1. Item 1a: Minutes of last meeting — The minutes of 3 March 2020 were agreed.

2. Future business programme — The Bureau agreed to recommend to the Parliament a revised programme of business for the week commencing 9 March 2020 and a programme of business for the weeks commencing 16 and 23 March 2020.

Elaine Smith requested a ministerial statement on NHS Lothian. Graeme Dey indicated that the Scottish Government was not minded to agree to a statement at this point and noted that a Topical Question on NHS Lothian had been selected for answer on 10 March. Business Managers agreed that further consideration could be given to the request at a future meeting.

The Bureau noted that Members’ Business on Tuesday 17 March 2020 would be motion S5M- 21178 Elaine Smith on 15th Anniversary of the Breastfeeding etc. () Act 2005, on Wednesday 18 March 2020 would be motion S5M-20962 Gordon MacDonald on Tory Immigration Policy Detrimental to Scottish Care Sector and on Thursday 19 March 2020 would be motion S5M-20685 Miles Briggs on World TB Day, 24 March 2020.

3. Referral of a Bill at Stage 1 – The Bureau agreed to recommend to the Parliament that the Economy, Energy and Fair Work Committee be designated as the lead committee for consideration of the Heat Networks (Scotland) Bill at Stage 1.

4. Approval of SSIs — The Bureau agreed to recommend to the Parliament that the following SSIs be approved—

• Energy Efficiency (Domestic Private Rented Property) (Scotland) Regulations 2020 [draft] • the Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 [draft] • the First-tier Tribunal for Scotland Social Security Chamber (Procedure and Allocation of Functions) Amendment Regulations 2020 [draft].

5. Referral of a Members’ Bill proposal — The Bureau agreed to refer the draft proposal for a Proposed Mandatory Registration of Automated External Defibrillators (Scotland) Bill to the Health and Sport Committee for information.

6. Sub-Committee membership and substitution on committees — The Bureau agreed to a recommend to the Parliament that—

• Shona Robison be appointed to replace Jenny Gilruth as a member of the Justice sub-committee on Policing • Johann Lamont be appointed to replace David Stewart as the Scottish Labour Party substitute on the Public Audit and Post-legislative Scrutiny Committee.

7. Removal of motions — The Bureau agreed that all motions lodged on or before 26 November 2019 be removed from the Business Bulletin with the exception of the following—

FUTURE BUSINESS PROGRAMME: POSSIBLE MOTIONS FOR MEMBERS’ BUSINESS

1. Bureau Members will be aware that under Rule 5.6.1(c) the Bureau has a duty to ensure that there is a period of time available for Members’ Business at each meeting of the Parliament.

2. Motions submitted for Members’ Business are shown below.

S5M-21194: Kenneth Gibson: Recognising the Impact of Alcohol Foetal Spectrum Disorders - That the Parliament recognises the prevalence and significant impact of Foetal Alcohol Spectrum Disorders (FASD) in Scotland, as discussed at the meeting of the parliamentary Cross Party Group on Improving Scotland’s Health: 2021 and Beyond on 26 February 2020; notes the presentation by Dr Sarah Brown of the Foetal Alcohol Advisory and Support Team at NHS Ayrshire and Arran, which highlighted that FASD results from alcohol exposure in the womb and is preventable, yet is the most common neurodevelopmental condition in Scotland; further notes data from Glasgow Royal Infirmary research, which showed that one-in-seven babies born there were at high risk of FASD, which suggests a much higher prevalence in Scotland than previously thought; understands that FASD affects neurodevelopment, attainment, physical and mental health and that, without adequate support, it reduces life expectancy to around 34 years of age; believes that 94% of people living with FASD experience mental health problems, 79% experience unemployment, and over a third struggle with addictions; acknowledges the vital work that is being carried out by FASD Hub Scotland in providing a national telephone helpline and range of support for parents/carers and those supporting families affected by FASD, as highlighted by the presentation to the group by Aliy Brown, FASD Project Lead at FASD Hub Scotland, which is run by Adoption UK Scotland; supports the "No Alcohol, No Risk" message, which makes clear that any alcohol consumed during pregnancy can be damaging to the unborn child, and acknowledges its calls for implementation of the new SIGN 156 clinical guideline for Prenatal Alcohol Exposure, and welcomes the development of the National Preconception Framework as a key opportunity to reduce risks to parents and children from alcohol and other health-harming products in Cunninghame North and across Scotland.

