This Constitution is specific to the Theta Chapter located at the University of California, Merced, and draws inspiration from the national bylaws of Delta Epsilon Mu as stated and maintained by the National Board of Delta Epsilon Mu. While this Constitution is markedly unique, it remains loyal to the fundamental values and intentions of our national bylaws, which our forefathers set before us. All rights are reserved by Delta Epsilon Mu, LLC – Theta Chapter, University of California, Merced. All unauthorized distribution and usage will be considered as plagiarism, and a claim will immediately be filed against the offending party with the Student Judicial Affairs division of the applicable university group.

Preamble

Delta Epsilon Mu exists to provide an informative, educational and social setting for all students either pursuing or interested in the health fields. With this being our aim, we in order to strengthen our fraternal bonds, hereby establish and agree to follow the following codes of the constitution.

Purpose

The members of Delta Epsilon Mu are committed to serving the community by advocating health education and care, and through active participation in service activities, fundraising, and outreach programs. Members are given the opportunity to directly participate in health- oriented workshops and discussions, thereby attaining access to pertinent academic and career information through association with professors, advisors, career professionals, alumni members and fellow active members.

History

This organization was first established on the grounds of State University of New York at Binghamton, in the spring semester of the year 1996. Delta Epsilon Mu was initiated with a goal of uniting students interested in entering various pre-health professions including medicine, psychology, dentistry, nursing, physical therapy, nutrition, etc. The founding fathers untied their interests in building a co-ed pre-health fraternity which would serve the students by exposing them to professionals from various health fields. Delta Epsilon Mu was formed for the benefit of its members and all students within the campus. A large part of the fraternity’s interests were focused on serving the community by uniting people of different age groups to help each other and learn from one another.

In the Fall of 1995, Debbie Amster, Ellen Hoffman, Marianna Strakhan, and Teri Broklawski joined together to form a pre-health fraternity. Teri then asked Sherine Banton Wendy Cooper, Keri Weintraub, and Wendy Goldstein if they would be interested in helping to for the fraternity. The Student Association told the eight girls in order to begin order to begin the process they needed one hundred signatures of students who wanted to become members of the fraternity. As soon as the Student Association approved their constitution in January 1996, Delta Epsilon Mu took off, and began to pursue its goals. Advertisement had been made to the entire Binghamton campus informing students about the newly formed organization.

Eighty six students came out to the rush February 21st 1996. Thirty six members of various interests were chosen to take the role of co-founders of Delta Epsilon mu in addition to six E- board members.

In fall of 2002, Delta Epsilon Mu spread across the to Davis, California by Daniel Pham. Daniel Pham wanted to unite students from various health fields together and build a system based on support, loyalty, and brotherhood just as the original founding fathers. Daniel came across the Delta Epsilon Mu website and decided to contact the Alpha Chapter. Daniel was contacted by the Alpha chapter who explained to Daniel the process of expansion to create the Beta Chapter. Daniel along with six others started to recruit members for the founding class and started the paper to induct Delta Epsilon Mu as a registered student group on their UC Davis campus. On January 17th 2003 Twenty Four students at the University Of California at Davis were inducted to become the founding class of Beta chapter. The Gamma Chapter of Delta Epsilon Mu is located at the University of Maryland at college Park.

In fall 2005, Delta Epsilon Mu was once again spread across the nation to the east coast. April Leary, a student at the University of Central Florida, contacted Beta Chapter for information pertaining to the possible expansion of Delta Epsilon Mu to UCF. April spent her first two years of school searching for the perfect sense of brotherhood she needed to fulfill her time spent at UCF. Just as the Beta Chapter was created, April informed her peers of the fraternity and on May 13th 2006, Carley Burt, Keren Castellucci, Haily Le, April Leary, Bethanne Nichols, Matthew Rossen, and Hillary Sivik were inducted as the founding class of Zeta Chapter.

In Spring 2007, students at Commonwealth University in Richmond Virginia were inducted to become the founding class of the Eta Chapter.

