While his fundraising and donation history is sporadic, he was considerably active for Democrats and Obama in 2008 and 2012. • As a registered Democrat, and someone who has financially supported Democrats, do you have any reservations about working in a Republican administration, and if so what are they? • Will you agree to cease all political activity and donations in support of Democratic candidates and causes inconsistent with the political goals of the President-elect while working within the administration? • Do you believe the aggressive rhetoric of this past campaign season has damaged Mr. Trump’s ability to governor? Hedging on Mr. Trump during the Campaign Deadline Background: During the campaign, Emanuel refused to answer whether he would welcome Trump back as a client if he lost the election. However, it should be noted Emanuel does have a lengthy positive professional history with Trump. • Given your history working with Mr. Trump, your lack of support during the campaign was notable. Do you have any doubt you will be able to publicly back the President during turbulent times should you join the administration? • Will you have any personal issues during times when the Trump administration faces partisan criticism from Democrats, including your brother Rahm or President Obama? 1 Environment At Emanuel’s Endeavor Background: In 2002, Emanuel’s company was sued by an employee for allowing “rampant pot-smoking, obscene hazing at corporate retreats, [and] sexual frolics on desks.” Emanuel was also accused of making antigay and racist slurs (the lawsuit was settled out of court). • Was there any truth to the allegations made about the work culture at your company, and if not why did the company decide to settle with the plaintiff? • Would it be at all likely that former employees might emerge with public accusations similar to those outlined in this lawsuit? • Has there been any event or problem at Endeavor that could arise and create issues should you join the administration? Past Business Relationship with Trump Background: Mr. Trump has been a client of Emanuel’s for years. Emanuel’s firm also recently purchased Mr. Trump’s Miss Universe Pageant In 2015. • Do you believe any past business relationships with Mr. Trump would create any appearance of a conflict of interest were you to join the administration? Policy Questions Gun Control Background: Emanuel is a staunch advocate for gun control and was extremely vocal following the 2012 Newtown shooting. • Will you have moral and ethical qualm being a member of an administration that will likely emphasize 2nd amendment rights and often oppose further regulation of firearms? • Should a major shooting occur and the debate in Washington turn partisan, will you be able to stand by the President? TRUMP-PENCE Trump In March 2016, Emanuel Refused To Answer Whether He Would Welcome Trump Back As A Client If He Lost The Election. “[The Hollywood Reporter:]Deadline Donald Trump was a WME client. You guys are both committed Democrats and have contributed to Hillary in this campaign. Given some of Trump's rhetoric, would you have him back as a client after the election if he doesn't win? Also, according to Ms. Epstein’s filings, Mr. Emanuel made antigay and racist remarks accusations he disputed at the time. Ms. Epstein said Mr. Emanuel blocked her from sending a script about the Navy Seals to the actor Wesley Snipes. ‘That is the dumbest thing I’ve ever heard,’ the agent was reported in the papers to have said.

    SENDING AGENTS TO THE PRINCIPAL’S OFFICE: How Talent Agency Packaging and Producing Breach the Fiduciary Duties Agents Owe Their Artist-Clients Brian T. Smith Abstract Talent agents have always been indispensable to writers, actors, and other creative workers in the entertainment industry, providing independent representation to their artist-clients in dealings with sophisticated corporate employers. But following a historical shift in their revenues from commission- ing clients to lucrative television packaging fees, the power and profits of the biggest agencies grew exponentially. Revenues from packaging fees allowed these agencies to diversify into other businesses and attracted outside invest- ment by private equity firms leading to further vertical integration. Now, the largest agencies have turned their eye toward a new revenue stream: producing and owning content through agency-affiliate production companies. These innovations have come at the cost of the independent representa- tion agents are supposed to provide their clients. Packaging and producing by talent agencies and their affiliates breach the well-established fiduciary duties agents owe their clients under the law by aligning the agency’s own interests with the interests of its clients’ employers. Outside investment in the agencies only exacerbates these conflicts. These departures from traditional agenting undermine the avowed purpose of the California Talent Agencies Act: to pro- tect vulnerable artists from the conflicted practices of their agents. While these issues are at the heart of the ongoing industry dispute between the Writers Guild of America and the big agencies, their importance should concern all agency clients and their unions. Shao, Slippery Rock University, Slippery Rock, PA, U.S.A. dx.doi.org/10.18374/JIMS-19-1.1 ABSTRACT Since 2017, increased sexual harassment incidents have been reported in Hollywood; yet, little guidance has been offered on how organizations, which are informally governed by their network members, can effectively reduce sexual harassment. Building upon the theory of network governance, this paper suggests social mechanisms, which are used to coordinate and safeguard exchanges between Hollywood organizations, are more effective at reducing incidents of workplace sexual harassment than traditional strategies. These social mechanisms direct change to the macroculture through collective sanctions that damage the perpetrators reputation and restrict access to network opportunities. In essence, perpetrators become toxic assets that Hollywood avoids and this avoidance is similar to economic sanctions that can deter sexual harassment.     “No Conflict, No Interest” –Ari Emanuel, WME co-CEO, 2015 How the Major Hollywood Talent Agencies Put Their Interests Ahead of Their Clients’ Interests Introduction Talent agencies have represented Hollywood actors, writers, and directors for almost a century. But what began as a service to artists in their negotiations with film studios has become a cartel dominated by a few powerful agencies that use their control of talent primarily to enrich themselves. Today, the major Hollywood agencies make money not by maximizing their clients’ earnings and charging ten percent commission, but through direct payments from studios known as “packaging” fees, which are unrelated to their clients’ compensation and come directly from TV series and film production budgets and profits. More recently, an even more overt form of conflict has taken root. The largest talent agen- cies have themselves formed production entities that hire and employ their own clients. These conflicted practices systematically favor the interests of the major agencies at the expense of their clients, and constitute a violation of fiduciary duty under multiple bodies of law. During a period of unprecedented prosperity for the major media companies, these conflicts have contributed to declining writer pay. In each of the last three years, the compa- nies that dominate the entertainment industry—Disney, Fox, Time Warner, Comcast, CBS, and Viacom—generated more than $50 billion in operating profits. Meanwhile, television writer-producers’ median weekly earnings declined 23 percent between 2014 and 2016. Conflicted practices have driven agency profits, attracting billions in investments from pri- vate equity firms and institutional investors that now own majority stakes in the two largest agencies, William Morris Endeavor (WME)1 and Creative Artists Agency (CAA), and have a minority stake in the third, United Talent Agency (UTA).
