recognising the County Administrative Boards of Norrbotten, Västerbotten, Västernorrland, Gävleborg, Uppsala, Stockholm, Södermanland, Östergötland, Kalmar, Västra Götaland and Halland in Sweden for the purposes of Article 6 of Commission Regulation (EU) No 737/2010 of 10 August 2010 laying down detailed rules for the implementation of Regulation (EC) No 1007/2009 of the European Parliament and of the Council on trade in seal products

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Commission Regulation (EU) No 737/2010 of 10 August 2010 laying down detailed rules for the implementation of Regulation (EC) No 1007/2009 of the European Parliament and of the Council on trade in seal products1, and in particular Article 6 thereof,

Whereas:

(1) Commission Regulation (EU) No 737/2010 sets out the conditions under which seal products resulting from hunts by Inuit or other indigenous communities and seal products from marine resources management may be placed on the EU market.

(2) Any placing on the market of such products must be accompanied by a document from a recognised body attesting that the conditions set out in Commission Regulation (EU) No 737/2010 have been met.

(3) The European Commission received on 20 January 2011 a request by the Swedish Ministry of Agriculture, on behalf of the County Administrative Boards of Norrbotten, Västerbotten, Västernorrland, Gävleborg, Uppsala, Stockholm, Södermanland, Östergötland, Kalmar, Västra Götaland and Halland, dated 20 December 2010, for those bodies to be recognised for the purposes of Article 6 of Commission Regulation (EU) No 737/2010. The request was accompanied by documentary evidence.

(4) By letter dated 7 July 2011, the European Commission accepted that the eleven applications be treated jointly and requested additional documentary evidence with regard to fulfilment of some of the requirements set out in Article 6 (1) of Commission Regulation (EU) No 737/2010.

(5) By letter dated 6 October 2011, the Swedish Ministry for Agriculture submitted additional information and documentary evidence.

EN 2 EN (6) The European Commission has assessed on the basis of the entirety of the documentary evidence submitted whether the requirements for recognising bodies under Commission Regulation (EU) No 737/2010 have been met. It is satisfied that each of the County Administrative Boards fulfil each of the requirements of Article 6 (1) of Commission Regulation (EU) No 737/2010.

HAS DECIDED AS FOLLOWS:

Article 1

The County Administrative Boards of Norrbotten, Västerbotten, Västernorrland, Gävleborg, Uppsala, Stockholm, Södermanland, Östergötland, Kalmar, Västra Götaland and Halland in Sweden are recognised for the purposes of Article 6 of Commission Regulation (EU) No 737/2010.

Article 2

The Director-General of the Directorate-General for Environment is instructed to ensure that the applicants are notified of this Decision and that the content of this Decision is published on the Commission's website without delay.