In fall of 2008, Delta Epsilon Mu began the process to expand to its second University of California campus. Jason Castillo and the previous members of the Pre-Health Professionals Club at the University of California, Merced, got into contact with Beta Chapter to begin the process of expansion. On February 7th 2009, 26 students of the University of California, Merced traveled to Beta Chapter to complete the expansion process. After a smaller ceremony was held for the 6 remaining students who could not make it to Davis, the 32 students were inducted to become the Founding Class of the Theta Chapter. The members of the founding class of Theta Chapter also established a foundation of health education and care based on the principles of support, loyalty, friendship and dedication.

In December 2010, students at George Washington University in Washington DC were inducted to become the founding class of the Iota Chapter.

In Spring 2011, students at the in Lawrence, KS were inducted to become the founding class of the Kappa Chapter.

On April 15th 2012, students at Texas A&M University were inducted to become the founding class of the Lambda Chapter.

On May 5th 2012, students at California State University, Sacramento were inducted to become the founding class of the Nu Chapter.

Article I. Governing Statement

Section 1. Constitution of Delta Epsilon Mu Fraternity This Constitution is the governing document for Theta Chapter of Delta Epsilon Mu Fraternity at the University of California, Merced. All provisions of the National Bylaws of Delta Epsilon Mu Fraternity, and all of the provisions governing professional fraternities at the University of California, Merced, as set forth by the administration of said institution, form a part of this constitution as if hereto attached or herein repeated.

Section 2. Conflicts If this constitution shall be found in any way to be in conflict with the National Bylaws of Delta Epsilon Mu Fraternity or with the regulations governing professional fraternities at University of California, Merced, the article or section of the constitution that is in conflict shall be null.

Section 3. Prior Constitutions This constitution supersedes all prior existing constitutions of Theta Chapter of Delta Epsilon Mu Fraternity.

Article II. Membership Membership of this fraternity shall be chosen without discrimination on the basis of race, religion, sex, sexual orientation, color, disability, national origin, age, or marital status, except in cases of fraternity and sorority organizations which are exempt by federal law from Title IX Regulations concerning discrimination on the basis of sex. However, membership should be comprised of UC Merced Undergraduate Students.

Section 1. Pre-Membership A “Pre-Member” or prospective new member is used to refer to an individual who has fulfilled the following requirements: a. A member must be an undergraduate student at UC Merced. b. A member who is interested in the health field. c. A member should have a minimum 2.5 college level grade point average. d. A member should have submitted a copy of their resume and completed the interview process. e. A member should be willing to dedicate at least 5 hours solely to Delta Epsilon Mu.

Section 2. Prospective Membership A “Prospective Member” is used to refer to an individual who has been invited to become a candidate for undergraduate membership, and has accepted that invitation, but has not yet been initiated. Section 2.1. Selection process The New Members are selected based on the following: (a) Fulfilment of Pre-Membership Requirements as mentioned in Article II, Section 1. (b) Attendance of Recruitment Week i. The prospective new member must have attended at least three Recruitment events, or provided a valid excuse for absence of events.

(c) Interview i. The prospective new member must be invited to an Interview by the Director of Prospects and obtain an average of 75% or higher on the interview to become a part of the New Member/Prospect Process. ii. The average is based on a question criterion and is scored by all Active Members of the Theta Chapter.

Section 2.2. New Member Process The New Member Process will be a ten-week process followed by the initiation ceremony, Crossover. The process is based on the four pillars, Loyalty, Dedication, Friendship, and Support. Throughout the ten weeks the New Members/Prospects will be given opportunities to build relationships with the Active Members as well as discover more about their respective career goals in the health-field.

Termination of any status of a Prospective Member shall be at the discretion of the active Executive Board.

Section 3. Active Membership Section 3.1. Active Membership Requirements An “Active Member” is used to refer to an individual who has been initiated through a crossover ceremony. All active members are required to fulfil the following duties: a. A member will attend all weekly general meetings, actively participate in a committee, complete community service and fundraising activities, and attend all mandatory events as specified by the executive board. b. A member attending a weekly general meeting must be dressed in either of the following: Professional attire or letters. c. A member will either hold a position or be actively involved in the planning of at least one Delta Epsilon Mu, Theta Chapter Event. d. A member will contribute to the financial upkeep by paying semester dues, which is subject to change as determined by the Treasurer. e. Delta Epsilon Mu as whole family will commit 5 hours of volunteering service each semester.

