Banquet Room and Audio Visual Rental: Rentals are determined by event type at the time of booking. Revisions in group counts, times, dates or meal times, function may necessitate revision of room rental. All rentals are subject to 8% sales tax and 18% service fee. Any direct connections (fax, credit card machines, etc.) are not possible.

Deposits: Scheduled functions will not be considered definite until applicable deposit is received with a signed banquet event order. All deposits are non-refundable.

Guarantees: A guaranteed number of attendees must be received no later than 10 working days of event. This number is the minimum on which charges are based. If no guarantee is given, the original number of guests indicated will be the guaranteed number.

Payment: Payments can be made by cash, cashiers check or authorized credit card only. No personal checks can be accepted. All events must be paid in full 5 working days prior to event. Direct billed accounts are an exception.

Food: All food and beverage must be supplied and prepared by the hotel. Food and beverage selections are subject to 10% sales tax and 18% service charge. Leftover food will not be allowed to be taken off property. Our buffets are only a type of service and are not to be mistaken for “all you can eat”.

CATERING OR PRIVATE FUNCTION STANDARD TERMS AND CONDITIONS

Taxes and Service Charges : In addition to the charges set forth elsewhere in this agreement, patron agrees to pay any and all federal, state, municipal, or other taxes imposed on or applicable to the event of this agreement. All food, beverage and rentals are subject to 18% service and 8% state tax. Food and beverage are subject to an additional 2% hospitality tax.

Excused Non-performance : The performance of this agreement by either party is subject to acts of God, war within the continental US, governmental authority, disaster, strikes (exception: Hotel may not terminate this contract for situations involving the Hotel’s employees), civil disorder within 20 miles of the hotel, curtailment of transportation facilities, or any other emergency making it illegal or impossible to provide the facilities or to hold the event. This contract may be terminated without a cancellation charge for any of the above reasons by written notice from one party to the other.

Provision of Food & Beverage : No food or beverage of any kind will be permitted to be brought into the banquet rooms by the patron, guests, invites, or others from outside. All food and beverage must be provided by the hotel. Due to SC DEHC laws, leftover food will not be allowed to be taken off property. The hotel and patron shall adhere to all federal and state laws regulating the sale and service of alcoholic beverages.

Banquet Rooms and Rental : Function rooms are assigned to the anticipation number of guests. If there are fluctuations in the number of attendees, the hotel reserves the right to reassign the banquet room accordingly. Space assignments can be made by the hotel without notice. To comply with the security regulations from Hilton Worldwide, we have our meeting room phones set to auto dial the front desk. Any direct connections (fax, credit card machines, etc.) are not possible.

Conduct of Event : Patron shall conduct the event in an orderly manner, in full compliance with applicable laws, regulation and hotel rules. Groups that do not hold their event in a professional and respectful manner will not be rebooked and may be asked to terminate the event in progress. Patron assumes full responsibility for the conduct of all persons in attendance and for any damage done to any part of the hotel’s premise during any time such premises are under the control of, used by, or damaged by patron, or patron’s guest, attendee, or independent contractor employed by the patron.

Displays and Decorations : All displays and decorations proposed by patron shall be subject to the prior approval by the hotel in each instance. Any personal property of the patron, guests, or attendees brought onto premises of the hotel and left thereon either prior to of following the event, shall be at the sole risk of the patron. The hotel will not be liable for any loss of or damage to any such property for any reason.

Deposits and Guarantee : All deposits are due at time of signing of this agreement and are non-refundable. The remaining balance is due and payable the week prior to the event stated on the banquet event order. All initial deposits can be made by credit or debit card, cash or cashiers check. Where food and beverage functions have been scheduled, the number of people indicated to attend will be considered your final guarantee, not subject to reduction and charges will be made accordingly. The hotel will set and be prepared to serve five percent (5%) over this guarantee.

Deliveries: Arrangements for delivery of packages should be made through the sales department. You must prepay all packages sent to the hotel.

Cancellations: Neither party has a right to cancel or terminate this contract except as specified in this agreement. Neither party may make any changes to the terms of this agreement without the written consent of the other party. The patron agrees that it has no right to terminate this agreement for the sole purpose of changing its meeting site to another city or location. Should cancellation take place by the patron, any charges owed to the hotel, will be considered reasonable, and not as a penalty. These charges are subject to the hotel’s duty to mitigate its damages by making a reasonable effort to resell the canceled space. The hotel agrees that after receipt of this cancellation payment it will not seek additional damages.

Americans with Disabilities Act Mutual Compliance : The hotel warrants that it is in compliance with the Americans with Disabilities Act (ADA) and all regulations hereunder. The hotel will identify to patron, prior to acceptance of this contract, any ADA deficiencies that are “grandfathered” and that the hotel is not required to correct. The hotel and patron will each indemnify and hold harmless the other from any liability arising from ADA violations by the indemnifying party.

Arbitration and Attorney’s Fees : Any unresolved controversy or claim arising out of or relating to this contract or breach thereof, including without limitation any dispute concerning the scope of this clause, will be settled by arbitration in accordance with the commercial rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any award shall be limited to actual damages; punitive damages shall not be awarded. The prevailing party shall be entitled to recover its expenses of arbitration including but not limited to reasonable attorney’s fees and any other justifiable costs.

Final Payment : Unless credit has been established in advance by the patron with the hotel, payment in full of all balances due must be paid by certified or bank check on the same day we finalize the numbers guarantee. If credit has been established, payment will be due in accordance with the terms of no later than 30 days following the event.

Banquet Checks : All banquet checks must be signed by the person in charge or designated representative at the completion of each function. Any discrepancies in counts or charges must be identified and resolved at that time.
