Attending: Ken Macintosh (chair), Linda Fabiani, Christine Grahame, Graeme Dey, Liz Smith, Elaine Smith, Patrick Harvie, Willie Rennie. Observing: Tom Arthur Officials present: David McGill, Tracey White, Irene Fleming, Catherine Fergusson, Lewis McNaughton, Emma Cameron, Joanne McNaughton, Steven Bell. 1. Item 1a: Minutes of last meeting — The minutes of 3 March 2020 were agreed. 2. Future business programme — The Bureau agreed to recommend to the Parliament a revised programme of business for the week commencing 9 March 2020 and a programme of business for the weeks commencing 16 and 23 March 2020. Elaine Smith requested a ministerial statement on NHS Lothian. Graeme Dey indicated that the Scottish Government was not minded to agree to a statement at this point and noted that a Topical Question on NHS Lothian had been selected for answer on 10 March. Business Managers agreed that further consideration could be given to the request at a future meeting. The Bureau noted that Members’ Business on Tuesday 17 March 2020 would be motion S5M- 21178 Elaine Smith on 15th Anniversary of the Breastfeeding etc. (Scotland) Act 2005, on Wednesday 18 March 2020 would be motion S5M-20962 Gordon MacDonald on Tory Immigration Policy Detrimental to Scottish Care Sector and on Thursday 19 March 2020 would be motion S5M-20685 Miles Briggs on World TB Day, 24 March 2020. 3. Referral of a Bill at Stage 1 – The Bureau agreed to recommend to the Parliament that the Economy, Energy and Fair Work Committee be designated as the lead committee for consideration of the Heat Networks (Scotland) Bill at Stage 1. 4. Approval of SSIs — The Bureau agreed to recommend to the Parliament that the following SSIs be approved— • Energy Efficiency (Domestic Private Rented Property) (Scotland) Regulations 2020 [draft] • the Social Security (Advocacy Service Standards) (Scotland) Regulations 2020 [draft] • the First-tier Tribunal for Scotland Social Security Chamber (Procedure and Allocation of Functions) Amendment Regulations 2020 [draft]. 5. Referral of a Members’ Bill proposal — The Bureau agreed to refer the draft proposal for a Proposed Mandatory Registration of Automated External Defibrillators (Scotland) Bill to the Health and Sport Committee for information. 1 RESTRICTED – POLICY PB/S5/20/MINS/9 6. Sub-Committee membership and substitution on committees — The Bureau agreed to a recommend to the Parliament that— • Shona Robison be appointed to replace Jenny Gilruth as a member of the Justice sub-committee on Policing • Johann Lamont be appointed to replace David Stewart as the Scottish Labour Party substitute on the Public Audit and Post-legislative Scrutiny Committee. 7. Publication scheme — It was agreed that all papers considered at the meeting should be published. 9. Date of next meeting — The next meeting of the Bureau would be at 12 noon on Tuesday 17 March 2020. Irene Fleming Clerk to the Parliamentary Bureau 10 March 2020 2 RESTRICTED – POLICY PB/S5/20/44 PARLIAMENTARY BUREAU FUTURE BUSINESS PROGRAMME: POSSIBLE MOTIONS FOR MEMBERS’ BUSINESS 1. Bureau Members will be aware that under Rule 5.6.1(c) the Bureau has a duty to ensure that there is a period of time available for Members’ Business at each meeting of the Parliament. 2. Motions submitted for Members’ Business are shown below. S5M-21194: Kenneth Gibson: Recognising the Impact of Alcohol Foetal Spectrum Disorders - That the Parliament recognises the prevalence and significant impact of Foetal Alcohol Spectrum Disorders (FASD) in Scotland, as discussed at the meeting of the parliamentary Cross Party Group on Improving Scotland’s Health: 2021 and Beyond on 26 February 2020; notes the presentation by Dr Sarah Brown of the Foetal Alcohol Advisory and Support Team at NHS Ayrshire and Arran, which highlighted that FASD results from alcohol exposure in the womb and is preventable, yet is the most common neurodevelopmental condition in Scotland; further notes data from Glasgow Royal Infirmary research, which showed that one-in-seven babies born there were at high risk of FASD, which suggests a much higher prevalence in Scotland than previously thought; understands that FASD affects neurodevelopment, attainment, physical and mental health and that, without adequate support, it reduces life expectancy to around 34 years of age; believes that 94% of people living with FASD experience mental health problems, 79% experience unemployment, and over a third struggle with addictions; acknowledges the vital work that is being carried out by FASD Hub Scotland in providing a national telephone helpline and range of support for parents/carers and those supporting families affected by FASD, as highlighted by the presentation to the group by Aliy Brown, FASD Project Lead at FASD Hub Scotland, which is run by Adoption UK Scotland; supports the "No Alcohol, No Risk" message, which makes clear that any alcohol consumed during pregnancy can be damaging to the unborn child, and acknowledges its calls for implementation of the new SIGN 156 clinical guideline for Prenatal Alcohol Exposure, and welcomes the development of the National Preconception Framework as a key opportunity to reduce risks to parents and children from alcohol and other health-harming products in Cunninghame North and across Scotland. S5M-21189: Sarah Boyack: Private Student Accommodation - That the Parliament welcomes the Scottish Government’s commitment during the stage 3 debate on the Non-Domestic Rates (Scotland) Bill to explore the issues surrounding the privately- owned, purpose-built student accommodation (PBSA) sector in Scotland; notes what it considers the massive growth in privately-owned PBSA in the student housing market and in Scotland’s communities, including in the Lothian region; understands that PBSA buildings with more than 30 beds and with planning permission to operate as student accommodation are exempt from the Private Housing (Tenancies) Scotland Act 2016, and that PBSA renters can have fewer rights as tenants; considers there is a lack of a 1 RESTRICTED – POLICY PB/S5/20/44 central strategy for the supply of PBSA and student housing in the context of the needs of the communities in which they are located; believes that student accommodation should complement national policy objectives, such as widening access and improving maintenance support; understands that the average PBSA rent in Scotland is approximately two-thirds of the maximum amount of student support available to students in higher education, and exceeds the maximum amount available to students in further education, and notes the view that a review should be progressed to ensure that the sector provides affordability and accessibility, and caters for the wellbeing of Scotland’s students. S5M-21179: Iain Gray: 20 Years of Haddington Farmers’ Market - That the Parliament congratulates Haddington Farmers’ Market on its 20th anniversary, which will be celebrated at the market on 25 April 2020; understands that Haddington, widely recognised as the "friendly farmers’ market", was one of the first to be established in Scotland and has continued to provide a monthly opportunity for high- quality local producers to sell their unique range of products to consumers; believes that the market’s success has helped to support jobs and contribute to the area's economy by bringing people to the town centre and giving businesses an opportunity to promote their goods and build their brands; recognises what it sees as the wider benefits for the economy, jobs, environment and health that is provided by Scotland’s excellent farmers’ markets; commends the volunteer organisers on the Haddington Farmers’ Market Committee for establishing, maintaining and growing the market and for upholding the important principles of farmers’ markets, and wishes them, the stallholders and everyone else involved with the market continued success. S5M-21102: Alex Neil: Scottish Prison Service Rehabilitation Services - That the Parliament recognises the importance of providing comprehensive rehabilitation programmes for long-term prisoners, including those in Shotts Prison, prior to their release back into the community; considers that the available evidence clearly indicates that such programmes provide the necessary support to help ensure that their transition back into society is properly planned and supported by the relevant agencies; further considers that such programmes play a vital role in helping to reduce the reoffending rate among former prisoners; believes that this is having a serious effect on the mental health of prisoners who, having engaged positively
