Filing of Claims to 1998 Cable Royalty Fees

CABLE JOINT CLAIM (GAME) OF THE NATIONAL BASKETBALL ASSOCIATION

COMES NOW, the National Basketball Association, a not-for-profit partnership (hereinafter "NBA"), and files the instant Cable Joint Claim (Game) on behalf of all 27 members of the National Basketball Association.

Statement of Authorization The instant claim is made pursuant to Section 111(d)(5)(A) of the Copyright Revision

Act of 1976 and Copyright Royalty Tribunal Reform Act of 1993, 17 U.S.C. $ 111(d)(5)(A), which states:

Notwithstanding any provision of the antitrust laws ... for purposes of this clause [distribution of compulsory license fees], any claimants may agree among themselves as to the proportionate division of compulsory licensing fees among them, may lump their claims together and file them jointly or as a single claim, or may designate a common agent to receive payment on their behalf.

The making of this claim was authorized by Section 24(e) of the Constitution and By-Laws of the National Basketball Association and the powers vested in the Commissioner of the NBA.

Statement of Claim

Pursuant $252.2 of the Regulations of the Copyright Office, a claim is hereby made for compulsory license fees for secondary transmissions by cable television systems during the period January 1, 1998 through December 31, 1998. (a) and (b) A claim is hereby made by the National Basketball Association, Olympic Towers, 645 Fifth Avenue, New York, New York 10022, Telephone (212) 407-8000; Facsimile (212) 832-3861 for any and all fees that may be due as a result of telecasts involving the following:
