BACKGROUND INFORMATION: Pursuant to RFQ No 2018-003-6696, as authorized by Commissioners Court Order Number 2018- 0682, dated June 05, 2018, Dallas County awarded an Indefinite Delivery/Indefinite Quantity (IDIQ) contract for engineering services to Arredondo, Zepeda, & Brunz, LLC. (AZB).

The purpose of this Work Order is to supplement the Consultant Agreement to provide to the County of Dallas, the Engineering Support of Harry Hines Multimodal Connection MCIP 40216 project during design and construction and as well as provide for the compensation accordingly.

OPERATIONAL IMPACT: The engineering services will create an operational impact to the project, as the additional services are required to continue with the design and construction.

FINANCIAL IMPACT: AZB will provide services to perform the engineering services stipulated, as detailed in Attachment “A” and “B” of the attached Work Order No. 2 for the amount not to exceed One Hundred Sixty Eight Thousand Forty Four Dollars and no cents ($168,044.00). Funding is available from Fund 196, Project 40216.

LEGAL IMPACT: The District Attorney’s Office, Civil Division, has reviewed Work Order No. 2 and the Work Order has been approved as to form. There is no legal impact as Dallas County has awarded an engineering IDIQ services contract to Arredondo, Zepeda, & Brunz, LLC.

PROJECT SCHEDULE: Engineering starts in March of 2021 and estimated completion spring 2022.

SBE PARTICIPATION: The services authorized under this work order will be performed in compliance with County’s SBE good faith effort policy.

ADMINISTRATIVE PLAN COMPLIANCE: The Harry Hines Multimodal Connection MCIP 40216 Project supports the following visions of the Dallas County Administrative Plan:

WORK ORDER NO. 2

This Work Order No. 2 is entered into this _____ day of ______, 2021, to supplement the Indefinite Delivery/Indefinite Quantity Contract for Engineering Services (“IDIQ Contract”) between Dallas County (the “County”) and Arredondo, Zepeda, & Brunz, LLC., (the “Consultant”), for the Harry Hines Multimodal Connection MCIP 40216 (“Project”).

Whereas, pursuant to Dallas County Commissioners Court Order 2018-0682, dated June 05, 2018, and RFQ 2018-003-6696, Dallas County awarded an IDIQ Contract for engineering services to Arredondo, Zepeda, & Brunz, LLC.

Now therefore, this Work Order No. 2 is made by and entered into by the County and Consultant for the mutual consideration stated herein.

I. Purpose

County and Consultant both mutually agree to supplement the IDIQ Contract in accordance with the terms of the existing agreement, except as modified below. The purpose of this Work Order is to supplement the IDIQ Contract to expand the scope of services to provide engineering services for the Harry Hines Multimodal Connection MCIP 40216 Project from Manana Drive to Webb Chapel Extension in the City of Dallas, Dallas County, Texas, and as well as provide for the compensation accordingly.

II. Supplemental Provisions

A. Article IV. “Work Order(s)”, of the IDIQ Contract shall be supplemented to include those services set forth in Attachments “A”, “B”, and “C” of this Work Order No. 2, which are attached hereto and incorporated herein by reference. The anticipated completion date is spring 2022.

B. Article V. “Compensation” of the IDIQ Contract shall be supplemented to include this Work Order No. 2 as further detailed in Attachments “B” and “C”, which are attached hereto and incorporated herein by reference.

a. The fee to be paid to the Consultant under this Work Order for all of the scope of services specifically set forth in Attachment “A” shall not exceed One Hundred Sixty Eight Thousand Forty Four Dollars and no cents ($168,044.00) provided however, that modifications to the scope of services, or other conditions defined in the Attachments “A” and “B” may necessitate a change of fee. Furthermore, any additional fee is to be approved by the Commissioners Court in accordance with the terms of this Work Order and the IDIQ Contract.

b. The Consultant shall provide reports and invoices with attached documentation as required by Dallas County. Each report and invoice shall identify the services performed according to the scope of services. c. This Work Order will be paid from MCIP Fund 196, Project 40216.

C. The Consultant agrees to comply with the provisions of “Small Business Enterprise Specifications (“SBE”) as filed by the Consultant with the County’s SBE office in response to RFQ No. 2018-003-6696. Said Consultant’s response is fully incorporated herein by reference for all purposes as if reproduced word for word.

III. Effect of Work Order

This Work Order shall not change or waive any contractual provisions, clauses or conditions of the original IDIQ Contract, as well as previous and/or subsequent Work Orders, unless otherwise provided for herein.

