The Chief Secretary for Administration will address the Council on "The Government Minute in response to the Report No. 48 of the Public Accounts Committee dated July 2007". 100 LEGISLATIVE COUNCIL ─ 17 October 2007 The Government Minute in response to the Report No. 48 of the Public Accounts Committee dated July 2007 CHIEF SECRETARY FOR ADMINISTRATION (in Cantonese): Madam President, laid on the table today is the Government Minute responding to Report No. 48 of the Public Accounts Committee (PAC). When presenting the PAC Report No. 48 on 11 July, the Chairman of the PAC set out in detail the comments of the PAC on three selected chapters from Director of Audit's Reports, viz the administration of short term tenancies (STTs), the administration of the Hong Kong Applied Science and Technology Research Institute Company Limited (hereinafter referred to as the "ASTRI") and the management of government fresh food wholesale markets. The Administration is grateful for the effort and time that the PAC has devoted. Today, I would like to highlight the key measures taken in the relevant areas. Details of the Government's response to the conclusions and recommendations in the Report are set out in the Minute tabled. Administration of STTs Land is one of our most valuable resources. It has always been our policy to optimize the use of this scarce resource. Where there is a vacant government site which has not been designated for specific use or is not required for development in the near future, the possibility for tendering it through STT for temporary use is explored. The STT system has been practised for many years, and the system has proven to be effective. On the one hand, we can derive some leasing revenue from these tenancies, and on the other hand the vacant sites can be put into various temporary uses. Although the Lands Department (LandsD) is relieved from managing those vacant government sites by way of STTs, in return it has to take up the extensive task of administering the STTs which have now totalled over 4 000 in different parts of Hong Kong. The LandsD has, over the years, developed its policies and practices for administering STTs. New issues arise as the number of STTs grows and the complexity of STTs intensifies. The Audit and PAC Reports came as a timely reminder for the LandsD to review its policies and practices. The LandsD has critically re-examined many aspects of STT administration, in response to the observations and recommendations made by the Audit Commission and the PAC. LEGISLATIVE COUNCIL ─ 17 October 2007 101 The observations and examinations made by the Audit Commission focus on three main areas in the STT system, namely administration of rent arrears, monitoring tenants' performance and enforcement of tenancy conditions. The LandsD has accepted all recommendations of the Audit Commission, and this has been noted by the PAC.

    LCQ11: Promotion of Cantonese Opera development *********************************************** Following is a question by the Hon Priscilla Leung and a written reply by the Secretary for Home Affairs, Mr Tsang Tak-sing, in the Legislative Council today (January 7): Question: With the joint effort of Guangdong, Hong Kong and Macao, the Chinese Ministry of Culture, in September last year, applied to the United Nations Educational, Scientific and Cultural Organisation for the inscription of Cantonese opera onto the Representative List of the Intangible Cultural Heritage of Humanity ("the inscription"). Furthermore, as an agreement on tenancy renewal has yet to be reached between the tenant and landlord of the Sunbeam Theatre in North Point, this large-scale performance venue for Cantonese opera may soon disappear. In this connection, will the Government inform this Council: (a) of the current policies to support the work of inscription by the Chinese Ministry of Culture, and to facilitate the sustainable development of Cantonese opera; (b) whether it will consider proposing options to the landlord and tenant concerned in respect of tenancy renewal for the Sunbeam Theatre, so as to preserve this performance venue for Cantonese opera with historic value; if not, of the reasons for that; (c) whether it will consider converting the Yau Ma Tei Fruit Market into a world-class large-scale Cantonese opera theatre, as well as converting the Yau Ma Tei Theatre into an academy of Cantonese opera, so as to nurture professionals and talents in the field; if not, of the reasons for that; and (d) given that many amateur artists and audience of Cantonese opera gather around Temple Street and the "Banyan Tree" in Yau Ma Tei, whether the Government will study the adoption of a targeted approach to promote and develop the culture of Cantonese opera in the area; if not, of the reasons for that? In 2015-2016, of those 3 100 cases pursued and concluded, 88.4% were concluded by inquiry (85.0% in 2014-2015), 7.3% by full investigation (10.4% in 2014-2015) and 4.3% by mediation (4.6% in 2014-2015). There was a significant increase in 2014-15 in the number of complaints handled by mediation. The number of cases resolved by mediation was largely maintained in 2015-16. 4. Based on the allegations made by the complainants, the top three causes for complaint in 2015-16 were: error, wrong decision or advice (32.1%) ineffective control (15.3%) delay/inaction (15.1%) These causes were the same as in 2014-15 in terms of order. 5. Among the 226 complaints concluded by full investigation in the 2015-16, 81 (35.8%) were substantiated, partially substantiated or unsubstantiated but other inadequacies found. Of the 2,740 inquiry cases concluded, inadequacies or deficiencies were found in 475 (17.3%). 6. Of the cases completed in the year, nearly 90% (87.5%) were concluded within three months, 12.1% were concluded in three to six months, while 0.4% took more than six months. 7. As in the past years, lodging complaints by email was the most popular mode. In 2015-2016, 2 507 email complaints (including by online complaint form) were received, accounting for 47.8% of the total complaints received. This was followed by letters through post, with 1 069 (20.4%) complaints. 8. Report No. 51] Laying of the Report The Report of the Director of Audit on the Accounts of the Government of the Hong Kong Special Administrative Region for the year ended 31 March 2008 and his Report No. 51 on the results of value for money audits were laid in the Legislative Council on 26 November 2008. The Committee's Report (Report No. 51) was subsequently tabled on 18 February 2009, thereby meeting the requirement of Rule 72 of the Rules of Procedure of the Legislative Council that the Report be tabled within three months of the Director of Audit's Report being laid. 2. The Government Minute The Government Minute in response to the Committee's Report No. 51 was laid in the Legislative Council on 20 May 2009. A progress report on matters outstanding in the Government Minute was issued on 12 November 2009. The latest position and the Committee's further comments on these matters are set out in paragraphs 3 to 40 below. Administration of short term tenancies (Paragraphs 3 to 4 of Part 3 of P.A.C. The Committee was informed that the Lands Department ("Lands D") was considering the option of asking tenderers of short term tenancies to provide a bank reference as a simpler and acceptable alternative, instead of requiring them to provide a personal guarantee and a statutory declaration.

Chan # Springer Science+Business Media Dordrecht 2013 Abstract This paper explores the policing of a traditional wholesale fruit market located in a densely populated neighborhood of urban Hong Kong. Based on ethnographic and historical research, we outline the political arrangements that govern the discretionary arrangements of police power at the market. A historically developed system maintains an informal status quo against various pressures to change. We identify crucial features in the contemporary policing system that emerge from a fusion between the democratic ethos of community policing ideals and non- democratic aspects of local administration in the Hong Kong Special Administrative Region. These features of this historically developed mode of order-maintenance, we suggest, might be seen as broadly characteristic of a “Hong Kong style” community policing. Introduction: function vs. history Hong Kong likes its fruit: government statistics estimate the city’s consumption at over 1,500 tons per day [2]. Distributing this perishable commodity is a big business, organized almost entirely through two wholesale markets: the Western Wholesale Food Market on Hong Kong Island and the Yau Ma Tei Wholesale Fruit Market in Kowloon [1]. Despite their functional equivalence as wholesale fruit markets, these are two quite different institutions. The Western Market is a new creation, engineered and run by the government to move a billion Hong Kong dollars of fruit every year. The Yau Ma Tei market, by contrast, is a messy, opaque, historically developed institution run by a traditional merchant’s association.
