I. Invitation

A. The Fire Department of the City of New York (“Fire Department” or “FDNY” or “The Department”) in the interest of promoting competition, and in obtaining a highly reliable supply of Personal Protective Equipment (“PPE”) Bunker Apparel (“Bunker Gear”) for the members of FDNY is seeking qualified proposers to respond to this Request for Information (“RFI”).

B. The purpose of this RFI is to review PPE and Bunker Gear that is commercially available and the conduct an in depth technical and field evaluation of the PPE Bunker Gear submissions. Proposers are asked to identify any new technology with their submission.

C. The Fire Department is interested in obtaining innovative solutions that proposers believe will maintain superior burn protection to interface areas, such as wrists, knees, and leg areas of the Bunker Gear.

II. Information to Proposers

A. On March 8, 2016 at 2:00 PM, a non-mandatory conference will be held at FDNY Headquarters located at 9 MetroTech Center, 1st Floor Auditorium, Brooklyn, New York 11201. Representatives from the Fire Department will be available to answer questions concerning this RFI. Proposers are encouraged to submit questions in writing or via Email prior to the pre-proposal conference. Minutes of the pre-proposal conference will be provided to all proposers receiving a certified copy of this RFI.

B. All questions regarding this RFI must be submitted in writing to the following address, no later than ten (10) days prior to the proposal due date:

C. Proposers shall submit one (1) original, ten (10) copies, and two (2) electronic versions of their written proposal in accordance with Section VIII of this RFI.

D. All proposals shall be delivered no later than 4:00 PM on March 29, 2016 to the following address:

III. Definitions

A. “Bunker Gear” means pants and/or coats designed for firefighting purposes as defined by NFPA Standard 1971 (2013 Edition) (or current revision).

B. “City” means City of New York, its officers, employees, agents, and representatives.

C. “CCHR” means Conductive and Compressive Heart Resistance.

D. “DRD” means Drag Rescue Device.

E. “FDNY” or “Fire Department” or “The Department” means the Fire Department of the City of New York with its headquarters located at 9 Metrotech Center, Brooklyn, New York 11201.

F. “FDNY Authorized Representative” is the Chief of Fire Operations or FDNY member designated by the Chief of Fire Operations to act as the liaison and primary point of contact for this RFI.

G. “ISO” means International Organization for Standardization.

H. “NFPA” means National Fire Protection Association.

I. “OSHA” means Occupational Safety and Health Administration.

J. “PSS” means Personal Safety System.

K. “RFI” means Request for Information.

L. “QM” means the FDNY Quartermaster.

M. “SCBA” means Self Contained Breathing Apparatus.

N. “Summer” means the period between June 21 and September 21.

O. “THL” means Total Heat Loss.

P. “TPP” means Thermal Protective .

Q. “UV” means Ultraviolet.

R. “Winter” means the period between December 21 and the following March 21.

IV. General Requirements

A. Proposers shall provide information regarding PPE Bunker Apparel (Coats, Pants, knee pads and Suspenders) that shall function in accordance with its intended use.

B. Proposers shall be registered to the ISO Standard 9001.

C. All Bunker Gear shall be of the highest quality workmanship, and shall meet or exceed the following standards:

1. NFPA Standard 1971 (2013 Edition) (or current revision).

2. OSHA Standard 29 CFR Part 1910.1030.

3. OSHA Standard 29 CFR Part 1910.156.

4. All applicable City, State, and Federal laws, codes, rules, regulations, and any other industry standards.

D. All components and composites used in the construction of the Bunker Gear shall be third party tested, certified and listed for compliance to NFPA 1971. The label of the third party tester shall denote certification.

E. All garments shall include a user information guide which shall contain all required information pursuant to NFPA Standard 1971 (2013 Edition) (or current revision).

F. All Bunker Gear manufacturers shall include in all garment outer shells and liners a bar code label to facilitate tracking. A complete and fully functional electronic database system for enhanced tracking capabilities shall be made available to the Fire Department at the time of delivery of the Bunker Gear to the FDNY and shall be updated regularly. This electronic database will be required for ongoing Bunker Gear tracking, which shall include but not be limited to:

1. Assignment

2. Inspections

3. Cleaning

4. Repairs

5. Cost analysis

6. Removal/condemnation.

7. Manufacturing Date.

8. Fabric lot number.

9. Trapezoidal Tear Value.

G. In addition to the barcode label, each garment shall have the capability to allow for the installation of embedded chip technology into the garment by the FDNY Quartermaster or as original equipment from the Bunker Gear manufacturer, as directed by the FDNY. This area shall not inhibit normal operations of the coat and shall have equal thermal and water protection as the other sections of the garment.

H. Each garment composite, which consists of an the outer shell, moisture barrier, and thermal liner, shall provide a TPP, THL, and CCHR in accordance with NFPA standards, including but not limited to, NFPA Standard 1971 (2013 Edition) (or current revision).

I. All Bunker Gear outer shell stress points including but not limited to the top and bottom pocket corners, pocket flap corners, top and bottom of storm flap/fly, and any other attachments shall be reinforced for extra strength and durability.

J. All Bunker Gear shall be designed to allow for the attachment and easy deployment of the FDNY PSS.

K. All Bunker Gear hardware shall be reinforced and secured by suede leather, or by FDNY approved equivalent, to prevent hardware from pulling through the garment. All seams shall be designed and stitched to ensure maximum strength and durability.