IN WITNESS WHEREOF, THE COUNTY OF DALLAS has caused this Work Order No. 2 to be signed by its County Judge duly authorized to execute the same in its behalf by Court Order No. , approved by the Commissioners Court on , 2021, and signed by and through Arredondo, Zepeda, & Brunz, LLC.’s duly authorized representative, thereby binding the parties hereto, their successors, assigns and representatives for the faithful and full performance of the terms and provisions of this contract.

Part 1 Basic Services I. Environmental Services

A. Checklist Preparation ENGINEER will complete the State’s Check List for environmental document. Data Collection The Data Collection Phase and field investigation shall be initiated upon receipt of the project notice to proceed and the field investigation shall occur upon receipt of notification of right of entry (ROE) has been obtained. ENGINEER shall obtain the following publicly available information that pertains to the project area:

 Project Specific Information (including record drawings of utilities if available)  Location of public buildings, schools, churches, parks, etc.  Aerial/Infrared photography and parcel data, if available without charge through the City of Dallas, Dallas County, the State or other sources  Historical resources/Archeological site listings  National Wetlands Inventory Maps  Dallas County hydric soils list  Dallas County Soil Survey  Hazardous materials database information  Demographic data/census information  FEMA 100-year floodplain mapped areas  Vegetation information  Threatened and Endangered Species Information ENGINEER shall review and organize the existing files relating to the project. Project Coordination Requirements ENGINEER shall undertake project coordination efforts with the State and other agencies and local governments that are required for completion of the Programmatic Categorical Exclusion (PCE) and to secure necessary approvals. Historical Studies ENGINEER shall oversee the development and coordinate the Project Coordination Request required by the State’s current PCE Standards of Uniformity. The Project Coordination Request shall allow State and County staff to determine if the project information is enough to record Section 106 actions. Community and Cumulative Impacts ENGINEER shall conduct an evaluation of community and cumulative impacts associated with the construction of the sidewalk and trail. Archeological Resources ENGINEER shall prepare the Certification Standards for Projects that Do Not Require Project- Specific Review checklist by the State’s PCE Standards of Uniformity. Hazardous Materials Per the State’s PCE Standards of Uniformity, the State’s Hazardous Materials Initial Site Assessment (ISA) checklist shall be completed. This form is required for all construction projects to document completion of the Hazardous Materials ISA for the project file. Deliverables:

 Project Coordination Request checklist (up to two electronic PDFs)  Archeological Resources Certification Standards for Projects that Do Not Require Project-Specific Review checklist (up to two electronic PDFs and two hard copies)  Hazardous Material ISA checklist (up to two electronic PDFs and two hard copies)

B. Environmental Document Preparation Background Information ENGINEER shall prepare a PCE document in accordance with the State requirements and shall assist in coordinating the document through approval. Environmental documentation shall be prepared in accordance with State guidelines; the State’s Standards of Uniformity (Latest version); the State Environmental Manual; 23 Code of Federal Regulations, Part 771 and 772; Federal Highway Administration’s (FHWA’s) Technical Advisory T6640.8A; the State’s latest version of Guidelines for Analysis and Abetment of Highway Traffic Noise; and the State’s latest version of Air Quality Guidelines. ENGINEER shall also prepare the PCE supporting information

(i.e. cultural resources coordination requests, hazardous materials initial assessment checklist, natural resources impact calculations, etc..) for submittal to the State’s Dallas District with the preliminary draft PCE. PCE document exhibits shall include: project location map; FEMA Floodplain and USGS quadrangle map; existing and proposed typical sections (provided by County’s design staff); and proposed design layout (provided by County’s design staff) on aerial photography showing waters and wetlands features, hazardous materials sites, and other similar environmental features; representative project area photographs; and up to three additional exhibits. The scope includes the development of the document, quality control/quality assurance reviews and publication of the documents in accordance with the deliverable requirements. Draft PCE Format and Content The PCE shall identify the Build and No-Build alternatives that were considered. The PCE outline to be followed is listed below:

