10.1 CITY OF MARKHAM 24 6808 14TH AVENUE To construct, reconstruct, erect or place a building or structure on Lot 26, Plan 65M-4180, (6808 14th Avenue), in the City of Markham, Rouge River Watershed. The purpose is to recognize the construction of a 10.75 ft. (3.2 m.) long by 5.3 ft. (1.6 m.) wide by 4 ft (1.2 m.) deep basement walk-out at the rear of an existing dwelling within TRCA's Regulated Area of the Rouge River Watershed associated with a municipal building permit.

10.2 CITY OF MARKHAM 27 VILLARBOIT (MARKHAM) HOLDINGS LIMITED PARTNERSHIP To site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 20, Concession 8, (9999 Highway 48), in the City of Markham, Rouge River Watershed as located on the property owned by Villarboit (Markham) Holdings Limited Partnership. The purpose is to alter a waterway and conduct grading works within a Regulated Area of the Rouge River watershed in order to realign and naturalize a stretch of Exhibition Creek at 9999 Highway 48 in the City of Markham.

2 10.3 CITY OF [ YORK COMMUNITY COUNCIL AREA] 31 1305 ROYAL YORK ROAD To construct, reconstruct, erect or place a building or structure and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 56, Plan 965, (1305 Royal York Road), in the City of Toronto (Etobicoke York Community Council Area), Watershed. The purpose is to acknowledge the construction of two sheds in the rear yard of the existing dwelling at 1305 Royal York Road in the City of Toronto (Etobicoke York Community Council Area). The two sheds and a retaining wall were constructed without the benefit of any TRCA or municipal permits. The retaining wall has since been removed and the slope has been restored and revegetated.

10.4 CITY OF TORONTO [NORTH YORK COMMUNITY COUNCIL AREA] 33 CITY OF TORONTO To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, and alter a watercourse, at Bestview Park, located at 115 Bestview Drive, near and East, in the City of Toronto (North York Community Council Area), Don River Watershed, as located on property owned by the City of Toronto. The purpose is to undertake storm sewer upgrades. Works will involve replacement of various segments of storm sewer, as well as replacement of an outfall structure. The warm water construction timing window of July 1 to March 31 will apply to this proposal.

10.5 CITY OF VAUGHAN 35 53 PARK DRIVE To construct, reconstruct, erect or place a building or structure on Lot 14, Plan 545, (53 Park Drive), in the City of Vaughan, Humber River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Humber River Watershed in order to facilitate the construction of a 79.9 sq. m (860.26 sq. ft.) two-storey addition to an existing single family residential dwelling and a replacement wood deck located at the side of the existing dwelling. The proposed works are associated with a municipal building permit. The subject property is located on lands known municipally as 53 Park Drive, in the City of Vaughan.

10.6 CITY OF VAUGHAN 38 MADISON GROUP To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 17, Concession 2, south of Lebovic Campus Drive, west of Ilan Ramon Boulevard, in the City of Vaughan, Don River Watershed as located on the property owned by Madison Group. The purpose is to conduct topsoil stripping works and site grading/development in order to facilitate the servicing and development of a residential townhome subdivision, on lands owned by Madison Group, located in Planning Block 11, in the City of Vaughan.

3 10.7 CITY OF VAUGHAN 40 PINESTAFF DEVELOPMENTS INC. To site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere, interfere with a wetland and alter a watercourse on Part Lot 24, Concession 9, (Huntington Road, between Major Mackenzie Drive and Nashville Road), in the City of Vaughan, Humber River Watershed as located on the property owned by Pinestaff Developments Inc. The purpose is to allow development, interference with a wetland and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and the installation of sediment and erosion control measures in Phase 2 of a draft approved plan of subdivision (19T-10V005) within Block 61 West, east side of Huntington Road between Major Mackenzie Drive and Nashville Road, in the City of Vaughan. The purpose is to also allow the construction of the eastern slope of the enhanced natural corridor on the subject lands (Tributary 'A' corridor), which requires the creation of a new low flow channel along a portion of the tributary.

10.8 CITY OF VAUGHAN 43 28 MCCLINTOCK CRESCENT To construct, reconstruct, erect or place a building or structure on Part Block 262, Plan M-1957, 66R-12303, PARTS 8 & 9, (28 McClintock Crescent), in the City of Vaughan, Don River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Don River Watershed in order to facilitate the construction of a replacement dwelling with a ground floor area of 776.85 sq. m (231.15 sq. ft.) and a 21.47 sq. m (231.15 sq. ft.) attached garage, associated with a municipal building permit. The property is located on lands known municipally as 28 McClintock Crescent, in the City of Vaughan.

10.9 TOWN OF CALEDON 46 8 BRUNO RIDGE DRIVE To construct, reconstruct, erect or place a building or structure on Lot 4, Plan 43M-1182, (18 Bruno Ridge Drive), in the Town of Caledon, Humber River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Humber River Watershed in order to recognize the construction of a 4.5 m. by 7.6 m. (15 ft. by 25 ft.) shed located at the rear of the property associated with a municipal building permit.

10.10 TOWNSHIP OF KING 48 MATTAMY (MONARCH) LTD. To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 10, Concession 4, ( and 15th Sideroad), in the Township of King, Humber River Watershed as located on the property owned by Mattamy (Monarch) Ltd. The purpose is to allow development and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate the construction of a stormwater management facility (SWM Pond C1) and associated outfall to service a portion of a draft approved plan of subdivision (19T-10K01) known as Mary Lake Estates at the southwest corner of Keele Street and 15th Sideroad, in the Township of King.

