NSW LABOR POLITICAL BRIEFING Report from the Administrative Committee August 2016 1. VALE CYRIL JOSEPH NETHERY AM Cyril Nethery joined NSW Labor in March 1941 at the age of 21. He was a Lancaster pilot during World War II and was described as compassionate, selfless man. Cyril was heavily involved in his local community through rugby union clubs, as a volunteer firefighter and was passionate about assisting indigenous and underprivileged families through his work at St. Vincent de Paul. Cyril was recognised for his service to the community by being awarded a Member of the Order of Australia medal. Cyril was a long time active member of the Woolooware Branch of the ALP. He was a great supporter of Gough Whitlam’s reforms as he believed in making Australia a better place, taking his children to see Gough at an event in Cronulla. Cyril’s commitment to Labor values was second to none, and he was awarded life membership at State Conference. Cryril died peacefully with his family by his side at the age of 96. He is survived by his wife, Valmarie, and his children who are also strong, Labor supporters. 2. VALE MARGOT LONGWORTH Margot Longworth was a deeply committed and passionate member of NSW Labor for almost 37 years. She was a member of the Newcastle Branch for 19 years from 1979 to 1998, before transferring to the Newcastle City Day Branch where she remained actively involved until her health declined in recent years. Margot held almost every executive position at Newcastle City Day Branch and served with great enthusiasm as a long-time delegate to the Newcastle SEC and FEC. -

Agreement in Principle Ms KRISTINA KENEALLY (Heffron—Premier, and Minister for Redfern Waterloo) [11.39 a.m.]: I move: That this bill be now agreed to in principle. I acknowledge that we are on the traditional lands of the Gadigal people. I pay my respect to elders past and present, and recognise that we have in the Chamber today many distinguished Aboriginal people from a range of areas within our community. I acknowledge Ms Bev Manton, Chairperson of the New South Wales Aboriginal Land Council. Bev is a proud member of the Worimi nation and is a welcome guest in our House today. I also acknowledge Uncle Charles "Chicka" Madden, a most respected local Aboriginal elder who also joins us on the floor of the Parliament for these historic proceedings. I have been to many events with Chicka over the years, and at all times he has been a strong advocate for his people and respected in all communities. I also acknowledge the Hon. James Spigelman, Lieutenant-Governor of New South Wales and Chief Justice of New South Wales, representing the Governor today. I also acknowledge our invited guests in the Chamber today. You are welcome guests of this Government and this Parliament to witness today's proceedings. It is humbling to have the opportunity to put before this House legislation to recognise our first people, our Aboriginal people, in the New South Wales Constitution Act. -

GOVERNOR'S SPEECH: ADDRESS-IN-REPLY Fourth Day's Debate Debate resumed from an earlier hour. Mr GUY ZANGARI (Fairfield) [6.17 p.m.] (Inaugural Speech): Mr Deputy-Speaker, I congratulate you on your election as the Deputy-Speaker. We look forward to your distinguished service to the House and to the people of New South Wales. It is a privilege to address the House this evening. It is a sincere honour to be elected to the oldest Parliament in the country and the Fifty-fifth Parliament of New South Wales. It is equally an honour to be the elected representative for Fairfield. Life's journey is characterised by the people you meet and the family you are part of. People are shaped and formed by their experiences throughout life, and I need to thank many people for shaping and moulding me into the person I am today. My life has been an experience of two halves. The first is to have grown up in the inner-western suburbs of Sydney with my parents and siblings; the second is to have been tertiary educated and to work, live and raise a family in the outer-western Sydney suburbs. I am always a westie and proud of it. I begin by acknowledging the people who assisted the Fairfield Labor Party campaign. My campaign director, Adrian Boothman, is a former student of Patrician Brothers' College, Fairfield. His tireless efforts, constant support and advice were and remain invaluable. -

LABORLABOR NEWSNEWS OctoberOctober 2008 2012 PREMIER’S MESSAGE An Abbott Federal Government would be a disaster for Tasmania. It’s difficult to overstate the damage that the federal Opposition leader’s policies would do to the Tasmanian economy and government services if he is ever elected Prime Minister. The single biggest threat is the Liberal Party’s stance on the distribution of GST revenue. Mainland Liberal Premiers are united in pushing for a per capita distribution of GST revenue, which would strip up to $700 million per annum from Tasmania’s budget. That’s the equivalent of $5000 for every Tasmanian household. Mr Abbott has consistently expressed sympathy and support for his Liberal colleague’s campaign. His claims that such an approach would not disadvantage Tasmania are laughable. Liberal Premiers are pursuing a change in the way GST revenue is distributed because they PREMIER LARA GIDDINGS want to get their hands on more of it. With a finite amount of cash available, giving more to WA, Victoria, Queensland and NSW must mean there’s less available for the smaller States. The impact on public services in Tasmania of a further massive reduction in GST revenue would be devastating. But the potential damage to Tasmania of an Abbott government does not end there. Mr Abbott’s pledge to repeal the price on carbon would strip a further $70 million per annum from Tasmania, as we benefit financially from our strong advantage in renewable energy. He has also pledged to abandon the NBN, which would cost Tasmania 800 jobs in the roll-out phase and jeopardise our place in the new digital economy. -