L. All Bunker Gear and composites shall have label(s) permanently and conspicuously attached including detailed warning instructions and a statement to read, at a minimum- “THIS GARMENT MEETS THE GARMENT REQUIREMENTS OF NFPA STANDARD 1971, STANDARD ON PROTECTIVE ENSEMBLE FOR STRUCTURAL FIREFIGHTING, 2013 EDITION”.

M. Each garment shall be packaged in a manner to provide protection (including UV protection) during shipping prior to its assignment and deployment for firefighting purposes.

N. Each garment shall have a lifetime warranty against defects in material and workmanship.

V. General Requirements- Bunker Coats

A. Bunker coats shall be made available to the Department for the purposes of evaluation. Chest and tail sizes shall be provided in two-inch (2”) increments and sleeve lengths shall be provided in one-inch (1”) increments.

B. Bunker coats shall be constructed in all layers of innovative design for optimum comfort to maximize mobility and reduce stress. All bunker coats shall incorporate a six-inch (6”) tail on the rear panel for all layers.

C. The material composite for the bunker coats shall be comprised of three (3) layers:

1. Outer Shell- +/- 7.5oz/Sq.Yd. Tencate Gemini XT in the color of black.

2. Thermal Liner- Tencate Defender M SL2 7.8oz/Sq.Yd in the color of camo.

3. Vapor Barrier- Crosstech® Black (Type 2F) : ® substrate laminated to a lightweight breathable, Teflon membrane, with a weight of 5.0 oz/Sq. Yd.

D. The inner liner of the bunker coat shall have an eight-and-one-half-inch by eight-and- one-half-inch (8.5” x 8.5”) internal pocket on the left side of the inner liner comprised of a material prior approved in writing by the FDNY Authorized Representative.

E. The moisture barrier shall be sewn to the thermal liner at its perimeter with the breathable membrane oriented inward toward the thermal liner and away from the outer shell. All moisture barrier seams shall be sealed in accordance with the moisture barrier manufacturer specifications. The moisture barrier/thermal liner shall be finished to the outer shell to deliver maximum protection.

F. The moisture barrier/thermal liner shall be completely detachable from the outer shell via the use of a hook & loop mechanism or a snap mechanism to allow for cleaning and regular maintenance.

G. The moisture barrier/thermal liner shall contain opening that will allow for the complete inversion of the moisture barrier/thermal liner system to properly view the integrity of the system. This inspection system shall be hidden when the moisture barrier/thermal liner is properly installed into the outer shell. The outer shell of the bunker coat shall be equipped with a noticeable method that indicates that the bunker coat’s moisture barrier/thermal liner is not properly installed.

H. The DRD shall be constructed in accordance with all applicable NFPA Standards, including but not limited to, NFPA Standard 1971 (2013 Edition) (or current revision), and shall be affixed with a red/orange reflective trim flap to clearly signify the DRD access location.

I. The bunker coat trim shall be Diamond Reflexite, lime/yellow applied in the following manner:

a. One three-inch (3”) strip shall be set full circumference at the bottom sweep of the outer shell.

b. One three-inch (3”) strip shall be set around each sleeve approximately four- inches (4”) above the cuff.

c. One three-inch (3”) strip shall be set full circumference at the chest.

J. The bunker coat collar shall be three-inches (3”) and designed, shaped, and constructed for maximum protection and comfort. The bunker coat collar shall be configured in a manner that it shall remain standing while providing continuous thermal and moisture protection around the neck and face. The bunker coat collar shall be comprised of a layer of self-material and a later of CROSSTECH ® black. The design shall be compatible with the outer shell so that the liner does not buckle, pull, or restrict body motion in any way. The Bunker Gear collar shall be designed in a manner that it does not interfere with the SCBA face mask or helmet being utilized by the FDNY.

K. The bunker coat sleeve cuff shall be extended and reinforced with a binding of Arashield (or alternative material prior approved in writing by the FDNY Authorized Representative) not less than two-inches (2”) in total width for abrasion resistance and thermal resistance and thermal protection. A secure and easily accessible system fastener shall be set in the cuff to attach the outer shell to the moisture barrier/thermal liner.

L. Quality wristlets shall be incorporated and securely bound to the moisture barrier/thermal liner for a proper interface with the FDNY firefighting gloves that will provide extended thermal and splash protection. A system that will reduce water backup into the sleeve is not required, but is strongly preferred.

M. The bunker coat shall contain continuous thermal and moisture protection around the entire torso and storm flap.

N. The bunker coat shall close left edge over right edge by utilizing a hook & loop and snaps from the collar to the hem. The outer shell coat front closure design will also be completely protected by an outside storm flap.

O. The storm flap shall be set on the outside of the right side of the cost opening and shall consist of a minimum of three (3) industry standard reinforced hook and dee type closures.

P. As additional readily accessible and easy to operate closure system shall be incorporated in the chest area that can be utilized for the direct attachment of a large

CMC carabineer of the FDNY personal harness. This closure shall include at a minimum, a three-and-one-quarter-inch (3.25”) Pole Snap Hook (Niagra Safety N3040 or an alternative material prior approved in writing by the FDNY Authorized Representative) and reinforced one-thirteen-sixteenths inch (1 13/16”) single slot D- Ring (Pensafe 3221 or alternative material prior approved in writing by the FDNY Authorized Representative) shall be installed as part of the closure system. This snap hook and single slot “D” ring shall be attached and reinforced in such a matter as to withstand a load of not less than five hundred (500) pounds tensile strength.