10.13 CITY OF VAUGHAN 54 MILLWOOD VALLEY DEVELOPMENTS INC. To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 22, Concession 6, North of Major Mackenzie Drive and East of Pine Valley Drive, in the City of Vaughan, Humber River Watershed as located on the property owned by Millwood Valley Developments Inc. The purpose is to conduct topsoil stripping and pre-servicing works which will facilitate the development of a residential subdivision, on lands owned by Millwood Valley Developments Inc., located in Planning Block 40 South (northwest of and Major Mackenzie Drive), in the City of Vaughan.

5 10.14 CITY OF VAUGHAN 56 SOBEYS CAPITAL INC. To site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 9, Concession 9, 8265 Huntington Road, in the City of Vaughan, Humber River Watershed as located on the property owned by Sobeys Capital Inc. The purpose is to conduct site grading in order to install a watermain extension across a tributary of the Humber River on lands owned by Sobeys Capital Inc., located south of Langstaff Road and east of New Huntington Road, in the City of Vaughan.

10.15 STANDARD DELEGATED PERMITS 58 Standard Permits, including Emergency Infrastructure Works permissions, are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard Permits , including Emergency Infrastructure Works permissions, are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A198/13, #A199/13 and #A103/15, respectively. All standard and emergency infrastructure works are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years of less.

RE: BELL CANADA REQUEST FOR PERMANENT EASEMENT Town of Whitchurch-Stouffville, Regional Municipality of York, Duffins Creek Watershed CFN 22428 ______KEY ISSUE Receipt of a request from Bell Canada to provide a permanent easement for an existing telecommunication equipment cabinet, located north of Main Street, west of Mill Street, Town of Whitchurch-Stouffville, Regional Municipality of York, Duffins Creek watershed for the purposes of accessing and maintaining an existing Bell equipment cabinet.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Bell Canada to provide a permanent easement for maintenance of an existing Bell Equipment Cabinet, North of Main Street and West of Mill Street, Town of Whitchurch-Stouffville, Regional Municipality of York, Duffins Creek watershed;

AND WEHERAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with Bell Canada in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.0064 hectares (0.02 acres), more or less, be granted to Bell Canada for maintenance of an existing telecommunication equipment cabinet, said land being Part of Lots 5 and 47, Registered Plan 70, Town of Whitchurch-Stouffville, designated as Parts, 1, 2, 3, and 4 on Draft Plan of Survey prepared by Speight, Van Nostrand & Gibson Ltd., under their Job No. 150-0149, dated June 23, 2015, subject to the following conditions:

(a) the permanent easement price is $10,300.00;

(b) Bell Canada is fully indemnify TRCA from any and all claims arising from injury, damages or costs of any nature resulting in any way, either directly or indirectly, from the granting of this easement or the carrying out of any maintenance;

(c) any terms or conditions deemed appropriate by TRCA staff or solicitor;

THAT said easement be subject to the approval of the Minister of Natural Resources and Forestry in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C. 27, as amended, if required;

AND FURTHER THAT authorized TRCA officials be directed to take any necessary action to finalize the transaction including obtaining of any necessary approvals and the signing and execution of documents.

BACKGROUND Bell Canada has formally requested a permanent easement to recognize an existing telecommunication equipment cabinet, north of Main Street, west of Mill Street, in the hamlet of Stouffville. The cabinet was constructed in 1983 according to Bell Canada records.

The subject TRCA-owned lands were acquired from Percy Brillinger on June 1, 1978 for a nominal consideration.

The new easement will be located entirely within the Regional storm flood plain and Regulated Area of the Stouffville Creek however, there is no construction proposed at this time and therefor no anticipated impact on TRCA lands. In the future, should Bell Canada wish to construct any works on the easement area, a permit application pursuant to Ontario Regulation 166/06,as amended, will be required.

Attached is a plan showing the location of the subject easement

FINANCIAL DETAILS It is proposed that the $10,300.00 compensation for the permanent easement be utilized for the purchase of priority properties under the “Greenland Acquisition Project for 2016–2020.”

RE: GREENLANDS ACQUISITION PROJECT FOR 2016-2020 Flood Plain and Conservation Component, Rouge River Watershed Westhill Redevelopment Company CFN 55969 ______KEY ISSUE Acquisition of property located east of Leslie Street and north of Bloomington Road, in the Town of Aurora, Regional Municipality of York, under the "Greenlands Acquisition Project for 2016-2020," Flood Plain and Conservation Component, Rouge River watershed.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 7.132 hectares (17.624 acres), more or less, of vacant land, located east of Leslie Street and north of Bloomington Road, said land being Part of Lot 12, Concession 2 and Part of Lots 11 and 12, Concession 3, designated as Block 81 on a Draft Plan of subdivison prepared by Donevan Fleischmann Petrich Ltd., Ontario Land Surveyors, Job # 2013-017, dated August 4, 2015, in the Town of Aurora, Regional Municipality of York, together with a conservation easement containing 0.910 hectares (2.25 acres) designated as Parts 1 and 2 on Draft R-Plan prepared by Donevan Fleischmann Petrich Ltd., Ontario Land Surveyors, Job # 2013-017-5, dated May 4, 2016 be purchased from Westhill Redevelopment Company;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

THAT the firm Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

BACKGROUND Resolution #A161/15 at Authority Meeting #8/15, held on September 25, 2015, approved the Greenlands Acquisition Project for 2016-2020.