Section 3.2. Active Membership Standards Any person initiated into Delta Epsilon Mu becomes a member for life, except in the case that they are deactivated from Delta Epsilon Mu for violations of the National Bylaws and Chapter constitution or by choice. No member of Delta Epsilon Mu shall become a member of any other professional organizations declared competitive by Delta Epsilon Mu, National Board. All life members are required to fulfil the following duties, and violation of them is subject to deactivation:

a. A member will act with integrity and in a professional manner in all circumstances. b. A member will try to follow the principles of the four pillars. i. Support: Each brother and sister shall support each other emotionally, personally, and career-wise.

ii. Loyalty: Each brother and sister shall be honest and true to each other, the creed, mission statement, and the letters of DEM. iii. Dedication: Each brother and sister shall express commitment, pride, and effort for their family and fraternity. iv. Friendship: Each brother and sister shall work to maintain strong lasting relationships between brothers and sisters. c. A member will support the new members, and will attend all the required new member meetings. d. A member will remain loyal, and must not leak any secret information regarding our fraternity and its various processes, unless violating any laws or causing harm. e. A member can’t be seen with or around alcoholic beverages or illegal substances while wearing anything affiliated with Delta Epsilon Mu. f. A member will not be involved in any sort of hazing activity.

Section 4. Inactive Membership An “Inactive Member” is used to refer to an individual who wish to maintain their membership within the fraternity but required a semester off for personal or academic reasons. All members seeking inactive status must require: a. To submit a statement of intent to the President, Vice President, and Secretary at least two weeks before the first meeting of the semester. b. To go inactive one semester per academic year, and should not go inactive consecutive semesters. Failure to do so could subject to deactivation. c. To understand that they are still representing the fraternity, and thus must respect the letters that they are allowed to wear as stated in Article II Section 3.2. d. An inactive member can’t be nominated for executive board/ officers. An executive board member or officer must forfeit his/her chair position if he/she is inactive. Inactive members are welcome to participate in general or committee meetings, social or community service events or any fraternity events. Inactive members are responsible for paying appropriate monetary compensations, as determined by the Treasurer, for any fraternity-sponsored events attended.

Section 5. Probation Status A “Probation Status” is given to an individual who has been unable to fulfil his/her duties as an active member.

Section 5.1. Points Probation Individuals who are unable to maintain a positive point value as outlines in Article IV Section 5 shall be subject to Points Probation. Individuals on Points Probation shall be required to: a. Achieve a positive 3 points and maintain a positive net sum by the end of the semester according to the current points value system. b. He/she cannot be nominated for an executive board or officer position. A member must forfeit their executive board/officer position if he/she is on probation.

Section 5.2. Academic Probation Individuals who are unable to fulfil the academic requirements shall be subject to Academic Probation. Individuals on academic probation shall be required to: a. Attend 5 hours of study hours per week b. Attend all health and career events, however, they shall not be required to attend social events or new member meetings c. Understand that he/she may not be allowed to pick up a little

All members on any form of probation shall abstain from all voting until they are no longer on probation.

Any failing to meet the requirements of probation shall be subject to deactivation after 3 warnings from the executive board. The Executive Board shall make decisions upon situations meriting forced probation that are not explicitly addressed in the constitution. If the vote is close, or there is a tie, then co-officers are allowed, provided that 60% of the voting members are in support of co-officers.

Section 6. Deactivation Status A “Deactivation Status” is given/offer to an individual who has violated or wished to not continue the lifetime membership. A member could receive a “Deactivation status” by either voluntary or forced deactivation.

Voluntary deactivation is given to a member who decided to deactivate from Delta Epsilon Mu, and must submit a formal written proposal of intent to the President and Vice President.

