The Gunditjmara Land Justice Story Jessica K Weir
The legal outcomes the Gunditjmara achieved in the 1980s are often overlooked in the history of land rights and native title in Australia. The High Court Onus v Alcoa case and the subsequent settlement negotiated with the State of Victoria, sit alongside other well known bench marks in our land rights history, including the Gurindji strike (also known as the Wave Hill Walk-Off) and land claim that led to the development of land rights legislation in the Northern Territory. This publication links the experiences in the 1980s with the Gunditjmara’s present day recognition of native title, and considers the possibilities and limitations of native title within the broader context of land justice. By heat-treating them, more plants could be eaten, and new nutrients were available. The heat killed parasites and made it easier to digest meat. Something that led to a higher calorie and nutritional intake, which made it easier to survive and have more children.” Banyule Council selected this beautiful piece of artwork for our RAP cover, as the short-finned eels and the Australian raven both feature in this picture and are recognised by the Wurundjeri Woi-wurrung as being historically significant animals to Banyule Flats. The Australian Raven is known as Whaa and is the Wurundjeri Woi-wurrung people’s moiety. Banyule Flats was also an important area of annual eel trapping and spear fishing for Wurundjeri Woi-wurrung People. Wotjobaluk, Jaadwa, Jadawadjali, Wergaia and Jupagalk determinations These native title determinations marked a turning point in Victoria because they were the first to be made by agreement or consent. A consent determination was able to be reached because all parties agreed, through mediation, that the native title claimants have native title rights and interests over part of the area they claimed. In making the determinations, the Federal Court recognised the Commonwealth of Australia and the terms and conditions of Wotjobaluk, Jaadwa, Jadawadjali, Wergaia and Jupagalk peoples’ a co-existence protocol between the parties. non-exclusive native title rights over a part of their original claim area (Area A on the map). First contact between Wadawurrung and the Europeans. William Buckley escapes from Capt. Collins’ temporary settlement at Sorrento and walks around Port Phillip Bay. Later he is invited to join the Mon:mart clan of Wadawurrung People when Kondiak:ruk 1803 (Swan Wing) declares him her husband returned from the dead. Aboriginal people believed that the dead were reincarnated in a white form. They call Buckley Morran:gurk (Ghost blood). 1820s 1824 Hume & Hovell arrive on Wadawurrung land at Corio Bay and are greeted by Wadawurrung resistance. In Tasmania settlers are authorised to shoot Aboriginal people. Martial law is declared in Bathurst (NSW) after violent clashes between settlers and Aboriginal people. 1827 Batman and Gellibrand apply to the colonial government for Kulin nation land. 1828 Martial law declared in Tasmania where the Solicitor General says ‘the Aborigines are the open enemies of the King and in a state of actual warfare against him’. -

Norris, Cilla Norris, Duane W. Hamacher and Reg Abrahams Abstract. Wurdi Youang is an egg-shaped Aboriginal stone arrangement in Victoria, Austra- lia. Here we present a new survey of the site, and show that its major axis is aligned within a few degrees of east-west. We confirm a previous hypothesis that it contains alignments to the position on the horizon of the setting sun at the equinox and the solstices, and show that two independent sets of indicators are aligned in these directions. We show that these alignments are unlikely to have arisen by chance, and instead the builders of this stone arrangement ap- pear to have deliberately aligned the site on astronomically significant positions. 1. Traditional Aboriginal Australian cultures include a significant astronomical component, perpetuated through oral tradition and ceremony. This knowledge has practical navigational and calendrical functions, and in some cases extends to a deep understanding of the motion of objects in the sky. Here we explore whether this astronomical tradition is reflected in the rock art of Aboriginal Australians. We find several plaUSible examples of depictions of astronomical figures and symbols, and also evidence that astronomical observations were used to set out stone arrangements. With these exceptions, astronomical themes do not seem to appear as often in rock art as in oral tradition, although it is possible that we are failing to recognise astronomical elements in rock art.