Q. The bunker coat shall contain two (2) reinforced tabs attached to the upper right and left chest area for easy access of the microphone of the FDNY portable radio.

R. The bunker coat shall contain a reinforced system sewn to the right chest area designed to support a Streamlight LED 90500 flashlight.

S. The bunker coat shall contain a three-inch (3”) yellow Scotchlite iron letters across the yoke of the coat, with the lettering “F. D. N. Y.”

T. The bunker coat shall include a right side twelve-inch wide by seven-inch deep (12” x 7”) outside full bellows pockets that expand by means of side and bottom gussets to a thickness from zero (0) inches in front to 3.5 inches back. Pockets shall be outer shell material lined with KEVLAR® twill lined on all sides inside of pocket and have a properly sized pocket flap utilizing hook and loop for proper closure.

U. The bunker coat shall include a right side twelve-inch wide by seven-inch deep (12” x 7”) outside full bellows pockets that expand by means of side and bottom gussets to a thickness from 1.5 inches in front to 3 inches back. Pockets shall be outer shell material lined with KEVLAR® twill lined on all sides inside of pocket and have a properly sized pocket flap utilizing hook and loop for proper closure.

V. Notwithstanding any of the above requirements, the proposer may provide additional recommendations that further improve performance and safety subject to approval in writing by the FDNY authorized representative.

VI. General Requirements- Bunker Pants

A. The bunker pant shall have a low rise waist design. Bunker pant sizes shall be made available to all members of the FDNY, even waist sizes in two-inch (2”) increments with inseam lengths available in one-inch (1”) increments.

B. The material composite for the bunker pants shall be comprised of three (3) layers:

1. Outer Shell- +/- 7.5oz/Sq.Yd. Tencate Gemini XT in the color of black.

2. Thermal Liner- Tencate Defender M SL2 7.8oz/Sq.Yd in the color of camo.

3. Vapor Barrier- Crosstech® Black (Type 2F) : NOMEX ® substrate laminated to a lightweight breathable, Teflon membrane, with a weight of 5.0 oz/Sq. Yd.

C. The moisture barrier shall be sewn to the thermal liner at its perimeter with the breathable membrane oriented inward toward the thermal liner and away from the outer shell. All moisture barrier seams shall be sealed in accordance with the moisture barrier manufacturer specifications. The moisture barrier/thermal liner shall be finished to the outer shell to deliver maximum protection.

D. The moisture barrier/thermal liner shall be completely detachable from the outer shell via the use of a hook & loop mechanism or a snap mechanism to allow for cleaning and regular maintenance.

E. The moisture barrier/thermal liner shall contain opening that will allow for the complete inversion of the moisture barrier/thermal liner system to properly view the integrity of the system. This inspection system shall be hidden when the moisture barrier/thermal liner is properly installed into the outer shell. The outer shell of the bunker coat shall be equipped with a noticeable method that indicates that the bunker coat’s moisture barrier/thermal liner is not properly installed.

F. The inner liner shall have one (1) eight-and-one-half-inch by eight-and-one-half-inch (8.5” x 8.5”) internal pocket which shall be made of an FDNY approved liner material. The liner pocket shall be located in the upper left area of the pant liner.

G. The bunker pants trim shall be Diamond Reflexite, lime/yellow applied in the following manner:

1. One three-inch (3”) strip shall be set full circumference at the bottom sweep of each pant leg four-inches (4”) from the bottom cuff.

H. The outer shell of the bunker pants closure shall consist of a right over left overlapping fly front, it should utilize hook and loop for secure closure. A hook and dee ring closure shall be used for quick one motion closing at the waist.

I. The bunker pants shall contain two (2) waist straps installed at the waistband on the right side and the left side of the bunker pants. The strap shall be designed and installed allowing for quick waist adjustment.

J. The knee section of the bunker pants shall be designed throughout all layers so that it allows for free movement with few restrictions involving range of wearer movement.

K. The outermost layer of the knee sections of the bunker pants shall consist of black polymer coated aramid for abrasion and moisture resistance. Additional layer(s) of materials may be incorporated to increase thermal insulation. The polymer coating shall extend to the top of the reflective trim for added thermal shin protection. The polymer coating shall extend to the top of the reflective trim for added thermal shin

protection, with final approval of the design to be provided in advance in writing by the FDNY Authorized Representative.

L. The knee composite shall demonstrate an average CCHR rating of eighty (80) seconds or greater for both dry and wet conditions when measured in accordance with NFPA 1971-2013, but with extrapolation of the Stoll curve specified in ASTM F1060- Standard Test Method for Thermal Protection Performance for Materials for protective clothing for Hot Surface Contract, using the following formula:

Using the formula contained herein, where 푡푖 is equal to the time to second degree burn, the Contractor may be required to supply approved third party test data that demonstrates that the knee area provides the level of protection as stated by the Contractor.

M. The cuff area of the bunker pant shall be reinforced with a binding of black Arashield or FDNY approved alternative, not less than two-inches (2”) in total width for greater strength, abrasion resistance, and thermal protection.

