E-Tender is invited for Supply of Book at Central Library for the Department of Library and Information Science, Lifelong Learning, Rural Development Studies, Sociology, and Visual Arts, University of Kalyani by the eligible venders. Interested venders may follow the instructions as given below for submission of their tenders under online mode along with EMD of Rs.10, 000/- as per the following manner:
(a) Payment by Net Banking (any listed bank) through ICICI Bank Payment Gateway:-
i. On selection of net banking as the payment mode, the bidder will be directed to ICICI Bank Payment Gateway webpage (along with a string containing a Unique ID) where he will select the Bank through which he wants to do the transaction.
ii. Bidder will make the payment after entering his Unique ID and password of the Bank to process the transaction.
iii. Bidder will receive a confirmation message regarding success/failure of the transaction.
iv. If the transaction is successful, the amount paid by the bidder will get credited in the respective pooling account of the State Government /PSU/Autonomous Body/Local Body/ PRIs, etc. maintained with the Focal Point Branch of ICICI at R N Mukherjee Road, Kolkata for collection of EMD/Tender Fees.
v. If the transaction is failure, the bidder will again try for payment by going back to the first step.
(b) Payment through RTGS/NEFT:- i. On selection of RTGS/NEFT as the payment mode, the e-procurement portal will show a pre-filled challan having the details to process RTGS/NEFT transaction. ii. The bidder will print the challan and use the pre-filled information to make RTGS/NEFT payment using his bank account. iii. Once payment is made, the bidder will come back to the e-procurement portal after
expiry of a reasonable time to enable the NEFT/RTGS process to complete, in order to verify the payment made and continue the bidding process. iv. If verification is successful, the fund will get credited to the respective Pooling account of the State Government /PSU/ Autonomous Body/Local Body/PRIs, etc. maintained with the Focal Point Branch of ICICI Bank at R N Mukherjee Road, Kolkata for collection of EMD/Tender Fees.

v. Hereafter, the bidder will go to e-procurement portal for submission of his bed.
vi. But if the payment verification is unsuccessful, the amount will be returned to the bidder’s account.
( c ) Refund of EMD of all unsuccessful bidder(s):-
Details guidelines of the same have been obtained from Finance Department G.O. No. 3975- F(Y) Dated 28th July, 2016.
Refund / Settlement Process:-
i) After opening of the bids and technical evaluation of the same by the tender inviting authority through electronic processing in the e-procurement portal of the State Government, the tender inviting authority will declare the status of the bids as successful or unsuccessful which will be made available, along with the details of the unsuccessful bidders, to ICICI Bank by the procurement portal through web services.
ii) On receipt of the information from the e-procurement portal, the Bank will refund, through an automated process, the EMD of the bidders disqualified at the technical evaluation to the respective bidder’s bank account from which they made the payment transaction. Such refund will take place within T+2 Bank Working Days where T will mean the date on which information on rejection of bid is uploaded to the e- procurement portal by the tender inviting authority. iii) Once the financial bid evaluation is electronically processed in the e-procurement portal, EMD of the technically qualified bidders other than that of the L1 and L2 bidders will be refunded, through an automated process, to the respective bidders’ bank account from which they made the payment transaction. Such refund will take place within T+2 Bank Working Days where T will mean the date on which information on rejection of financial bid is uploaded to the e-procurement portal by the tender inviting authority. However, the L2 bidder should not be rejected till the LOI process is successful.
iv) If the bidder accept the LOI and the same is processed electronically in the e-procurement portal EMD of the L2 bidder will be refunded through an automated process, to his bank account from which he made the payment transaction. Such refund will take place within T+2 Bank Working Days where T will mean the date on which information on Award of Contract (AOC) to the L1 bidder is uploaded to the e- procurement portal by the tender inviting authority.
v) As soon as the L1 bidder is awarded the contract (AOC) and the same is processed electronically in the e- procurement portal EMD of the L1 bidder for tenders of the State PSUs/ Autonomous Bodies/Local Bodies/ PRIs etc. will automatically get transferred from the polling account to their respective linked bank account along with the bank particulars of the L1 bidders.
vi) Once the EMD of the L1 bidder is transferred in the manner mentioned above, Tender fees, if any, deposited by the bidders will be transferred electronically from the polling account to the respective linked bank accounts for State PSU/Autonomous Body/ Local Body/ PRIs, etc. tenders.
vii) All refunds will be made mandatorily to the Bank A/c from which the payment of EMD & Tender Fees (if any) were initiated.
viii) Under no circumstances, University of Kalyani is accountable for refund of EMD of the unsuccessful bidders(both technically and commercially) because their EMD are not credited to the University Account. ix) University may forfeit the above sum in the event of the following circumstances: 1. Agency withdraws the bid before expiry of its validity. 2. Successful bidder fails to provide services within the scheduled time as specified in the Order. 3. In case of any false submission / statement by the bidder. In case of any refusal to abide by terms and conditions or refusal to enter into a written agreement as per prefixed terms and conditions. 4. In case of any complain regarding rendering of service by the agency. 5. In case of any loss of property that was not been traced out by the agency, neither compensated for the same. 6. For other reasons that may be decided by the University from time to time specially where monetary loss of the University is involved due to the reason for which the agency is accountable.

