PE641.097v02-00 6/9 RR\1190014EN.docx EN LETTER OF THE COMMITTEE ON BUDGETS Ms Lucia Ďuriš Nicholsonová, Chair Committee on Employment and Social Affairs BRUSSELS Subject: Opinion on the proposal for a Regulation of the European Parliament and of the Council amending Regulation (EU) No 1309/2013 on the European Globalisation Adjustment Fund (2014-2020) (COM(2019)0397 – C9-0109/2019 – 2019/0180(COD)) Dear Mr Chair, A Commission proposal for amending the European Globalisation Fund has been referred for opinion to the Committee on Budget. I understand that it is intended that a report on this will be adopted in the Committee on Employment and Social Affairs early in October 2019. This proposal is part of the Union preparedness and contingency plan to mitigate the most significant disruptions caused by a withdrawal of the United Kingdom from the Union without a withdrawal agreement. The proposed changes will specify that that redundancies resulting from the withdrawal of the United Kingdom from the Union without a withdrawal agreement fall within the scope of the EGF. The Commission proposal is intended to give a political signal that the EGF could respond effectively by offering assistance to workers made redundant in areas, sectors, territories or labour markets suffering serious economic disruption due to the withdrawal of the United Kingdom from the Union without a withdrawal agreement. The proposal does not modify the maximum annual amount of the EGF. I want to underline that the present proposal clearly confirms the Parliament’s long-standing conviction that the current budgetary framework does not provide the degree of flexibility that we need. The Committee coordinators have assessed this proposal, and asked me to write to you reporting that this Committee is in favour of amending Regulation (EU) No 1309/2013 on the European Globalisation Adjustment Fund as proposed by the Commission. Yours sincerely, Johan Van Overtveldt RR\1190014EN.docx 7/9 PE641.097v02-00 EN PROCEDURE – COMMITTEE RESPONSIBLE Title Proposal for a regulation of the European Parliament and of the Council amending Regulation (EU) No 1309/2013 on the European Globalisation Adjustment Fund (2014-2020) References COM(2019)0397 – C9-0109/2019 – 2019/0180(COD) Date submitted to Parliament 5.9.2019 Committee responsible EMPL Date announced in plenary 16.9.2019 Committees asked for opinions BUDG Date announced in plenary 16.9.2019 Rapporteurs Vilija Date appointed Blinkevičiūtė 3.9.2019 Discussed in committee 24.9.2019 Date adopted 2.10.2019 Result of final vote +: 53 –: 0 0: 2 Members present for the final vote Atidzhe Alieva-Veli, Abir Al-Sahlani, Gabriele Bischoff, Vilija Blinkevičiūtė, Milan Brglez, Jane Brophy, Sylvie Brunet, David Casa, Özlem Demirel, Klára Dobrev, Jarosław Duda, Estrella Durá Ferrandis, Lucia Ďuriš Nicholsonová, Rosa Estaràs Ferragut, Nicolaus Fest, Loucas Fourlas, Cindy Franssen, Chiara Gemma, Alicia Homs Ginel, France Jamet, Agnes Jongerius, Radan Kanev, Ádám Kósa, Stelios Kympouropoulos, Katrin Langensiepen, Elena Lizzi, Radka Maxová, Lefteris Nikolaou-Alavanos, Matthew Patten, Sandra Pereira, Kira Marie Peter-Hansen, Alexandra Louise Rosenfield Phillips, Dragoş Pîslaru, Manuel Pizarro, Miroslav Radačovský, Dennis Radtke, Elżbieta Rafalska, Guido Reil, Daniela Rondinelli, Mounir Satouri, Monica Semedo, Beata Szydło, Eugen Tomac, Romana Tomc, Nikolaj Villumsen, Marianne Vind, Maria Walsh, Tatjana Ždanoka, Tomáš Zdechovský Substitutes present for the final vote Brando Benifei, Andrea Caroppo, José Gusmão, Pierfrancesco Majorino, Bill Newton Dunn, Anna Zalewska Date tabled 4.10.2019 PE641.097v02-00 8/9 RR\1190014EN.docx EN FINAL VOTE BY ROLL CALL IN COMMITTEE RESPONSIBLE 53 + ECR Lucia Ďuriš Nicholsonová, Elżbieta Rafalska, Beata Szydło, Anna Zalewska GUE/NGL Özlem Demirel, José Gusmão, Sandra Pereira, Nikolaj Villumsen ID Andrea Caroppo, Nicolaus Fest, France Jamet, Elena Lizzi, Guido Reil NI Chiara Gemma, Lefteris Nikolaou-Alavanos, Miroslav Radačovský, Daniela Rondinelli PPE David Casa, Jarosław Duda, Rosa Estaràs Ferragut, Loucas Fourlas, Cindy Franssen, Radan Kanev, Ádám Kósa, Stelios Kympouropoulos, Dennis Radtke, Eugen Tomac, Romana Tomc, Maria Walsh, Tomáš Zdechovský RENEW Atidzhe Alieva-Veli, Jane Brophy, Sylvie Brunet, Radka Maxová, Bill Newton Dunn, Dragoş Pîslaru, Monica Semedo S&D Brando Benifei, Gabriele Bischoff, Vilija Blinkevičiūtė, Milan Brglez, Klára Dobrev, Estrella Durá Ferrandis, Alicia Homs Ginel, Agnes Jongerius, Pierfrancesco Majorino, Manuel Pizarro, Marianne Vind VERTS/ALE Katrin Langensiepen, Kira Marie Peter-Hansen, Alexandra Louise Rosenfield Phillips, Mounir Satouri, Tatjana Ždanoka 0 - 2 0 NI Matthew Patten RENEW Abir Al-Sahlani Key to symbols: + : in favour - : against 0 : abstention RR\1190014EN.docx 9/9 PE641.097v02-00 EN.

This explanation harks back to the famous 'highly likely’ statement made in 2018 by the then British Prime Minister, Theresa May. Apparently, the two ministers did not need to wait for the findings of a judicial investigation to assign responsibility (naming defendants), establish guilt (delivering a verdict) and impose sanctions (handing down sentences), in a case that is still far from being definitively solved. Does the Council not take the view that such a decision violates Articles 48 and 51 of the Charter of Fundamental Rights of the European Union, which state that 'everyone who has been charged shall be presumed innocent until proved guilty according to law’ and that 'the provisions of this Charter are addressed to the institutions and bodies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law'?