Limited English Proficiency Populations o Hazardous Materials o History o Indirect Impacts o Cumulative Impacts o Noise o Texas Parks and Wildlife Code Chapter 26 o Water Resources (Sections 401,402, and 404) o Section 4(f) of the US Department of Transportation Act o Section 6(f) of the Land and Water Conservation Fund Act Section 4(f) Determination Should they exist, ENGINEER shall identify Section 4(f) properties in the study area in accordance with 49 USC 303. The properties identified shall include property types listed in 23 C.F.R. 771.135 (49 USC 303). ENGINEER shall use existing engineering data and archeological and historical studies to determine whether Section 4(f) properties may be present. If in ENGIEER’s opinion there is insufficient archeological, historic or engineering data upon which to base a determination of 4(f) status, ENGINEER will contact Dallas County to discuss the situation and recommendations for resolution. Should it be determined that a Section 4(f) evaluation is required for the project, then this document would be prepared as an additional Special Service. Waters of the US Including Wetlands As part of the data collection task, ENGINEER shall review National Wetlands Inventory Maps, USGS topographic maps, and other available resources in conjunction with a field investigation to determine if Section 404 jurisdictional waters of the U.S., including wetlands, are present within the project limits. If it is determined that jurisdictional waters/wetlands and would be impacted, the recommended Section 404 permitting strategy would be discussed in the document. If a Nationwide Permit (NWP) Preconstruction Notification (PCN) or Individual Permit (IP) requiring coordination with the USACE is required, Dallas County shall be notified immediately. If a Section 404 NWP PCN or IP application is required, this and a Water of the U.S., including Wetlands Preliminary Jurisdictional Determination Report would be performed as an additional Special Service. After completion of the Draft PCE by ENGINEER, the PCE shall be provided for review and comment to Dallas County, and the State/County Coordinator. It is assumed that each agency shall review the PCE and provide comments up to three times for a total of up to nine document revision cycles. For scoping purposes, it is further assumed that each revision cycle shall consist of minor comments that require minimal revisions to the existing content of the PCE and do not require new content or exhibits beyond what was originally scoped. To document each revision cycle, a comment response form will be developed by ENGINEER that will include the comment, comment number, page/line number of the PCE where the comment originated, page/line number where the revision can be located, and the response.

Part 1 Basic Services II. Surveying

PROJECT SUMMARY Dallas County Public Works (Dallas County), has asked Arredondo, Zepeda & Brunz, LLC, (AZ&B) to submit a scope and fee estimate for the support of design survey services (Control, Topo, and ROW Survey) for the Harry Hines Multi Modal Connection Project along Harry Hines Boulevard from north of Loop 12 (W Northwest Highway) to Webb Chapel Extension. Designated project areas and limits are illustrated on the map or exhibit provided by Dallas County, see Attachment 1. More detailed survey limits are shown on Attachment 2 and are described as follows:

 Area A: Intersection of Harry Hines Boulevard and Webb Chapel Extension (approximately 0.91 acres)  Area B: East Right-of-Way line of Harry Hines Boulevard to the existing gutter from the north line of Area A to the north side of the Harry Hines Boulevard/Loop 12 intersection to include the U- turn area and at intersections with cross streets (approximately 3.40 acres)  Area C: West Right-of-Way line of Harry Hines Boulevard to the existing gutter from the north line of Area A to the north side of the Harry Hines Boulevard/Loop 12 intersection to include the U- turn area and at intersections with cross streets (approximately 3.50 acres)

General Scope of Services: Design Survey services include performance of surveys associated with the gathering of survey data for planimetrics, topography, cross-sections, and other related survey work to assist Dallas County. AZ&B will provide all services listed herein and clarify each area of responsibility and related services assumptions and exclusions below.

AZ&B proposes to use GPS/RTK, terrestrial LiDAR scanner, and conventional survey procedures, as appropriate, to efficiently, effectively provide the mapping, and design survey services as detailed below. The established control and mapping will be the basis for all survey efforts.

AZ&B proposes to tie all survey work directly to the AllTerra Central RTK network system on state plane coordinates (NAD83) without any local site calibration and adjusted to surface data using the following combined adjustment factor: 1.000136506. This detailed scope of service is as follows:

This proposal describes our understanding of the scope of work and services your project requires. 1. Project Control