S5M-21189: Sarah Boyack: Private Student Accommodation - That the Parliament welcomes the Scottish Government’s commitment during the stage 3 debate on the Non-Domestic Rates (Scotland) Bill to explore the issues surrounding the privately- owned, purpose-built student accommodation (PBSA) sector in Scotland; notes what it considers the massive growth in privately-owned PBSA in the student housing market and in Scotland’s communities, including in the Lothian region; understands that PBSA buildings with more than 30 beds and with planning permission to operate as student accommodation are exempt from the Private Housing (Tenancies) Scotland Act 2016, and that PBSA renters can have fewer rights as tenants; considers there is a lack of a

central strategy for the supply of PBSA and student housing in the context of the needs of the communities in which they are located; believes that student accommodation should complement national policy objectives, such as widening access and improving maintenance support; understands that the average PBSA rent in Scotland is approximately two-thirds of the maximum amount of student support available to students in higher education, and exceeds the maximum amount available to students in further education, and notes the view that a review should be progressed to ensure that the sector provides affordability and accessibility, and caters for the wellbeing of Scotland’s students.

S5M-21179: Iain Gray: 20 Years of Haddington Farmers’ Market - That the Parliament congratulates Haddington Farmers’ Market on its 20th anniversary, which will be celebrated at the market on 25 April 2020; understands that Haddington, widely recognised as the "friendly farmers’ market", was one of the first to be established in Scotland and has continued to provide a monthly opportunity for high- quality local producers to sell their unique range of products to consumers; believes that the market’s success has helped to support jobs and contribute to the area's economy by bringing people to the town centre and giving businesses an opportunity to promote their goods and build their brands; recognises what it sees as the wider benefits for the economy, jobs, environment and health that is provided by Scotland’s excellent farmers’ markets; commends the volunteer organisers on the Haddington Farmers’ Market Committee for establishing, maintaining and growing the market and for upholding the important principles of farmers’ markets, and wishes them, the stallholders and everyone else involved with the market continued success.

S5M-21102: Alex Neil: Scottish Prison Service Rehabilitation Services - That the Parliament recognises the importance of providing comprehensive rehabilitation programmes for long-term prisoners, including those in Shotts Prison, prior to their release back into the community; considers that the available evidence clearly indicates that such programmes provide the necessary support to help ensure that their transition back into society is properly planned and supported by the relevant agencies; further considers that such programmes play a vital role in helping to reduce the reoffending rate among former prisoners; believes that this is having a serious effect on the mental health of prisoners who, having engaged positively with rehabilitation over many years, are being denied these courses or having them unreasonably delayed; further believes that this is having a negative effect in promoting a less violent prison culture and encouraging others to take a less attritional attitude to custody; expresses concern that many prisoners are not, it believes, currently receiving the right level of support timeously due to the poor administration of the Scottish Prison Service’s Self-Change Programme; considers that, as a result of what it sees as its shortcomings, this programme is not realising its potential in either properly preparing prisoners for release or helping to reduce re-offending rates, and acknowledges the view that there is an urgent need to review the management and operation of the Self-Change Programme to identify what action needs to be taken to ensure that it achieves its objectives.

