1. Background

The Nebraska Reduced Cigarette Ignition Propensity (RCIP) Act was passed in May 2009, with an operative date of January 1, 2010. As a part of this Act the State Fire Marshal Agency was charged with generating and submitting a report every three years detailing the effectiveness of the Act. This is the first of the required reports.

This Act, most commonly referred to as the Safe Cigarette Act, was a response to a nationwide shift toward a new type of cigarette which was being manufactured. This shift was a result of research and studies conducted to try and reduce the number of and damage caused by fires attributable to cigarettes. A collaboration of many safety groups, including the Nation Fire Protection Association (NFPA), had joined with some of the Nation’s largest cigarette manufacturers to develop a cigarette that was capable of self-extinguishment, thus resulting in fewer fires and greater public safety. The first efforts went toward developing federal legislation, but it was soon determined that faster and more tailored results could be achieved through legislation at the State level. In June of 2004 New York became the first state to mandate reduced ignition propensity cigarettes.

The rationale for producing and requiring “safe” cigarettes is easy to understand. National Fire Data shows that cigarette fires cause hundreds of millions of dollars in damage each year, as well as incalculable amounts of trauma and stress. According to information gathered and published by the NFPA, “One-quarter of victims of smoking-material fire fatalities are not the smokers whose cigarettes started the fire: 34 percent are children of the smokers; 25 percent are neighbors or friends; 14 percent are spouses or partners; and 13 percent are parents.”1 While education about the dangerousness of smoking related fires has been a national campaign for many years, it was decided that if changes could be employed to improve the design of cigarettes this would be a major improvement in reducing the number of fires. According to information published on the NFPA website, “A fire-safe cigarette has a reduced propensity to burn when left unattended. The most common fire-safe technology used by cigarette manufacturers is to wrap cigarettes with two or three thin bands of less-porous paper that act as ‘speed bumps’ to slow down a burning cigarette. If a fire-safe cigarette is left unattended, the 2 burning tobacco will reach one of these speed bumps and self-extinguish.”

Once it was determined how the cigarettes could be manufactured to aide in self- extinguishment the next step in the process was to establish the standards that the new cigarettes would need to meet. This was accomplished by devising a system to test the effectiveness of the new design model. “Fire-safe cigarettes meet an established cigarette fire safety performance

2 standard, based on ASTM E2187, Standard Test Method for Measuring the Ignition Strength of Cigarettes.”1 Once this testing standard was recognized the States began passing legislation to implement programs within each state that would require tobacco companies to sell fire-safe cigarettes.

The New York Legislation became a model utilized in many states, including Nebraska. In general the legislation requires cigarette manufactures to register the brand families and brand styles that will be sold within each state. The manufacturer must provide information regarding the cigarettes such as length, type, circumference, and other information as required in the statutes. Additionally, each request for certification must be accompanied by testing results stating the cigarettes meet the established laboratory testing standard. All information is reviewed and if correct the required fee is charged and a certification is issued by the State.

However, in Nebraska there were some changes from the model legislation. For example, in Nebraska the companies pay to register their products by brand family and not brand style (all states require both brand family and brand style information; in most other states, registration fees are calculated by number of styles registered, not by number of brand families. Nebraska’s fee structure results in large companies being able to register a greater number of styles for the same fee that a small company pays to register two or three styles. Additionally, examples of the packaging are not required to be submitted. And finally, instead of renewing the certifications every three years, as is done in the other states, in Nebraska the companies re-register and pay the certification fee every four years.

2. Federal Law Tangential to the Program

The Family Smoking Prevention and Tobacco Control Act, which can be found at http://www.gpo.gov/fdsys/pkg/PLAW-111publ31/html/PLAW-111publ31.htm was signed into law on June 22, 2009 by President Barack Obama. This Act provided that the Food and Drug Administration (FDA) would have the power to regulate certain aspects of the tobacco industry. One of the major reasons for these new requirements was to limit the advertising produced to target children. Parts of these regulations included the need for new warnings and labels on tobacco products and their packaging. Another part of the regulations disallowed the use of terms such as “light” or “ultra-light” in packaging, as these terms might convey a false sense of a lower health risk when using those products. As a result of this law tobacco companies changed the packaging to remove the potentially misleading words and replaced them with various color types. For example, instead of light or ultra-light colors such as blue or light blue are used.