Negotiations have been conducted with Lloyd Cherniak, Executive Vice-President at Lebovic Enterprises, acting as agent for the owners.

Access to the subject lands will be achieved through adjacent TRCA-owned lands.

Attached is a plan showing the location of the subject lands.

RATIONALE The subject lands fall within TRCA's approved master plan for acquisition for the Rouge River watershed as outlined in the Greenlands Acquisition Project for 2016-2020. On November 14, 2011, the Ontario Municipal Board approved the draft Plan of Subdivision (19T-88105) based on OMB Case No.: PL090257 and PL090266, to permit the development of a golf course and residential subdivision, with the remaining open space lands, as agreed between TRCA staff and the owner, being transferred to TRCA.

TAXES AND MAINTENANCE Based on preliminary review of environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property may be eligible for exemption for the 2017 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

FINANCIAL DETAILS Funds for the costs related to this purchase are available in the TRCA land acquisition capital account.

RE: WATER-BASED ACTIVITIES Approval of Policy ______KEY ISSUE Approval of Toronto and Region Conservation Authority’s updated Water-Based Activities Policy.

RECOMMENDATION

THAT Toronto and Region Conservation Authority’s (TRCA) Water-Based Activities Policy, updated June 2016, outlined in Attachment 1, be approved;

AND FURTHER THAT TRCA’s Water-Based Activities Procedures, updated June 2016, outlined in Attachment 2, be received.

BACKGROUND The existing TRCA Water-Based Activities Policy was last updated and approved in 2002. At Authority Meeting #4/02, held on June 26, 2002, Resolution #A191/02 was approved as follows:

THAT the attached Policy and Procedures for Water Based Activities, be approved.

RATIONALE This policy was reviewed with the intent to update information and increase the clarity regarding the role of TRCA staff related to water-based activities across TRCA’s public use sites.

The updated Water-Based Activity Policy (Attachment 1) differs significantly from the existing policy in that the operational aspects will be moved into a new document entitled Water-Based Activity Procedures (Attachment 2). Segregating policy statements from procedures ensures that TRCA has appropriate responsibility to establish the principles and direction for water-based programs while delegating the development, implementation and update of procedures to the CEO or delegate, in keeping with TRCA practice for other procedural documents.

The updated policy aligns with TRCA’s strategic plan as follows:

 Strategic Direction 3: Rethink Greenspace to maximize its value;  Strategic Direction 5: Foster Sustainable Citizenship.

CONCLUSION The updated Water-Based Activities Policy is outlined in Attachment 1. The associated procedures outlined in Attachment 2 are for the information of Authority Members.

13 Item 8.1

DETAILS OF WORK TO BE DONE  Upon approval of the Water-Based Activities Policy, staff will post the policy and procedures on TRCA’s internal resources that house such documents.  All staff engaging visitors in water based activities will be informed of the revised policy and procedures.  The policy will be reviewed on an as-needed basis, minimum of every ten years.

14 Attachment 1 WATER-BASED ACTIVITIES POLICY

1.0 PURPOSE

This policy is to provide Toronto and Region Conservation (TRCA) with a clear approach to delivering water-based recreational activities, including swimming, splash-pad play and boating, across TRCA’s public use sites. This policy supports TRCA’s Strategic Plan to rethink greenspace to maximize its value and to foster sustainable citizenship across our communities.

2.0 SCOPE

This policy governs the responsibilities of TRCA staff providing water-based recreational services and the responsibilities of participants of water-based recreational activities at TRCA’s public use sites.

3.0 CONTEXT

TRCA strives to offer safe and engaging water-based recreational experiences for groups and individuals who visit the following public use sites:

 Albion Hills Conservation Area  Albion Hills Field Centre  Indian Line Campground  Heart Lake Conservation Area  Glen Haffy Headwaters Trout Ponds  Lake St. George Field Centre  Palgrave Pond  Petticoat Creek Conservation Area  Swan Lake Centre (under review).

Water-based recreational activities are not permitted at other TRCA-owned and/or operated locations.

Water-based recreational activities are defined as swimming, splash pad play, canoeing and kayaking and the use of row boats, paddle boats and pontoon boats.

Pools and splash pads have set rules and operating procedures as outlined in Ontario Regulation 565 and recommendations made by the Ontario Ministry of Health and Long Term Care.

15 4.0 PRINCIPLES

 TRCA will provide its visitors with opportunities to engage in meaningful and safe water- based recreation activities in a natural setting.  TRCA will provide water-based recreational experiences that are inclusive of all individuals. . 5.0 ROLES AND RESPONSIBILITIES

TRCA will:  Ensure that staff is trained in health and safety policies and procedures related to water-based recreational activities.  Ensure that all staff and all participants are wearing a properly fitted life jacket or personal floatation device before using canoes, kayaks, row boats, paddle boats and the pontoon boat except where exempt in the procedures.  Ensure the related procedure documents are kept up-to-date and are accessible to all.  Review with participants all applicable health and safety procedures prior to participation in a water-based recreational activity.  Conduct regular inspections of water-based recreation facilities and equipment.  Maintain water-based recreation facilities in a state of good repair.  Maintain watercraft and related rental equipment in a state of good repair; remove and/or replace watercraft and related items that cannot be maintained in a state of good repair.  Procedures and guidelines pursuant to the Water-Based Activities policy shall be developed to ensure audit implementation compliance.