S5M-20807: Colin Smyth: A Secret Vote for All - That the Parliament believes in the importance of the right of every enfranchised individual to cast their vote independently and in secret; notes the results of the RNIB report, Turned Out 2017, which found that three quarters of blind and partially-sighted people surveyed could not vote independently and in secret in the 2017 General Election; considers that this creates a disparity between blind and partially-sighted voters and their sighted peers; notes the Scottish Government's work on electoral reform to improve voting experience, and its intention to work with disability groups to address some of the concerns that they have; anticipates the results of RNIB’s 2019 Turned Out report reflecting on the voting experience of electors with a visual impairment during the General Election held on 12 December 2019, and acknowledges the hopes that practical changes will be tested and initiated that will allow people with sight loss, including those in South Scotland, to consistently vote independently.

S5M-20785: Miles Briggs: NRAC Funding Parity, NHS Lothian- That the Parliament notes that NHS Lothian has had its busiest year on record for hospitals and community health centres; understands that the health board provided care and treatment to more patients in 2019 than ever before, with a total of 1,693,614 attendances, admissions and appointments throughout acute and community services, an increase of nearly 3% on the previous year, with general practices carrying out around 5 million urgent and routine appointments across Lothian; acknowledges the hard work of all staff in NHS Lothian, who it considers do an exceptional job in what can be very challenging circumstances; understands that Edinburgh and the Lothians have the fastest growing populations in Scotland, and acknowledges the view that NHS Lothian should receive funding parity with other health boards, so that it is in a position where it has the resources needed to take forward long-term sustainable improvements to services.

S5M-20759: Clare Adamson: Scotland, A WorldSkills Success Story - That the Parliament marks Scotland’s ongoing success in WorldSkills UK’s skills competitions; considers that WorldSkills UK works to inspire, develop and influence the skills of the future with career advice and developing technical and employability skills of young people through national and international programmes, as well as influencing standards and approaches to training through its Productivity Lab programme in order that more young people and employers get access to world-class skills; understands that, since 2013, a college from Scotland has topped the medal table at the UK Finals, with New College Lanarkshire being ranked number one on four occasions, including most recently in November 2019, and City of Glasgow College on three occasions; recognises that Scotland was ranked number one in the UK at the WorldSkills UK National Finals in 2019, gaining 12 gold, nine silver, 13 bronze and 12 highly commended awards across 15 providers; further recognises that Scotland had five competitors representing Team UK in WorldSkills Kazan 2019, who brought back two medallions from the competition; notes that, over the last five years, Scotland has won 11 medals at international competitions such as WorldSkills and EuroSkills; believes that the achievements of Scottish competitors in these skills competitions are testament to the wealth of talent that exists in Scotland and demonstrate the immense potential of the country’s workforce for the future; commends the efforts and successes of all the

competitors and the team at WorldSkills UK, and wishes everyone involved in the competitions the very best in their future endeavours.

S5M-20757: Mary Fee: Fight for a Fair Start - That the Parliament supports the Fight for a Fair Start campaign, organised by NSPCC Scotland; notes that the campaign seeks investment for more specialist infant and perinatal mental health services in Scotland to support the healthy development of babies and the relationship between parents and children; understands that up to one in five mothers and one in ten fathers experience mental health problems during pregnancy and after birth; acknowledges that adverse childhood experiences, such as having a parent with a mental illness, can begin before birth and affect development outcomes throughout a child’s life; notes calls for NHS boards and integrated joint boards to boost priority given to infants within perinatal and infant mental health services developments, and acknowledges the view that each maternity unit should have access to a support perinatal mental health midwife for mothers and children in West Scotland and across the country.