Forced deactivation is given to a member who does not meet active membership requirements including but not limited to: professional representation of fraternity values, semester dues, community service and fundraising. Forced deactivation of members not meeting membership requirements will be determined by a majority vote of active members as set forth in Article IV Section 7.

All Deactivated members are required to return all paraphernalia bearing the words or symbols of Delta Epsilon Mu and may not refer to themselves as a member of Delta Epsilon Mu on job applications, school applications, resumes, etc.

Section 7. Associate Status An “Associate Status” is used to refer to a member who wishes to maintain membership within the fraternity and has completed their 8th and enrolled in their 9th consecutive semester at a collegic institution, but does not yet qualify for alumni status. An associate member must adhere to all active membership standards and adhere to the following: a. Pay Half Semester Dues b. Must participate in semesterly new member interviews, Big/Little Reveal, Crossover, and any other event(s) deamed necessary by the current executive board. c. Are welcome to attend any event not sponsored by the fraternity funds.

d. Are responsible for paying any monetary compensations, as determined by the current treasurer, for all fraternity funded events attended. e. Associate status is not a substitute for inactivity or alumni status. Alumni status must still be applied for upon completion of your diploma. An associate member may not return their status to active membership at any time nor are eligible for any forms of probations. Failure to abide by the above will result in forced deactivation.

Any active can petition for associate status, however executive board has the right to decide to award associate status to any qualified undergraduate and/or member with extenuating circumstances.

Section 8. Alumni Status An “Alumni Status” is used to refer to a member who had been a part of Delta Epsilon Mu until they graduated University of California, Merced. In order to qualify as an Alumnus Member of Delta Epsilon Mu, the individual must: a. Have been an undergraduate member of Delta Epsilon Mu, Theta Chapter; b. Be a person with distinction by virtue of outstanding character, morals, and value; c. Be a recipient of an earned or honorary degree from a four-year university or college. d. Must be in good standing with their respective Chapter at the end of their final semester. Any active can petition for alumni status, however executive board has the right to decide to award alumni status to an undergraduate.

Section 9. Transfer Status See Bylaws for now.

Article III. Separation of Powers Section 1. Executive Board The Executive Board shall at least include a President, Vice President, Secretary, Treasurer, National Liaison, Historian, Public Relations Director, and Director of Prospects. If required we may provide for additional Executive Board Officers, granted that none of the above officer positions are eliminated and the additional officer(s) role(s) is/are not overlapping the other officers. These positions must be approved by the National Board by a two-thirds (2/3) affirmative vote. All officers of shall be undergraduate members of that active Chapter.

Executive Board Requirement and Duties: a. The Executive Board shall: i. Help lead the fraternity by having vision and passion. ii. Must be an active member for the majority of at least two consecutive semester terms of an academic year prior to taking office. In the event that no active members wish to serve a position, other active members will be eligible for the position.

iii. Must maintain communication with other members of the Executive Board and other officers regarding plans, associated dates and position specific duties and responsibilities iv. Must be responsible for the appointment and overseeing of applicable sub-committees v. Must actively attend executive board meeting in addition to the general assembly meeting vi. Must adhere to the general rules, regulations, and requirements which are applicable to all active members (stated above in Article II), in addition to the position-specific responsibilities. EXCEPT: The President and Vice President must maintain at least a cumulative 2.75 GPA vii. Must be willing and able to take on extended and additional duties and responsibilities as necessary. viii. Must be willing and able to hold the position for a full academic year, except in the cases of extenuating circumstances as decided on by the majority of the current Executive Board ix. Act as the judicial branch of the fraternity x. An executive board member must forfeit his/her chair position if he/she is inactive, deactivated, or on probation.

b. The President shall: i. Maintain all administrative functions of running a student organization in accordance with the University Guidelines. ii. Oversee and maintain committees and membership. iii. Maintain communication between committees and between subsequent Chapters. iv. Authorize all administrative, financial and intra-organizational relations. v. Delegate duties and assignments to each of the officers. vi. Maintain communication with advisor and inform advisor of activities and functions of the organization. vii. Lead and organize all meetings. viii. Continue communication with the Office of Student Involvement and make certain that all organizational paperwork is up to date. ix. Become knowledgeable of Robert’s Rules of Order. x. Provide all documents and records pertaining to his/her responsibilities to the newly elected Secretary.