2. General Instructions: In the event of e-tendering, intending bidder may download the tender documents from the website: http://wbtenders.gov.in directly with the help of Digital Signature Certificate (DSC) or from the University of Kalyani’s website www.klyuniv.ac.in.
3. Submission of bids: Both Technical bid and Financial Bid are to be submitted concurrently duly digitally signed by the Company personnel who is in the pay roll of the Company (having Authorization from the Company management) in the website http:// wbtenders.gov.in. All papers must be submitted in English language.
4. Eligibility for Quoting: a) At least three (03) Single purchase orders of books of substantial value from any reputed university/ higher educational institution.
b) Profitability and Net worth of the bidder is to be positive at least in the Financial Year 2018-19, copy of audited balance sheet should be provided.
c) The bidder must submit scanned copies of the following documents: i. Certificate of Incorporation (in case of company) / partnership deed (in case of ii. firm), etc. 3
iii. Valid trade licence iv. Copy of the PAN Certificate v. Income Tax Returns for the Assessment Years 2016-17, 2017 – 18 and 2018-19. vi. Certificate of Authorised Dealership from the Original Publishers of the Books, where ever applicable. vii. Scanned Copy of EMD of Rs.10,000/- or Copy of updated MSME/SSI/NSC Certification if exempted for EMD viii. All Annexure d) Vendors who were declared black listed and/or insolvent by any Govt. Concern/any Institutions in the Country for particular item or items are not eligible to participate in the current tender for that item or items. e) Vender having average annual Turn Over for last three financial years from this Trade is more than Rs.10 lakh in India for the year 2016-17, 2017-18 & 2018-19 are eligible to participate in the Tender.
5. Submission of Tenders
5.1 General process of submission
Tenders are to be submitted online through the website stated in Clause 1. All the documents uploaded by the Tender Inviting Authority form an integral part of the contract. Tenderers are required to upload all the tender documents along with the other documents, as asked for in the tender, through the above website within the stipulated date and time as given in the Tender. Tenders are to be submitted in two folders at a time, one is Technical Bid and the other is Financial Bid .The tenderer shall carefully go through the documents and prepare the required documents and upload the scanned documents of originals in Portable Document Format (PDF) to the portal in the designated locations/folders of Technical Bid. He needs to fill up the BOQ in the designated cell and upload the same in designated location of Financial Bid. The documents uploaded are virus scanned and digitally signed using the Digital Signature Certificate (DSC). Tenderers should specially take note of all the addendum/corrigendum related to the tender till the bid submission ends. Tenderers should in general upload the latest documents as part of the tender, however, in case of failure in uploading such documents, it will be deemed that they (tenderers) have taken note of such latest documents including addendum/corrigendum, if published till the bid submission ends.
5.2 Technical Bid The Technical Bid should contain scanned copies and/or declarations in the following standardised formats in two covers (folders):