These changes affected Nebraska’s Safe Cigarette Program in that it required all the companies to re-register their brand families because of the name changes. All new documentation had to be provided and new certificates issued showing the name changes.

3. Nebraska Statutory Sections

Nebraska Statutes for the RCIP

69-501. Act, how cited.

Sections 69-501 to 69-511 shall be known and may be cited as the Reduced Cigarette Ignition Propensity Act.

69-502. Terms, defined.

For purposes of the Reduced Cigarette Ignition Propensity Act:

(1) Agent means any person authorized by the Tax Commissioner to purchase and affix stamps or cigarette tax meter impressions on packages of cigarettes under sections 77-2601 to 77-2615;

(2) Cigarette has the same meaning as in section 77-2601;

(3) Consumer testing means an assessment of cigarettes that is conducted by a manufacturer, or under the control or direction of a manufacturer, for the purpose of evaluating consumer acceptance of the cigarettes;

(4) Manufacturer means:

(a) Any entity which manufactures or otherwise produces cigarettes or causes cigarettes to be manufactured or produced anywhere that such manufacturer intends to sell in this state, including cigarettes intended to be sold in the United States through an importer;

(b) The first purchaser anywhere that intends to resell in the United States cigarettes manufactured anywhere that the original manufacturer or maker does not intend to be sold in the United States; or

(5) Quality control and quality assurance program means the laboratory procedures implemented to ensure that operator bias, systematic and nonsystematic methodological errors, and equipment-related problems do not affect the results of the testing. Such a program ensures that the testing repeatability remains within the required repeatability values stated in section 69- 503 for all test trials used to certify cigarettes in accordance with the Reduced Cigarette Ignition Propensity Act;

(6) Repeatability means the range of values within which the repeat results of cigarette test trials from a single laboratory will fall ninety-five percent of the time;

(7) Retail dealer means any person, other than a manufacturer or wholesale dealer, engaged in selling cigarettes or tobacco products;

(8) Sale means any transfer for consideration, exchange, barter, gift, offer for sale, or distribution in any manner or by any means whatsoever;

(9) Sell means to sell or to offer or agree to do the same; and

(10) Wholesale dealer means any person, other than a manufacturer, who sells cigarettes or tobacco products to retail dealers or other persons for purposes of resale and any person who owns, operates, or maintains one or more cigarette or tobacco product vending machines in, at, or upon premises owned or occupied by any other person.

69-503. Cigarettes; testing; requirements; performance standard; manufacturer; duties; civil penalty; State Fire Marshal; powers and duties.

(1) Except as provided in subsection (7) of this section, no cigarettes may be sold or offered for sale in this state or offered for sale or sold to persons located in this state unless the cigarettes have been tested in accordance with the following test method and meet the performance standard specified in this section, a written certification has been filed by the manufacturer with the State Fire Marshal in accordance with section 69-504, and the cigarettes have been marked in accordance with section 69-505. Testing shall be as follows:

(a) Testing of cigarettes shall be conducted in accordance with the American Society of Testing and Materials Standard E2187-04, Standard Test Method for Measuring the Ignition Strength of Cigarettes;

(b) Testing shall be conducted on ten layers of filter paper;

(c) No more than twenty-five percent of the cigarettes tested in a test trial in accordance with this subsection shall exhibit full-length burns. Forty replicate tests shall comprise a complete test trial for each cigarette tested;

(d) The performance standard required by this subsection shall only be applied to a complete test trial;

(e) Written certifications shall be based upon testing conducted by a laboratory that has been accredited pursuant to standard ISO/IEC 17025 of the International Organization for Standardization or other comparable accreditation standard required by the State Fire Marshal;

(f) Laboratories conducting testing in accordance with this subsection shall implement a quality control and quality assurance program that includes a procedure that will determine the repeatability of the testing results. The repeatability value shall be no greater than 0.19;

(g) This subsection does not require additional testing if cigarettes are tested consistent with the Reduced Cigarette Ignition Propensity Act for any other purpose; and

(h) Testing performed or sponsored by the State Fire Marshal to determine a cigarette's compliance with the performance standard required by this section shall be conducted in accordance with this subsection.