c. The Vice President shall: i. Assist the President in his/her duties. ii. Assume the President’s responsibilities in his/her absence. iii. Coordinate all conferences and committee operations. iv. Keep accurate records of all meetings in the Secretary’s absence. v. Perform an audit of all financial transactions of the organization once each month. vi. Provide all documents and records pertaining to his/her responsibilities to the newly elected Vice President. vii. Assist in special projects as assigned by the President.

d. The Secretary shall: i. Notify members of emergency meetings via e-mail and/or telephone ii. Keep accurate minutes and records of all meetings, providing a written summary of each to active members of the fraternity. iii. Maintain accurate list of members and their contact information. iv. Provide changes in organizational information to the university’s student organization office. v. Record and maintain Point-Value System for all active members vi. Issue notification of any changes in a member’s net total points vii. Take attendance at all meetings and maintain an attendance record. viii. Prepare ballots for elections. ix. Check eligibility for potential officers, prior to annual elections. x. Provide all documents and records pertaining to his/her responsibilities to the newly elected Secretary. xi. Assist in special projects as assigned by the President.

e. The Treasurer shall: i. Keep an accurate account of all funds received and expended. ii. Present a budget report of deposits and expenditures to the membership at least once per month, and as requested by the President, Vice President, advisor, or the university’s student organization office. iii. Be one of three (3) signers on financial documents. iv. Be responsible for collecting dues and notifying members who are delinquent in their payments. v. Be responsible for creating a budget at the beginning of each fall and spring semester, in conjunction with the President. vi. Provide financial records sufficient to allow the Vice President to perform audits. vii. Provide all documents and records pertaining to his/her responsibilities to the newly elected Treasurer. viii. Assist in special projects as assigned by the President.

f. The Historian shall: i. Organize and maintain member profiles and packets. ii. Provide the National Chapter with member profiles. iii. Organize the fabrication of and maintain all fraternity banners and memorabilia. iv. Oversee the taking of photos as well as organization and maintenance of a fraternity photo album. v. Organize and maintain the organization’s history and purpose on the fraternity’s website. vi. Submit proposal of own portion of the semester budget. vii. Provide all documents and records pertaining to his/her responsibilities to the newly elected Historian.

viii. Maintain local chapter section of website. ix. Assist in special projects as assigned by the President.

g. The Public Relations Director shall: i. Oversee and organize establishment of publications of Delta Epsilon Mu. ii. Print all materials for fraternity use. iii. Oversee the organization of prospective new member events. iv. Manage all materials and information that apply to the realm of public relations and information networking, including: apparel, accessories, brochures, etc. v. Submit proposal of own portion of the semester budget. vi. Provide all documents and records pertaining to his/her responsibilities to the newly elected Public Relations Director. vii. Assist in special projects as assigned by the President.

h. The Director of Prospects shall: i. Plan and implement schedules and events for all Prospective Members undergoing the initiation period. ii. Record and maintain Point-Value system for all Prospective Members. iii. Act as vote of final approval for all Prospective Members operations. iv. Submit proposal of own portion of the semester budget. v. Provide all documents and records pertaining to his/her responsibilities to the newly elected Director(s) of Prospects. vi. Assist in special projects as assigned by the President.

i. The National Liaison shall: i. Maintain relation with other Active Chapter’s National Liaisons ii. Represent the active Chapter members as a representative delegate in the National Chapter. iii. Plan and organize National Conventions in conjunction with the other National Liaisons and other delegates. iv. Serve as voting member of the National Board v. Educate and Advise the chapter on the wording and implementation of Chapter Constitution, the National Bylaws, and Parliamentary Procedure for all business conducted. vi. Provide all documents and records pertaining to his/her responsibilities to the newly elected Secretary.