16 Attachment 2 WATER-BASED ACTVITY PROCEDURES

This document reflects Toronto and Region Conservation’s (TRCA) standard procedures for water based activities. If visiting groups request a different standard of care or process, the request will be reviewed. Requests that would provide a lower standard of care will not be considered. Water-based programs that request additional staff and/or a differing level of certification will be accommodated if determined appropriate for the TRCA context, if it is economically feasible, and based upon staff availability.

It is the responsibility of the participants to:

 Review and acknowledge their informed consent of the risk involved before participating in any water-based recreation activity.  Parents / guardians will review and acknowledge their informed consent of the risk involved before children participate in any water-based recreation activity.  Adhere to the dry land training provided prior to participating in a water-based recreation activity.  Participate in boating during day-use hours of operation only.  Stay within the designated boating area.  Adhere to watercraft capacity and weight restrictions as indicated on the watercraft.  Adhere to age restrictions for equipment rentals including 18 years of age or older to rent equipment, or be accompanied by a responsible adult.

1.0 CATEGORIES OF WATER-BASED ACTIVITIES

The following categories of water-based activities are outlined in this document:  canoeing;  kayaking;  paddle boats / row boats;  pontoon boat;  swimming / splash-pad play.

Outlined below are the water-based activities that are permitted at each location and what the specific requirements are for both staff and participants. Pools and splash pads have set rules and operating procedures as outlined in Ontario Regulation 565 and recommendations made by the Ontario Ministry of Health and Long Term Care.

Additional TRCA “Signature Events” that include water-based activities and/or working around water (including but not limited to Paddle the Don, Mill Pond Splash, Heart Lake Dragon Boat Festival) may require additional procedures beyond the scope of this document and consultation with TRCA’s advisor of risk management and the manager of safety and well-being is strongly recommended.

1.1 Canoeing

Canoeing is currently a permitted water-based activity at the following public use properties owned and operated by TRCA:  Lake St. George Field Centre;

17  Indian Line Campground ;  Heart Lake Conservation Area;  Palgrave Pond.

Canoeing is currently a non-permitted water-based activity at the following properties owned and operated by TRCA:  Swan Lake Centre;  Albion Hills.

TRCA staff-led canoeing activities at permitted locations are typically hosted for but not limited to:  school groups;  summer camps;  community groups;  special event participants.

Procedures for Recreational Canoe Programs

 All staff and all participants must be fitted with a properly sized life jacket or personal floatation device before using canoes.  For children (under 18 years of age), a parent/guardian must sign a consent form.  Parent/guardians have the option to exempt their child from the canoeing activity.  Adults must sign a waiver acknowledging the details and associated risks of the canoe program.  Before entering the water, all canoe participants will be instructed in the safety procedures they will need to follow during the canoe activity.  All canoes must stay within the designated area.  A maximum of three persons are permitted per canoe.  Participants must be asked to leave the canoe activity if they are not following the safety procedures that were provided.  Participants must be asked to leave the canoe activity if their actions are creating an unsafe situation for themselves, other canoe participants or TRCA staff.  The maximum size group on the water canoeing at one time is 20 participants.  The ratio of staff/canoe leaders to participants is 1:10.  If the maximum size group exceeds 20 participants an additional lifeguard and an additional canoe leader/staff are required to meet the ratio. The costs for the additional lifeguard and canoe leader/staff will be billed directly to the client.  Canoe leaders include visiting group leaders (18 years and older), that have been trained in TRCA safety procedures and protocols related to canoeing.  TRCA staff canoe leaders must have the following certifications:  minimum Ontario Recreational Canoeing and Kayaking Association (ORCKA) certification as a Camp Canoe Instructor;  minimum lifeguard qualification of Bronze Cross;  Standard First Aid and CPR certification.  The staff with a canoe certification and lifeguard certification can be the same individual.  The on-site supervisor must ensure that all staff members are correctly certified for the function they are performing.  Canoe Rentals are currently unavailable at TRCA sites.

18 Procedures for Canoeing Rescue Craft

 One canoe or additional boat containing a maximum two people must be designated as the “Rescue Craft” during all canoe programs.  One of the two people in the “Rescue Craft” must have lifeguarding and/or ORCKA qualifications and be familiar with canoe over canoe rescues.  The on-site supervisor must ensure that all staff members are correctly certified for the function they are performing.  The rescue craft does not have to be motorized. The rescue craft must be equipped with a buoyant throw line and a first aid kit. Staff in the rescue craft must have a two way radio to allow communication with staff on shore.  Staff in the rescue craft will take the lead role in the event of any situation on the water including a canoe overturning and participant(s) entering the water.

1.2 Kayaking

Kayaks are currently owned and stored at Lake St. George Field Centre by visiting camp groups. TRCA does not currently rent kayaks or use them for public programs. As kayaks are a non-motorized boat they are welcome at Heart Lake Conservation Area and Indian Line Campground.

1.3 Paddle boats and Rowboats

Paddle boats and Rowboats are available for rent at Heart Lake Conservation Area. Refer to the TRCA website for current rental fees.

Procedures for Paddle boats and Rowboats

The following information can also be found on the equipment rental form for rowboats and paddle boats at the conservation area:

 Lifejackets or personal floatation devices (PFD’s) must be worn by all persons in paddle boats and rowboats.  No diving or swimming from paddle boats or rowboats.  All boats must stay within the designated area.  Persons renting equipment must be adults 18 years of age or older.  Persons under 18 years of age must be accompanied by an adult.  No horseplay is permitted in any watercraft.  A maximum of five persons are permitted per paddle boat, including no more than four adults.  Persons renting TRCA equipment must sign the release on the rental form or permit.  Failure to comply with boating rules shall result in cancellation of boating privileges.