(2) Each cigarette listed in a certification submitted pursuant to section 69-504 that uses lowered permeability bands in the cigarette paper to achieve compliance with the performance standard set forth in this section shall have at least two nominally identical bands on the paper surrounding the tobacco column. At least one complete band shall be located at least fifteen millimeters from the lighting end of the cigarette. For cigarettes on which the bands are positioned by design, there shall be at least two bands fully located at least fifteen millimeters from the lighting end and ten millimeters from the filter end of the tobacco column, or ten millimeters from the labeled end of the tobacco column for nonfiltered cigarettes.

(3) A manufacturer of a cigarette that the State Fire Marshal determines cannot be tested in accordance with the test method prescribed in subdivision (1)(a) of this section shall propose a test method and performance standard for the cigarette to the State Fire Marshal. If the State Fire Marshal determines that another state has enacted reduced cigarette ignition propensity standards that include a test method and performance standard that are the same as those contained in the Reduced Cigarette Ignition Propensity Act and the State Fire Marshal finds that the officials responsible for implementing those requirements have approved the proposed alternative test method and performance standard for a particular cigarette proposed by a manufacturer as meeting the fire safety standards of that state's law or regulation under a legal provision comparable to this section, then the State Fire Marshal shall authorize that manufacturer to employ the alternative test method and performance standard to certify that cigarette for sale in this state, unless the State Fire Marshal demonstrates a reasonable basis why the alternative test should not be accepted under the act. All other applicable requirements of this section shall apply to the manufacturer.

(4) Each manufacturer shall maintain copies of the reports of all tests conducted on all cigarettes offered for sale for a period of three years and shall make copies of these reports available to the State Fire Marshal and the Attorney General upon written request. Any manufacturer who fails to make copies of these reports available within sixty days after receiving a written request shall be subject to a civil penalty not to exceed ten thousand dollars for each day after the sixtieth day that the manufacturer does not make such copies available.

(5) The State Fire Marshal may adopt a subsequent American Society of Testing and Materials Standard Test Method for Measuring the Ignition Strength of Cigarettes upon a finding that such subsequent method does not result in a change in the percentage of full-length burns exhibited by any tested cigarette when compared to the percentage of full-length burns the same cigarette would exhibit when tested in accordance with the American Society of Testing and Materials Standard E2187-04 and the performance standard in subdivision (1)(c) of this section.

(6) The State Fire Marshal shall review the effectiveness of this section and report every three years to the Legislature the State Fire Marshal's findings and, if appropriate, recommendations for legislation to improve the effectiveness of this section. The report and

6 legislative recommendations shall be submitted electronically no later than November 15 each three-year period.

(7) The requirements of subsection (1) of this section shall not prohibit wholesale or retail dealers from selling their existing inventory of cigarettes on or after January 1, 2010, if the wholesale or retail dealer can establish that state tax stamps were affixed to the cigarettes prior to such date and if the wholesale or retail dealer can establish that the inventory was purchased prior to such date in comparable quantity to the inventory purchased during the same period of the prior year.

(8) The Reduced Cigarette Ignition Propensity Act shall be implemented in accordance with the implementation and substance of the New York Fire Safety Standards for Cigarettes as such standards existed on January 1, 2009.

69-504. Manufacturer; written certification; contents; fee; Reduced Cigarette Ignition Propensity Fund; created; use; investment; altered cigarettes; retesting required.

(1) Each manufacturer shall submit to the State Fire Marshal a written certification attesting that:

(a) Each cigarette listed in the certification has been tested in accordance with section 69- 503; and

(b) Each cigarette listed in the certification meets the performance standard set forth in section 69-503.

(2) Each cigarette listed in the certification shall be described with the following information:

(a) Brand or trade name on the package;

(b) Style, such as light or ultra light;

(d) Circumference in millimeters;

(e) Flavor, such as menthol or chocolate, if applicable;

(f) Filter or nonfilter;

(g) Package description, such as soft pack or box;

(h) Marking pursuant to section 69-505;

(i) The name, address, and telephone number of the laboratory, if different than the manufacturer, that conducted the test; and

(j) The date that the testing occurred.

(3) The State Fire Marshal shall make the certifications available to the Attorney General for purposes consistent with the Reduced Cigarette Ignition Propensity Act and the Department of Revenue for the purposes of ensuring compliance with this section.

(4) Each cigarette certified under this section shall be recertified every four years.