N. The back portion of the cuff area of the bunker pant should be designed and manufactured to prevent damage from the heel on the back of the cuff.

O. The bunker pants shall contain a six-inch by seven-inch (6” x 7”) outer shell material patch pocket shall be sewn on the thigh area of the left leg with the top pocket corners reinforced. One eyelet centered at the bottom of the pocket shall provide drainage of moisture. A properly sized pocket flap utilize hook and loop for proper closure.

P. The bunker pants shall contain a reinforced system to securely attach the Gemtor FDNY personal harness (Model # 541NYC) and shall be incorporated into the bunker pants so that can easily attach and remove the harness. Consideration should also be given to all areas that contact harness webbing to negate advanced wear issues.

Q. The bunker pants shall contain an easily removable but durable tangle free suspender attachment system.

R. Notwithstanding any of the above requirements, the proposer may provide additional recommendations that further improve performance and safety subject to approval in writing by the FDNY authorized representative.

VII. FDNY Bunker Gear Ordering and Utilization

A. For the purposes of this RFI, the FDNY anticipates the minimum delivery times to FDNY in standard conditions in the following manner:

1. 1-25 sets of Bunker Gear- 3 Weeks

2. 25-400 sets of Bunker Gear- 6 Weeks

3. 401+ sets of Bunker Gear- 8 Weeks

B. For the purposes of this RFI, the FDNY anticipates the minimum delivery times to FDNY in emergency conditions in the following manner:

1. 25-400 sets of Bunker Gear- 4 Weeks

2. 401+ sets of Bunker Gear- 6 Weeks

C. At the time of the placement of an order, the FDNY Authorized Representative will indicate whether standard or emergency conditions exist. All determinations will be final.

D. The quantities specified herein represent potential orders placed on a monthly basis. Proposers will be expected to manage multiple simultaneous open orders given the potential conditions stated by the FDNY Authorized Representative at the time of the placement of the order.

VIII. Proposer Qualifications

A. Proposers submitting a written proposal in response to this RFI shall be required to demonstrate the following:

1. At the time of the proposal submission, the proposer shall have a minimum of ten (10) years of experience and shall be currently manufacturing Bunker Gear similar to that required by this specification. Individual experience as an employee, principal, director, or officer of an organization may not be used to satisfy this requirement.

2. At the time of the proposal submission, the proposer shall demonstrate sufficient manufacturing capability through a validation of the following items:

a. The names, addresses, telephone numbers, and email addresses of at-least five (5) professional Firefighting organizations that utilize the Bunker Gear furnished by the proposer in response to this RFI, excluding the New York City Fire Department.

b. A report on the average and median manufacturing time in regular and emergency situations, as requested by the Department.

c. A description of any patents, copyrights, or licensing agreements applicable to the product.

d. A description of any pending lawsuits, judgments, or liens directly related to the manufacture of Bunker Gear or associated components.

B. Proposers shall limit the documentation provided in their proposal to the information concerning the products supplied as part of this RFI.

C. Proposals shall not make any comparison with other products manufactured or distributed by the proposer or any other information concerning competing proposers.

D. Proposer’s will be notified in writing by the FDNY that their Bunker Gear submission meets the needs of the Department and will be invited to participate in subsequent phases of the RFI evaluation as identified in Section VIII of this RFI.

IX. Evaluation Methodology

A. Proposers wishing to express interest in this RFI shall initially submit a written proposal, including any and all supporting product diagrams, photographs, designs, or other drawings of the Bunker Gear submission.

B. As part of the technical evaluation, proposers shall also include, at no additional cost to the Fire Department, one (1) full set of Bunker Gear for inspection by the Fire Department.

C. If the Fire Department determines that the Bunker Gear submission submitted for consideration meets the needs of the Fire Department, the proposer will provide a minimum of five (5) but no more than ten (10) additional units at no additional cost to the Fire Department for the User evaluation.

D. If the Fire Department determines that, as a result of the vendor qualification, technical evaluation, and user evaluation, the Bunker Gear submission for consideration meets the needs of the Fire Department, the proposer will be required to submit sixty (60) additional sets of Bunker Gear to the Fire Department for the purposes of conducting a multi-season wear trial by front line units. The FDNY Quartermaster Contractor will procure all Bunker Gear selected for the Phase 4-Field Evaluation. The FDNY Quartermaster shall establish a not-to-exceed fixed amount for each set of Bunker Gear which will be offered only to proposers who have been selected to participate in the Phase 4- Field Evaluation. This amount will be equal to all vendors invited to participate and will be final.

E. During the course of the evaluation process, the proposer shall be responsible for replacing any Bunker Gear or component parts thereof that is rendered unserviceable, at no additional cost to the Fire Department. The decision as to whether Bunker Gear in whole or in part is unserviceable shall be made solely by the Fire Department and will not be arbitrary or capricious. All decisions are final.

