Unique Switch Gear located at 46 Madhusudan Palchowdhury 1 st Bye Lane, P.S. Howrah, Dist. Howrah, alleging noise and air pollution due to engineering and sheet metal fabrication activities with spray painting. AND WHEREAS the unit was called for hearing on 15-02-2012 by the State Board to remain present with all statutory licenses, including `Consent to Establish(NOC)/Consent to Operate' of the State Board but nobody appeared on behalf of the unit. AND WHEREAS the unit was called for hearing again on 09-04-2012 by the State Board due to its gross violation of environmental norms and this time also nobody appeared on behalf of the unit and the unit was directed to submit the copy of trade licence and NOC & Consent of State Board within 24-04-2012 positively. AND WHEREAS the unit was called for hearing again on 27-08-2012 and this time also nobody appeared on behalf of the unit. NOW THEREFORE, considering non-compliance of directions of State Board, M/s. Unique Switch Gear is hereby directed to close all kinds of operation at the present location with immediate effect. Electricity connection of the said unit is ordered to be disconnected forthwith. The General Manager-Operation (C&M), CESC Ltd., is requested to take necessary steps to disconnect the electricity connection of the unit immediately. Closure order will take immediate effect and the Officer-in-Charge, Howrah Police Station, under Howrah Police Commissionerate, West Bengal Police is directed to execute the closure order against the aforementioned unit and submit the compliance report to the State Board within seven days from the receipt of this memo. This direction has been issued to the Officer-in-Charge, Howrah Police Station and the General Manager-Operation (C&M), CESC Ltd., in conformity with the orders of the Hon©ble High Court, Calcutta, dated 21-08-1998 and 28-04-1999 respectively. The Environmental Engineer, Howrah Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said unit. He is also requested to visit the unit involving the local police authority, if situation demands. -2- This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder.