(5) At the time a manufacturer submits a written certification under this section, the manufacturer shall pay to the State Fire Marshal a fee of one thousand dollars for each brand family of cigarettes identified in the certification. The fee paid shall apply to all cigarettes listed in the brand family identified in the certification and shall include any new cigarette certified within the brand family during the four-year certification period.

(6) The Reduced Cigarette Ignition Propensity Fund is created. The fund shall consist of all certification fees submitted by manufacturers in addition to any other funds made available for such purpose. The State Fire Marshal shall use the fund to carry out the act. Fees collected pursuant to this section shall be remitted to the State Treasurer for credit to the fund. Any money in the fund available for investment shall be invested by the state investment officer pursuant to the Nebraska Capital Expansion Act and the Nebraska State Funds Investment Act.

(7) If a manufacturer has certified a cigarette pursuant to this section and thereafter makes any change to such cigarette that is likely to alter its compliance with the reduced cigarette ignition propensity standards required by the Reduced Cigarette Ignition Propensity Act, such cigarette shall not be sold or offered for sale in this state until the manufacturer retests the cigarette in accordance with the testing standards set forth in section 69-503 and maintains records of that retesting as required by section 69-503. Any altered cigarette which does not meet the performance standard set forth in section 69-503 shall not be sold in this state.

69-505. Marking; inspections.

(1) Cigarettes that are certified by a manufacturer in accordance with section 69-504 shall be marked to indicate compliance with the requirements of section 69-503. The marking shall be either:

(a) Any marking in use and approved for sale in New York pursuant to the New York Fire Safety Standards for Cigarettes as such standards existed on January 1, 2009; or

(b) The letters "FSC" which signifies Fire Standards Compliant.

(2) The marking shall appear in eight-point type or larger and be permanently printed, stamped, engraved, or embossed on the package at or near the Universal Product Code.

(3) A manufacturer shall use only one marking and shall apply this marking uniformly for all packages, including, but not limited to, packs, cartons, and cases, and brands marketed by that manufacturer.

(4) Manufacturers certifying cigarettes in accordance with section 69-504 shall provide a copy of the certifications to all wholesale dealers and agents to which they sell cigarettes and shall also provide sufficient copies of an illustration of the package marking utilized by the manufacturer pursuant to this section for each retail dealer to which the wholesale dealers or agents sell cigarettes. Wholesale dealers and agents shall provide a copy of these package markings received from manufacturers to all retail dealers to which they sell cigarettes. Wholesale dealers, agents, and retail dealers shall permit the State Fire Marshal, the Department of Revenue, and their employees or peace officers of this state to inspect markings of cigarette packaging marked in accordance with this section.

69-506. Violations; civil penalty; seizure and destruction; additional remedies; Attorney General; powers and duties.

(1) A manufacturer, wholesale dealer, agent, or any other person or entity who knowingly sells or offers to sell cigarettes, other than through retail sale, in violation of section 69-503, shall be liable to a civil penalty not to exceed ten thousand dollars per each sale of such cigarettes for a first offense and shall be liable to a civil penalty not to exceed twenty-five thousand dollars for any subsequent offense per each sale of such cigarettes, except that this penalty against any such person or entity shall not exceed one hundred thousand dollars during any thirty-day period.

(2) A retail dealer who knowingly sells or offers to sell fewer than one thousand cigarettes in violation of section 69-503 shall be liable to a civil penalty not to exceed five hundred dollars for a first offense and shall be liable to a civil penalty not to exceed two thousand dollars for any subsequent offense for each such sale or offer for sale of such cigarettes. A retail dealer who knowingly sells or offers to sell one thousand or more cigarettes in violation of section 69-503 shall be liable to a civil penalty not to exceed one thousand dollars for a first offense and shall be liable to a civil penalty not to exceed five thousand dollars for any subsequent offense per each such sale or offer of sale of such cigarettes. The penalty against any retail dealer under this subsection shall not exceed twenty-five thousand dollars during any thirty-day period.

(3) In addition to any civil penalty, any corporation, partnership, sole proprietor, limited partnership, limited liability company, limited liability partnership, or association engaged in the manufacture of cigarettes that knowingly makes a false certification pursuant to section 69-504 shall be liable to a civil penalty of seventy-five thousand dollars for the first false certification and shall be liable to a civil penalty not to exceed one hundred fifty thousand dollars for each subsequent false certification.