1.4 Pontoon Boat

Lake St. George Field Centre has a solar powered electric pontoon boat. It is driven by certified staff to transport visiting school groups, community groups and on occasion, community event participants.

Procedures for the Pontoon Boat  All adult participants will be made aware of where the life jackets or personal floatation devices (PFD’s) are located on the pontoon boat and offered to be property fitted with a PFD prior to leaving the dock.  Participants using the Pontoon Boat are not required to know how to swim.  All children will wear a properly fitted life jacket or personal floatation device (PFD) at all times.  All participants must complete a signed consent form acknowledging the details of the pontoon boat activity and its associated risks.  For children, a consent form must be signed by a parent/guardian.  Parent/guardians have the option to exempt their child from the activity during a school field trip.  All participants in programs involving the pontoon boat will be instructed in safety procedures appropriate to the pontoon boat operation.  TRCA staff will ask participants to leave the pontoon boat if they are not following safety procedures, and/or their actions are creating unsafe situations for themselves, other participants and/or staff.  The pontoon boat will operate within applicable Transport Canada safety guidelines concerning annual inspection, safety equipment, safe operating guidelines, and operator certification.  Two staff is required for operating the pontoon boat. They must carry two-way radios to enable communication with staff on shore.  Both staff will have up to date Standard First Aid and CPR certifications  One of the two required staff operating the pontoon boat shall be a qualified lifeguard with Bronze Cross Certification or higher.  When the pontoon boat is in use, a motorized rescue boat will be available at the dock.  The motorized rescue boat must be equipped with a reaching assist, throwing assist, a first aid kit, blankets and a re-boarding device.  The pontoon boat will not be used after dark, and during inclement weather including electrical storms or high winds. TRCA staff will monitor weather conditions throughout programming.  The Pontoon Boat will remain locked when not in use.

1.5 Swimming and Splash Pad Play

Swimming is currently a permitted water-based activity at the following public use properties owned by TRCA:  the Petticoat Creek Conservation Area Aquatic Facility;  the Albion Hills Conservation Area Aquatic Facility;  the Heart Lake Conservation Area Aquatic Facility.

Swimming is currently a non-permitted water-based activity in the following natural featrues owned and operated by TRCA:  Heart Lake, Swan Lake and Lake St. George.

20 Procedures for Swimming Locations

Lifeguards: Lifeguards are an important safety feature but they are not intended to replace the close supervision of a parent, guardian, or designate (caregiver). Failure to follow facility policies and/or the direction of a lifeguard may result in removal from the aquatic facility.

Lifeguard Certification Requirements: Qualifications are required by Ontario Health Protection and Promotion Act Regulation 565. Proof of certification or enrolment in (re)certification course is to be produced upon hiring or rehiring.

 All staff is required to maintain their qualifications and inform their supervisor of any new and/or expired certifications.  Staff must present original certification prior to working their first shift. Copies must be kept on file and dates of expiry must be documented.  The on-site supervisor or aquatic staff in-charge must ensure that all staff members are correctly certified for the function they are performing.  The employee qualification record is to be verified, dated and signed by the supervisor or designate, and kept in the lifeguard office.  All aquatic certifications must be current as indicated:  Standard First Aid/CPR-C  Must be kept valid at all times (from a recognized agency including: Lifesaving Society (LSS), Canadian Red Cross, St. John’s Ambulance or the Canadian Ski Patrol).  Minimum age 15.

 National Lifeguard Service (NLS) Pool certification  Must be recertified every two years.  Minimum age 16.

Lifeguard Supervision Requirements (Taken from the updated TRCA Lifeguard Manual - March 2016)

For swimming pools with a water surface area of 500 m2 or less where all lifeguards hold a valid NLS the following applies:

Supervision:  Children 12 years old and under must be accompanied by, and stay within arm’s reach of a parent, guardian, or designate who is at least 14 years of age and older and responsible for their direct supervision.

 Children 0-6 years (2:1): Maximum two children to one parent, guardian, or designate.

 Children 7-12 years (4:1): Maximum four children to one parent, guardian, or designate.

 Children 7-12 years old who are swimmers may be permitted on the pool deck and in the pool unaccompanied if they are able to demonstrate comfort in the water and pass the facility swim test.

 TRCA staff directly supervising school groups or youth volunteers that are using a TRCA swimming pool or splash pad must be in a swimsuit and be at designated locations observing students / youth volunteers at all times and will take direction from the qualified lifeguard.

Serious Medical Conditions:

 Those with serious medical conditions should be accompanied by an individual who is knowledgeable of their condition and responsible for their direct supervision.

Pool Closures:  Examples of common temporary pool closures may include but are not limited to; inclement weather, pool fouling’s, lifeguard interventions, water chemistry, and scheduled announcements. Refunds will not be provided for pool closures.

Wristband Policy:  Wristbands must be purchased and securely affixed to participant’s wrist prior to entering the aquatic facility.  Wristbands are required even if participants do not intend on swimming.  If a wristband is lost or stolen, or if it becomes damaged and no longer able to securely attach to participant’s wrist then a new wristband must be purchased.

Refunds:  With a valid receipt refunds may be provided at TRCA’s sole discretion within 15 minutes of purchase. The timestamp listed on participant’s receipt will be used to determine eligibility for a refund.

2.0 RESTRICTIONS

If a thunderstorm or lightning is approaching all staff and participants must leave the water immediately.