F. The Bunker Gear evaluation will be comprised of four (4) phases.

1. Phase 1- Vendor Qualification

a. As specified in Section VIII herein, all proposers shall be required to demonstrate sufficient qualifications and capacity to participate in this RFI. These qualifications shall be documented through the written proposal specified in this section.

b. Proposer’s shall be required to submit a written proposal that shall include, but shall not be limited to:

i. The company name.

ii. Business address.

iii. Name, address, and telephone number of the person who is authorized to represent the proposer.

iv. A detailed presentation of the proposer’s overall experience, background, and experience in the production of Bunker Gear similar or the same to the specifications described herein.

v. A description of the proposer’s manufacturing facility, number of employees on a regular and seasonal adjusted basis (if applicable).

vi. A description of the proposer’s quality control program that will ensure that all of the requirements specified in this RFI will be met.

vii. A description of the timeframe required to manufacture and submit the Bunker Gear furnished by the proposer as part of this RFI. This description should include a timeframe for manufacture and ship during normal conditions and a timeframe for manufacture and ship in the event of an emergency.

viii. A description of any patents, copyrights, or licensing agreements applicable to the Bunker Gear submitted to the Fire Department in response to this RFI.

ix. The name, address, telephone number, and email address of all professional Firefighting organizations that currently utilize the Bunker Gear furnished by the proposer in response to this RFI, excluding the New York City Fire Department.

x. The “Acknowledgement of Addenda” form (See Attachments Section, Attachment A)

xi. The “Vendor Questionnaire” form (See Attachments Section, Attachment B)

c. The Fire Department may, at is sole option, request an oral presentation by the proposer for representatives of FDNY. During this presentation, the proposer may be asked to deliver a comprehensive presentation regarding the submitted Bunker Gear. The oral presentation content shall be kept confidential.

d. The Fire Department will qualify proposers who receive at least seventy percent (70%) of the maximum allowable points as listed in Attachment D- Phase 1 evaluation form.

e. Proposer’s will be notified in writing by the FDNY that their Bunker Gear submission meets the needs of the Department and will be invited to participate in Phase 2- Technical Evaluation.

2. Phase 2- Technical Review

a. Proposers who are selected by FDNY to participate in Phase 2- Technical Review shall be required to submit one (1) complete set of Bunker Gear for evaluation by FDNY.

b. Proposers shall be required to produce one (1) complete set of Bunker Gear within twenty-one (21) days of notification by FDNY. Proposers who fail to produce Bunker Gear within that timeframe will be disqualified from future phases of this RFI.

c. The FDNY will make FDNY members available for measurement to selected proposers at a time selected by the FDNY. Following the collection of measurements by the proposer, the proposer will have twenty-one (21) days to provide one (1) complete set of Bunker Gear for the Phase 2- Technical Review.

d. The FDNY Technical Review shall consist of, but shall not be limited to, the following:

i. A review of the Proposer submission to verify compliance with Section VII- Proposer Qualifications.

ii. A review of Attachment B- Proposer Questionnaire of this RFI.

iii. A copy of the current Bunker Gear User Guide for the subject submission.

iv. A description of the tracking and accountability system for the subject submission which shall include but shall not be limited to:

1. User Guides

2. Screenshots

3. Web Access

4. Maintenance Records

5. Accompanying patents, copyrights, or licensing agreements.

v. A copy of the current NFPA Certification for the subject submission by the Proposer. If the subject submission is not certified, the FDNY will accept a letter from an officer of the Proposer certifying that the subject submission will be certified prior to the use in Phase 4 if selected by the FDNY at no additional expense to the Fire Department.

1. Failure to obtain and demonstrate NFPA certification prior to the start of Phase 4 will result in a disqualification of the Proposer by the FDNY. No additional time, extensions, delays, or special considerations will be granted by the Fire Department.

vi. A review of the Drag Rescue Device as included in the subject gear for evaluation.

vii. A review of the front closure of the Bunker Pant and Bunker Coat.

viii. Utilization and interface with a minimum of the following:

e. Proposer’s will be notified in writing by the FDNY that their Bunker Gear submission meets the needs of the Department and will be invited to participate in Phase 3- User Evaluation.

f. Proposers who are invited to participate in Phase 3- User Evaluation will be notified in writing of the not-to-exceed fixed amount of compensation for each set of Bunker Gear which will be offered to proposers who have been selected to participate in the Phase 4- Field Evaluation.

3. Phase 3- User Evaluation

a. Proposers selected to participate in the Bunker Gear User evaluation will be required to submit a minimum of five (5) but no more than ten (10) complete sets of Bunker Gear for Phase 3- User Evaluation at no charge to the Fire Department.

b. The FDNY will make FDNY members available for measurement to selected proposers at a time selected by the FDNY. Following the collection of measurements by the proposer, the proposer will have twenty-eight (28) days to provide the five (5) to ten (10) complete sets of Bunker Gear for the Phase 3- User Evaluation.

c. Each set of gear will be given a unique identification number for the purposes of tracking and evaluation during the technical evaluation.

d. Upon receipt of the supplied Bunker Gear, the Fire Department will wash all Bunker Gear prior to the commencement of the Phase 3- User Evaluation.

e. The Bunker Gear will undergo an assessment at the FDNY training facility located at Randall’s Island, New York, New York, which shall include, but shall not be limited to the tests listed below and included in Attachment C of this RFI:

i. Form and Fit Test

1. The Form & Fit Test has been established to ensure that the presented bunker gear properly fits evaluating member. The test has been designed to go through the motions of what an FDNY is required to do each time he/she is called to respond to an alarm. The sample Bunker Gear set(s) will be set up as would be required when member is working in his/her unit. The members personal harness/PSS will be attached as well as his normal tools (different for most members) carried in pockets. Member will have the current FDNY uniform as well as an FDNY Motorola Radio. Members gear will be placed in the ready position near apparatus. Upon the start of the test he will be required to don bunker gear as responding to a phone alarm.