Section 2. General Officers Each officer is assigned a specific task, and is required to follow their duties: a. All Officers shall: i. Help lead the fraternity by having vision and passion. ii. Be an active member for the majority of at least one semester term of an academic year prior to taking office. In the event that no active members wish to serve a position, other active members will be eligible for the position.

iii. Maintain communication with other members of the Executive Board and other officers regarding plans, associated dates and position specific duties and responsibilities iv. Be responsible for the appointment and overseeing of applicable sub- committees v. Actively attend executive board meeting in addition to the general assembly meeting vi. Adhere to the general rules, regulations, and requirements which are applicable to all active members (stated above in Article II), in addition to the position-specific responsibilities. vii. Be willing and able to take on extended and additional duties and responsibilities as necessary. viii. Be willing and able to hold the position for a full academic year, except in the cases of extenuating circumstances as decided on by the majority of the current Executive Board ix. Forfeit his/her chair position if he/she is inactive, deactivated, or on probation.

b. Academic Chair shall: i. Oversee the academic development of the organization. ii. Coordinate and keep a record of study hours. iii. Handle actives on academic probation in unison with the President and Vice President.

c. Alumni Representative shall: i. Serve a 2 year term ii. Serve as 1 of 2 votes for a chapter on the national board

d. Conference Chair shall: i. Bring updates on conferences located near Merced. ii. Develops & submits a conference budget. iii. Organise a conference, if budget permitted. iv. Develop conference schedule, coordinate speaker needs, develop program booklet, set fees & registration options, and other conference planning and promotion issues, etc. (only applies when organising a conference).

e. Educational Outreach Chair shall: i. Organize workshops as well as school representative visits to our campus. ii. Have all plans made and presented to the Executive Board four weeks prior to visit. iii. One visit per semester is expected. iv. Be responsible for providing the actives with prior knowledge of the school and ask for input from the actives before booking visits. v. Be responsible for helping the Career Services Center with the Pre- Health speaker series.

f. Fundraising Chair shall: i. Coordinate at least five major fundraising events per academic semester (Fall/Spring). ii. Work closely with the Treasurer on establishing a budget for the fundraising events. iii. Build relationships that will benefit the organization. iv. Create a donor list of sources they can return to for future years and future events.

g. Inter-Club Council Chair shall: i. Be responsible for attending the weekly Inter-Club Council Meetings of UC Merced as the Delta Epsilon Mu Representative. ii. Rotate attending the ICC meetings with other Delta Epsilon Representatives serving on the ICC; however, the Chair will serve as the main liaison between the ICC and the Delta Epsilon Mu officers. iii. Work with the Treasurer and Fundraising Chair to request funds from the Inter-Club Council.

h. Philanthropy Chair shall: i. Oversee the planning of all organization philanthropic and at least 5 hours of volunteering service events per semester. ii. Register chapter’s philanthropy event with Office of Student Life. iii. Assist organization in setting goals and determining projects for annual service activities. iv. Report Treasurer on fundraised event immediately after completion of an event. v. Delegate tasks related to planning service event. vi. Have dates of each events presented to the chapter three weeks before the event. vii. Making and maintaining community contacts. viii. Assume the responsibility and liability of membership understanding and risk involved in activity, if appropriate.

i. Social Chair shall: i. Schedule and organize all chapter social activities. ii. Work with the social committee or appoint committees necessary for any social function. iii. Register all chapter social functions with Office of Student Life. iv. Have dates of each social presented to the chapter two weeks before the event.

j. Web Chair shall: i. Monitor all activity of the Delta Epsilon Mu Theta Chapter website. ii. Post all information pertaining to the fraternity on the website and check in regularly with the secretary for events to be posted on the site.

Article IV. Government and Organization Section 1. Nomination and Election

Section 1.1. Nomination On the last general meeting of the month of March, members are nominated for both Executive Board and officers positions for the following academic year; nominations can be made by any active member for any active member in attendance. In order to be considered for nomination of an executive board position, the active member must have been on active status during the prior academic semester and must currently be on active status for that spring semester term in which he/she is nominated into an executive board position. Each nominee will have a week to accept the nomination and submit all the required paperwork.

