North Carolina Department of Environment and Natural Resources Beverly Eaves Perdue Dee Freeman Governor Secretary MEMORANDUM TO: NORTH CAROLINA GENERAL ASSEMBLY Speaker Thom Tillis President Pro Tempore Phil Berger ENVIRONMENTAL REVIEW COMMISSION The Honorable David Rouzer, Chair The Honorable Mitch Gillespie, Co-Chair The Honorable Ruth Samuelson, Co-Chair FROM: Kari Barsness Director, Legislative and Intergovernmental Affairs RE: Supplemental Reporting on the Inactive Hazardous Sites Program Pursuant to G.S. 130A-310.2(b) DATE: Feb. 20, 2012 In 1987 the North Carolina General Assembly enacted the Inactive Hazardous Sites Response Act (G.S. 130A-310) to address sites with non-permitted releases of hazardous substances. This law requires two annual reports to the North Carolina legislature. G.S. 130A-310.10 requires certain elements be reported annually to the Environmental Review Commission by Oct. 1 each year. G.S. 130A-310.2(b) requires certain data be provided to each member of the General Assembly annually by Jan. 1 of each year. The October 2011 report has been provided to the Environmental Review Commission. This memorandum serves to convey the January report. G.S. 130A-310.2(b) requires that the department report to each member of the General Assembly the location of each inactive hazardous substance or waste disposal site in the member's district; the type and amount of hazardous substances or waste known or believed to be located on each of these sites; the last action taken at each of these sites; and the date of that last action. In fulfillment of this additional reporting requirement, but so as not to overwhelm your offices with paper, the following is provided. The location and status in the inventory for each site is shown organized by county on a table online at: http://portal.ncdenr.org/web/wm/sf/sfavailabledocs. Click on the link entitled “130A-310.2 Supplemental Report” under the reports header. In addition, activities at voluntary remedial action sites, priority cases, orphan site actions, imminent hazard abatement and National Priorities List sites are discussed in the Inactive Hazardous Sites report to the General Assembly. The report is also found at the above web link. That information continues to be included in the legislative report as well. Almost without exception, the "amount" of waste is unknown, as there is rarely a record of the amount of a spill. Also, because spills and dumping resulted in the contamination of various media, including soils and groundwater, a complete site characterization is needed and site-specific cleanup levels determined before that volume could be estimated. A table with the location of the Pre-1983 Landfills in the inventory organized by county is available at the web link indicated above. Click on “Old Landfill Inventory” under the Site Inventory header. These sites are being handled as prescribed in S.L. 2007-550 (Senate Bill 1492). As resources are available, the sites are ranked and transferred to the Sites Priority List. If a party volunteers to clean up a site and enters into an agreement with the Branch, the site is then transferred to the Voluntary Action category. Once cleanup is complete, the site is transferred to one of the "No Further Action" categories. Information on contaminants and contaminated media have only been compiled for the Sites Priority List. That information can be found in the Report to the North Carolina General Assembly on the Inactive Hazardous Sites Program. Other information on sites activities this reporting year can be found in that report in sections II -V of that report. The pre-1983 landfills are provided on a separate list as those sites will be handled as prescribed in SB1492 (2007 Session).