RE: APPLICATIONS FOR PERMITS PURSUANT TO ONTARIO REGULATION 166/06, AS AMENDED Development, Interference with Wetlands and Alterations to Shorelines and Watercourses ______KEY ISSUE: Pursuant to Ontario Regulation 166/06, as amended, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected.

RECOMMENDATION

THAT permits be granted in accordance with Ontario Regulation 166/06, as amended, for the applications which are listed below:

PERMIT APPLICATIONS 10.1 - 10.12 ARE MAJOR APPLICATIONS - REGULAR

Applications that involved a more complex suite of technical studies to demonstrate consistency with policies; applications that cover a significant geographic area (e.g. subdivisions, stormwater management ponds), extensive modifications to the landscape, major infrastructure projects, emergency infrastructure works, resolution of violations/after the fact permits, trail construction.

CITY OF MARKHAM

10.1 6808 14TH AVENUE To construct, reconstruct, erect or place a building or structure on Lot 26, Plan 65M- 4180, (6808 14th Avenue), in the City of Markham, Rouge River Watershed. The purpose is to recognize the construction of a 10.75 ft. (3.2 m.) long by 5.3 ft. RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to recognize the construction of a 10.75 ft. (3.2 m.) long by 5.3 ft. (1.6 m.) wide by 4 ft (1.2 m.) deep basement walk-out at the rear of an existing dwelling within TRCA's Regulated Area of the Rouge River Watershed associated with a municipal building permit. The subject property is located adjacent to a gently sloping stream corridor associated with the Rouge River Watershed. The rear potion of the subject property is located within the Regional Storm Floodplain (168.42 masl), however, the basement walk-out is outside of the flood hazard. As such, there are no flooding related concerns with this application. In addition, the basement walk-out is located in an area that is void of any significant vegetation and predominantly consists of manicured lawn. Therefore, there are no geotechnical or ecology related concerns anticipated with this application.

Permit Fee and Timing: The applicant initiated works in advance of obtaining a permit under Ontario Regulation 166/06, therefore the permit is to be issued "after the fact". The applicant has paid the application fee plus 100% as required for a permit "after the fact" in association with the violation of the regulation. In addition, the time frame for this permit will be adjusted to reflect that the works have been completed.

25 Control of Flooding: The proposed works are located outside of the Regional Storm Floodplain. As such, there are no impacts to the storage and/or conveyance of flood waters anticipated.

Pollution: Erosion and sediment controls (i.e. silt fencing) will not be required as the proposed works have been completed.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns anticipated with this project.

Conservation of Land: No significant vegetation has been removed as a result of the proposed works.

Plantings As no significant vegetation was removed, plantings are not required.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this permit application is to alter the alignment of a portion of Exhibition Creek to attenuate flooding issues affecting the subject property and significantly improve flood water conveyance, storage, and the overall ecology of the creek, associated with a municipal site alteration and grading permit. The subject property is located at the south east corner of Highway 48 (Markham Road) and Major Mackenzie Drive East, and contains a highly degraded and altered portion of Exhibition Creek.

Based upon updated floodplain modeling of the Rouge River Watershed, it was determined that due to the highly constrained channel of the Exhibition Creek, the channel does not contain the Regional Floodplain. Furthermore, due to the perched culvert downstream of the site, the flood waters overtops the banks of the existing channel, resulting in approximately 4 hectares of the 12.8 hectare property being encumbered by flood waters during a Regional Flood Event.

In 2011, in preparation for redevelopment, the landowner authorized the demolition of the structures on site, the filling of an on-site stormwater management pond, and the placement of fill in the various areas of the property which were regulated by the TRCA. TRCA issued a violation on the property on October 31, 2011 (Violation #2605) and subsequently on September 24, 2012 (Violation #V2670) for additional unauthorized works within TRCA’s Regulated Areas which resulted in adverse impacts to the Exhibition Creek corridor, including heavy sediment loads entering the natural system.

In December 2012, TRCA received a notice that the applicant appealed the applications to the OMB for non-decision. TRCA staff provided written correspondence to the OMB identifying the outstanding violations on the property and respectfully requested that the Board refrain from scheduling a hearing until such time as the violations under the Conservation Authorities Act have been resolved. The Board has respected TRCA’s request, and directed the applicant to resolve the outstanding violations in advance of proceed to a hearing.

28 TRCA staff continued to work with the landowner and consultants to reach a resolution with respect to the violations on the property. TRCA staff are satisfied with the final proposed restoration and alignment of Exhibition Creek. The proposed channel realignment is based upon natural channel design principles containing meanders and a new valley wall on approximately 1 hectare of the overall property. The overall width will be widened to create a channel ranging from 18 metres wide in the narrowest section, to over 70 metres at the widest section. A portion of the proposed works is located on adjacent lands. Landowner authorization was obtained from the Condominium Corporation for 9909 and 9889 Highway 48 to undertake works on their lands to confine the floodplain in the channel, removing a portion of the floodplain from these lands as well. The restoration works of Exhibition Creek will provide a significant improvement to the existing corridor, ensuring flood storage and conveyance of floodwaters will be contained within the new channel. In addition, the reconstructed channel will be restored with native, non-invasive plantings, providing an overall ecological benefit for the natural heritage system of this section of Exhibition Creek. TRCA staff have reviewed the voluntary restoration plan and are satisfied with the approach and methodology of the works. In collaboration with the City of Markham, the municipality will require the landowner to provide a financial security for the municipal site alteration and grading permit to ensure the works are completed to the satisfaction of the City and the TRCA.