Section 1.2. Election With the exception of the fraternity’s organizational year, elections shall be held in the middle of April for the next academic year. The exact date shall be established by the President. For all positions, candidates must present a speech to the general member assembly, followed by an open question-and-answer session. Depending on the circumstances, the length of speech and question-and- answer can vary by executive board member, in order to conduct the election more efficiently. However each nominee should be treated equally, without any discrimination. Once voted into a position, that chair-elect is required to assist the current board member in all responsibilities set forth in Article III for the elected position, for the remainder of the academic year. The chair-elect begins his/her term as a member of the executive board and an officer following the last week of the spring semester term. Due to extenuating circumstances, a special election can be held to fill a vacant position until the end of that academic year. In the event of such a vacancy, the President may appoint an interim officer. The newly appointed officer shall hold office until a special election can be held to either confirm or reject the appointee.

Section 2. Voting and Decision Making a. Every active member of Delta Epsilon Mu is guaranteed the opportunity to a single, equally weighted vote in all elections and fraternity decisions. b. In order for a decision to be recognized, a majority vote must be recorded. The term ‘majority’ in the case of voting constitutes at least 60% of all present active members’ votes regarding the issue. c. At least three-quarters of all active members must be present to pass a vote without prior notice. However, if the opportunity to cast a vote is given with prior notice, the vote will take place without majority attendance, albeit by the majority vote of the active members in attendance. d. In the event that no clear majority (at least 60% of the popular vote) can be reached because of the presentation of more than two mutually exclusive positions or issues – a second round of voting will take place between the two most agreed upon positions, issues or nominees. e. In the event that no clear majority (at least 60% of the popular vote) can be reached between the final two mutually exclusive positions, issues or nominees, the final decision will be placed upon the sole review and appointment of the Executive Board.

f. All Voting should be done anonymously on a piece of paper provided by the executive board members, unless the majority of the active body agrees to a different method. g. The votes will be counted by an impartial executive board member in the presence of all active members, and cannot leave the room unless asked for recounting.

Section 3. Impeachment Any officer can be impeached. a. Each member would be given three warnings prior to impeachment process. b. The 1st warning will warn an executive member or officer for not meeting their responsibilities. c. The 2nd warning will lead to a writing assignment, if an executive member or officer continues to violate their responsibilities. d. The 3rd warning will lead to loss the rights of an active member during one (1) active meeting. e. The impeachment process must be initiated with a written proposal of intent and explanation that is going to be presented to the active member assembly. f. The subject of impeachment will be given the opportunity to defend his/her position. g. A majority vote of active members’ pro-impeachment must be recorded for the impeachment to take place. h. An active member will be likewise voted in as the interim officer to complete the remainder of the term of the impeached. This is the only case where an executive position is not held to a full one-year commitment.

Section 4. Point Value System All fraternity events and functions are based on a point value system. a. Each member will be awarded points for successfully completing events or activities. Point-Values for optional events are determined by the executive board. b. Failure to attend an event without prior notification to the secretary will result in a loss of one point. c. Failure to attend an event previously signed up for will result in a loss of two points. d. At the beginning of each semester, points from the previous semester will be rolled over and halved. e. All new actives shall begin the semester at zero and any returning actives shall resume with half their previous point total.

Points will be continuously summed at the end of each week. Members are required to maintain at least zero net total points, or greater, or will be subjected to probation until they have reached a positive point value.

Section 5. Attendance Policy

a. No more than one unexcused absence is permitted from general meetings per semester; failure to adhere to this attendance police will result in the active being subject to probation. b. Arriving more than 5 minutes late or leaving before the adjournment of a general meeting without a permissible excuse will be equivalent to one absence and one point loss. c. One point (1) will be deducted from semester net point totals in the event that an active does not come prepared as specified by the executive board to a general meeting or event. d. One point (1) will be deducted from semester net point totals in the event that an active arrives late to a fraternity event without a permissible excuse. e. Two (2) points will be deducted from net point totals for failure to attend two out of three (2/3) Pre Health Speaker Events

Section 6. Member Dues a. The Treasurer is responsible for implementing and collecting member dues at a specific date as he/she sees fit. If dues are not paid in a timely fashion without a permissible or applicable excuse, the Treasurer will be responsible for implementing a loss of 3 points per deadline. b. If member dues are not paid the individual will be subject to probation status. c. Inactive members are required to pay dues.