S5M-20652: Brian Whittle: Future Options for South West Scotland Transport Infrastructure - That the Parliament welcomes the publication of the South West Scotland Transport Study - Initial Appraisal - Case for Change, which it considers identifies a clear need for investment in the transport infrastructure of south west Scotland and lays out a range of options to deliver significant improvements to road safety, journey time reliability, the quality and frequency of rail services and public transport integration; understands that the area’s transport infrastructure plays a key role in the operation of Scotland’s only direct ferry links to Northern Ireland, which are a significant contributor to the local and national economy; acknowledges the potential opportunities to use transport infrastructure investment to benefit the environment, including reducing air and noise pollution in towns and villages through bypassing, installation of electric vehicle charging infrastructure, improving the resilience of road surfaces, and thereby eliminating increased emissions resulting from long diversionary routes, increasing the viability of public transport as an alternative to the car in more rural areas, and greater availability of active travel routes; notes that the proposals contained in the study will be assessed as part of the ongoing second Strategic Transport Projects Review, and acknowledges calls from communities and businesses in south west Scotland for improvements to roads, such as the A77, A76, A75, A70 and the Bellfield interchange, and the area's rail lines to be treated as a matter of urgency to ensure the area remains an attractive place to live, and that the local economy remains competitive with other parts of Scotland and the wider UK.

S5M-20604: Stuart McMillan: National Defibrillator Network Launched by British Heart Foundation - That the Parliament welcomes the launch of a national defibrillator network, known as The Circuit, which has been developed through a partnership between the British Heart Foundation, Microsoft and the Scottish Ambulance Service; notes that the network has been developed with the aim of mapping the location of defibrillators in Scotland and across the UK, with the goal of enabling all ambulance services to direct bystanders to the nearest one in the event of an out-of-hospital cardiac arrest (OHCA); acknowledges that prompt defibrillation, together with early

CPR, is a vital component in providing an OHCA patient with the best chance of survival; understands that the British Heart Foundation estimates that there are currently 60,000 unregistered defibrillators in the UK; recognises that the goal of this initiative is to support an increase in OHCA survival rates, and notes the calls for anyone responsible for a defibrillator, both in Inverclyde and across Scotland, to ensure that it is registered through the website, thecircuit.uk.

S5M -20468: Bruce Crawford: 700th Anniversary of the Declaration of Arbroath: That the Parliament celebrates the 700th anniversary of the Declaration of Arbroath, the Scottish declaration of independence sent to Pope John XXII and dated 6 April 1320; notes that the Declaration followed the First Scots’ War of Independence and sought to confirm the Scottish nation’s status as an independent, sovereign state; understands that the document is believed to have been sent from Arbroath Abbey by the Chancellor of Scotland and Abbott of Arbroath, Bernard of Kilwinning, and was signed and sealed by 51 magnates and nobles; notes that the surviving letter, the Declaration of Arbroath itself, is one of three written to the Pope at the time, with one other letter from King Robert the Bruce, and one from four Scottish Bishops supporting Scotland’s independence; commends the Declaration being placed on UNESCO’s Memory of the World Register in 2016; notes that the Declaration is considered by many to have influenced the drafting of the American Declaration of Independence as recognised by the Senate having designated 6 April as Tartan Day; welcomes the work of the Arbroath 2020 Group and its six-month festival starting in April 2020 and running until September, celebrating Arbroath’s future and its history, and notes the view that it is vital that the memory and legacy of the Declaration of Arbroath is carried through to future generations as a defining moment in Scottish history and culture.

S5M-20255: Alexander Stewart: 180th Anniversary of the Scottish SPCA - That the Parliament congratulates the Scottish SPCA on its 180th anniversary; notes that Scotland's animal welfare charity was set up on 18 December 1839 to rescue horses in Leith and now has outposts across the country, including a wildlife centre in Fishcross, Alloa; acknowledges that, among its many successes, it is one of the only charities in Europe that can impose legislation, which it does under the Animal Health and Welfare (Scotland) Act 2006; understands that it is involved in around 95% of legal cases regarding the protection of animals and that, in 2018, it reported 90 cases to the Procurator Fiscal; acknowledges its work in the field of education, with around 240,000 school pupils receiving talks by its staff, which it believes helps parents become informed as well, and commends everyone at the Clackmannanshire Wildlife Centre and across the Scottish SPCA for their sterling work and unerring commitment to education and animal welfare.