a. Establish approximately four(4) primary control points throughout the general project area, outside the proposed construction area when reasonable and possible. Maximum distance between primary control points will be 1,000 feet. b. Use VRS/GPS/RTK and/or conventional survey methods and procedures to establish the control. c. Conventional survey methods and procedures will be used in areas where GPS/RTK is not appropriate. d. Publish all coordinates in adjusted surface values. e. A closed differential level loop will be ran thru the established primary control points based on a minimum of 2 existing Bench Marks (City of Dallas, USGS, GPS control, etc.) f. Set additional temporary horizontal and vertical control for the project, as necessary to support the design survey activities. g. Primary Control points will consist of either MAG nails with washer or shiner or “X” cuts in concrete. 2. Right-of-Entry Coordination a. Right-of-Entry is not anticipated to be required for areas A, B and C. 3. Design Survey a. Map the planimetric and topographic features within the limits of survey as depicted on Attachment 1 and more specifically depicted on Attachment 2. b. Map the planimetric features within the project areas, including; visible utilities and other visible improvements. c. Map the topography of the site (including grade breaks) sufficient to produce one (1) foot contours. d. Map the observable horizontal locations of all visible utilities within the survey limits. e. Topographic survey will be conducted using a total station, GPS Base/Rover, and/or a terrestrial LiDAR scanner. f. Submit Texas811 (One-call) tickets online and survey the location of utilities as marked by Texas811. g. To the extent possible, illustrate the location, size and direction of flow of wastewater systems and storm drainage systems. h. Acquire top of structure (rim, grate) and invert elevations of wastewater system and storm drainage system. i. As-built culvert information (if accessible) will include; flowlines/invert elevations, sizes, material flow direction and provide pictures of each structure. j. Locate fire hydrants, water meters, water valves and water valve top of nut elevations. k. Capture electronically the information for all points (horizontal and vertical) compile in an automated system and convert into a topographic survey plan. l. Map the location, size and common species name (if known) of all trees greater the 4-inches in caliper. m. Perform sufficient research and field survey to determine the ROW lines of Harry Hines Boulevard, Webb Chapel Road, and Loop 12 for Areas A, B, and C to include any existing

easements (Existing ROW plans/maps of Harry Hines Boulevard, Webb Chapel Road, and Loop 12 are to be provided by the Client for Areas A, B, and C). In the absence of the existing ROW plans/maps, the adjacent deeds/plats, City of Dallas Block Maps, etc. will be used to determine the ROW lines. 4. Design Survey Deliverables a. Planimetric mapping in 2D MicroStation Connect b. Terrain surface DTM and contour data in 3D MicroStation Connect c. Terrain surface TIN data in OpenRoads d. ASCII points file 5. Duration a. Heath W. Brown, R.P.L.S. will assign the project to a Survey Project Manager who will manage and coordinate the project schedule with representatives of the Client. 6. Fee a. AZ&B will provide our professional surveying services for this project on a “Lump Sum” basis. The fee is based on our estimate of the personnel assigned to the project and the associated man-hours to complete the scope of services. This fee includes reimbursable expenses, necessary personnel and the normal equipment to complete the tasks in an efficient and effective manner. The LUMP SUM fee for completing the scope of services as detailed herein are as follows:

7. Assumptions a. Client Responsibilities 1. The Client will notify AZ&B in writing immediately of any changes, omissions, revisions or disputes arising out of the professional services rendered. 2. The Client will provide a name of the on-site contact person prior to start of fieldwork. 3. The Client will assist AZ&B in securing access to the site and will provide notification to parties now in possession of the property.

4. The Client will provide basis for the project datum (horizontal and vertical) on which to base the project, if different from specified herein. 5. The Client will ensure adequate control is available and at the project site, if specific datum is required. 6. The Client, its representatives and consultants will provide access to all relevant existing data concerning the project, including prior surveys, design plans, electronic files, etc., in their possession. 7. The Client will provide CAD Standards, including cell libraries, level lists, resource library, etc. 8. AZ&B assumes no responsibility for errors and/or omissions that may exist in the supplied data or related design plans. 9. The Client will provide Existing ROW plans/maps of Harry Hines Boulevard, Webb Chapel Road, and Loop 12 for Areas A, B, and C. b. Clarifications 1. AZ&B will adhere to the minimum requirements as promulgated by the Texas Board of Professional Engineers and Land Surveyors. 2. AZ&B assumes Dallas County Survey Guidelines are required. 3. AZ&B will contact Texas811 (One-Call) or individual utility companies for any additional utility information. 4. AZ&B will provide the Personal Protective Equipment (PPE) for the field personnel being; steel toed boots, safety vests and hardhats, as needed. 5. AZ&B assumes the site conditions are safe and no special PPE equipment is necessary due to site contamination. 6. AZ&B assumes no responsibility for errors and/or omissions that may exist in the supplied data or related design plans. 7. Some circumstances beyond AZ&B’s control may arise such as inclement weather conditions or delays in receiving information from third parties. In any event, AZ&B will neither assume any obligation associated with either an expressed or implied target date or any damages, claims or liabilities that may arise because of such delays. 8. Underground utilities as depicted on the design survey are not guaranteed as to accuracy or completeness. c. Exclusions 1. Engineering design is not included in this Scope. 2. A complete Tree Survey is not included in this Scope. 3. A Wetland Survey is not included in this Scope. 4. Preparation of any Zoning or Platting documents is not included in this Scope. 5. Attendance at P&Z, City Council meetings and/or other meetings is not included in this Scope. 6. Construction staking is not included in this Scope. 7. Post-construction as-builts are not included in this Scope.