5.3 Financial Bid The Financial Bid should contain the following document in one cover (folder):
Bill of Quantities (BOQ) : The tenderer should fill-up the designated cell as marked by the University in the BOQ sheet.
6. Bids received on e-tendering portal only will be considered. Bids in any other form sent through sealed cover/email/post/fax etc. will be rejected.
7. The tenderers are not required to submit hard copies of Technical File (Statutory) or My documents (Non-Statutory). Submission of hard copy of Financial Bid is strictly prohibited and only be submitted through on line through NIC portal.
8. Evaluation of the tenders During the tender evaluation process, the “Technical Bid” will be opened first. Those Bidders who have qualified in respect of the essential & other requirements in “Technical Bid” will be identified and their financial bid will be opened. The financial bid of those Tenderer failing to meet the technical & other requirements laid down in the tender will not be opened and be rejected. The 5
Tenderer offering the item found suitable and as per the tender specifications will only be selected. Final selection of the bidder in respect of Financial Bid is subject to further verification of several parameters allied with Financial Bid Evaluation. The Financial Bids of only those tenderers who have been considered as Technically Qualified will be opened.
9. As per the GST Rules, there should be no GST on Books. Statutory deduction for GST and other Government taxes in the hand of the payee will be made as per the law in force, if applicable.
10. TERMS & CONDITIONS REGARDING PURCHASE POLICY OF TENDERING AUTHORITY:
10.1 Bid Information :
a) Bidder may quote in Currency as available in the BOQ Sheet. b) The rate quoted by the bidder shall be fixed for the duration of the contract and shall not be subject to adjustment on any account. c) Bidder must follow the instruction for filling up BOQ as per Clause 6.3. d) Partial Quotation/Incomplete Quotation within the quoted item(s) both for Technical and Commercial aspects may subject to cancellation of tender. 10.2 Evaluation of Quotation : The Purchaser will evaluate and compare the quotations determined to be substantially responsive stage wise. Firstly, Technical Bid will be evaluated and thereafter Price Bid for technically qualified bidders will be evaluated for selection of vender. In case of any technical error for which University of Kalyani is not accountable, University of Kalyani may take suitable measure to rectify the error and derive actual fact and figures.
10.3 Award of Contract : The purchaser will award the contract to the bidder whose quotation has been determined to be substantially responsive both technically and commercially for both the equipments. Purchaser reserves the right to reject any or all the tender, wholly or partly, without assigning any reason thereof and shall not be bound to accept the lowest bid.
10.4 All the books should be according to the details given in the tender and should be of latest edition (unless specific edition is mentioned), new and good in condition and as per the required quantity.
10.5 In case any defect and dispute are found in any book, the same has to be replaced at the earliest without any cost.
10.6 Discount rates offered by the bidder shall not be linked with the quantum of the purchase order.
10.7 All Books/Annual Reviews/ Monographs shall be supplied with an authentic price proof.
10.8 Any Supplier found to have cheated by supplying old and remaindered books and defaulted in supplying books even on extended time limit without reasonable grounds, will be liable for blacklisting besides imposition of penalty to the tune University of Kalyani may deem fit.
10.9 In case of cheating by charging more than actual Publisher‘s Price, the Firm can be punished by blacklisting/forfeiting the Performance Security deposit or both.
10.10 As per relevant order issued by the Higher Education Department, Government of West Bengal, Book Supplier must quote discount not less than 15%.
10.11 Bidder should submit copy of updated Trade Licence and Income Tax Return submission document.

10.12 DSIR Certification : University of Kalyani possesses the privilege for availing the facility of procuring items at Concessional Customs Duty and without incurring any excise duty as per DSIR certification.
10.13 Time Schedule : The supply work must be completed within 21 days from the date of receipt of the order either through e-mail or by post, whichever is earlier.
10.14 Validity of offer : A bidder should spell out in the tender that it shall remain valid for a minimum period of 120 days from the date of opening of the tender and during this period, the bidder shall not be entitled to revoke or cancel its offer.
10.15 University reserves the discretion to issue work order either in full or phase wise depending upon the requirement and selected vendor will not charge any extra amount for such supply and delivery.

10.17 Payment Information : Payment be made after satisfactory delivery of the books. For Foreign Books quoted in foreign currencies, payment be made to the book seller/publisher/bidder in INR as per the conversion rate prevailing to our banker as on the date of payment.
10.18 Quantity Changeability : Quantity as stated in the tender document may subject to change at the time of issuing purchase order due to the fund crunch or for other valid reasons.
10.19 Requisite Documents to be submitted: Bidder must have adequate documents relating to Trade License and updated returns for Income Tax, Audited Statement of Accounts and other documents.
10.20 Disposal of Disputes : In case of any dispute, the University’s decision will be treated as the final and conclusive. All legal actions are subject to Kolkata jurisdiction only.
10.21 Conditional bid may be liable for rejection.
Discretion of the University :
10.22 University may take decision about non-purchase of the said item even after selection of vendor due to its fund constraints and/or for other valid reasons.
10.23 University may seek documents from the bidder in addition to the scanned documents sent by them at the time of uploading technical bid for verification and evaluation of tender.
10.24 University enjoys the right to select vender either item wise or as a whole or as a group or by a suitable manner as to be decided by the Tender Evaluation Authority.
10.25 University reserves the right to relax any clause as stated hereinabove for selection of responsive vender.
11. Opening the financial bid as per schedule will BE NOTIFIED LATER ON.

Financial bid can be seen & accessed by the bidder through the NIC Portal on line after opening of financial bid on line. No objections raised by any Bidder in this respect will be entertained by the University. No informal tender will be entertained in the Bid further.
12. During the scrutiny, if it comes to the notice to tender inviting authority that the credential or any other paper found incorrect/ manufactured/ fabricated, that bidder would not allowed to participate in the tender and that application will be rejected outright without any prejudice.
13. The Tender Selection Committee reserves to right to cancel the N.I.T. due to unavoidable Circumstances and no claim in this respect will be entertained.