Section 7.1. Disciplinary Action Any member who does not meet the requirements for active membership, who does not accurately represent the goals and values of the fraternity, and/or violates his/her obligations to the Fraternity, shall be subject to forced probation or forced deactivation from Delta Epsilon Mu. A forced status of probation may occur throughout the semester when a member does not follow the rules listed within this constitution or the national bylaws of Delta Epsilon Mu.

Any undergraduate or alumnus member of a Chapter accused of violations of any governing documents or misconduct may request a hearing, in the event of such a request the President shall establish a date, time, and location for a meeting to consider the matter. The president should also notify all active members of the hearing process during the active meeting before the hearing time and notify the accused member a minimum forty-eight (48) hours in advance of the hearing by any means necessary. The president would also notify all undergraduate members of the active Chapter of the hearing information. It is recommended that a specific outline of infractions be provided to the accused member.

Section 7.2. Hearing procedure: a. President will call hearing to order b. Evidence against the accused may be presented using any or all of the following forms: individual handouts, slide show, or verbal presentation. c. Witnesses may be called by any member present to testify their knowledge of the matter.

d. Accused member shall have the right to speak on his/her own behalf. The amount of time allotted for Point B must equal the time allowed for Point D. e. Cross examination on the accused member. Questions shall be limited to either the infractions presented in Point B or statements made by the accused in Point D. Any unrelated questions can only be asked during deliberation (Point F). f. Accused Member must leave the hearing location to allow active members to deliberate. The amount of time allotted for deliberation must equal the time allowed for cross examination.

g. Present remaining members shall then use paper ballots upon a motion to suspend [inactivate] or deactivate. At least 75% of Active Members must be present and vote to make quorum. A minimum two-thirds (2/3) vote in favor of either punishment is required for the motion to pass. h. Records of the proceeding shall be sustained with respect to the accused member. i. These records shall be submitted and sent to the National Board.

Article V. Advisor

What an Advisor is and does?

“A student organization advisor is a person, selected by the organization, to provide guidance and advice in the operation of the organization. Advisors shall consist of UC Merced faculty members. Advisors have a variety of roles with an organization including being a mentor, teacher, leader and follower.”

“The advice of the advisor, given to the organization’s membership and leadership, is always welcome and viewed as valuable. The decision making and goal setting for the organization should remain in the hands of the student membership but should be tempered with the valuable insights of the advisor.”

What an Advisor is not and does not do

“An advisor is not someone who cleans up after a major event or makes sure that regular meeting rooms for the organization have been reserved; these are responsibilities of the student leadership of the organization. An advisor is not someone to invite to events but otherwise exclude from the business of the organization until the organization is in trouble; the advisor should be informed about and consulted with regard to the on-going business of the organization. An advisor does not take control of the organization; this is the responsibility of the student membership and if the organization ceases to exist due to inaction by the student membership, this is an unfortunate but appropriate outcome. Organizations should not look to their advisor to do crisis intervention on behalf of the organization but only to seek to do so in conjunction with the student leadership.”

Term of an Advisor

The term of an advisor is annually in accordance to the academic school year. At the end of the academic school year, the advisor has the right to continue his/her term into the next

When the advisor decides to end his/her term, the Executive Board of Delta Epsilon Mu Theta Chapter will collaborate and pursue a new advisor.

Article VI. Amendments

Any member can submit amendments to the constitution to the general membership. Any article, section, or subsection, or the constitution in their entirety may be changed or amended with a 60% vote of the active chapter members during second meeting of the academic year or during the elections of the officers in the Spring semester. In the event of emergency members may propose that new amendments should be voted on. The voting event that shall follow the proposal must be approved by the President and Vice President