REFERRAL OF BILL AT STAGE 1: LIABILITY FOR NHS CHARGES (TREATMENT OF INDUSTRIAL DISEASE) (SCOTLAND) BILL Introduction

1. The Liability for NHS Charges (Treatment of Industrial Disease) (Scotland) Bill is a Member’s Bill introduced in the Parliament on Monday 9 March by Stuart McMillan MSP.

Discussion

2. The Bill extends an existing statutory ‘compensation recovery’ regime in the Health and Social Care (Community Health and Standards) Act 2003 to cover industrial disease, so as to allow for the recovery by the NHS of the costs of treating a person for an industrial disease where the person is being compensated for contracting the disease. 3. The Bill appears to engage the remits of the following committees for the following reasons:

Health and Sport Committee The primary effect of the Bill is to allow for the recovery by the NHS of certain costs of treating some patients who have an industrial disease. It therefore engages the remit of the Health and Sport Committee.

Economy, Energy and Fair Work The Bill is concerned with the effects of Committee industrial disease and with encouraging safe employment conditions. As such, it engages the remit of the Economy, Energy and Fair Work Committee, which includes economy and fair work matters falling within the responsibilities of the Cabinet Secretary for Economy, Fair Work and Culture.

Justice Committee In relating to damages for personal injury arising from industrial disease, the Bill is also concerned about civil justice matters which fall within the responsibility of the Cabinet Secretary for Justice.

4. The Health and Sport Committee appears to have the main interest and is expecting to consider the Bill. When the draft proposal for the current Bill was lodged in March 2018, the Bureau agreed to refer it to the Health and Sport Committee for information.

5. We are not aware of a desire by any other committee to be formally designated as a secondary committee. Designation of one committee as lead committee

does not preclude any other committee whose remit is engaged from considering the Bill if it wishes to do so.

Recommendation

6. The Bureau is invited to consider recommending to the Parliament by motion that it agrees, under Rule 9.6.1, to designate the Health and Sport Committee as lead committee for consideration of the Liability for NHS Charges (Treatment of Industrial Disease) (Scotland) Bill at Stage 1.

Purpose 17. To provide for the rules of procedure that are to apply in the First-Tier Tribunal for Scotland General Regulatory Chamber when hearing cases against the decision of a local authority to issue a penalty charge notice or bus lane enforcement notice.

The Budget (Scotland) Act 2019 Amendment Regulations 2020

Purpose 20. To give effect to the revised spending plans for 2019-20 as set out in the Spring Budget Revision.

The Public Services Reform (Registers of Scotland) Order 2020

22. The Finance and Constitution Committee has recommended that the above order be approved by the Parliament. Under Rule 10.6.5, the Bureau is required to lodge the following motion—

Purpose 23. To remove a legislative inconsistency resulting from the reclassification of Registers of Scotland to central government, which is in line with best regulatory practice.

Consideration by committee 24. Following consultation under the super-affirmative procedure, the Finance and Constitution Committee considered the order at its meeting on 11 March 2020. The Committee agreed to the order without division. It is expected that the Committee report will be published by 17 March 2020.

The UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020

25. The Culture, Tourism, Europe and External Affairs Committee has recommended that the above regulations be approved by the Parliament. Under Rule 10.6.5, the Bureau is required to lodge the following motion—

Graeme Dey on behalf of the Parliamentary Bureau: That the UEFA European Championship (Trading and Advertising) (Scotland) Regulations 2020 be approved.

Purpose 26. To help ensure successful delivery of the Football Championship by ensuring that the commitments required by UEFA in relation to protection of commercial rights for event sponsors are met.

Consideration by committee 27. The regulations were considered by the Culture, Tourism, Europe and External Affairs Committee at its meeting on 12 March 2020. The Committee agreed to the regulations without division and the Committee report will be published by 17 March 2020.