2. The scenario will include but shall be limited to:

a. Member will don bunker gear and get onto apparatus, position him/herself in seat, don shoulder straps of SCBA, and put seatbelt on for response.

b. Member will release seatbelt and dismount apparatus with SCBA on.

c. Member will then be required to “mask up”. This will include completing all securing straps of the SCBA, properly donning hood, helmet, and face piece and turning on air from cylinder.

d. Member will then be required to access tool/equipment from pocket(s) and then access PSS for deployment.

e. Member will then remove SCBA and place it back in SCBA holder on apparatus. Member will the doff gear and get it ready for next response.

ii. Selected sections of the Functional Skills Training and Test (See Attachment C)

1. The Fire Department will be following the general framework of the Functional Skills Training and Training Test as included in Attachment C. Modules may be completed in whole or in part at the discretion of the Fire Department. f. At the conclusion of the assessment specified in this section, the FDNY evaluators will be asked to complete the evaluation tool included in the Attachments section (Attachment F) of this RFI. g. At the conclusion of the assessment specified in this section, the Bunker Gear will be inspected by the FDNY Authorized Representative and the FDNY Quartermaster to determine whether any damage and/or wear is visible. Any and all items will be noted by the FDNY Authorized Representative and the FDNY Quartermaster. h. Following the inspection described in this section, all Bunker Gear may be cleaned in accordance with FDNY requirements, inspected by the FDNY Authorized Representative and FDNY Quartermaster. All damage and/or wear will be noted. The Bunker Gear will then be returned to the evaluators. i. Upon return from cleaning, the evaluation steps specified herein for Phase 3- User Evaluation will be repeated at least one (1) time, but may be repeated

additional times if determined to be necessary by the FDNY Authorized Representative.

j. At the conclusion of the assessment specified in this section, the FDNY evaluators will be asked to complete the evaluation tool included in the Attachments section (Attachment F) of this RFI.

k. At the conclusion of the assessment, the Bunker Gear will be inspected by the FDNY Authorized Representative and the FDNY Quartermaster to determine if any damage and/or wear, over and above that previously noted on previous inspections, is present. Any and all defects will be noted by the FDNY Authorized Representative and the FDNY Quartermaster.

l. The scores by each member of the evaluation committee will be tabulated and will constitute the Phase 3- User Evaluation score.

m. Tabulated proposer scores will be ranked from highest to lowest. A reasonable cutoff will be established and the highest rated proposer(s) will be notified in writing by the FDNY that their Bunker Gear submission meets the needs of the Fire Department and will be invited to participate in Phase 4- Field Evaluation.

4. Phase 4- Field Evaluation

a. The Phase 4- Field Evaluation will entail the deployment of the proposed Bunker Gear to active Fire Department units for the purposes of conducting a multi-season field test. Depending on the timing of the evaluations, the evaluation will include at-least one (1) Winter and one (1) Summer, and may be extended at the sole discretion of the Fire Department.

b. Prior to the commencement of Phase 4- Field Evaluation, proposers who are invited to participate will be required to submit proof of insurance in accordance with the insurance provisions of this RFI.

c. Prior to the commencement of Phase 4- Field Evaluation, proposers who are invited to participate will be required to sign an indemnification agreement in accordance with the indemnification provisions of this RFI.

d. Proposers selected to participate in Phase 4- Field Evaluation will be required to coordinate the delivery, outfitting, and supply of sixty (60) additional sets of Bunker Gear with the FDNY Quartermaster.

e. The Fire Department will select units to participate in the field evaluation. These units may be comprised of Engine Companies, Ladder Companies, Squad Companies, Rescue Companies, Battalion, Division, or training units.

These units may be located in anywhere within the geographic boundaries of the City of New York. f. The FDNY will make FDNY members available for measurement to selected proposers at a time selected by the FDNY. Following the collection of measurements by the proposer, the proposer will have forty-five (45) days to provide the sixty (60) complete sets of Bunker Gear for the Phase 4- Field Evaluation. g. Each set of gear will be given a unique identification number for the purposes of tracking and evaluation during the field evaluation, as designated by the FDNY. h. Following the completion measurement of the FDNY members by both proposers, the FDNY Authorized Representative will provide both vendors with a date for the delivery of the full lot of Bunker Gear to the FDNY. i. Upon receipt of the supplied Bunker Gear, the Fire Department will wash all Bunker Gear prior to the commencement of the Phase 4- Field Evaluation. j. Bunker Gear will be distributed by the FDNY Quartermaster in an effort to adhere to field evaluation strategy determined by the Fire Department. Members of the selected units will be provided with one (1) set of each Bunker Gear set that has made it to Phase 4. A system to allow all bunker gear being evaluated will be established by the department. At the conclusion of this period, members will be asked to complete the evaluation tool included in the Attachments section (Attachment G) of this RFI. k. During the course of the evaluation process, the proposer shall be responsible for replacing any Bunker Gear, in whole or in part, that is rendered unserviceable. The final decision as to whether the Bunker Gear is unserviceable is shall be solely by the Fire Department. l. All Bunker Gear will be inspected and washed not less than one (1) time during the field pilot. All gear that has been certified to continue with firefighting purposes will be returned to the assigned user in accordance with the FDNY field evaluation schedule. m. The Fire Department reserves the right reserves the right to remove any set of Bunker Gear, in whole or in part, from the field evaluation if there are any safety or operational concerns. All decisions are final. n. The Phase 4- field evaluation will conclude no earlier than thirty-nine (39) weeks following the start date.

o. At the conclusion of Phase 4, the completed evaluation tools will be compiled and tabulated to determine a percentage rating between 0-100% of total possible points. Upon written request, proposers may be provided with the results of the user evaluations for their submission only for phase 4.