The proposed works complement a recent permit for the restoration, realignment and enhancement of an upstream section of the same corridor, located at 9900 Highway 48. Similar works for this property have been approved and permitted on June 5, 2015 (TRCA permit C- 150828), and are currently under construction.

The works are associated with a future redevelopment proposal on the subject lands, consisting of consisting of a mixed use commercial - retail development, with a potential residential component. The enhanced Exhibition Creek corridor will be required to be conveyed into public ownership as a condition of the future development approvals.

Conditional Permit: Subject to the above, TRCA staff recommends that this permit be approved conditionally based upon the following conditions, which pertain to the construction of the monitoring of the channel realignment and stabilization:

1. The Owner shall implement the approved long-term monitoring plan in accordance with the May 19, 2016 report for monitoring services, prepared by Greck and Associates Limited; 2. The Owner provide a Compliance Monitoring fee to review monitoring reports be provided in accordance with TRCA's Administrative Fee Schedule for Permitting Services; 3. The Owner shall provide the TRCA with written confirmation from the City of Markham within 30 days, confirming that the municipality is holding the security deposit for the works subject to this permit to the satisfaction of TRCA; 4. The Owner agrees that any non-compliance with the approved permit, plans, documents and/or conditions shall make the following remedies available to TRCA, in addition to any other remedies available to it under law: · Requesting the City to drawing on the Letter of Credit in whole or in part; · Undertaking or completing at the Owner’s cost any works approved under the permit; · Rectifying issues of non-compliance at the Owner’s cost; · Entering upon the Owner’s lands through TRCA’s employees, servants or agents; · Canceling the permit issued with respect to the Owner’s land.

29 5. Within 60 days of the completion of the approved works, the Owner shall demonstrate to the satisfaction of TRCA that the works approved under this permit have been implemented pursuant to the approved permit, plans, documents and conditions. This will include, but is not limited to, the submission of as-built plans, monitoring reports, and written certification by the consulting engineer, professional geoscientist and landscape architect and/or other professionals as deemed necessary by TRCA to the satisfaction of TRCA.

Applicable Fees As works were undertaken on the property without approval or permit from this Authority under Ontario Regulation 166/06, an additional administrative fee has been charged to this application.

Control of Flooding: TRCA Water Resources Engineering Staff are satisfied that the proposed channel has been adequately sized to contain and improve flood water conveyance and storage in the area. As such, TRCA staff concur with the consultants' report that the works will not have adverse upstream and downstream impacts.

Pollution: Appropriate Sediment and Erosion control measures will be put in place and maintained during all construction phases.

Dynamic Beaches: Not applicable

Erosion: All new valley wall slopes will be constructed at stable slopes and will be vegetated. As such, there are no geotechnical issues associated with this application.

Conservation of Land: The existing watercourse is currently in a highly constrained and degraded state. No significant vegetation will be removed through the proposed works. The works will take place within the warm water fisheries timing window (July 1 to March 31).

Plantings A restoration planting plan is included as part of the proposed works. Proposal: The City of Toronto is proposing upgrades to the existing storm sewer system in Bestview Park, located east of Bayview Avenue, south of Steeles Avenue East. This project is part of the City's ongoing Basement Flooding Protection Program. These works were previously identified in a municipal class environmental assessment, completed in 2008. Works will involve replacing various segments of 1050-2400mm concrete storm sewer with new 3000mm storm sewer, as well as replacement of an outfall structure discharging into a tributary of German Mills Creek.

33 The new outfall will be pulled back, with the existing channel gabion walls to remain, and the new exposed channel lined with armour stone. The new outfall will include a new energy dissipation surface of boulders and rip rap. Storm flows will be bypass pumped around the work area during construction, discharged back to the channel downstream of the construction area. Silt fence and silt socks will be employed for erosion and sediment control, while a coffer dam system will be employed to allow the storm sewer replacement to occur in the dry. Staging areas will be established within the delineated limits of disturbance. There are approximately 30 tree removals associated with this project, which are to be replaced with 66 new caliper trees and 21 whips, as well as 136 shrub species at the completion of works. Construction will occur from late summer 2016 through 2017.

Control of Flooding: The proposed works are not anticipated to impact flooding, flood storage or conveyance of flood waters. The proposed works will improve the existing storm runoff conditions in this area. All grades will also be maintained or matched.

Pollution: Erosion and sediment control measures (silt fence, silt socks, coffer dam) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into German Mills Creek, a tributary of the East Don River. Erosion and sediment control measures have been provided in accordance with the Greater Golden Horseshoe Area Conservation Authorities’ Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches: The proposal will not have any implications to dynamic beaches.

The proposed work site is located on the southwest corner of Lebovic Campus Drive and Ilan Ramon Boulevard (northwest of Bathurst Street and Rutherford Road), in Planning Block 11.

The proposed works consist of the erection of erosion and sediment control measures including silt fencing along with sediment traps to capture sediment runoff from the site before it migrates into the adjacent open space valley system located to the west. In addition, topsoil stripping works will take place along with servicing infrastructure for the development of townhomes. This servicing work fulfils a condition of draft plan approval for the associated Draft Plan of Subdivision (19T-15V008) and is required in order to prepare the site for overall development and final grading and construction of townhomes on the property.

The purpose is to also allow the construction of the eastern slope of the enhanced natural corridor on the subject lands (Tributary 'A' corridor), which requires the creation of a new low flow channel along a portion of the tributary.

