme di sostanza, ha portato ad una riduzione del numero totale dei canoni, che da 220 sono divenuti 89. 4 Cf. Questo Schema Generale è diviso in due parti, delle quali la prima raccoglie le ephemerides degli avvenienti nella storia, la composizione e lavori della Pontificia Commissioni per la revisione del Codice di Diritto Canonico. L’altra riferisce i veri argomenti di ciascuna delle Sessioni di tutti i gruppi di studio 6. La rivista, che continua a essere pubblicata con cadenza semestrale, può essere di grande aiuto per la ricerca, soprattutto grazie alle relazioni sugli argomenti trattati nelle sessioni avute dai membri della Commissione, dei differenti gruppi di studio e dei consultori che lavorarono per portare avanti questo compito. Abbiamo diviso il nostro lavoro in cinque paragrafi basandoci sullo schema elaborato dagli autori precedentemente citati, ma soffermandoci su quello che ci interessa per raggiungere gli obiettivi proposti. Pur partendo dallo stesso sistema (che permette di rendere lo schema più simile al lavoro già realizzato), abbiamo aggiunto il numero delle pagine ove si trova ogni contenuto trattato nelle sessioni rispettive ed una appendix che indica la formazione del futuro Schema (nel nostro caso per i libri De Matrimonio e De Processibus). Nel primo paragrafo potremo vedere la formulazione storica dell’elaborazione del Codex, sezione assai importante dal nostro punto di vista per inquadrare tutto l’elaborato. Abbiamo tratto il percorso di elaborazione del Codice dall’articolo del Card. J. HERRANZ contenuto in “Comentario Exegético al Código de Derecho Canónico”, vol. I, e l’abbiamo completato con la Prefazione fatta per il Codex Iuris Canonicum e con il “Codice di Diritto Canonico e leggi complementari, commentato” pubblicato dalla Pontificia Università della Santa Croce e dalla casa editrice Colletti a San Pietro. Nel secondo paragrafo ci soffermiamo sul titolo De Matrimonio, contenuto del futuro Liber IV del Codex 83. Contiene quattro sezioni che trattano delle sessioni per l’elaborazione dei canoni che sistemeranno il contenuto giuridico del sacramento del Matrimonio. Nel terzo, il

Remus Mircea Birtz, OBSS Summary This study presents some data about the Romanian Traditional Catholic writers, the painter Paul Scorţescu / Scortesco / Scortzesco (1893, Yassy – 1976, Paris), his brother the diplomatic minister Theodor Scorţescu / Scortzesco (1895, Yassy – 1979, Buenos-Aires), known in the Romanian literature, and Miss Myra Davidoglou (1923, Bucharest – 2001, France) a graphic artist too. Some historical and genealogical data about the Scortzesco Moldavian-Romanian noble family are given, and a short landscape of the Traditional Catholic Resistance. It is proven that the well-known statement of Paul Scortzesco about the 1963 Conclave cannot be true, however without denying the election of Cardinal Giuseppe Siri as Pope (Gregory XVII) in the 1958 Conclave. Some biographical data about the Scortzescos can and must be certainly corrected, when new informations from the yet unknown Romanian Exile Culture will be available. Washburn The New Natural Lawyers, Contraception, Capital Punishment, and the Infallibility of the Ordinary Magisterium In the years following Humanae Vitae, the encyclical enjoyed little support from Catholic theologians; but a few moral theologians, led by Germain Grisez, heroically came to its defense.1 These theolo- gians attempted to use their New Natural Law theory (NNLT) in the service of the magisterium, but their arguments proved inad- equate to stem the tide of dissent. In 1978, John C. Ford and Ger- main Grisez took a new approach, publishing an article arguing that the Church’s teaching on the immorality of artificial contraception was taught infallibly by the ordinary universal magisterium. Their article was so successful that Russell Shaw’s 1978 summary of their argument is still on the United States Conference of Catholic Bishops website.2 The NNLT, however, has led a number of its proponents to hold views on other theological issues that are clearly contrary to the teaching of Sacred Scripture and the doctrine of the Catholic Church, most notably on the issue of capital punishment.3 The NNL theorists do not merely argue that capital punishment should pru- dentially be set aside, given the numerous problems associated with its contemporary use, but that capital punishment should be con- demned as intrinsically evil.