G. All proposers who successfully complete the Phase 4- Field Evaluation will be requested to submit a price proposal for one-thousand (1,000) full sets of Bunker Gear to the FDNY Quartermaster within thirty (30) days of request by the Fire Department.

X. Compensation for Material Submissions

A. The FDNY Quartermaster Contractor will procure all Bunker Gear selected for the Phase 4-Field Evaluation. The FDNY Quartermaster shall establish a not-to-exceed fixed amount for each set of Bunker Gear which will be offered only to proposers who have been selected to participate in the Phase 4- Field Evaluation. This amount will be equal to all vendors invited to participate and will be final.

XI. Fire Department Reserved Rights

A. All materials submitted, including all Bunker Gear, in whole or in part, become the property of the Fire Department.

B. At its sole discretion, the Fire Department reserves the right to:

1. Reject any and all proposals in response to this RFI.

2. Request supplemental statements, documentation, or information of any kind from proposers in response to this RFI.

3. Extend the deadline for the submission of RFI proposals.

4. Amend, waive, modify, or withdraw (in whole or in part) this RFI and/or to waive any requirements outlined herein.

XII. General Information

A. This RFI has been compiled without any attempt to restrict competition. If a proposer believes that any of the requirements defined herein limit said competition they should note this in their response.

B. In the event that any amendments to this RFI are required prior to the closing date, said amendments will be furnished via email to all prospective proposers who have received a copy of the RFI and have registered their name and email address with the Fire Department. Any amendments issued in the form of an addendum will be available via the FDNY Website. Failure to acknowledge an addendum on the

Acknowledgement of Addendum form (See Attachments Section- Attachment A) may result in the proposal not being considered.

C. The New York City Comptroller is charged with the audit of contracts in New York City. Any proposer who believes that there has been unfairness, favoritism, or impropriety in the proposal process should inform the Comptroller, Office of Contract Administration, 1 Centre Street, Room 835, New York, New York 10007; Telephone Number (212) 669-3000.

D. The issuance of this RFI and the submission of a proposal to the Fire Department does not obligate the Fire Department or the City in any way.

XIII. Security of the RFI Proposal

A. The content of each proposal will be held in the strictest confidence, and not details of any proposal will be discussed outside of the evaluation organization, unless required by law.

B. Upon submission, a proposal and any other materials submitted by a proposer in conjunction therewith including designs, drawings, maps, microfilms, computer tapes or discs become subject to the New York State Freedom of Information Law (FOIL), New York State Public Officers Law Sections 84-90. The general rule is that records are to be made available to the public for inspection and copying. However, the Fire Department may deny public access to such records or applicable portions thereof which are “trade secrets or are maintained for the regulation of commercial enterprise which if disclosed would cause substantial injury to the competitive position of the subject enterprise”, “are specifically exempted from disclosure by state or federal statute”, “if disclosed would impair present or imminent contract awards”, “are inter- agency or intra-agency materials which are not final agency policy or determination” or are otherwise exempted from disclosure under FOIL.

C. Vendors may mark as confidential those portions of the RFI proposal that they believe are not required to be disclosed under FOIL. While the Fire Department may not exclude a proposal from consideration simply because it restricts disclosure of data, it is, however, obligated to disclose information consistent with the requirements of FOIL notwithstanding any such marking of confidentiality made by a vendor.

XIV. Insurance

A. The proposer shall procure and maintain insurance against claims for injuries to persons or damages to property which may arise from or in connection with the provision of products hereunder by the proposer, his agents, representatives, employees or subcontractors. The cost of such insurance shall be borne by the proposer and shall be solely responsible for payment of all premiums for insurance.

B. COMMERCIAL GENERAL LIABILITY ("CGL") with a combined single limit for Bodily Injury, Personal injury and Property Damage of a least $1,000,000 per accident and a minimum aggregate of $2,000,000. The limit may be provided through a combination of primary and umbrella/ excess liability policies. Coverage shall include the BROAD FORM COMPREHENSIVE LIABILITY ENDORSEMENT (GL-0404) (of the ISO or an equivalent). Coverage shall provide and encompass at least the following:

1. X, C, and U (explosion, collapse, and underground) hazards, where applicable;

2. Independent Contractors;

3. Blanket written contractual liability covering all indemnity agreements and indemnification;

4. Products liability and completed operations, with the provision that coverage shall extend for a period of at least 12 (twelve) months from Project completion;

5. CGL coverage written on an occurrence form;

6. Endorsement naming the City, its officers, officials and employees as an additional insured, and

7. Waiver of Subrogation.

8. The policy shall contain no exclusions or endorsements, which are not acceptable to the City and shall be of a form and by an insurance company acceptable to the City.

C. Umbrella and/or excess liability policies used to comply with CGL y limits shown above shall be warranted to be in excess of limits provided by primary CGL.