The permit will be issued for the period of June 10, 2016 to June 9, 2018 in accordance with the following documents and plans which form part of this permit:

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is to allow development, interference with a wetland and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and the installation of sediment and erosion control measures in Phase 2 of a draft approved plan of subdivision (19T-10V005) within Block 61 West, east side of Huntington Road between Major Mackenzie Drive and Nashville Road, in the City of Vaughan.

There are two watercourses on the Pinestaff Developments Inc. property: one which traverses the central portion of the site (Tributary 'A') and a second in the eastern portion of the property (Tributary 'C'). There are small wetland pockets associated with each tributary and a woodland defining the Tributary 'C' corridor.

This permit will facilitate topsoil stripping and the installation of various erosion and sediment control measures in Phase 2, which includes all lands east of the Tributary 'A' corridor and west of the Tributary 'C' corridor. The works also include the construction of the eastern slope of the enhanced Tributary 'A' corridor on the subject lands. Tributary 'A' was previously a swale within an agricultural field through much of Block 61 West. A new corridor has been designed and built on the lands to the south, which consists of a minimum bottom width of 18 metres, 3:1 side slopes and 7.5-metre wide buffers. This corridor treatment will be continued on the lands owned by Pinestaff Developments Inc. The final Tributary 'A' corridor design will be detailed in a separate report to the Executive Committee at a later date.

Prior to the slope installation, a new low flow channel for Tributary 'A' will be created at the northern end of the site to direct flows from the existing culvert to the new Tributary 'A' corridor on the property. As part of these channel works, a splash pad will be installed at the downstream end of the culvert, located at the north end of the site, and bank stabilization measures provided on the slope opposite the culvert (i.e., fascines and/or coir rolls).

Both the Tributary 'A' and Tributary 'C' features will be protected during the topsoil stripping and slope creation activities through the use of sediment and erosion control measures.

Only a portion of the topsoil stripping activity is regulated by TRCA. The applicant requires approval from the City of Vaughan for those portions of the site not within the TRCA's Regulated Area.

Control of Flooding: There will be no impact on the storage or conveyance of floodwaters.

Pollution: Sediment and erosion control measures will be installed and maintained throughout construction to prevent sediment from entering the adjacent natural features.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical/slope stability issues associated with the proposed development. In addition, the implementation of the aforementioned sediment and erosion control measures will minimize erosion on the site.

Conservation of Land: All natural features on the site will be protected during the topsoil stripping and pre-grading activities.

41 Plantings A planting plan has not been submitted with the current proposal, but the applicant is required to provide extensive plantings to satisfy TRCA's conditions of draft plan approval. A portion of the subject property is located within the Regional Storm Flood Plain associated with Fisherville Creek, which is located to the west of the property. The Regional Storm Flood Plain extends to an elevation of 188.43 metres above sea level (masl) on the subject property. Based on a review of topographic information for the subject property, it appears that the proposed replacement dwelling is located outside of the Regional Storm Flood Plain. However, the attached garage is located within the Regional Storm Flood Plain. The proposed garage will be flood-proofed in accordance with TRCA policies, such that no openings from the garage into the dwelling are proposed. (15 ft. by 25 ft.), located behind an existing dwelling associated with a municipal building permit. The subject property is located within the Palgrave Estates Residential Community land use designation of the Oak Ridges Moraine Conservation Plan (ORMCP) and is within the 120 metre Area of Influence of a wetland. However, the shed is located on a portion of the site that is void of any significant vegetation and consists of manicured lawn. As such, there are no flooding, hydrological, geotechnical or ecology related concerns with this application.

54 Proposal: The proposal is to conduct preliminary topsoil stripping, and pre-servicing works in order to facilitate the eventual development of a residential subdivision, located northwest of Weston Road and Major Mackenzie Drive, in Planning Block 40 South, in the City of Vaughan.

The property is approximately 16.2 ha in size and is located adjacent to a valley/open space corridor associated with the Humber River. This valley is located to the north and west of the property while there is an existing stormwater management pond facility to the south. A residential subdivision that is currently under construction is located east of the site.

The subject works consist of preliminary topsoil stripping and grading works to prepare the site for the development of a residential subdivision. This includes the erection of erosion and sediment control measures including silt fencing. An additional permit will be required for final site grading/construction of the homes along with restoration planting/edge management works in the valley system. The subject permit application fulfils a condition of draft plan approval for the associated Draft Approved Plan of Subdivision (19T-08V01).

Control of Flooding: The proposed works are located outside of the Regional Storm Flood Plain of the Humber River. As such, the storage and/or conveyance of flood waters will not be impacted.

Proposal: The proposal is to conduct site grading in order to install a watermain extension across a tributary of the Humber River on lands owned by Sobeys Capital Inc., in the City of Vaughan. The work area is located south of Langstaff Road and east of Huntington Road; east of the existing Sobeys distribution warehouse. The works are required in order to service a proposed industrial subdivision to the north (Squire Ridge - 19T-06V01).

The works involve the open cutting of the watercourse in order to install a 300 mm watermain under the watercourse. The watercourse will be isolated through the installation of coffer dams along with a pump by-pass for flows from the watercourse. The proposed works are anticipated to take a few days and therefore, are not anticipated to impact the flood plain and/or the watercourse itself. Conditions requiring contingency plans and weather monitoring will be included.

56 Control of Flooding: The proposed watermain is located under the watercourse and is not anticipated to impact the storage and/or conveyance of flood water during a Regional Storm Event. Additionally, work materials and equipment will be located outside of the flood plain to ensure that they will not be washed away during a Regional Event.