(4) Any person violating any other provision of the Reduced Cigarette Ignition Propensity Act shall be liable to a civil penalty not to exceed one thousand dollars for a first offense and shall be liable to a civil penalty not to exceed five thousand dollars for any subsequent offense.

(5) Whenever any peace officer of this state or duly authorized representative of the State Fire Marshal or Tax Commissioner discovers any cigarettes (a) for which no certification has been filed as required by section 69-504 or (b) that have not been marked as required by section 69-505, such peace officer or representative may seize and take possession of such cigarettes. Cigarettes seized pursuant to this subsection shall be destroyed, except that prior to the destruction of any cigarette seized pursuant to this subsection the true holder of the trademark rights in the cigarette brand shall be permitted to inspect the cigarette.

(6) In addition to any other remedy provided by law, the Attorney General may file an action in a court of competent jurisdiction for a violation of the Reduced Cigarette Ignition Propensity Act, including petitioning (a) for preliminary or permanent injunctive relief against any manufacturer, importer, wholesale dealer, retail dealer, agent, or other person or entity to enjoin such entity from selling, offering to sell, or affixing tax stamps or cigarette tax meter impressions to any cigarette that does not comply with the requirements of the Reduced Cigarette Ignition Propensity Act or (b) to recover any costs or damages suffered by the state because of a violation of the act, including enforcement costs relating to the specific violation and attorney's fees. Each violation of the act or of rules or regulations adopted and promulgated under the act constitutes a separate civil violation for which the Attorney General may obtain relief. Upon obtaining judgment for injunctive relief under this subsection, the Attorney General shall provide a copy of the judgment to all wholesale dealers and agents to which the cigarette has been sold.

69-507. Tax Commissioner; power to inspect; notice to State Fire Marshal.

The Tax Commissioner, in the regular course of conducting inspections of wholesale dealers, agents, and retail dealers, as authorized under section 77-2605, may inspect cigarettes to determine if the cigarettes are marked as required by section 69-505. If the cigarettes are not marked as required, the Tax Commissioner shall notify the State Fire Marshal.

69-508. Attorney General; enforcement powers.

To enforce the provisions of the Reduced Cigarette Ignition Propensity Act, the Attorney General may examine the books, papers, invoices, and other records of any person in possession, control, or occupancy of any premises where cigarettes are placed, stored, sold, or offered for sale, as well as the stock of cigarettes on the premises. Every person in the possession, control, or occupancy of any premises where cigarettes are placed, sold, or offered for sale shall give the Attorney General the means, facilities, and opportunity for the examinations authorized by the act.

69-509. Act; exemptions.

Nothing in the Reduced Cigarette Ignition Propensity Act shall be construed to prohibit:

(1) Any person or entity from manufacturing or selling cigarettes that do not meet the requirements of section 69-503 if the cigarettes are or will be stamped for sale in another state or are packaged for sale outside the United States and that person or entity has taken reasonable steps to ensure that such cigarettes will not be sold or offered for sale to persons located in this state; or

(2) The use of cigarettes solely for the purpose of consumer testing utilizing only the quantity of cigarettes that is reasonably necessary for the assessment.

69-510. Termination of act; conditions; preemption of local law.

(1) The Reduced Cigarette Ignition Propensity Act shall terminate if a federal reduced cigarette ignition propensity standard that preempts the act is adopted and becomes effective.

(2) The Reduced Cigarette Ignition Propensity Act preempts any local law on the subject and no political subdivision shall enact or enforce any ordinance or other local law or regulation conflicting with any provision of the act or with any policy of this state expressed by the act, whether the policy is expressed by inclusion of a provision in the act or by exclusion of that subject from the act.

69-511. State Fire Marshal; rules and regulations.

The State Fire Marshal may adopt and promulgate rules and regulations necessary to carry out the Reduced Cigarette Ignition Propensity Act in accordance with the Administrative Procedure Act.

Nebraska Statutes for General Fire Marshal Duties

81-502. State Fire Marshal; fire prevention and safety; duties; delegation of authority to local fire prevention personnel; rules and regulations; compliance; late penalty.