D. The Vendor shall furnish its proposal, Certificates of Insurance effecting coverage required by this clause. The Certificates for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The Certificates must provide for 15 days written notice prior to cancellation, non-renewal or material modification.

E. All required insurance policies shall be maintained with companies that may lawfully issue the required policy and have an A.M. Best rating of at least A- or a Standard and Poor’s rating of at least AA.

F. The Vendor shall secure, pay for, and maintain property insurance necessary for protection against loss of owned, borrowed, or rented capital equipment and tools, including any tools owned by employees and any tools, equipment, staging, towers, and forms owned, borrowed or rented by the Vendor. Failure of the Vendor to secure

such insurance or to maintain adequate levels of coverage shall not obligate the City, or its agents and employees for any losses, and the City and its agents and employees shall have no such liability. The insurance policy for such Vendor shall include a waiver of subrogation as follows:

"It is agreed that in no event shall this insurance company have any right of recovery against the City."

G. Any deductibles or self-insured retention must be declared to and approved by the Fire Department.

H. The City, its officers, officials and employees are to be covered as insured as respects: liability arising out of activities performed by or on behalf of the Vendor; products and completed operations of the Vendor; premises owned, leased or used by the Vendor. The coverage shall contain no special limitations on the scope of protection afforded to the City, its officers, officials and employees.

I. The Vendor's insurance coverage shall be primary insurance as respects the City, its officers, officials, and employees. Any other insurance or self-insurance maintained by the Fire Department, its officers, officials, and employees shall be in excess of, and not contribute to, the Vendor's insurance.

J. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the Fire Department, its officers, officials, and employees.

K. The Vendor's insurance shall apply separately to each insured against whom a claim is made or suit is brought, except with respect to the limits of the insurer's liability.

L. Should the Vendor engage a subcontractor, the same conditions applicable to the Vendor under these Insurance Requirements shall apply to each subcontractor.

M. NOTICE OF ACCIDENT OR CLAIM - Notice of accident shall be given to the Insurance Company within one hundred twenty (120) days after such claim shall have been filed with the Comptroller of the City of New York. Notice to the Insurance Company by either party shall be deemed sufficient notice under the policy.

N. All policies purporting to insure the City of New York must explicitly name the City, its officers, officials, and employees as the insured, and not only the Department.

O. The policy of insurance shall not be cancelled, terminated, modified or changed by the Insurance Company unless at least fifteen (15) Days prior written notice is sent to the Named Insured by Certified Mail and also sent by Registered Mail to both the Commissioner and to Comptroller's Office, attn: Office of Contract Administration, Municipal Building, Room 835, New York, New York 10007; and VIOLATION OF ANY OF THE TERMS of any policy issued by the Insurance Company to the Vendor shall not invalidate this policy.

XV. Indemnification

a. The proposer agrees to indemnify and hold harmless the City of New York (“City”), its officers, employees, agents, and representatives (“Indemnitees”), from any and all claims, causes of action, judgments, costs, expenses (including attorney’s fees and litigation costs) or other damages resulting from injury to any person (including injury resulting in death), or damage to property of any nature belonging to or in the custody of any person, corporation, partnership, association, or other entity arising out of any defects in the design, manufacture, and/or use of the Bunker Gear, or any acts or omissions of the proposer, its officers, employees, agents, or representatives in connection with this RFI and the testing and evaluation process.

b. The proposer agrees that the indemnification obligation hereunder contemplates (1) full indemnity in the event of liability imposed against Indemnitees without negligence and solely by reason of statute, operation of law or otherwise; and (2) partial indemnity in the event of any actual negligence on the part of the indemnitees, either causing or contributing to the underlying claim (in which case, indemnification will be limited to any liability imposed over and above that percentage attributable to actual fault whether by statute, by operation of law, or otherwise). Where partial indemnity is provided hereunder, all costs and expenses shall be indemnified on a pro rata basis.

XVI. Confidentiality

a. The proposer acknowledges that all records, information, or data which it may have access to, examine, prepare, maintain or have custody of and deliver hereunder are confidential records (“Confidential Information”). All Confidential Information is the property of the Fire Department, and the vendor shall not at any time make any disclosure or statements or release to any third party any Confidential Information without the prior approval of the Fire Department.

b. The obligation to maintain Confidential Information would include the duty to comply with all Federal, State, and Local laws, rules, and regulations. The proposer agrees that it will instruct its officers, employees, and agents, to maintain the confidentiality of any and all Confidential Information.

c. Upon completion and termination of the evaluation program, the proposer shall return to the Fire Department any and all Confidential Information in the possession of the proposer or its subcontractors, and permanently delete any and all Confidential Information maintained in any electronic form by the proposer or its subcontractors.

d. The Fire Department reserves any and all other rights and remedies in the event of unauthorized disclosure.

XVII. Infringement- Vendor Warranty

a. The proposer shall deliver the Bunker Gear free from the claim of any third party by way of infringement including but not limited to patent, copyright, trade secrets, or the like. The submission of a proposal is deemed to be a warranty by the proposer that the proposer has inspected the specifications and has determined that no claim of any third party by way of infringement or otherwise will result from compliance with the specifications. The proposer shall indemnify any hold the City harmless against such claim regardless of whether or not the infringement arises out of compliance with the specifications.