Yours sincerely Rhys Edwards Secretary 9 October 2010 Department of Premier and Cabinet - Annual Report 2009-10 1 The Department of Premier and Cabinet is a central agency of the Tasmanian State Government. The Ministers to whom the department is responsible are the Premier, and the Minister for Innovation, Science and Technology, Hon David Bartlett MP, the Minister for Local Government and the Minister for Veterans’ Affairs, Hon Bryan Green MP, the Minister for Children, Hon Lin Thorp MLC, and the Minister for Community Development and the Minister for Climate Change, Hon Nick McKim MP. The department also supports the Secretary to Cabinet, Cassy O’Connor MP, who has been authorised to undertake administrative functions related to the Community Development Division’s Disability Bureau, Multicultural Tasmania, Seniors Bureau and Women Tasmania on behalf of the Minister for Community Development. The department provides a broad range of services to the Cabinet, other members of parliament, government agencies and the community. The department works closely with the public sector, the community, local government, the Australian Government and other state and territory governments. The department also provides administrative support to the State Service Commissioner and the Tasmania Together Progress Board, each of which is separately accountable and reports directly to parliament. -

The program is into its sixth year and the number of Agreements and positive outcomes continues to rise. This year has seen the signing of the first reviewed Agreement under the program. The Circular Head Agreement was originally signed in June 1999 and a renegotiated Agreement was signed in September this year. A number of other Councils have also agreed to review and renegotiate their Agreements, including Launceston City, Flinders, Glenorchy City, Kingborough and Northern Tasmania Development. The Partnership Agreements program has proven that it can deliver tangible outcomes to local communities. Progress in the last twelve months has included: • Up to $10 million in State Government levies on Local Government have been abolished under the new Financial Reform Partnership Agreement. • The Rivers Run Tourism Association has been established and has produced a touring map and guide for tourists in Central Highlands and Derwent Valley municipal areas. • The Circular Head Community and Recreation Centre was opened in August. The facility caters for a range of sports and includes function facilities. The State Government provided funding under the original Partnership Agreement and allocated a further $200,000 under the revised Agreement signed this year. -

For further information contact the UOW Library: [email protected] The Devil Undone: The Science and Politics of Tasmanian Devil Facial Tumour Disease Josephine Veronica Warren BA (Hons) University of Wollongong School of Social Sciences, Media and Communication 20 December 2013 This thesis is presented for the degree of Doctorate of Philosophy Abstract The Tasmanian devil is a carnivorous marsupial endemic to the island state of Tasmania, part of the larger continent of Australia, threatened with extinction from a deadly cancer. The research into the cancer, termed Devil Facial Tumour Disease (DFTD), followed a pathway that supported the hypothesis that the cancer was transmissible, passed from devil to devil by biting, called an allograft. By adopting a political sociological approach, I analyse the scientific research into the devil cancer through the concept of undone science, which I expand by developing a typology of reasons, both practical and political, for deficits of knowledge. My analysis initially finds that scientific evidence has not been established to confirm the transmission of the cancer by biting. -

In this our first Report as referred to in the Committee’s report. Co-Directors of the CCCS, we’d like to draw attention to some of the highlights. We were also delighted to learn of the stellar success of CCCS Research Assistants Joshua Quinn-Watson, Luke Chircop and Anna Saunders in the Commonwealth Moot (see page 1). Our New Members gratitude and congratulations go to Joshua, Luke and Anna 2017 saw the arrival of several new postdoctoral fellows for their wonderful achievement in bringing home a title that attached to the CCCS. As foreshadowed in our December 2016 Australia has not held for a decade newsletter, Dr Stijn Smet has now joined us as a post-doctoral fellow associated with Adrienne Stone’s ARC Laureate Project Finally, we invite all of our readers to enjoy our Constitutional in Constitutional Law. -

James Morgan* PROTECTING DEMOCRATIC INTEGRITY: RE DAY [NO 2] (2017) 343 ALR 181 I INTRODUCTION ection 44(v) of the Australian Constitution is one of several express provisions imposing candidacy restrictions for the Australian Federal Parliament, and has San important role to play in the protection of representative and responsible government. This particular section operates to disqualify any person with a pecuniary interest in an agreement with the Commonwealth Public Service, from being elected or sitting as a Commonwealth parliamentarian. The provision had previously only been considered by the High Court of Australia once, in the case of Re Webster,1 in which an interpretation so narrow as to rob the provision of all practical impact was adopted. Following decades of criticism, the High Court adopted a broader con- struction of s 44(v) in the case of Re Day [No 2],2 a constitutional challenge to the eligibility of an Australian Senator. This case note, after reviewing the background of Re Day [No 2], turns to analysis of the Court’s decision and the resulting ramifications. For so long, the narrow interpre- tation of s 44(v) has rendered the provision functionally inert and without purpose. While Re Day [No 2] leaves significant ambiguity regarding s 44(v)’s outer limits, it nevertheless marks a long overdue development in the interpretation of the Australian Constitution, by extending the provision to the prohibition of certain conflicts of interest for Commonwealth parliamentarians. This broader construction of s 44(v) reinforces the duty of Australian elected representatives to serve the interests of the people above their own — yielding a positive outcome for the protection of represen- tative and responsible government. -

Reform Options Conclusion INTRODUCTION Multiple nationality arises often from cross-cultural marriage of parents under the jus sanguinis rule found in Japanese law on the one hand, and from the birth of children to foreign residents in national territory under the jus soli rule found in Australian law on the other hand. Interestingly, despite such different nationality laws, the parliamentary eligibility of multiple nationals has become topical in both countries in recent times. For a long time, foreign residents in Japan numbered fewer than one mil- lion, and most of these were Koreans and Taiwanese who came as Japanese nationals before World War II, when Korea and Taiwan were a part of Japa- nese territory, as well as their descendants.1 They are generally called ‘old comers’.2 However, since the late 1980s foreign residents have rapidly in- * Prof. Dr. Yasuhiro Okuda, Chūō University, Law School, Japan. ** Ass.