(1) It shall be the duty of the State Fire Marshal, under authority of the Governor:

(a) To enforce all laws of the state relating to the suppression of arson and investigation of the cause, origin, and circumstances of fires;

(b) To promote safety and reduce loss by fire;

(i) Liquor establishments for which a license or renewal of a license is sought, upon request of the Nebraska Liquor Control Commission, pursuant to section 53-119.01;

(ii) Licensed foster care facilities or applicants for licenses for foster care facilities, upon request by the Department of Health and Human Services, pursuant to section 71-1903;

(iii) Licensed providers of programs or applicants for licenses to provide such programs, upon request of the Department of Health and Human Services, pursuant to section 71-1913. The State Fire Marshal shall report the results of the investigation to the department within thirty days after receipt of the request from the department;

(iv) Licensed hospitals, skilled nursing facilities, intermediate care facilities, or other health care facilities which are licensed under the Health Care Facility Licensure Act or applicants for licenses for such facilities or institutions, upon request by the Department of Health and Human Services, pursuant to section 71-441; and

(v) Mobile home parks for which a license or renewal of a license is sought, upon request of the Department of Health and Human Services, pursuant to section 71-4635; and

(d) After a careful study and investigation of relevant data, to adopt, promulgate, alter, and enforce, through inspections and code compliance, orders, rules, and regulations covering:

(i) The prevention of fires;

(ii) The storage, sale, and use of flammable liquids, combustibles, and fireworks;

(iii) Electric wiring and heating, protection equipment devices, materials, furnishings, and other safeguards within the structure necessary to promote safety and reduce loss by fire, and the means and adequacy of exits, in case of fire, in assembly, educational, institutional, residential, mercantile, office, storage, and industrial-type occupancies as such structures are defined in the National Fire Protection Association, Pamphlet Number 101, and associated pamphlets, and all other buildings, structures, and enclosures in which numbers of persons congregate from time to time for any purpose whether privately or publicly owned;

(iv) Design, construction, location, installation, and operation of equipment for storing, handling, and utilization of liquefied petroleum gases, specifying the odorization of such gases and the degree thereof;

(v) Chemicals, prozylin plastics, X-ray nitrocellulose films, or any other hazardous material that may now or hereafter exist;

(vi) Tanks used for the storage of regulated substances pursuant to the Petroleum Products and Hazardous Substances Storage and Handling Act; and

(vii) Accessibility standards and specifications adopted pursuant to section 81-5,147.

(2) The State Fire Marshal may enter into contracts with private individuals or other agencies, boards, commissions, or governmental bodies for the purpose of carrying out his or her duties and responsibilities pursuant to the Arson Reporting Immunity Act, the Nebraska Natural Gas Pipeline Safety Act of 1969, and sections 81-502 to 81-541.01, 81-5,132 to 81-5,146, and 81-5,151 to 81-5,157.

(3) The State Fire Marshal may delegate the authority set forth in this section to qualified local fire prevention personnel. The State Fire Marshal may overrule a decision, act, or policy of the local fire prevention personnel. When the State Fire Marshal overrules the local personnel, such local personnel may follow the appeals procedure established by sections 81-502.01 to 81- 502.03. Such delegation of authority may be revoked by the State Fire Marshal for cause upon thirty days' notice after a hearing.

(4) The State Fire Marshal, first assistant fire marshal, and deputies shall have such other powers and perform such other duties as are set forth in sections 81-501.01 to 81-531 and 81- 5,151 to 81-5,157 and as may be conferred and imposed by law.

(5) The rules and regulations adopted and promulgated pursuant to subdivision (1)(d) of this section may conform generally to the standards recommended by the National Fire Protection Association, Pamphlet Number 101, known as the Life Safety Code, and associated pamphlets, but not when doing so would impose an unduly severe or costly burden without substantially contributing to the safety of persons or property. This section and the rules and regulations adopted and promulgated pursuant to subdivision (1)(d) of this section shall apply to existing as well as new buildings, structures, and enclosures. Such rules and regulations shall also apply to sites or structures in public ownership listed on the National Register of Historic Places but without destroying the historic quality thereof.

(6) Plans for compliance with the rules and regulations adopted and promulgated pursuant to subdivision (1)(d) of this section shall be reviewed by the State Fire Marshal. Plans submitted after remodeling or construction has begun shall be accompanied by a penalty of fifty dollars in addition to the plan review fee set out in subdivision (4)(a) of section 81-505.01.

4. Program Evaluation and Statistical Data

The Agency was charged with implementing the Safe Cigarette Program and then submitting a legislative report every three years. This is the first report to be submitted as the first three year period has been completed. In accordance with the statutory requirements the State Fire Marshal (SFM) Agency has implemented the Safe Cigarette Program in Nebraska. In order to evaluate program effectiveness the Agency has collected a variety of data dealing with both the certification process and the fires which have occurred and been linked to smoking material. The information concerning fires was gathered from the investigations conducted by our internal staff, our delegated authority staff, and reports submitted by Nebraska Fire Departments through the Nebraska Fire Incident Reporting System (NeFIRS). Informational graphs, as well as excel spreadsheets, have been included in this section to illustrate the information gathered. A brief description of each figure is included to aid in understand the information presented.

Figure One

This graph shows the total number of certifications that have been issued for brand families in Nebraska. The chart is broken down to show the number of families and styles that were registered each year. Per the statutory requirements there is a thousand dollar fee charged for each brand family registered. The program officially started on January 1, 2010 but the

14 requirements stated the companies had to be registered on that day so the companies had to send in the information necessary for registration at the end of 2009 to ensure compliance with the Act on January 1, 2010.

It displays the information provided by the company as well as showing the places where the companies had to re-register due to the change in Federal law regarding words such as “light” or “ultra-light.”

Conclusions

An examination of the program’s implementation and functionality during the first three years has revealed areas of efficacy and areas needing improvement. The Agency developed a section of our website to deliver information to interested parties. The submittal process was streamlined by utilizing electronic means for both submittal and storage. There have not been any reported violations of the selling requirements. In the few instances were non FSC products were located in stores it was determined that the products had Nebraska Tax stamps issued prior to January 1, 2010 so were still eligible to be sold. This information would point to the program being effective.

However, when trying to analyze the program’s effectiveness in terms of a reduction in the number and damage caused by cigarette fires it is very hard to make firm determinations as there is not good data from the years prior to the implementation of the Act to use as a base line. Prior to the Act there was no need to gather detailed information about the types of cigarettes in a fire. Also, there was no registration requirements for manufacturers to follow so it is unknown if compliance has increased or decreased. When examining just the number of fires it does appear that there was a small increase in the total number of fires and fires caused by cigarettes in 2011, a year after the program was enacted. However, there could be a number of reasons for this so it is hard to point to program effectiveness or the lack thereof as a definite cause of this increase. It

23 should be noted that there may have been an adjustment period required for people to understand exactly how the fire safe cigarettes work. When a cigarette style is tested for compliance, there is an only a requirement that 75% of the tested cigarettes self-extinguish. Thus, the term “fire safe” is a misnomer, as the cigarettes can still cause fires. This commonly used term may have given people the false impression that these cigarettes would always self-extinguish so the disposal of them may have been somewhat careless.

The Agency was also charged with determining any legislative changes that may be needed to aide in the administration of the program. In preparing this report and monitoring the program for the first three years a few items that need to be changed have become apparent. As can be seen in each of the charts, information for the third year of the program has a stop date of October 31, 2012. This date was chosen to try and give the Agency time to compile the statistical data. However, even with this deadline much of the data needed for fires that occurred prior to this date was not available until much later. For example, the total number of fires in Nebraska for 2012 appears to have dropped by approximately 2000 fires. The number of reported fires for the year will increase after the end of the year when many departments submit their data for the year. Based on this delay the date for the report as listed in Neb. Rev. Stat. §69-503 (6) should be changed from November 15 to February 15 of the year directly after the three year reporting period. Additionally, Nebraska deviated from the model legislation in using a requirement that the companies only have to register every four years, instead of every three years. This discrepancy has caused issues in a number of ways. First of all the program was designed to be self-sufficient in that the registration fees would pay for the program administration and staffing. However, extending the deadline for recertification to four years has left a gap in available funding. Additionally, the certification requirements in other states are three years so it is confusing to the industry members that a different cycle is used in Nebraska. The Agency has already been contacted by industry members requesting a three year cycle be utilized. As such the Agency recommends that Neb. Rev. Stat. §69-504 (4) be changed to state (4) Each cigarette certified under this section shall be recertified every three years.

If the recommended legislative changes are implemented, the overall program efficacy should continue to increase. The program will need to be re-evaluated at the end of the next three-year reporting cycle. Because there will be a previous three-year period during which detailed fire data was collected, a more detailed analysis of program effectiveness in relation to a reduction in cigarette fires will be possible.
